K-1 Fiance(e) Visa Process & ProceduresThis is really annoying....
I just went through this process. The key is not getting an RFE for something you did wrong. We were approved 2 days ago with no RFE's. The process is frustrating but when you get approved look back at it like I am now, you will likely agree that it is done properly in many ways.

I watched the boards. I saw many couples break up between 1 and 4 months in. The fact is that many couples rush into this process and are truly not solid in their relationships. If this process was done any faster, many more couples would get married and have to get unmarried. Our approval took 5 months, 20 days. Our NOA2 was approved just after 4 months. We went through Vermont. I think they did a good job. I grew up in this great country and not everybody should be allowed in.

If you can't make it through 5 or 6 months, you'll never make a lifetime of marriage.

K-1 Fiance(e) Visa Process & ProceduresSkype Log - how many is too many?

I didn't submit a single skype page with my 129F application and I got approved. Now, going into the interview I am printing all 6,000 pages (double-sided) and compiling them in 5 separate 6-inch binders for my fiance to take with her. So my 100 pound fiance is taking in 50 pounds worth of supporting documentation... I LOVE IT!

In the Embassy my fiancee is in right now as a matter of fact, people only take 1 page of email or skype print from each week or even less and get approved. They will not be impressed by 50 pounds of paper. The interviewer/CO will rely on your fiancee's answers and tone of conversation with a balance of other information. You might could lighten the poor girls load up by at least 90% to make her not feel so much like a pack mule, unless there is something special about the Embassy where she will interview at.

K-1 Fiance(e) Visa Process & ProceduresPlease take a second look at my petition package!
The divorce decree is called a exemplified copy in Florida. Look it up on google. What I got was the complete copy but most importantly the first page has the judges signature and the court seal on it. Just make sure it was signed by a judge and has the seal. Refer to it as an exemplified copy and they should know what you are talking about.

Also, go to the regional forum on China and post and read in there. The Embassy that I deal with will be different from the standards you deal with in China.

K-1 Fiance(e) Visa Process & ProceduresPlease take a second look at my petition package!
I described our meeting in the box that was provided by typing it in. I covered our meeting completely in 4 lines. They don't want a love story there. Your divorce decree must be a certified copy signed by the judge and original signatures.

I left a few fields blank on one of the forms but I don't think I will get an RFE for it. My best advice is to look at the forms and compare them with the example forms on-line line by line. I sent a complete package, just like in your list or more... but my only error was not comparing the example forms to what I sent. Again, the fields were not really important I don't think because I left the Alien fiancee number out.. because anybody cuold tell since she has not been here yet, she doesn't have one but I should have put N/A.

By the way, I hand wrote nothing. I filled it out with Adobe and typed it right in and printed it. Much neater and probably easier on them.

K-1 Fiance(e) Visa Process & Procedures3question at interview
We just got approved too. It took us Five months and 19 days. We could have shaved another week or more off of it had I not been in the Philippines during some of this time after the NOA2. The key is getting the MNL# quickly and using it to schedule everything.

First off, I feel sorry for the woman because it wasn't her fault. Getting a K-1 Visa is about three times harder than it is getting a mortgage on a house. I hope your financee has learned his lesson. I appologize to the lady.

K-1 Fiance(e) Visa Process & ProceduresHave long das it take to gat K-1 Visa ???
It depends on many things. How well your I-129f is put together is a big factor. Many where similar to mine though. We filed the I-129f on August 28th at the Vermont Service Center. We receieved our NOA2 December 28th (lots of holidays during that period too). We got the MNL# 10 days later in January. We then used the MNL# to get her medical and then scheduled the interview on February 15th. She was approved and she recieved her Visa on February 23rd.

Some take longer but I assume that is due to people who are not natuarly born US citizens from high risk countries but I am guessing about that. I just know that all of the filers I have spoken with that were born in America got their NOA2 similar to our time frame, just 3 1/2 to 4 months.

So you see there are a lot of steps. :wow: For us, waiting to get the NOA2 was the hardest part. Everything after that went much faster. The best advice you can get is just study and read this forum for the next four months so you know what to do. We didnt use a lawyer. If you do you a lawyer, you need to understand what they do so you can make sure they do it right.
Good luck !

K-1 Fiance(e) Visa Process & ProceduresWhat is the procedure after contacting US Congressman - No sign of NOA2?
Waiting from NOA1 to NOA2 is the hardest. The best thing you can do is divert your attention. I doubt anything you do will effect when you get your NOA2. I was really patient near the end because I knew I would get it when it came. If you have your NOA1 in hand, you will get your NOA2. This process will not last forever and you will probably get it anyday now. Mine just showed up in my mail box after 4 months. I didn't get a touch, email or text notification.

