My fiance is just under 5 years younger than me. Because I'm the USC and a WOMAN, I have accumulated 65 pages (so far) of SMS log, 10+ pages of skype log (painful process using screen shots and photoshop to make it readable) and multiple emails with lots of 'detail'. 5 years nothing to worry about. You are good. Its those, like me with a 20 year gap, that has something to worry about...lol. If i were a man, they would have no problem...Go figure :angry:

We didn't have any age related issues with the consulte in our case either (HCMC - VN)

They really dont have issues with men being older then the women. Its the women being older then the men. I think that is wrong and discriminatory. They shouldnt base it on age but love. Because of the country (sorry), but the COs (Consular Officers) will be looking for Visa fraud. This is nothing intentional on your part. But because of the relatively large age difference and the USC woman being older than the alien fiance (man) they will look very closely.

I cannot say they will deny you. I can suggest you prepare. They will not deny you for age difference, they will deny him (the beneficiary) for what they will think is Visa fraud. Using a potential marriage to enter the USA.

This is not what I think at all. This might be what the COs at the Embassy are thinking.

Immigration practices discrimination in rejecting older woman who have younger spouses while letting old men bring in females that are years younger than their own children. You should be fine.


This is one of our concerns too. I am older then my fiancee and he and his family spoke about it..I also spoke with my famliy about it. We are fine with it and age should have nothing to do with love.I am 20 years old then him. Will they really frown on our age difference? Can they really deny a petition because of age? What should we do if they do? Can i call my senator aboutit? Can i sue them for age discrimination? We are jsut so concern for this. How bad does Ghana frown on age differences? Need advice for this situation...

I am currently employed but have requested a Leave of Absence from my employer until January as I plan to stay with my fiancee in Macedonia while we wait for his K-1 VISA to be approved. We received our NOA1 over a month ago and I do not foresee any problems with getting this approved before January. The problem is my employer has not approved my Leave of Absence yet. I originally had decided that, if they do not approve it, I will resign, spend the six months with my fiancee in Macedonia and find other employment before returning to the U.S. I make a six figure income (already reached this year) and have for the last three years. I have plenty of money in my savings account for living expenses for well over a year even if I am not "actively working". My concern is that without being actively employed, his VISA will be denied.

Should I contact the US Embassy in Skopje directly to see if they will answer this question for me? Should I maybe arrange for a co-sponsor? Or should I just reconsider resigning if not granted the Leave of Absence from my employer? Should we consider applying for a tourist VISA for him so we could be together in the U.S. while we wait for the K-1 approval? Yes, we are obviously impatient! :)

**The wait time for the VISA's are understandable but also extremely heartbreaking when you have to be apart this long. It has already been three months and I cannot imagine having to wait another 5-7 months while I am working in the US and he has to remain in Macedonia. ANY ADVICE WILL BE APPREICATED

I am actually about to go through the same thing. I am in Afghanistan (where I met my fiancee) and when I return home, I will not need to work for quite some time. My fiancee and I have already filed our I-129 and I was worried too about "not being activity employed" when I am back in the U.S. Any yes, it could affect him. You just never know about the interviewer at the time. As I understand, you can base your support on your assets OR you can have a co-sponsor. This is what I am going to do just because I don't want to take any chances. I will file the Affidavit of Support and so will my co-sponsor...so there will be two. It surely can't hurt. :) Tell him good luck...and be prepared to wait it out. This is very slow and painful process.

It is not necessary to hire an attorney, but I must warn you....there are a lot of forms and documents to gather. The process is very long, even if everything goes perfectly and nothing is forgotten. You will wait approximately 6-8 months. I hired an attorney because I was afraid I would miss something and hold the process up longer than needed. Not to mention I am currently in Afghanistan working while we wait this process out. My attorney is in the US but has an office in Italy and he worked with us through Skype interviews...and he did not require all the money up front and allowed us to make payments. Not all attorneys will do this so be careful. Good luck to you!

