and they couldnt give any info.

I am in somewhat of the same situation you are, and I am hoping and praying that is not what is holding up my NOA2. I applied the first time back in 2002, and due to the fact we were not quite ready for everything we cancelled ours also, but we didn't stop loving each other and we always knew we would want to be back together one day when we were both ready. We kept in touch over the years, he visited me, and now that we are both more mature and know exactly what we want we feel we are in a much better position to get married and have a fulfilling life together. So, we decided to apply again, this year. I contacted an attorney and spoke with him about it and he said there is no problem with doing this and it should not be a problem or raise any red flags as we did not break any laws. I wrote CSC an email yesterday about our case because I am starting to get worried about not getting our NOA2 when a lot of others that have applied after me are getting theirs, and this was their reply:

The petition is undergoing security checks required of all applications and petitions, there is no time limit to this processing. Please 60 days before your next inquiry unless you receive a request for evidence or a approval notice.

So, I am hoping and praying that this part of the process just has not ended yet and the NOA2 will be on the way soon. Have you contacted them by email? If you have, what response were you given? Were you given the same one I was? Was your case transferred to CSC or is it really at the TSC office? Mine was transferred over to the CSC office. Well, I hope we both get our NOA2 soon, we both deserve it, just because we did the right thing by cancelling our petitions prior to finishing because we weren't ready, isn't any reason to punish us by making us wait forever now. Please keep me informed on how your case is going.

Received exactly the same respose from the said Officer. I believe that we are in for quite a bit of waiting. Let us pray . It is hard , I cried to-day when I read the USCIS web site explanation of security checks. Let us try and stay positive, inspite of what is said.

Oh SHar, I really feel so sad for you, I know you have been waiting for so long, and to think now, I may be waiting this long as well, gosh why do they have to do this to us when all we are trying to do is be with the person we love. I know they are trying to keep the country safe and that is a good thing, but does it actually take this long to get security checks on someone, I mean you have been waiting for a very long time, I am praying that you will be approved very very soon.

I emailed CSC yesterday, I have to say they were very quick getting back with me about my case, I just don't know what this email mean, does it mean they are just still processing, or we are under some kind of review? Has anyone else been told this before, what do you guys think?

This is my second petiton, yet it is for the same person, I cancelled the first one due to the fact we were not quite ready. Our first one was in 2002, I spoke with an attorney and he said that as long as no laws were broken there is nothing wrong with petitioning twice. So, I don't think there would be a problem for you. As to it being approved and how long it would take, no one can answer that question. I think mine is taking a little longer than others, I don't know if it is due to the fact it is the second petition or not, or if it is just because CSC is slow, who knows....I did email them and they told me it was just regular processing issues and security checks, so as for now I am not having any major problems with mine.

If you could please fill in your timeline that would give us a better idea of your situation. Have you not rec'd a NOA1 yet? Did you pay by check, and if so have they cashed the check? If they did cash the check, your case # is on the back of the cleared check. I would begin to worry as well if I were you, if the check had not been cleared yet and you have not rec'd any correspondence from them after 70 plus days. You may want to give them a call and find out what is going on with your case.

It is not required that the USC attend the interview, only the beneficiary....but it is supportive if the USC can be there.

We did the same thing the others did, just typed up a statement, one for both of us to sign. Attached both statements to all of the evidence. We had ours notarized, I don't think that is a requirement, we just had it done. I will attach an example of the one we sent it is just pretty clear cut and to the point.