I wonder why yours takes so long but mine went through in 4 months? I was born in the US and sent it my birth certificate and a copy of my passport. Maybe they have to verify who you are if you came from another country. That could explain the additional time of processing. There must be a reason for the additional time of your application processing.

Settle down. It's fine. My NOA1 says the same thing. You've got at least 4 months to go... and remember don't stress about it. It will come when it comes. My NOA2 showed up after 4 months. I was suprised by it because I was prepared to wait for six months before stressing.

(by the way, my fiancee is there for her interview on February 15th. Now I can stress !!! :help: :girlwerewolf2xn: )

K-1 Fiance(e) Visa Process & Proceduresabout the forms

hi, i wouldl ike to ask if i print out every forms, what size of paper would i use? Do i need to fill out every form like G-325A for me and my fiancee in ballpen or encoding it is better? also, the letter of intent to marry, would it be encoded or hand written?

Print all forms using standard 8.5x11" paper. The forms are available in fillable PDF format here on VJ or the USCIS website. Just sign using ballpoint. Most I believe just type out the letter of intent (both you and her) and sign (I did). However writing it out would be OK as well as long as it is clearly legible.

K-1 Fiance(e) Visa Process & Proceduresproof of relationship and avoiding RFE's!!
Those are all used as 'secondary' proofs .... so it does not need to be 'exact' stuff. Just submit what you have (what you 'DO' have look strong enough). Include those boarding passes and hotel confirmation if you want to. Those just solidifies your case. A lot of people got away just by marriage certs and very few other proofs.

Btw, it may help to put together a few affidavits of relationship bona fides.

K-1 Fiance(e) Visa Process & ProceduresFilling out Forms
I have spent many Hours searching US Government sites before filling out I-129F Package. After I send my package of, I found VisaJourney. I still have several questions.

1; In what Language should the Forms for my Fiancée be filled out. Spanish or English?
2; If she fills out the Forms in Spanish, the Computer will use some foreign characters. In most of the Form Instructions, it says not to use foreign character’s when filling out these Forms.
3; I am filling out the following forms for her, DS-156, DS-156K, DS-230

K-1 Fiance(e) Visa Process & ProceduresNVC can't find our file!?

Hey,

We were approved for the I-129f on Dec. 5th.

I called the NVC numerous times since then to see if they received our file. I was told that it takes X amount of days for them to receive it, etc. etc.

I called again today, the woman (rude b**ch) told me that she can't find the file and to forward the email that we got from USCIS, to them (NVC).

What is going on?

Anyone had to do this before?

Thanks!

YES Same thing is happening to me!! We were approved on Dec 16th but they have no recorded of it

K-1 Fiance(e) Visa Process & ProceduresI-129F Denied ----Refiling

HI,

My I-129F petition got denied because apparently me and my fiance did not meet in the past two years, which is untrue but i somehow failed to adequately prove that.

I researched everywhere and the best way to deal with this seems to be to refile which is fine.

My questions are if anyone will be so kind to help me out:

1)Is there anything special to refiling or just as the first and i make sure this time all the criteria are perfectly met?

2)When i filed my first one i accidentally replaced one letter in my fiance's last name instead of "Sayed" I put "Sayad". On his passport its "Sayed". Should i fix it in the second one? And explain that this is how it is on his passport and the first petition had that tiny error. And i send a copy of his passport? OR should i just fix it and not mention anything.

Thank you for anyone who replies i know they are very simple questions but you can never be too careful.

How did you fail to prove you met? Pretty easy.. send in copy of your passport stamp and reeipt from airline book and photo copies of entering and leaving the country alone with photos together.

first off congrats, the k1 process is a really smooth process if u have all the paper work in order and you don't leave any spaces on the application blank so make sure u recheck everything. Also every form in the application requires the original signatures.

Knope2012 sent u a link on the k1 process read it, read it, and read it to make sure you and the petitioner qualifies for the K1. make sure u have boarding passes, pictures to prove he was there within the last 2 years

here are the example forms and cover letters showing u how everything should be arranged in the k1 packet(remember u need to send in 2 letters of intent from each of u):

http://www.visajourn...ontent/examples

last, at the end of each month it's a good ideal to start cataloging all the skype log, emails, call logs, and snail mail(send each other from time to time it helps) and it's a real time saver to have everything prepared already for the interview.

september is plenty of time and if u follow the example forms and don't leave any spaces blank on the k1 application u should be fine. also, make sure on the form to put n/a and none in the appropriate spaces because sometime they will send u a rfe it for a minor error like the one listed

good luck

ok wow u guys have been of great help.seems to me theres so much for us to do before we put in our application.thnx for the link aswell uve been of great help and i will read knope2012s link aswell thank u so much!

