:unsure: My Fiance send I-129F package on 20 March via USPS to Texas SC. Today we checked delivery status and got the following comments on USPS web-site: "We attempted to deliver your item at 10:13 AM on March 22, 2007 in MESQUITE, TX 75185 and a notice was left. It can be redelivered or picked up at the Post Office. If the item is unclaimed, it will be returned to the sender. Information, if available, is updated every evening. Please check again later".

What does ot mean? Does anyone work at TSC?

I-130 IMMIGRANT VISA PETITIONS

As of January 22, 2007, consular offices abroad were instructed to cease accepting certain immigrant visa petitions because consular officers lacked the means to perform the required criminal background checks on American citizen petitioners, as required by the Adam Walsh Act.

Subsequently, the Department of State and the U.S. Citizenship and Immigration Service (USCIS) worked to develop a mechanism whereby USCIS will perform these required “Adam Walsh Act” checks for any petitions accepted abroad by consular officers.

Effective immediately, consular posts abroad will accept petitions for immediate relative immigrant classification from American citizens who are resident in their consular districts, including members of the armed forces, as well as true emergency cases, such as life and death or health and safety, and others determined to be in the national interest.
Examples of family emergency include minor children who would be unexpectedly left without a caretaker. Examples of national interest include facilitating the travel of United States military and other USG direct hire employees assigned overseas who are pending transfer on orders and need to petition for immigrant classification of their spouse and minor children at posts overseas.

To demonstrate residency in a consular district, American Citizen petitioners must be able to show that they have permission to reside in the consular district and that they have been doing so continuously for at least six months before filing the petition. Individuals who are in the country on a temporary status, such as student or tourist, would not be considered to meet the residency standard.

All lawful permanent residents, and American Citizens resident in the United States or with a permanent address in the United States, must file I-130 petitions at the USCIS Service Center having jurisdiction over their place of residence (as indicated on the USCIS website: http://www.uscis.gov...form/i-130.pdf).

So... here is my story.

I live with my fiance in Norway. Orginally, we were going to get married here and file for a I-130 at the American Embassy in Norway. With the passing on the Adam Walsh Act, embassies abroad were no longer able to accept these applications. Well... now they are.

My question is... can we cancle the fiance visa we filed in February?

If so, how do we do this? We would much rather go through the process here since it is supposed to move much faster.

Any advice?


What do you mean? Where did you get this information? I am asking because we planned as well to get marry in my country (Kazakhstan) and after to file for I-130, but US Embassy informed us that they don't do it anymore ...

Begins with three letters - CSC filers begin with "WAC" - someone correct me if am wrong..but three letters for sure.

Hmm...Nope. They don't know what they're doing, definitely. I sent the money order made payable to Department of Homeland Security, and it was accepted.


My Fiance send check payable to Department of Homeland Security as well. Even I-129F Instruction from USCIS web-site says that. I think you need to call USCIS and ask them

A lot of people want to know, can the foreign fiance VISIT the US fiance in the US during this process?

There are no guarantees.... Many people historically been turned away at the port of entry after
starting the k-1 process. If you try to make an entry during the k-1 process you may be turned back and
sent home. If you elect to visit, be aware that the POE officer may not to allow you to enter the US and turn you right around (at your cost).
Be aware of this risk. It is not illegal to enter the US during this process but you have to realize that there is an elevated
risk that the POE officer will decide that you are trying to bypass the fiance visa process. I would personally advise anyone
considering this to make plans for the US Citizen to travel abroad instead. Why take the risk just for a visit?
Keep in mind that if you are turned away (for any reason) this may delay your interview for the visa and result
in complicating the situation later on.

see she is listed as a widow and we have all the paper work to prove it she was married for 2 months before he died suddenly
and several years later she meet the dead beat

i guess my post is will the interviewer be considerate to what happen buy the time of her interview everything should be final as far as the annulment ..we not trying commit fraud

Random voice of reason here: See a lawyer who specializes in Manila ASAP. This is not something you should be guessing about or taking the 'average' of VJ responses for.
You *do* have an opportunity to make a 'timely retraction' of mis-information without it being a material misrepresentation. Do YOU know when the best time to do that is?

