Oh Yes you are right, i read I-130 so many times I was confussed. Actually we filled it out first and then discovered the mistake so he had to send new G-325A forms . Thanks.

I have read and re-read as much on this forum as possible. I am still in awe of all the forms, and numbers and such...sometimes I think i have the road map figured out (thanks to the guides) and then someone gives another number and I think..oh no mr.bill do i do that too?

Here is what I am thinking we do to get married. He-a German citizen living in Germany, I a US citizen living in US

Apply for a K-1 visa by submitting the I-129, and the I-130 (Done)
Get a NOA (got one for the I-129, but should I have gotten one for the I-130 at the same time? This just occured to me today)
Ticlkling and touching (nothing, nada, have not even had a glance-based on time line...I dunno it seem slow compared to some but..)
Get RFE's if its going to happen

Get 2nd NOA basically the approval.

Case is then transferred to Nevada where the locals make book on if you will actually get your boyfriend here to marry you.~~Oh wait, is this Nebraska? ooo ok.

They then do their magic on it (I have no idea what they do) and then forward it to hubbys home country (Germany) embassy for them to start. They prepare a letter to send to my guy pie.

They send forms to him, he sends them back (at this time he could also have the medical forms done? or do those need to be waited upon)~~what are the magical 3 packets I have read about o'masters but I am still not able to find info about them?

He gets interview

At this point if he needs a waiver (if he thinks he may possibly need one) he brings it to the interview incas they turn him down, and he hands it in right away

(if you get to this place in the game, stop, dont pass go, wait your turn for 10 months???)

if it gets approved he gets his visa


he comes here
gets off the plane
we have lunch

go to bed and sleep for 12 hours

get up, have some coffee
go to the beach
Ok ok.....this is as far as I can t hink at this point....

what theheck does he bring to the interview, i ahve yet to find a COMPLETE list

We did not send in my birth certificate (I was the beneficiary) with our I-129F application. It was needed later at the interview stage.

We had no problems and did not get an RFE for it.



Good, I we didnt send one, didn't even think to send it since it wasn't asked for. Wow you have to be Karmac from Johnny Carson to know which way to go on some of these things.

Here is my question, my fiance and I have been self employed, duel members of an LLC for almost the last 2 years. We were told not to put it on the application because the ...oh Catholic Charities people said it didnt matter.

Now I wonder about some of the advice they gave us

The whole thing boils down to making sure the person you are petitioning for a fiance(e) will not become a public charge once they are here. The government wants to make certain you are able to provide adequate financial support. Petitioners for the K-1 will need to prove they do meet the 2007 Federal Poverty Guidelines. If you are able to show that you are, you've met the requirement. If you do not meet that poverty guideline, you can use your assests or have a co-sponsor for the visa. I think it's great you are working in the same LLC. Unfortunately, I do not believe they will include her income. It is usually just the petitioner. I could be misinformed about this since the two of you are duel members of a LLC. I hope there will be more input on this situation for you from people in a similiar situation as yours or has already gone through it.
As far as what you read from this forum or what you hear from Catholic Charities, you should always research further to confirm advice. People on here are not immigration lawyers. If you are unsure, you may want to contact a competent immigration attorney.



Well while we do good business the profits are slow in coming, so I won't even be using it as a form of income. I actually might have to go get a job to qualify, I qualified last year I think, and the year before,but this year is SLOW....I have 2 forms of self employment.

I am a Sub "S" corp. The profits from my biz go to my W2. I can not get my personel tax returns untill the company returns are complete. We are not going to file untill the deadline in Sept.
I do not have any problem meeting the minimum income requirements so that is not an issue. I can show all my bank statements, checking and saving as well as my investment accounts as well as payroll stubs from the biz. I am not going to be able to provide end of year tax statements for 2006 untill who knows when.

I'm a sole proprietorship. I am not familiar with "S" corporations. Hopefully, someone will come along soon and offer a little more to you. I know for sure that meeting the financial requirement is the same for all of us. I see on here sometimes people stating their "business" makes more than the adequate amount required. The one thing that is pointed out, it's not the business petitioning for the visa, it's the person. Now, it all comes down to "proving" it to the embassy when the time is right.

We filed I-129F in Feb and now I (filer) changed the address so my fiancee's 'intended address' is also changed.
So, on the letter of confirmation they mentioned that I should call them as soon as address changes, but I also read here on the forum about form AR-11 (which apparently is now possible to file online).

My questions are:
1. Do I just call them? (as official letter from them states).
2. Do I also file AR-11 form?
3. Can I file AR-11 form online?

I have noticed my dates seemed off, so tonight I double checked everything, when it was sent, received and so on.

The notice date on my I-797NOA for the I-129F is March 6. So I assume that is actually my NOA date. I had been saying 3-12 which is the date on the internet on my account. Does this mean my file was looked at once after March 6th? Like on the 12th? So maybe this is a touch, and I could be getting a NOA2 or an RFE?