As long as they are legally divorced and can prove the documents stating this, you'll be fine. Is the ex wife a US citizen? I think the only way they would give you a harder time at the interview is if he also brought her to the US through a K1, but even then, it's possible to fall in love with two people overseas. The processing time varies, but I filed last week and the website currently states that it's 5 months. However, after that, there is some waiting for your paperwork to be sent to the US embassy in Ghana and then a wait for the interview. I would be hopeful that it gets approved by September, but with the USCIS, you never know.

HI YES the are legally divorced, but she was a Us Citizen they are still good friends and my fiance never treated her badly, hes never filled a k1 visa for anyone before, and this is our first time.if theres anything more i shd know kindly do well to tell me.God bless u .sad abt the YOU MIGHT NEVER KNOW PART THO.:( LOL

I would start here:

K1 Visa Guide

This is the complete guide for a K1 Visa and it helped me out a lot when I filed a few weeks ago! You basically need to start by having your fiance to file an I-129F and gathering the documents for it, and the guide explains how it is done. Your fiance will have to gather some of the information himself, as he is the one who sends off the initial documents.

oh really that was fast thanks so much sure am sure he can take a day or two of so we could start the process.however do u have any idea of waiting times and processing times, i must mention that hes divorced, his ex wife and i are friends, their divorced was based on an agreement between them because her little boy couldnt bond with him,no matter how hard he tried she had to go back to her ex husband.lol.but is there anything i should know or find out about her before we start? i could ask her personally :) thnxs a bunch for the quick response

Hello everyone greetings to all of u
i happen to have stumbled on this website when my fiance suggested we filed for a K1 visa.i live in ghana and we have a small bussiness together.am 24 soon to be 25 this year and hes 34 soon to be 35,even tho he looks like hes 27 lol.we met through my classmate who lives with him in the states .this was around january but we hadnt met personally cos it was on phone, i must say i had just come out from a very bad relationship which left me very heartbroken, and so i wanted nothing to do with men.i totally closed the love chapter in my life, until my friend called out of the blue saying she heard i broke up and she had the best man for me .i smiled and said here we go again,am not interested. She said wait till u meet him hes just like u caring humble and kind.so my craz friend gives him my number and we start talking.I was amazed to find out that he would call me every single day.i realised i had fallen head over heals inlove with him without even setting eyes on him,.I accepted his proposal in february by then we new alot about each other,he spoke to my mum and family and we grew from strenght to strenght.then he came to see me in ghana in august!.I must say it was the most memorable day of my life, when i met him in person i realised what a kind heart he had he was God fearing and honest i knew then that this was my Soulmate.Enough walabaloo.
I believe in Ghana and i believe in the possibilities here,i am not a fun of the united states because i think they are a waiting timebomb.ive begged my fiance to come and live here with me but he is clueless where to start. We talked things over and hes convinced me to join him in the united states.we got engaged in december 14th .now we want to file for the fiancee visa.all i want to know is where to start i get to d all the research cos he works like hell all time anytime,i feel bad for him cos i worry about his eating, and studies and realised that i could be of greater help to him in the states than here in ghana.he doesnt send me funds because we have a small bussiness together here in gh which brings in the income.we skype most of the time and hardly email each other ,however we also chat on yahoo sometimes but its all skype skype skype and more skype But he calls my cellphone most times aswell. hes been to ghana twice since we met 1st to see me and the second to get engaged, hes coming home again soon tho.I really need help on how he can file for me cos because he doesnt have time to do all the research .can someone here help me out with the answers i seek.hes employed and meets all the employment requirements.please brief us on how to start and when to start i am hoping to get an approval by september 2012 because thats when he starts schooling,i need to be there to help him out.thanks to u all and stay blessed

Hi there, a lot of what you are speaking of is not considered primary evidence. Primary evidence so to speak is things like ticket stubs from airline flights there, hotel receipts with both of your names, and items of the like. If you have phone records, keep those and use those. In your skype account, there is a way to saver your history, start saving that. Pictures any any visits you've had together, any receipts you have from whe you were together also help. Another thing you might want to try, if you do not have a lot of e-mails and things of that nature, written statements from both sides of the family and friends confirming the relationship may help. Snail mail is regular mail sent through the post office. I would suggest you starting using this form if you are not already, then keep the envelopes when they are delivered to you. Because the countries "stamp' the mail it is good evidence that you are corresponding. You stated you just filed your K-1 most of this type of evidence will be needed at interview which is some months off. Yes, you may not have a lot of these items now but begin gathering it now as you move forward.

