K-1 Fiance(e) Visa Process & Proceduresfaxed I-129F Expedite Request this morning
I’m currently in the US Air Force based in Germany. I’m due to return to the U.S. in Oct 07. My fiancé and I currently live together at my residence in Germany.

I originally applied for an I-129F in Mar 07. The California service center denied my application saying that because my current location was overseas, I must submit my application to the nearest American Embassy. I then contacted the US Embassy in Frankfurt Germany and was informed they do not process I-129F Visa’s.

After numerous phone calls and emails to the US Embassy, US State Dept. and USCIS, (which weren’t very helpful) I was advised to re-file my application and use a stateside address on the petition. I did so in Jun 07. A few weeks later, I finally received notice that my application was received and being processed.

Clearly the I-129F application refers to U.S. Service members living overseas (I-129F part C question 1). For this reason, I feel that my first application should not have been denied. Had my first application been approved (submitted Mar 07), the process would have most likely been completed before I was due to return to the U.S. in Oct 07

(though i would hope people would research ACTUAL statistics instead of recycling tired, unproven conventional wisdom like the "drain" of illegals with no though to the contribution made to the labor market. better yet, everyone go have a big salad for lunch or dinner today and ponder whose hands pulled the veg out of the ground to get it to you.)

Maybe a less fortunate American would pull those veggies out of the ground given the right price?? Instead hes sitting in the unemployement line because he/she has no education and cant afford to work for pennies on the dollar. Its funny how the price of everything is going up but wages are not keeping pace. Nice contribution to the labor market.

Bush talks to all the Immigration Head Officers and is responsible for the breakups of couples due to delays from bad paperwork and just the fact that certain countries just have more people trying to immigrate than others... this kinda reminds me of everyone saying Bush put a bomb in the ocean during Hurricane Katrina to make it go towards New Orleans.. hmm... and Bush responsible for Global Warming... all his cows I guess? and Bush responsible for oil prices going high (Let's not say its the greedy oil companies in the middle east understanding supply and demand in America).

One question I think you ppl should ask to yourselves when you come up with such dumb comments about immigration and why the US has an immigration policy and a procedure to follow... How do you think it would be if we allowed EVERYONE in the world come who felt like it, without a screening process nor an application. No checks, no concern if someone will become a public charge to the country. No nothing. Just total anarchy.. there would be no control over society.

Let's stay on topic and not bring silly comments into such a great helpfullll board like VJ.

Procedure??? Last time I checked we had 20 million losers from Mexico here eating up our social programs and taking jobs from America's less fortunate. You know your country is being overrun when you have to press 1 to get english. Nice procedure?? My girl is educated, knows english and she has go through a bunch of BS to come here yet 20 million losers with no education , most cant speak english just come over the border??? Some procedure??? Round this cancer up and send them back and build a fence with a mine field. Let the people who can add value to the country and show respect come in without the BS. Why do I need to show respect for criminals? Read the law, thats what they are when they come illegally. Its not my problem they cant "afford it". Mexico is not our problem and they should not make it our problem. Their government has a long history of stupidity and by coming here does not fix their problem. Sorry, but I'm not a PC person. I call it like I see it and so do many other people. This isnt a case of "brain drain". This is a case of getting Mexico's population that can't get their sh*t together. Sorry , but no thanks , I prefer to cut my own grass and pay more for a watermelon then pay for their medical costs over the long term because they have no insurance. Weigh the benefits and costs!! Save a few bucks on vegatables and fruit or pay more in taxes to suppliment the social programs they swallow up?? Do the math!! DONT COME HERE UNLESS YOU CREATE VALUE OR AT THE VERY LEAST PAY FOR YOURSELF!!! YOUR NOT OUR PROBLEM!

Nobody said we didnt have an illegal immigration problem... and I'm all up for strict policies on immigration.. especially stopping all the illegal mexicans and terrorist slipping through the Mexican border. But from what this thread was talking about, the solution seemed to be that the policy needs to be less strict. Americans need to put their panties on, and try to not be so politically correct always, and especially stop trying to find solutions that will make everyone happy.

Call the USCIS and do the RFE trick. Press the prompt for RFE(recieved something in mail). Enter you receipt number. This will direct you to your service center regarding your RFE(even if you did not get one).Then you can play stupid or just plain ask if you have been approved. I was touched and the USCIS site said still pending so I called and asked about a RFE I never got and a very nice lady told me I had no RFE and was approved. This way at least you know something. My packet was sent on 8/10 so I am glad this this phase is finally complete. What will happen next? Will I be contacted when they receive it, or will I not be contacted until they need more info or approve the petition? I guess I am a little nervous because I sent it from VT, but I used a FL return address-hope this does not confuse anything...

Many members use the online case status site https://egov.immigra.../jsps/index.jsp

The account set-up page contains a place to enter an email address to have actions emailed to the petitioner. This way, we don't need to wait for snail mail to learn of changes. :)

All of the email sites I know allow multiple email addresses on one line in the TO: field, as hunk01@mymail.com, sweetie@ukr.net to send to multiple recipients. It is not necessary to enter additional email addresses in the CC: field.