I do not know why people are calling me a troll or saying I am making a big joke. I came here for help. I have other post. I have better things to do then go on forums and troll. I just wanted to see if anyone who was in my situation had some sort of help to me. Or someone has the best possible next step to take. I am sure no one was intentionally trying to be rude. I think maybe they have just never heard of this happening before. This is a quote directly from the U.S State Department Website:

You should be aware that a visa does not guarantee entry into the United States. So yes...it is possible and apparently DOES happen. This is actually not the first time I have heard of this. Of course the good question is WHY and how do you fix it. I agree that you should contact an attorney that has had experience with this and knows the laws. Some will charge for consulation and some will not. At this point, you just need advice as to your next step.

I AM wondering if it wasn't the language barrier. I have found that some countries don't know the word "fiancee". My fiancee refers to me as his wife all the time when we are in Macedonia. ( I will need to relay your story before he gets to POE though!) I had to explain to him what fiancee was. And when I was going through passport control at Skopje...I told them I was visiting my fiancee. There officers there had no idea what I was tailing about. "Future Husband" is what got me in.

What is point of going through this ridiculously long process, detailed documents and intimidating interview for ONE guy at the airport to decide in 10 minutes you are lying. It is almost as of the VISA is useless. Something in this system definitely broken.

I will admit that I, too, am in the beginning stages of this process, but from everything that I have read in these forums, you should wait to do anything until your fiancee has received her letter from the Embassy. This packet should contain all the instructions regarding what additional forms are necessary and where to go for her medical. This is the time when she will also set her date for an interview. As I understand it, that time will be 4-6 weeks AFTER the Embassy receives everything from USCIS and she receives her letter with instructions.

Also, I hope this isn't being too negative, but the Timeline you see here on VJ is based ONLY on the people that are on this website..NOT the actual processing time for your service center. You can check their actual processing times on the USICS website...and keep in mind, these change also. It would be such a shame to see you set a wedding date, get invitations prepared and then your VISA takes longer than expected. Although I keep my fingers crossed for you and wish you the best of luck and hope nothing goes wrong...so many things can happen between now the issuing of your VISA.

I'm sorry, answersing to the topic... I feel your pain too, and I think that if a processing time takes 5 months there is something wrong with the process itself. They don´t have enough people working in visa cases if they have to take 5 months or more to check someone's background, and personally I feel that making two people wait so longs in some cases much more is inhuman, no one should wait this much to live their life like they want specially if it is in a good way like getting marry.

I hired an attorney to handle our VISA procedures as I a was afraid I would miss something. I have been very pleased with him so far. It actually isn't a that hard a process but there is a lot involved. Missing one thing could delay you by weeks if not months. I didn't want to take that chance. After I got all the information he requested, he sent it ALL within a couple of days. It costs a little more, but the peace of mind was worth it for us.

I will tell the reason I chose him over other attorneys. First, I am in Afghanistan right now working with the military. My attorney allows me and/or my fiancee (who is in Macedonia) to Skype with him for any meetings or questions that may come up. That is SO convenient for all of us. Second, and most importantly, he did not make me pay the entire fee up front. He allows me to pay by the month. He said "I feel it is less stress on my clients financially. Not to mention that if you stop paying, I stop working. And if I stop working...YOU stop paying. It is only fair".

I hired him right away! :)

I got to be in a very unpleasant situation, and right now Im looking for the best thing to do. Hope you can give me some advice so I wont act stupid. :) Here is my story.

I got k1 visa and arrived on april 10th to NY. All this time I have been living with my fiance. he is a very busy person running various businesses during summer time. So all this time I have been here we didnt do anything together, no dinner outside, no movies, no beach walking, nothing, except talking, and sleeping, and I help him with some papers. Its difficult to live out like that but we both came to this with understanding. We love each other and he doesnt want me too leave. But! But the time by what we should get married is till 10th of July and today is the 2nd. He said that he loves me and dont want me to leave but this is insane to get married even didnt spend time together, like how weknow that we are the right for each other if we dont do anything together. and all we know is that we love each other. We waited two years to get k1, had patience, love and now he came with this..its insane to get married without spending time together. Very rational thought but my time is almost over. He says its not right to leave now after what we survived, and its not right to get married yet. he wants me to stay till september, and then he will get less busy, so we can spend time together, for the whole month and then understand if we are right for each other. im writing all of this because I am really lost now. I love him, and he loves me, and both of us dont want me to leave but time is almost out, and we are not ready yet....My question is the following...if we dont get married within 90 days but get married later, what problems I may have with USCIS? My I94 is till 7th of august, and if I overstay for 2 or 3 months and then get married to petitioner, will I have problem? and in the situation if I overstay 2 or 3 months and we decide that we are not right for each other and wont get married, what problems I may have in future?