I had my skype information and phone records showing I texted him. We had nothing from Ghana records- im not sure if you can even get them...

Pictures, snail mail, travel documents. As much from the beginning as you can. But start collecting now.

Israel and I didnt have anything but pictures for the first 6 months because i was living in Accra. Never had an issue of them asking for emails or anything from that time.

Don't stress. Just collect what you can now- and just build on it.

I just posted to another person a few seconds ago about putting a package together. I just got approved yesterday from Vermont. I followed the guidelines on VJ. My petition was about 1 months of chats. A few months at the beginning, middle and prior to filing the petition. I had 4 pictures of us together in Manila printed from Walmart. Then I made 6 Powerpoint slides with 3 picture on each page with details on what took place in the photos. I wrote on the Walmart pictures too! I sent copies of packing slips of item I sent her and the kids. I made copies of all the letter she and family sent me. A copy of the reciept of the engagement rings, phone bill showing text messages, copies of my passport, copy of her passport, copies of plane ticket/boarding, copies of hotel reciepts and any places we visited together and family picture of us together. My coverletter was the same use in the guideline. My letter of intent was similar to VJ's guideline. What I did was I made 4 copies of all docuemnts, (letter of intent, I-129, her G-235-A, and my G-235) I signed them and had her sign them too. As for the letter of intent, she signed a copy and sent back to me. I sign the letter of intent of marriage and then took it to the notary. Then I sent the notorized copy with my petition. That was basically my petition. If you don't have email that is ok! You just evidence that shows there is somekind of relationship. The lenght of time is not the real important factor. I just has to show you are together. Send messenger chats, phone bills, letters/cards to eachother just anything! I say about 20 picture that are timestamp.

Good Luck

well.. do you have pictures to show you two have seen each other within the last 2 years? Real pictures, not photoshop kinda of thing? Do you also have passport stamps that one or both of you made a trip to see each other? If so, then you have a good chance to pass thru USCIS (might cuz urself extra review). Now, the consulate/embassy stage is where you could struggle. But since that takes 5-6mnths to get to, you can start doing those things you don't have like emails (dont make it obvious), sign up for a phone system/card that will give you call records when needed.

what about remmittances we dont have that either cos we run a bussiness together.i read somewhere that u need to show moneygram or western union sheets? :(

You do not need all that "evidence" YET. You only need to prove proof of having met IN PERSON with the last 2 years and that can be done with boarding passes, passport stamps, receipts and of course pictures. The Skype logs and such you will want for later during the visa process at the embassy.

snail mail = postal system

thanks a bunch .what kind of receipts are we talking about here? hotel reciepts? dinner reservations? ??? :(

First relax- you have another year before you will even be looking at in interview in accra.

pictures, start emailing and using other forms that can be printed. If he calls you from his cell or text he can get records (should be able to). Passport stamps from his passport showing visits. I believe you said there had been two. Boarding passes if you have them. Letters from mutual friends in ghana.

Do you have any business things with your names on it?

Letter form Senator wont do anything about evidence.

WELL YES WE DO.BUT HOW IS IT POSSIBLE TO GET CALL RECORDS WHEN HE USES A CALING CARD? PLS EXPLAIN :(. I USE THE SERVICE PROVIDER CALLED TIGO BY THE WAY.is it my call records that are needed or his or better still BOTH? :(

I agree with midge you have a year or more to begin gathering information. I just went throught the interview process 2 days ago. What they want to see is the reality of your relationship. Over the next year begin to gather and put together everything. Write a progression of your relationship, Picures during your meetings, family pictures together, for phone calls using VIP for phone calls really worked for us. VIP even wrote a letter stating this is our client, she open her account thid date, she mainly calls Ghana, these are her calls type of thing. The certified letters from family and friends also are a good touch. Accra is a tough Embassy our fiancee visa was not approved that is why I worked so hard on the IR/1. It can be done and you have time.

what is a VIP FOR PHONE CALLS KINDLY BRIEF ME MORE ON THAT PLS :(