Has anyone tried to use two email addresses on one line in the email field on the case status site? I put two email addresses on one line in the address field, and the update accepted them.

Will this work?

Try it out. See if it works :) If you get your first e-mail at both e-mail addresses you will know it worked. If it doesn't work you have not lost anything in trying.

We were worried about she probably can´t sponsor me, but at least we do have a "good" co-sponsor (we think so :P ) , so if this is not directly a problem, surely it will be fine .

Hi everyone, I´m from Spain and my girlfriend from Puerto Rico. I´ve discovered this awesome forum few days ago, and you´ve solved us a lot of doubts we had....but we still have million more :whistle:

We´ve recieve the NOA1 in June 1st., and since then nothing yet :angry: . But even without the NOA2 in my hands, I´m very very worried about the affidavit of support.... the reason are these:

1.She is not working now because she is on holidays with me here in Spain (she´ll return the next moth).

2.Before she came here she was studing....so there weren´t any incomes (she worked before, the last year, but not in this).

3.Our intentions are (when getting the K1 approved), to go to Florida to live, not to PR.

So...what do you think? :) ... really difficult right??. As you see we can only have one co-sponsor, she can´t be the first one because she hasn´t incomes....we´ve thought that maybe if she gets a job the next month there, maybe it could work??, I mean, would it be enough to be my first sponsor and also attach another co-sponsor in addition to her??. But is still one problem....i won´t go to PR, both of us will move to Florida, so there, none of us will have a work at the moment of moving.... :blink:

Any idea of what can we do??? :help: :help:

I think you don´t have to worry so much about it, we ´re almost in the same situation, I´ve asked to lawyers here too and they told me that it is even worse to apply for a re-stay for another 3 months (in Spain US citizen only can stay for 3 months and apply for another 3), because you´ve to prove that she will be supported by you, she won´t overstay that 3 moths more, and more such things. AND if they consider that some of that could happen automatically they stamp in your passport an exit order...

In the other point, the US government is not concerned about this (for me this is the most important point), and you should think about when you get your K1 Visa, and you get married, her status will change because she´ll became your wife, so her entry in UK can´t be denied anymore (she won´t be an inmigrant under visa waiver). :thumbs:

I would advise against it for now. I talked about this with my lawuer and she said that i would have to start again their is no way to change it. Im not sure if she was just trying to get more money from me but she said she would have to do it again and for me not to let my love move it would slow everything down alot. I hope this helps

You don't have to worry about it.
However, while you're waiting for your NOA2 you can fill out the forms and keep them (as if they were copies). You can also print out any e-mails you may have sent and make copies of the originals to keep and/or send a copy to your fiance.

If you look at my signature you'll see that we also sent our application to Texas - then it was transferred to California. It took 12 days from when I mailed out our I-129F until we received our NOA1.
As far as USCIS is concerned our journey began on 9/18 because that is the date our check was cashed and they have as our receipt date. Our case was approved on 3/13 - so it took 6 months.

I believe that if the case is straightforward and you don't receive an RFE - the process can be anywhere between 6-9 months. It will depend on your consulate though, and if you and your fiance are prepared to send the forms out to the consulate as soon as they get them.

I sent copies of a few of the used calling cards (some with pretty pictures of Mexico on them), a phone bill, proof that I have bought (AMEX statements) calling cards on-line, and of our www.dial55.com account (which has both of our names as the ID/PIN).

I'd say it's worth it to send a bit of everything - that's what we did.

Congratulations!

Once your case is approved it is forwarded to the NVC which then takes about 2 weeks to forward it to the consulate. Once your case arrives at the consulate they will notify your fiance.

If you wish, you can contact the NVC to find out when your case is received/sent out and then contact the consulate to know when your case arrives there. The NVC will assign you a case number as well.

You don't need anything notarized at this point.
Kitkat is right - tell the truth. USCIS is not asking if your job was legal or not anyway.

Check the directions again - I don't remember, but I think they only ask for where you've lived for at least 6 months, right? Otherwise, include it all. I have lived in many different houses (during college/studying/working abroad) so I wrote SEE ATTACHED SHEET and put it all down on another sheet.
My fiance has had many jobs too - no problem for us.

Where in Peru did you work?

The non-USC not knowing English is nothing to be worried about. My fiance does not speak English and that has never been a problem. Why should he need to? I speak fluent Portuguese. What is important is that we can communicate. I spoke both English and Portuguese at his interview.
Now that he is here he is studying A LOT and has learned a great deal in 5 weeks. But before his arrival here - there wasn't too much need.

Our process also took 6 months and we never received an RFE or any other set back.
I've seen couples who HAVE hired lawyers and they've messed up - another reason why I'd say DON'T hire a lawyer. IMHO.

I'd send individual pictures with your application instead of putting a few on a page. That is what we did. We sent 6 pictures and they were sent in a ziploc bag and labeled. On the back of each picture we wrote our names, dates, and the location.
