I wrote SEE ATTACHED SHEET on the G-325 because I moved a lot in college - no problem.

You do have another option...... you have a legal wedding once you arrive within the 90 days and you then plan a big family wedding for a later date.... this is a much safer option and you then have time to enjoy all the planning without the worry of visa's.....

Thank you for advice. but the problem we want proper wedding.... We think is not fair... if we are citizens of different countries we shouldn't have proper wedding... I don't want to say YES without our families... So we are taking this risk... :unsure:

Wedding date is the main issue we have... We set the date as 1 December 2007. it is already 50 days as we got NOA-1. So hopefully we will have everything on time. We plan that I have visa in hand by October, when we send our petition in March. Unfortunatelly we can't wait till the last moment as our relatives and friends need to set the date of their vacation. People will arrive from the different places as UK, Kenya, Kazakhstan, Russia, Canada, India etc... My Fiance booked church, reception hall, etc... We can't tell our quests in 1 months advance "You are welcome to our wedding"!, as all of them are very busy people, as well as my parents. So it is big risk, but we don't have another option :unsure:

if you filed, you are ok for the 129. but need to pay new AOS fees which now is a package fee

Send only copies :) My Fiance sent only copy of BC, and we even didn't include copy of his passport... I remember many people told us to make copies of each page of his passport as well as BC... but we sent only BC and recieved NOA-2 with no problem! Good luck!

Don't worry... If everything is OK I think you will get NOA-2 by the end of October. We are late March filers and we have visa 2 weeks alerady!!! so for us it took 140 days!

Hi
I was preparing with my fiancé the K1-Visa application and we faced a major problem. :wacko:

On this page it says that the vermont service center will take incharge the I-129F application by july 2007

but on this page, and after following the I-129F form on the USCIS section "where do i file?" it says that application should be send to Texas Service Center and the only remark about the Vermont Service Center was that they accept the I-129 Form only.

As it states, If you are sending after July 30th, you'll have to send it to VSC(assuming you live in a state that falls under their jurisdiction)

Looks like VSC processes K-1 much quicker than CSC and If you can wait until July 30th, I would send it to them although the fees will be going up substantially..so TSC is a better option(fees-wise)

I see folks travelling internationally to meet their beloved(fiance/fiancee) ones.

I thought it would be a good idea to share this information.

You can register with the State Dept [ https://travelregist...s/ui/index.aspx ] and this information can be looked up by the local consulate and can serve as proof that you travelled to the intended country but this may not be used as proof that have met your beloved one..

Any thoughts?

90 days is really the longest this should take. when you hear about some types of petitions that take years, well you must wonder who is in charge of this cluster? The instructions are hard to read, they are ambiguous at best and in some cases it requires a lawyer. This seems to be equal protection for the people who can afford it. I wonder how many waivers would have been approved if the applicant had the 5K Laurel Scott fee, instead of having the sponsor do the best they could.

I don't know, its not perfect, but it is ours, the system. But, it can be improved!

Bureaucrats unite, Rise up! Excellence is JOB 1....(I'm losing the crowd aren't I? ....ahh well enough, I think I have hijacked this thread and I didn't mean to!

I need my fiance too, I really do. Why can't they expedite all of us? Work with a sense of urgency. My fiance and I have a business together, for over 2 years now. I really need him cause I need a dang day off.
Besides, there is a box, on a really really high shelf i can't reach. And a light bulb that needs changing. I also need a back rub.

You know I am only kidding, but I do think they should work a bit quicker, and probably it is not even that. It is probably that they are under staffed, and they work very hard and long.

iv been coming in and out of US since xmas .I dont think its illegal,as im not overstaying and not on welfare.

thing is,im thinking of going to Canada on Business for the day! and come back same night for another 3 months stamp.
What do you guys think.?.........I also have a going home ticket to the UK within 3 months.

I have a friend who has a GF in another country. He wants to meet her in person so he can file a K-1. He can't get a passport because he owes back child support, and she can't get a US VISA to come here to visit. We're looking for ways for them to meet but there appears to be none.

First you are asking for ideas, and the obvious is to pay the child support.
Why cant she get a visa?

Truly this is opportunity cost. When you choose one opportunity, you lose another.
We prepare ourselves in life to take advantage of opportunities, money in the bank so when the "car" goes on sale, and such.
This person wasn't prepared to meet an expensive girlfriend, or to have a passport. That is a pity. However, he should begin to see why being prepared to take advantages of opportunities in life is important.
No one has pity for someone who isnt working towards paying the child support, back support sounds a bit like, Billy, you are going to get dinner from 2006 that was missed for all those months.....
I got 80 bucks in child support in 18 years, no pity, no apologies from me.

Get married way before the Visa expires so it does not cause a problem. Have a judge do it. THen have the real wedding when you want. But do yourselves a favor and don't bunch all of this stuff up together.

It's like some friends of mine got married on New Years..well thats fine....we go to the weddding, but every year an anniversary party on New Years? I dont thUnk so...its my news years too.

