The instructions are fairly clear: I-129fs can't be filed or adjudicated overseas. You're instructed to mail it to the US Service Center covering your last US address. You are to use a US address on that petition. Unfortunately, that's the part you missed, and why your petition was returned to you.

I'd ditch the 'incompetent' attitude until you know more about what you're doing.. they aren't bad liars or incompetent--the people on the phone don't even work for the CIS, and your calls can not be x-ferred between buildings.

BUT, I have an even better idea for you. Why not get married and petition for your sposue overseas? That is the fastest immigration process available, it is the absolute most complete (no more work to do on it once in the US) and best of all, it is custom designed for people living overseas (all those other GIs you're wondering about).

Most non-Germans find that it is far faster and easier to get married in a nearby country and then file in Germany.



If there is some other, compelling reason that you want to petition and apply for a K-1, get a valid US address where someone can watch/forward your mail to you.



I did use a US address on the petition. And I will use the word incompetent because its painfully obvious this is the case. Believe me, Ive been through a similar process with the same organization before.

And the people on the phone stated they were "case officers" and gave me badge numbers so I have every reason to believe they are employees of the INS.

The instructions arent clear in the sense they say they cant be adjudicated overseas. I'm a US citizen STATIONED overseas and a RESIDENT of the US and my mailing address IS a US address.

ALSO, there is an actual PARAGRAPH (Part C.) on the application asking if you are a US military serving overseas. On top of that, I gave a detailed account of our circumstances which obviously fell on deaf INCOMPETENT ears.

And NO, I will not get married just to make it expeditious for the INCOMPETENT INS. they are there for US and not the other way around.

Me and my fiance are trying to file a K1 visa from Germany (I'm in the military stationed in Germany)

Well, we tried to file at the US Service center but they rejected the application because they said I live overseas...file at your local consulate.

I called the local consulate and they said they do not file K1 applications.
I called THE only number for INS customer service and they basically told me (after about an hour of run-around) to wait until I returned to the US to file the application.
I knew they would be of limited assistance so I asked them to connect me with the service center that rejected our application.
They said they didnt know how to contact the CSC where I filed my application. Either they are very bad liars or are very very very incompetent!... Most likely a combination of both :whistle:


I'm pretty darn sure Im not the first G.I. to file for K1 from Germany. :ranting:

Does anyone have any advice on where we should go next? :help:

It's fine. Just explain the mis-representation to the consulate officer. If you call them to change it, it will take up to 45 days to have it changed which will delay your petition.

Really?? Ok I will wait for the interview. I was under the impression that CSC would look over all documents not just 129. Thanks for your input!!!!! I think I will be able to sleep now!!!!!!

It wasn't mentioned until I brought it up at the embassy. They said they will spell the visa like the spelling on the passport. I am not sure they would have caught it at all if I hadn't said something. So, I don't think it is any big deal


I have her middle name spelled Anatolievna on 129 and Anatolyevna on G-325A and other documents.But ways are techincally correct. However, if I dont call them I dont know what way to use when I send info for interview or which way they will put in the database. I think I will call as a precaution!! I dont know if they can help me if I'm not in the system yet. Only NOA1, i'm only into it about 46 days!! I dont want to wait for a RFE!! HELP!!!


I forgot to mention her middle name is not translated in her passport.

You can call customer service line to have it fixed. My father's name was mispelled on the marriage certificate, however, I haven't receive any RFEs for it since it spelled differently on the g-325. I didn't call them to fix the name.


My petition is only in its 46th day. I only have my NOA1. Am I in the database already? Do I call my service center(California)? Help!!!!!!!

You have a while yet. The G-325 doesn't need to be filed until after the NOA2. As far as the dates of employment all I can say is; make sure the last five years are all accounted for. As far as the two week job and the one day job, well, again just make sure all time is covered; one day jobs, personally I wouldn't put down on the form. Sorrry to be so vague. Remember, I don't really think anyone goes back to check employment history of the SO, but I could be wrong. Maybe other people here will know more. Also, again the G-325 doesn't need to be filed with the petition. I hope I was some help.

WHAT!?!?!?! No, no, no. The G-325 is filed WITH the I-129F. All 4 copies with original signatures need to be sent in for both the beneficiary and petitioner. Your submission should be as accurate as humanly possible.

Do you have someone at home who can check the mail and forward on important parts to you? If you can get documents when you need them you should be fine.

Check the I-34 requirements and instructions and make sure you have everything you'll need to give her for the interview.

Check your regional discussion area and check for the later requirements. With preparation - lots of things are possible!

