I'm the USC. I've been living and working abroad(file taxes as an expat) for many years. We're abroad now, but I'm currently not working(by choice, new well paying job in the US shouldnt be a problem). If I want to start a K-1 visa process at which points in the process do I have to physically be in the US? Ideally I would stay abroad with my fiancee in her country or better yet travelling around. Only head back to the US at the very end. Does anyone have experience with this? I see from one line on the 129f process that you can mail your forms from abroad, but no further detials on where we are allowed/should be in the meantime..



No, you don't have to be in the U.S. at the time of filing.
Many people are in situations similar to yours.

I would just state that she was unemployed for the years that she was in college. The college part can be added as well, but not necessary.



I agree. In college is not a job.
Many people go through the same thing as you. I worked while I was in college (as long as I was in the U.S.). When I studied abroad I wrote UNEMPLOYED for those months - because I was.
Your employment record needs to be as accurate as possible but it's not a big deal if you were unemployed while you were in college. That's normal.
They ask for your education - so they'll see that.

My fiancee and I are back on track and hope to finish our fiancee visa proicess and get married.

One concern I have is the length of time it will take to get back her police reports from other countries. My fiancee is in an odd siuation...she was born and raised in Kyrgyzstsan but married a Russian man earlier in her life and moved to Magadan in Russia where she lived for 13 years. When she married she became a Russian citizen complete with a Russian passport, After a few years she divorced him. Seven years ago she moved back to Kyrgyzstsan and got a job and bought a flat...yet she chose to retain her Russian passport. So..she lives as a citizen of Kyrgyzstsan but is technically a Russian citizen.

This situation has caused us many problems! Initially, I tried to go the K-3 route and marry her in Kyrgyzstsan but she was not allowed to marry there because of her Russian paasport...whcih ws a lot of silly nonsense generated by a lot of anti-Russian sentiment in Kyrgyzstsan. If I tried to marry her in Moscow it could cost a fortune and take a long time as Russia requiires a 30-day waiting period to marry...and it costs a small fortune to live in Moscow.

So...we now are going the K-1 route but there is still issues about the Kyrgyzstsan versus Russia issue. I am afraid that getting her police background checks will be dffiicult due to her odd citizenshup status.

How long should i wait before taking some action with the US Embassy? It has already been over 45 days or more since she sent off the police check forms and no replies. I am afraid this process could take months or require resending forms.

Has anyone encounterd a similar situation? What can i do to expedite this process?

I dont think anything should prevent you from getting the police certificates that you need. But how long it will take will vary by country. In some you can get it done in a day or two, while others have you waiting for months.



Can she contact the Russian embassy in her home country?

There are countries where fraud is almost non-existent, and one can easily obtain a visa. There are countries that have a high incidence of fraud, and the Consuates will be very careful in issuing visas after alot of background checks and proofs. And there is Nigeria........

I was filing the form I-129F with my fiancé and we have some trouble with question 18 which says:
"Describe the circumstances under which you met. If you have not personally met each other, explain how the relationship wasestablished. If you met your fiancé(e) or spouse though an international marriage broker, please explain those circumstances inQuestion 19 below. Explain also in detail any reasons you may have for requesting that the requirement that you and yourfiancé(e) must have met should not apply to you."
My fiancé (the petitioner) answered on the I129F Form like this:
"On December 26, 2006 I got to see and meet Mehdi personally. We had been chatting since March 8, 2000 and exchanging e-mails since February 14, 2000. I had already known him for six years and meeting him personally confirmed everything I already knew."
Is it enough for the I-129F application or should we give more detail about the trip she maked to meet me?

The circumstances need to include dates and places that are supported by the evidence you are including. Brief is fine. Something like this would be better.

"On December 26, 2006 I flew to CITY and met Mehdi personally. We had been chatting since March 8, 2000 and exchanging e-mails since February 14, 2000. I had already known him for six years and meeting him personally confirmed everything I already knew."


Then provide the evidence you flew to that city and that you entered India. Passport stamps, visas and plane ticket stubs are good, as are hotel receipts. You can add pictures as secondary evidence. Don't mention anything in your statement that cannot be verified with the evidence you are submitting.





Sounds good to me - short and sweet.