Yes as the others said you have to be free to marry before filing the (K1 Visa) or else you will get rejected.
No he cant come and stay with you and just marry and stay for good,you guys might want to file K1 Visa.
Read the guides here on VJ and you guys can look into K1 K3 etc.

Fees are being increased starting July 30th. The total cost will probably be in the $3000 range by the time your fiancee applies for citizenship. But you dont have to pay all the fees at once. And citzienship is optional.

The info on the G-325A is not very critical, especially for the US Citizen G-325A I would not worry much about it, that is a simple typo.

Make sure that the forms for the visa interview (DS-230, DS-156, DS156K ect) are carefully filled out, and checked a few times though.

Oh My GOd, I can not believe I did this. I am getting things together to send to the SO for his internview if the gods at UCIS ever grant us one. I am looking over the G-325A and I can not believe I put in a wrong date, several times. I missed the length on my job by 10 years, I wrote 87 instead of 97...and the job..well it began like a year or so after...and i put the same for living in this house but i have only owned it for 4 yiears......

what should I do?????/

You should be seeing some action in a couple of weeks. Don't be surprised if you don't receive any notice and it's been sent to NVC and forwarded to the consulate. I don't know what the hell is going on at CSC. But I know my case is on it's way to Ukraine. I still don't have my NOA2. The website has not been updated or anything. It's crazy man! :rolleyes:



Mine says the same thing, no change, and when I call uscis they say, it wont be done for many months. I did call the NVC once and got "we have no record of that WAC number" but I will all again this week.

Self employed people are required to submit the three most recent tax returns. Employed people are not required to submit more than 1 but 3 is a good idea if it will help your case.

USCIS requirements for Affidavit of Support do not come into play until after the visa is issued and AOS is applied for. For now, the sponsor is only satisfying the public charge concern for the Consulate. Those requirements tend to vary by country.



I have been reading this and tried to look to see what Germany required, but I noticed on the Affidavit it says 3 years for a self employed person. It is a bit confussing, they seem to change things just slightly, 100% at consulate, and then 125% of poverty line at AOS. One year of tax returns, three years....

First, I think people missed the fact that you are a student, and working. To me that screams of no time and no money to do this. Second, if you did somehow get the visa, how would you sponsor him? Or could you. I wonder also, beyond the child issue, which yes, is serious, but are you going to have a baby, need to go to school, and work....beyond that issue..why arent you waiting until you are more set, finished with school and able to support your SO while he acclimates to the USA?, gets a green card, and is ready to work. Marriage is always hard, but harder when you are both young (and you look young so if you arent...god is smiling on you LOL)....but when you are young and broke....thats really tough...After college you will have it so much easier. Just a thought.

Well, it is coming up to 30 days now since NOA1.

I hope I pre-empted an RFE by submitting the correctly signed G325A for me with a covering letter marked with my receipt number and contact details.

HOWEVER - We have the wedding all arranged for the 28th July 2007 (booked it, packed it etc), and I really dont think now that it will all come through in time - it seems to me generally to take 90 days to the day for interviews etc which would put us inside of August.

SO - does anybody know if there is an effective way of contacting the consulate. Is it worth telling them this - I have evidence of all of the arrangements? Is there a chance of pulling forward the interview assuming all other things run smoothly?

Otherwise, would I have to leave the USA after the wedding and sit through another 6 months of isolation awaiting a spouses Visa?

YES...this is the part no one spoke to, if you get married, it is no longer a K-1. Then you are changing horses mid stream. Good Luck with the project, just dont come and get married and act like it didnt happen. A few bucks lost on deposits is not a big enough loss to jeportize this.

If your fiance/fiancee came to the US on a tourist visa with the intent of immigration and marriage, and you are not yet married, then he/she should return to his/her home abroad, and the K-1 visa should be filed (using an I-129f) instead of the I-130 to avoid a denial, deportation, or even being banned from re-entry to the US.

I wouldn't do it...

sounds like a good reason for an expedite to me! USCIS messed up and put out bad gouge, so they should make it right.

I’m currently in the US Air Force based in Germany. I’m due to return to the U.S. in Oct 07. My fiancé and I currently live together at my residence in Germany.

I originally applied for an I-129F in Mar 07. The California service center denied my application saying that because my current location was overseas, I must submit my application to the nearest American Embassy. I then contacted the US Embassy in Frankfurt Germany and was informed they do not process I-129F Visa’s.

After numerous phone calls and emails to the US Embassy, US State Dept. and USCIS, (which weren’t very helpful) I was advised to re-file my application and use a stateside address on the petition. I did so in Jun 07. A few weeks later, I finally received notice that my application was received and being processed.

Clearly the I-129F application refers to U.S. Service members living overseas (I-129F part C question 1). For this reason, I feel that my first application should not have been denied. Had my first application been approved (submitted Mar 07), the process would have most likely been completed before I was due to return to the U.S. in Oct 07