Ok so it was a touch..well thats still good news. Maybe they put it in a new file cabinet or on Mary Janes Desk. That's why i did not want to post this. Please, if somebody has a similar experience or can give me opinion about how this could affect my visa, i will be grateful. But do not ask me questions like why do i want to get involved with a person with such a backgrund. The answer is- because the love does not know limit and because before you fall in love you dont ask somebody for his background and because we simply love each other and because what matters for me is the present and the FUTURE, not the past, and yes, i believe that the people can change if they meet someone to share their life with, because loneliness is the worst thing that could happen to anyone and loneliness can make you take the wrong decisions in your life. The loneliness kills, the love brings back to life. This is only my opinion and as far as i know this person with the terrible past, i know that i will have happy future with him. I kinow him for a year and half and i know that the love is the most powerfull feeling and it can change anything and anybody. All of us here are in love and all of us should know this.



I am reading these old files, and while this is a year ago, I have to say something. IF you are offended...get over it. First off, Love does know limits. It is my little girl heart that does not know. Love knows that the person whom I need and want in my life should not be someone whose history is littered with alchol abuse and my future will be a mirror image of this past.
I am sorry to say, however you can see your future in his past. I think you are idealistic or very young, either way, God Bless you for not being realistic. Realism gets in the way of a healthy fantasty life. Love does not change people. People change people.

I think what you are feeling must be normal. I know the last time I saw my fiance in Germany, it was a bit tough. After 4 days he finally said, I feel like I have never heard English before and I have no idea what you have said for the past 4 days. He speaks great English. I think it is just adjustment. Once I realized that, and I backed off a bit, then it began to go very smooth, and a few days later it was very natural.

I think I do not envy you, these are strong emotions, but I think it will all be very fine, in a very quick time period.

Congrats and really, have a darn happy life.

Since the G-325A does not allow you save info and send the file over the internet for her to print and sign it, it's a problem.

What I did was fill up her G-325A form and emailed her screen shots of the filled form as a Word document along with the blank G-325A form. My wife filled up the G-325 pdf exactly as I had by looking at the screen shots, printed, signed and mailed it to me.

Better to have a typed up form than a hand-written one to avoid mistakes, just my opinion!

I see this question alot, my question is, if they have the form and sign it, why cant they fill it out? Am I the only one who made my man fill it out and write his letter of intent (although I think we did this wrong, I said why we are perfect for each other, and his was a drop dead love letter. ....made me cry.. :)...anyway, so whats up, is it the english that kicks them? I am sure it would help to have the form in their own language, translation is really hard.

I did the same, but this question perplexes me still, how do you "prove" to someone else that you met another person. Passport stamps, boarding passes, hotel receipts only show you were at a particular place at a particular time, but nothing in there shows proof of meeting anybody in particular (except maybe customs officials, airline officials, or hotel workers). I think pictures are better proof (assuming we say *nothing* about PhotoShop), but unless you are holding up a newspaper or something giving the date, how is that proof that the meeting happened in the last two years? I passed this question around my office, no-one has yet to come up with definitive proof, everything seems to be just circumstantial evidence. I think a better form of proof would be an eyewitness under oath (who would lie to the USCIS?), but haven't come-up with a good way yet to mail one into the USCIS :huh:



I think you have been watching too much Csi. IF your have met, you have met. If you have photoshopped you have photoshopped. I think that is not a real issue. As long as you have met, your evidence will be fine, they may ask for more, but it will not be the big question. Unless you photoshopped.

Hello! I'm almost finished but my fiancee got his birth certificate and divorce certificate translated but the company certified it with a blue stamp:

"Certified Correct Translation: (the translator's name) (translator's signed signature)" We then were also given a card with the company's address.


This is not exactly the USCIS form-- the translator never actually states that they are fluent in English and Thai. They also do not have the address or date on the document itself.

The below is what USCIS specifically asks for.

I typed name , certify that I am fluent (conversant) in the English and
languages, and that the above/attached document is an accurate translation of the
document attached entitled .

Date
Address

Should I get the documents re-translated? Will I receive an RF if I don't? What do you recommend? I actually sent the USCIS form with the documents but the company didn't sign them. Auuggh! Should I go to a different translator?


I would suggest typing that information and taking it back to the translator. For any of us, we should type that information and have it ready to hand it to the translator. Being proactive seems to really be the stratedgy to get through immigration.

I completely agree. I am in the real estate industry, people ask, wow how will this affect my taxes, is this legal to do. They basically want my 10 years worth of experience to give them some advice or worse yet to type a contract for them. I'm cool with helping, however without a consistant interjection...Im not a lawyer and this isnt legal advice...however........without saying that, you can actually be charged with practicing law with out a license.

Its ok just to put the approximate date, month/year of the filing, her name and place where the service center is, and just wether the previous petition was approved. You didn't specify wether he filed a K-3 or K-1 before, but if his
ex-wife is still in the U.S. she should know her A#. But in any case they have the info on record so if you don't have the A# don't worry about it, or you can state the circumstance and that you don't have this info on an attached sheet
( signed and dated ).


His ex is not in the US. She is in Italy now.

We were starting to fill out the form yesterday when we noticed that in Q11 they ask if "you have ever filed for this or any other fiance or husband/wife before?" you need to give the name, place, date and A# and result.
Now is our problem that My fiance DID file for his ex-wife in 2000, but he doesn't have the paperwork cauese she has it.

What can we do? Is there a way to find that info?
