I am still hanging in here with ya, I have been so frustrated lately too. I know what you are going through, you and I have been going through this entire process together seems like. It seems as if our cases are going through the exact same thing, HUH. Hopefully you will have better luck with your senator than I did. Good luck to you , I am glad you finally got in contact with them at least. Hopefully they can give you some answers. We really need some at this point. I guess I am just going to wait another month and see if anythign happens at the magic 6 month mark. Good Luck to you you are in my thoughts.

You can email and call and call and call, but as you can see by my timeline, sometimes it does little good. Not too seem negative or anything, it is just reality. I am still waiting on my NOA2, and I got my NOA1 in January.....but I do email them and call at least once a month, even though I still get the same answer. I have gotten the Congresswoman involved as well, and that has done no good either. So, all I can say is you just have to hang in there, and wait. But , do stay on them....don't let them think you are just sitting there taking it. Bug the hell out of them. LOL....

President George W. Bush signed a bill into law on January 5, 2006 that is aimed at protecting foreign nationals who enter into marriages with U.S. citizens through international marriage brokers. These individuals are typically women, commonly referred to as mail-order brides, although it is now the Internet and certain Internet-based businesses that facilitate many of these arrangements. The law, known as the International Marriage Broker Regulation Act of 2005 (IMBRA), was passed as part of the reauthorization of the Violence against Women Act or VAWA under HR 3402. The purpose of such a law is to protect spouses in any abusive relationship, not only women. Even though VAWA refers to women in its title, and women traditionally are more often abused or victimized, the law has always been gender neutral and protects both women and men who are victims of domestic abuse.

Requirements under the New Law

A key provision of the new law is that the prospective foreign spouse, typically a wife, will be provided with information pertaining to any criminal background of the prospective U.S. spouse, typically a husband. The foreign spouse will also receive information regarding legal rights with regard to domestic violence. Marriage brokers are required to conduct background searches on their clients. This is very important, as there are certain types of abusive men who are attracted to the power, control, and opportunities inherent when a woman without resources is transplanted to an unfamiliar country. Some of the international marriage brokers cater to men with desires to dominate and control helpless and subservient women. Such men often look for very young women, often minor children, who will come with forged birth certificates in order to have better opportunities in the United States or to provide for their families back home.

Lifetime Limit on Number of Fiancée Petitions by U.S. Citizens

The law also prohibits the filing of multiple, simultaneous fiancée petitions. Each petitioner is limited to a lifetime cap of three fiancée petitions.

Conclusion

We at the Murthy Law Firm think this law is an important step in protecting vulnerable foreign nationals who might be victimized by unscrupulous marriage brokers or potential spouses with ill intentions. There are certainly genuine fiancée cases filed by those who wish to marry foreign nationals living abroad. These measures, however, should help in efforts to separate these bona fide cases from those that would be exploitative.

No as far as I know there s no problem, my husband came from Cuba on a I-129F visa, and after we married he went back to Cuba, not because we intent to live in Cuba but because we were advised that once we got married he had to return and them apply for a I130. And this is what we are doing, Once I found out that this was not the proper way to go called Immigration Office and they said that it was no problem to go ahead an apply for I-129 and the I-130, that s were we are at know.


A I 129F is not a visa. It is a form that one fills out when petitioning for both K1 and K3s.

At any rate, I'm not sure how your situation is the same as what the OP wants to do. It sounds as if you were planning to reside in the US.

I fell the soma way, We were told by our congressman (worker at his office) that my husband had to return to Cuba in order for his to get his green card, or he will have to stay for one year and one day illegal and them apply to the Cuban adjustment. Well he has so wrong that sometimes I feel like going over to his office and giving him a peace of my mind, the only reason I don’t do it is because you never know what they could do and I want my husband to come as soon as possible.

Why did it take 5 moths for interview that is a long time, as to the Carta Blanca, it takes about a month to get, or that how long it took us.

Hi all,
I am using an immigration attorney for the K1 processing..I spoke to him yesterday and he told me that there should be no RFE's comming since the old 129f form was still vaild until the new one is approved.I told him about this site and what everyones been speculating about and he said not to listen to all this stuff...that his firm is well aware of whats going on and that i wont recieve any RFE's coz of the new draft 129f form.
So i guess we'll see what happens..he just said it might take a bit longer due to how backlogged they are due to the ones comming back for more securtiy checks.The firm does advertise on this site..if anyone is interested the firms name is Roth,Livingston,&Poles...I hope he is correct..he seemed offened when i told him waht was being said on this site,rather than what he knows from his expertise in the immigration field.

Just to let you know my laywer called me last week and wanted to know if i sent the RFE back and i told him yes and that they recieved it.He then told me that if everything was ok with it that he expects approvals to be comming within three weeks time,he siad that they are working extra hard to relieve the backlog of cases.I was really suprised he told me to expect an approval in 3 weeks.I dont know if he has inside info since thats all the frim handles is K1 visas,and it states on his website that they have full USCIS and embassy support.So lets keeep our fingers crossed and PRAY to GOD that all goes speedy from here on out.
They recieved my petition on 5-30-06 and then CSC recived it on 06-07-06 and ive been touched like on the 4th 5th 7th and 8th of this month.Any comments would be appricated.What do you all think?

Alhough I got my NOA2 in april.
No RFE for me yet.

Last in line.. I don´t know what to do.

See, I really think that you should call someone about that, because it's way outside the processing time for VSC.

I originally sent my petition to the CSC. I just sent back my RFE. All they wanted is some from to know if we met through an internatioal marriage broker or if I'm a criminal. Seems like a waste to me. Why don't they include that form in the petition package so they can have it from the beginning? Anybody have any idea how long I have left???


The whole thing stems from a law called IMBRA that was passed in early January to go into effect on March 6. Unfortunately, DHS and USCIS didn't have the new form (requiring these few extra questions) sorted out by the deadline and it took them three months after the deadline to get the forms sorted. Hence, all applications recieved after the law's effective date are subject to the law and need the new questions. Sharp eyed people here noticed it in April, about two months before USCIS said anything official about it.
