I have to let you know that it is VERY difficult for Brazilians to be granted tourist visas to the U.S. They have to show VERY strong ties to Brazil - proof that they will return to Brazil and not overstay their visa.
This can include a steady job, good salary, owning a home, proof they're in college, family, etc.
Even Brazilians who are middle class are often denied a visa because the consulate does not think they have strong enough ties to their home country.

In my opinion, I think it'd be better for you both if you went to Brazil. Your fiance will not be granted a fiance visa if you have not met in person within the last 2 years. That is one of the requirements for the visa (having met in person).

I lived in Brazil so everything I'm saying is from my experience. My fiance is Brazilian and we never thought about applying for a tourist visa because it is too hard to get.

We sent a bit of proof for ongoing relationship - a few e-mails, letters, a phone bill.
Like the others said, we took TONS of proof with us to the interview - I think the fact that I went there was quite the proof. The CO did ask for pictures and since I had a scrapbook with me - I opened it up and turned the pages so he could see them through the glass.
He really wants to visit where my husband is from so I think he was being a bit nosy :lol:

I wouldn't worry about the denials for visas to other countries - like everyone said - it doesn't have anything to do with the U.S. And if anything, it shows how much you two want to meet.

You have to be honest ALWAYS about the student visas.
I'm sorry to say, but when I think of Nigeria I always remember those Dr. Phil shows about fraud and men doing anything to come to the U.S. That may as well not be your case, but this will probably be a big obstacle for you.

Good luck and be strong if you two decide to apply for the K1. The K1 visa is not a tourist or student visa.

Don't worry about timelines.. I was looking at mine Center (Texas) and as I understood to get NOA2 will take max 3 months. And after everything will depend on you- I mean how long you will collect all necessary documents for your Consulate.

If my Mexican fiance has a tourist visa for the United States, is she still permitted to come and visit me in the United States while our K-1 is processing?

Does she automatically surrender her Tourist Visa when we apply for a K-1?

Is something noted in the Immigration system when she enters the US on the tourist visa that she is also in process for a K-1?

I'm trying to understand if I always have to be the one to fly down or can she also fly up to visit me.

Maybe a better question than "can it be done" is how many have successfully had a fiance visit the US with a K1 application pending,


But each entry is so individualized, how can this be helpful? It varies with the same person/same circumstances/different day.

The important thing to remember, IMO, is that it is not against the law or any unwritten rule. If you are refused entry, it will not harm your K-1 application (your wallet is another story). If you have mostly been living in the US on a visitor's visa, your odds of being turned back raise every entry.


Maybe you are absolutely right that every case is completely individualized and offers little help in determining our own case, but I (being a person who works with numbers) feel that the numbers of those who are in similar (obviously not the same, but at least similar) cases can give us at least an example of what may happen if we were to be in a similar case. I do realize that it could be completely different for another couple. But simply thinking logically and examining the numbers of those who have succeeded in having a non USC visit during K1 pending would help me determine if it is worth the risk of a lost plane ticket or not.

In my opinion, if 95% of non US citizens successfully visit their USC during the application process of the K1 and it causes no delay in the process, then that tells me it may be worth the risk. If that number is more like 25% who are successful (no matter their specific case) that tells me that it just might not be worth the risk.

I could be completely wrong thinking in numbers, but you have to go by something when you are thinking of taking this same risk of either having your non USC visit successfully or wasting even more money on a ticket when they will still be turned away at the border.


I think you are absolutely on target in thinking about the probability of successful entry. And it appears this is what we are dealing with. Some may be comfortable in taking the chance if the probability of success were 25%. Others would not chance the expense and hassle if it were 75%. Unfortunately, I don't think we can gather the statistics to accurately gauge the odds. We only know that visitor may or may not be turned away. There are no hard and fast rules.

In my case, I can visit my fiancé in her country without being at the mercy of some immigration officer who drank too many smoothies last night. :crying: I prefer to visit her for the next few months while we wait our turn.

Another excellent discussion! My fiancé has a tourist visa and has visited several times before applying for our fiancé visa. But our lawyer advised us that if she tries to enter the country again, she could be denied entry. When I pressed for odds, he said in his opinion and experience that she probably had a 50/50 chance of being denied entry. :angry:

With her fear of US immigration and the expense of having a return flight ready for her, we decided against her visiting the US until the K-1 is approved. Could the attorney be wrong? Sure. But he specializes in fiancé visas and has many years experience. We simply decided it wasn't worth the expense and hassle. :wacko:

We are a little confused about what to expect with the processing times, because the USCIS web site says they are processing forms received in sept 2006, but that doesn't really match the timelines other users are posting on the web site :huh:

Marry now. File for AOS and advanced parole. You'll probably only end up "stuck" in the US for a month or two longer than you're able to stay right now.

I'm totally biased because I'm losing my mind due to the duration of my separation from my fiance - but if you have the ability to marry now and adjust status, for crissake, take it.


I regret not doing this. She was travelling here to see me regularly. I could have married her on OUR schedule instead of some unkown date in the future. If only I knew then what I know now...

However, this is a huge decision and a misstep could be disastrous. Please read all you can. I may get flamed here but I recommend getting good legal advice from a professional that specializes in visas.

Lesson #2 should be, even if you think you have a simple case go to a lawyer anyway for a consultation to review the facts of your case and verify whether or not it really is simple. Has it made the process go faster? I've not seen a case yet where a lawyer has sped up this process in any way at all. I do agree that sometimes a lawyer is necessary, for the most part they aren't. Some have successful stories with their lawyers...many do not. It doesn't, however, speed up the process no matter how darn good the lawyer is.