Shop around a little, it should not be a huge expense. Good luck!

Yes, but the way things are going for me you may beat me to the brass ring. I have been stuck in A/R for two months with no end in sight. I heard of one case that was in A/R for 8 years.

The other thing to keep in mind is when we are in a real relationship we know it is real. The C/O doesn't. Sometimes our confidence in our relationship makes it so obvious in our mind that we forget we need to prove it to him.

This is a such great thread, with interesting questions being raised.

If a relationship is genuine -- that will come through. Sure we'll be nervous during the embassy interview, yet we'll have documentation ready to support what we're saying.

My friends and family can see it in me when I talk with them. I've described the many potholes and delays in getting a visa. They're astounded. I imagine that the hard work will begin when he gets here. The first year of any marriage requires major adjustments. So I want to enjoy and celebrate all the good things that come our way!!

Our relationship is genuine (with all the ups and downs and "What??" included). We have nothing to hide, so I'm not worried about questions that might be asked. We'll just answer them. I believe the legitimacy of our love and marriage will be self-evident at the interview in Ankara. Though, I may be 80 years old by the time that day comes ...

I didn't use a personal check, I sent a PO money order, thinking I would not have to worry if it takes time to cash so I can not see that online to get my number, I must wait for the mail man.

I sent in the application on February 23, 07 and the post office shows it was delivered on February 25, 07.

When I read everyone's posts it appears they got a notice stating it was received much sooner. Did the TSC send it to them.
Since Texas doesn't show wait times for the I-29f does that mean it gets sent away (first I have heard of this)?

Also where did you find where all of these acronyms are? NOA1 NOA2 RFE.......

I need the glossary to marrying a foreign guy!

Yes, TSC sends it to CSC (in California), because Texas no longer processes the I-129F.

My fiance is from Germany too, and things are going really smoothly for us, so good luck!!!

Why not get a sea shipping frieght forwarder? Even if yo come back to get more items, you are still limited to what you can take on a plane. If you actually have that many things, I would think you could go through WestKamp or IFF and have it stuck on a boat for as cheap as a airline ticket.

Thanks Everyone, good words of support. I did file the one that expired on the 18th of February. When I read a note in here about it, I checked right away.

Having worked for Govt before (nothing so glamorous though) I know the attitude. But for now, I say nothing and make the symbol of the cross and say GO IN PEACE to these people, (like a catholic thing)

Hi, well my bad news for the night
I read on here over the weekend the I-129 form was expired on the 18th of Feb, and of course I sent mine in on the 23rd. When I checked the form (saved in my computer) of course it is the wrong date. sigh.
I did get back my receipt today, so while this made me happy, I was unsure to call and say, ops missed the date on the bottom of the form, or if I should let lying dogs sleep (i love backwards ok).

What do others say? Should I call and let them know, assuming in 4 weeks they will reject it and then tell me?
Or should I wait?

wow I feel dumb, in our letters of intent to marry, we wrote why we wanted to marry. I made these statements about how we have spent time finding if we were compatible on several levels and how we are happy and in love...but I didnt say in 90 days, I assume that is understood.

His letter....oh my god, I cried when I read that letter. I plan on keeping a copy so when we get into an arguement I can re read it. It was really heart felt.

That is an ERROR in the Example Form, or a trap to make sure you are still thinking, and filling in your own information.

First..I think you're going to be (crossing my fingers) OK on your outdated form (by 5 days) - hopefully they will let it pass - form promulgation isn't an exact science after all..especially for our government.

Next - you'll get an NOA2 for just your petition (129f) but his little tag-a-long buddy (the 130 - are you sure you need that?...hmm) will get to make the trip too. They've already had a fun trip since they went to take a tour of Texas..then got a free ride to California...since Texas doesn't do I129f's anymore.. too upity I guess..

You'll be busy worrying at this point, but your NOA1 gives you hope..so you jump on the USCIS web site and register using your receipt number..and sign up for the well known compulsive-screen-refreshers anonymous club.. You'll make careful notes on your Last Processed date(s) you see there..and yell YIPPIE when it changes.. now you will be able to say (to people who will look at you like you're crazy) I've Been Touched...