We used an extra sheet of paper....we'd lived together and then I went back a couple times to visit before applying for the visa. I thought it was better to mention this because I sent proof of my residence in Brazil...as long as my trips back and forth.

The 90 days begin starting on the day your fiance arrives in the U.S. - not from the date the visa was issued.

I believe that she has up to 6 months to come here - from the date the visa was issued. This is separate from the 90 days you have to get married. Meaning, she doesn't have to come immediately after her K1 visa is issued.

I agree! When I sent out the packet I had just returned from Brazil. My hubby had signed the G-325A there and we didn't realize it was expired. So...I had to mail it to him, have him sign it, then mail it back to me.
That way it took another 2 weeks to mail out the package.

No, we are a bonafide couple and won't have a hard time proving it, we've been living toether for the past year.

I think I'm a combination of scared/worried of the whole process and I had heard age could be a factor.

Also, our age difference was hard for me to accept at first because we are socialized to expect the man to be older, not the woman. Luckily I have friends and family who are more reasonable than I (as well as my fiance) who told me that was a silly thing to deter me from exploring this relationship. Now a year later, it seems silly to me too, but in ths process you are opening yourself up to a lot of 3rd party judgement.

We are by the way 30 and 24, so we are on the young end of the spectrum.


At CDJ this is not usually an issue. But you should be prepared with a lot of relationship evidence as well as for the question to come up -- know exactly how you are going to answer an "accusations" they may throw at you.

I didn't use extra labels...but rather had 2 more "cover letters" - one for the proof of meeting, and another for proof of ongoing relationship.
This was apart from the I-129F cover letter.

Of course you need to prove that you've met in the past 2 years...but what else? I moved back to the U.S. and wanted to show that we are still very much in contact with each other - hence the e-mails, letters, pictures, gifts, phone bills....

I suspect he is getting confused about the question on the I 129f about the petitioner's citizenship. The number they are asking for is the one on the naturalization certificate.

If he derived his citizenship from his birth in the US, then he obviously would not have a certificate number.

A passport is a completely separate document from a naturalization certificate, so what good would that number do?



Exactly. That citizenship number only refers to naturalized citizens.

I agree that quite often the K1 is easier to get. I know that my (now) husband would never have been successful at getting a tourist visa.

Well, not necessarily. The K1 visa was quite easy for us.
It is very difficult for Brazilians to be given tourist visas to the U.S. - where the fiance visa was not.

If you have the EAD from JFK you can work - because it's an EAD.
With the green card you can work legally - but since it can take awhile people apply for the EAD which allows you to work while you're waiting for the GC.

It doesn't have to be done by a professional either. A friend can do it, they just need to sign that they are competent in both languages. We sent 5 e-mails (with translations), a hotel receipt, my Brazilian residency card, a card or two, and a letter from our friend talking about our relationship - like a witness.

You need to have translated whatever you send to USCIS. For the interview - the emails/letters/cards can be in either Spanish or English.
I sent romantic emails along with my evidence - it wasn't anything too personal...just a lot of te amos...you know?

It doesn't matter if they have record of you or not - you lived there.

As far as having an SSN - that doesn't affect your process either.

Hi everyone, Can someone tell me if I have to send any original documents with the Affidavit of support to my Fiancee? She is tell me I need originals for her to take to Kiev for her interview. Bank statements,IRS transcripts,W-2, divorce papers etc. I am worried to send these documents with my soc.number on them and bank account numbers. I have heard horror stories about identity theft and it takes years and lots of $$$ to get it all strightened out. My Fiancee told me she has talked to some girls on a Russian forum that have gone through the interview there in Kiev and they told her they need originals there. I suggest you asking this question in the K1 forum. You may have a problem. If I were you, I'd make a copy of my passport and be prepared to send it out in the case that you do receive an RFE. Good luck.

But that wasn't a problem - he had his blood tests and x-ray done where he lives and had a medical done a few days before the interview (in Rio).

I wrote when we met, where, the time we lived together, and then gave the dates of my following visits to Brazil...
no lovey dovey stuff - only facts - dates and location.

We met at XXXX in Brazil and lived together for XXX time. I went back to the U.S. on (date) and then returned on (date) to stay for XX amount of time...

Something like that...