I need some advice!!!! I am at CSC, Moscow Embassy, recieved NOA1 March 9, they recieved petition 3/01. Looking at the immigration timelimes(CSC and Moscow embassy, 3 month and 6 month) I am HOPING for NOA2 email around May 28. (I know, dont hope too much!!) I am leaving for Russia May 31 -Aug 31 for 3 months and (hoping) that she will come home with me. (dont laugh). Anyway, do I need the NOA2 or copy for interview?? Or any other documents from CSC or NVC??? Ideally I would like to leave about a week or so after approval but tickects jump from 1150.00 May 31 to 2050.00 June 1st, plus I miss her dearly!!! Do I need to stay until approval???? I have prepared all documents(FED EX) for any RFE scenarios. I need some advice!!!!

Russia is alot cheaper then Germany my friend. My girl pays about 150 bucks for a nice 1 bedroom apartment. Food is pretty cheap as well as everything else. I would prefer her to come to me but I am not going to worry anymore. If for some reason they say no I will sell all my stuff, buy a beater of a car and leave it at my moms. Come back for a month if i need money. Once I learn Russian I wont have to do it but it is a nice fall back for some quick $$$.

No country, no service center, no embassy, no consul (with a god-like complex) will stop me from being with my Irina!!!!!!!! I will be with my Russian Queen May 31 to Aug 31!! Hopefully I will be there for the interview!! It will be close!! Might skip to Ukraine to get a 1 month visa if necessary!!!

I wonder if i can get a job at the CSC and approve my own K-1??? They would probably fire me because I am too quick and efficient.

I am alittle worried becasue we tried for a B2 tourist visa in 2/07. We put off our engagement because she wanted to see USA before she left all behind. I told her to check no for "fiance in usa" becasue we were not technically engaged. She was denied tourist visa. We decided to go ahead with 129f so i sent the visa application with january dates(when i visited her in jan we filled out 129f). I hope the embassy doesnt think she lied. I emailed the moscow embassy explaining myself and they suggested i send a "letter of explanantion" with my fiance to interview.

To be honest, I am just plain tired of all this visa ****. All the worrying. Does anyone know why it takes 100 days to approve a 3 page petiton and to look at some pictures and emais. I could do 100 k-1's a day!! It is sooooooooo stupid. Hey USCIS, dont send my K-1 from Texas to California where they are already jammed up. Send it to Vermont where they are counting ceiling tiles. IDIOTS!!!

Anyway, I feel better now!! I am prepared to move to Russia if necessary so I dont worry anymore. Fortunately I can work for 6 weeks in the USA and live for a year in Russia. I kind of like the thought of living in Vladimir, Russia! It is a beautiful and crime free little city!!! Its awesome!!

Include as much information as possible. Pictures of you and her with her family will score points. I dont agree AT ALL with "when in doubt leave it out". I have never seen an RFE for too much evidence. As for saving evidence for interview. I would be more concerned with getting to that point then saving evidence for an interview. More evidence the better, you dont want anything to hold this process up. If you decide to overkill with evidence (like me!!) make sure it is organized so it is an "easy read" for the person viewing your petition.

oh sorry, we live in Michigan. he was here on a visa, but he overstayed and left in order to do everything right. which is why we used a lawyer, and im sure he has a passport stamp from when he left. would it be a good idea to use it? we didnt lie about him overstaying or anything.
I went to see him, but i went in december and we filed in November.

That would work. I doubt he will get another tourist visa since he overstayed. Over staying is a big no-no if there is not a good reason for it. You could of married him while he was here providing it was a "spur of the moment decision" then he would not have had to leave.

I think if you truly love her, your love will get stronger with the uphill battle you will have to go through, Or it will fall apart. Sometime people just meet and click right from the start. I have dated alot of women in the states for years and when i meet my fiance in colombia we just click like no outher women i was with in the states. I take my hat off to you to try to make this work for you, I think i would not bring up where she work at all. Also i have to say. just because she works in that line of work does not make her a bad person at all. I know women in america that get it more and do not get paid for it. what does it make them?

I would try to take a few vac days off and put it around a weekend and see her for 3 or 4 days to get to know her plus it would help your k1 process showing you have seen her more then one time down there.

But then I do realize that it will just be my new name that I'll hear every two seconds ;) .

I'm excited for the name change, but supportive of women who choose not to. My mom changed her name back to her maiden name when she was divorced. When she got remarried she just added my stepdad's name so she has 2 last names (no hyphen). She is always referred to by her newer last name but legally she still has her maiden name.
I think it's nice that she did that since I now have a little sister and the 3 of them have the same last name.
