K-1 Fiance(e) Visa Process & ProceduresI-129F - question 18 - descrie the circumstanaces under which you met.
It's up to you about how much you want to write. If you've only met in person once then you probably don't need to write a lot. I explained where my husband I met and how I lived with him in Brazil, then about the trips I made back there before we applied for the K1 visa.

I'd leave out all of the lovey dovey stuff and just stick to the facts (dates).

Yea Angela!!!
I'm very happy for you too.
I wanted to stop by quickly and say hi. I have a fiance to tend to as well :) - we're going to the movies. I'm so proud of him - he barely knows English but works SO hard.... (L)

K-1 Fiance(e) Visa Process & Proceduresbonafide relationnship (k1)visa
We included both proof of having met in the past 2 years and proof of ongoing relationship.
I think it's important (IMO) to show that you still have a relationship and are committed to each other. We met in 2004 and lived together in Brazil - but when my visa ran out I returned to the U.S. I thought it better to show USCIS that we still talked constantly, wrote e-mails/letters, sent each other presents, etc.

You'll need another passport picture at the time of your medical interview - and another for packet 3 - and at least another for the interview.
Wow, they sure do like us, right?

Oh yea, my husband sent 4 when he applied for his work permit and his green card.

K-1 Fiance(e) Visa Process & ProceduresWhat is a fair price?
I just don't understand why to hire a lawyer if your case is straight forward. It is NOT necessary. The process of obtaining the K1 visa is NOT brain surgery.
In addition to that, so many lawyers make mistakes.

K-1 Fiance(e) Visa Process & ProceduresWhat is a fair price?
I'd suggest paying NOTHING - which is what I did.
My husband is here, we're married, and he's applied for his green card and work permit....already done biometrics (fingerprints).

We had NO problems along the way (thanks to VJ) and our own intelligence :innocent:

K-1 Fiance(e) Visa Process & ProceduresEvidence for I-129F petition
We only sent 6 pictures with our I-129F. We sent a bit of everything: e-mails, letters, proof I worked in Brazil, copies of passport pages, visas, etc.
At the interview we told the CO that we lived together in Brazil - he seemed pleased with that answer. I had returned to Brazil 2 times and then was at the interview (making it my 3rd trip - not counting when I was living there).
IMHO, it's better to have a bit of everything to show you have a relationship.
Pictures don't prove everything but they're good to show you've met in person.

Brazil does require the I-134 (I-864 will be for AOS).

This is the only document that needs to be notarized. You can have that done at your local bank - or by anyone that is a notary. You sometimes find notaries at the bank of other package stores.

A bunch of secretaries where I work are notaries, and one did it for free  .

what i did was highlight the stamps and the dates of the passport stamps
then i printed off my email confirmation of my flights
and hightlighted the dates on those as i also lost my boarding pass

I also highlighted the calls I made to Brazil on my phone bill, important dates on the itinerary and flight coupons...along with important information in the e-mails.

I also recommend paying with a personal check - easier to know what's going on. You can usually see the case number stamped on the bank of your check (via your on-line banking).

Takes about a week or so to get to the NVC, 2-3 days to go through it, and another week to get to the embassy. It will take about 2 weeks or so provided that you dont get stuck in AP or AR.

K-1 Fiance(e) Visa Process & ProceduresIs the K-1 right for me?

after all this discussion about visa fraud and such, i am wondering...couldnt the following situation occur -
an international couple is very much in love and truly committed and wanting to get married...apply for and receive K-1 visa for fiance to enter the states for them to marry (lets say its his first time in the states, so also he will meet the family, get used to it, etc..)..

lets say 2 months into the stay, something dreadful happens, be it he is instantly enchanted by a gorgeous american, or something happens and the engagement is broken off, the couple breaks up, etc...although they entered into the K-1 with the full intention of marrying. i mean, thi ngs happen, its life, its not scripted...

i suppose my point is, how can the USCIS or INS or what have you actually prove fraud? it all seems very subjective. in any case, i guess you dont want to take risks with potentially being thrown out of the country, eh....

This happens to a few couples - I've read about two recently.
These cases were about two Brazilian girls who came into the U.S. with the K1 visa because they were in love with their fiances and had every intention of getting married. However, when they arrived they got into arguments with their fiances and decided against getting married. That is why USCIS gives us 90 days to get married.
Both of these girls returned home - as their only reason for coming was to get married, and since they didn't - they went home.

I can't tell you what to do - only that the K1 visa is a FIANCE(E) visa and for people who want to get married....not to try it out. There are people who apply for other visas to be together in the same country - and who are not sure if they want to get married yet. That may be worth applying for. However, I know that it is not easy to get visas to the U.S. I work in an international school and hear A LOT of visa/immigration stories.
Good luck.

(Just remember that the K1 visa is to get married).

K-1 Fiance(e) Visa Process & ProceduresMarrying after K-1 is received
Once you get married you have to apply for adjustment of status - for your green card (residency).
When you have that you can work legally and travel no problem (as long as you don't stay out of the country tooooo long).

If your green card takes awhile to get approved (could be 2-3 months/could be 2 years) then you can apply for a work permit and/or advanced parole.

But you don't pay 6k at one time. First you pay for the I-129F (do that now before the fees go up), then you pay for plane tickets, doctor, AOS, etc...
Anyway, it's worth every penny.

K-1 Fiance(e) Visa Process & ProceduresDoes the USC have to be/stay in the US during the process?

I'm the USC. I've been living and working abroad(file taxes as an expat) for many years. We're abroad now, but I'm currently not working(by choice, new well paying job in the US shouldnt be a problem). If I want to start a K-1 visa process at which points in the process do I have to physically be in the US? Ideally I would stay abroad with my fiancee in her country or better yet travelling around. Only head back to the US at the very end. Does anyone have experience with this? I see from one line on the 129f process that you can mail your forms from abroad, but no further detials on where we are allowed/should be in the meantime..

No, you don't have to be in the U.S. at the time of filing.
Many people are in situations similar to yours.