Please, help me to get things worked out right. I don't know what to do...

Hi all,

As our embassy appointment approaches I'm wondering how much evidence of an ongoing relationship we need? USCIS clearly believed our relationship was genuine, so I'm assuming now we just need proof that we have continued together in the meantime?

I live in my fiancé's country with him. Here's what we have for evidence:

  • Letters of intention to marry from both of us
  • My residency visa showing that I live in his country
  • Passport stamps and boarding passes showing that I visited the States for a week in February but then came back and have been here since
  • Our rental contract with both names (sent with original I-129F petition)
  • Rent payment receipts from past few months
  • Text messages (one per month)
  • Photos of us together (one per month)

Does that look like enough? I could get affidavits from family/friends if that'd help...

Hi,I will have an intrview within 6 days and I'm gonna bring every single picture that we are together on,Trip tickets,airplane tickets,bills from our honeymoon that shows that we were together all the time.I think you got my point,bring everything that you have ,it's better to have more then less and I think they're gonna appreciate it.Hope that helps.Good luck to you ! :thumbs:

Congratulations!!! The K-1 Visa will take anywhere from 6 - 10 months to process completely, provided you don't run into any issues. You can start any time you are ready. The sooner, the better. Gather your forms, gather your supporting documents and get to work! Don't forget to include flight tickets, train tickets...primary evidence. If you want it free, just ask and people will tell you. This is a great website !

You are going to end up doing the work anyway if you hire an attorney !!! All they are is a project manager. They will tell you what to give them. You will have to gather all the documents and fill out all the forms but they will review everything (if you are lucky).

There are forms right here on this forum to compare to. It does seem overwhelming but just fill out the G-325 forms, the I-129f, gather all your pictures, 5 emails, proof of meeting her (boarding passes etc..) and send it in. Remember, the paper work is only three pages I think. That's it !!! 99% of the documents is proof. You have to gather.

By the inch it is a cinch.

It was a lot of work. Hire a law student at $ 15 an hour. This process is too simple. I work a lot too and I understand you need help. I just got my NOA2. This process is about twice as hard as getting a mortgage but an attorney is not going to help you much. If you do go the attorney route, ask them each specifically what you get for your money. If they say file it, does that mean they are going to ask you to fill out the paper work, are they going to tell you what to do ? Go with the cheap attorney and if they screw you.. report them to the bar. This process is not that difficult. It is just time consuming.

I just got my NOA2 !!!! and I will soon have her here. I did it all myself by reading this forum.

If you like videos.. watch this. Last time I watched it, I thought it was a
good intro but I watched it five months ago.

Get the certified paper work from the court ahead of time just to be safe. If the disposition shows closed/dropped/abandoned the USCIS will know what that means and you will not be given an RFE on it (from my experience). Check "No". Do not send anything in on it being proactive. Since there was no conviction or court case, I do not think they can mention this to your fiancee but I wouldn't count on that. Your fiancee absolutely has to know about this in case they ask. I am explaining my situation in detail to my fiancee and how I was railroaded courtesy of my ex.

My I-129f/NOA2 was approved in exactly 4 months. No RFE. You are good to go.

We are about ready to go to the Interview. I would order the IRS Transcripts for your previous years, it only takes a week to get them and it is free. I would also bring a copy of your 1040. That is what it ask for on the Manila web site so I am researching this issue now. I will also give them my W-2's from previous years and a letter of employment. Since it is so early in the year, I strongly suggest you providing them a 2011 1040 and you should also give them a bunch of recent pay stubs. I am going to submit 10.

It's over kill but you want to pass the support test easily because this hangs a lot of people.

The web site is unreliable. Ours never showed up. Just wait 130 days or so for your NOA2 like ours did. Our EAC number never worked in the web site but we are scheduling our interview this week.

My NOA2 was approved on December 28th and I think the NVC got my documents probably around January 8th but they said it was still in processing. Good luck.