If you're lucky..you'll have been touched..doesn't mean much sometimes..since your case file now has a bar code used to keep track of it.. but it might (or might not) get 'touched' by time you get your NOA2..

(RFE - from what I've read, typically these are usually time setbacks..not a total loss..they want X, you send X - file back on track.if you sent them what they asked for...)

Mini Party for NOA2...yay..

Your case is packed in it's file with some other eager filers stuff and shipped to NVC - grand music please..it's the National Visa Center...in New Hampshire..? hmm..what else is there? (just kidding).. it falls off the radar for a short while..in between places.. but..you get a handy (non-toll-free) number to call..and ask (or you can email..)

Your file will manage to get to NVC in a couple of weeks..some get there faster because they're just SPEEDY.. but..it'll get there..

NVC will take it..sprinkle pixy dust on it..and ship it off to Frankfurt.. now - if you have called enough times..you'll have a NEW case number to hold in you now sweaty palm..this number is really important..Once you have this number..you can check back in a few days to see if your happy little file has left on it's now-international journey..

And... (running out of breath) now Hecan call Frankfurt and ask if they received it..using this new number..

They'll say.."of course...what do you think we are? idiots?.." and they will...and you/he will...

They (Frankfort) will open your file..think 'geez..is everyone leaving Germany".. and prepare and send out what is called (lovingly) Packet 3.. to him.. which he'll get in a few days I imagine.. In it.are intsructions..and forms.(of course).. there are things he has to do..and something you'll have to do..

Now you have to fill out your (another form) I134 (which is in his packet, but you may as well fill it out, with all the supporting papers ahead of time) - your affidavit of support.. and, you'll probably have confusion on that..but that's ok..it's built into every stinking form..

You're going to pack that form and a copy of your whole 129F (that you sent and hopefully made copies of) file, original documents (divorce, etc) but not Passport/Birth..your NOA2 (keep a copy, send original) and more ongoing relationship stuff..and some candy..and #######..and ship it off to Germany.. DHL is best by the way..

While that's happening he (presumably)
Can be researching which forms he'll have to complete (this time..get the up to date ones...).. and have all that ready.. by now..he should have his shots..(vacinations) up to date.. and his police report..(which it sounds like a waiver is needed? hmmm.. has someone bad?...maybe too many trips to Amsterdam? (am teasing)..).. (I cant help with that..but plenty here will help).. so he's gotta be busy by now.. setting up a medical..etc....

He'll prepare the forms - send Frankfurt what they want sent (again, see the Embassy Section and Guides for more details)....and will keep everything else for the interview...(the instructions will - hopefully-explain).

So..he's gathered everything.. been to the doctor..got your shots ..(even though many will tell you you don't have to do the shots until later..but may as well).. set up the civil doctors appointment for the physical.. put together all that stuff you sent him, ate your candy.. and puts on a suite.. he waits for the letter telling him when he is to come for the interview..ok, now he can put on the business casual attire..and hop on his scooter..

He'll arrive early or the day before..since the interviews are always in the morning..rumor has it..but check the Embassy section for Germany to find out more...hint hint hint..

He'll get in there..and... (Lets assume) gets out without a scare.. They'll mail him his visa..(usually, that's what I hear they do).. He'll have 6 months to get his butt on a plane to see you.. Note: if he actually takes 6months..uhm..I'd throw him back.. anway..6 months to leave Germany..once on US soil..he has 90 days to get hitched..or get out! (I think we invented the shotgun wedding..lol)..

He'll get off the plane..thinking hes done..but no.. Customs has to raise their wicked-ugly hand.. but that doesn't take tooooooo long..

Long ride home...all smiles.. tired.. happy..

Sleep for a week..

Go to beach..

Happy Ever After..

Only form I-129F along with 2 4 page G-325A forms (Beneficiary, Petitioner) are filed for a fiance(e) visa. I-130 is used for Spouse, and other relations.

Only form I-129F along with 2 4 page G-325A forms (Beneficiary, Petitioner) are filed for a fiance(e) visa. I-130 is used for Spouse, and other relations.

Oh Yes you are right, i read I-130 so many times I was confussed. Actually we filled it out first and then discovered the mistake so he had to send new G-325A forms . Thanks.
