Not for the package you send to USCIS - everything has to be in English or translated into English. My husband didn't know English at the time we mailed off the I-129F but I told him what it said and he signed.
The letter of intent can be in Spanish for the interview since it'll be in Colombia.

When I was in Brazil (before we mailed out the forms) in '06 I had my husband sign everything...only to find mistakes on everything (an expired G-325A, the wrong address on the letter of intent...grrr).
So I mailed my husband a couple G-325As and he sent them back signed - the letter of intent he printed from an e-mail, signed it, and the mailed it back. This put us back a couple of weeks, but luckily for us I found the mistake on the G-325A while I was still getting everything together, so while we were waiting on the mail I was photocopying, printing, and signing my own stuff.

I mailed the G-325As since my husband did not know English at the time and I filled out everything for him.

Your fiancee's friend is mistaken and your conclusions are correct. Your fiancee will be able to travel outside the US after she receives her green card which will probably be about 3-6 months or after filing the I-485.

Once you get married, send out the papers for the AOS and along with that the AP (permission to travel before residency is granted). That can take +- 3 months to be approved (I think 6 months is the worse case scenario).

My husband's AOS took a long time and that was still 10 months after he arrived in the country...

According to my finace, there's only one package which is picked up at the U.S. interest section......I'm not sure what Package 3 or 4 means for Cuban filers.

Ok, so our interview has been scheduled for March 28th in London so now I am in the process of looking for flights to the states for my fiancee. I seem to remember reading that JFK is the only point of entry that grants the initial 90 day work visa... Is this correct? Seems sort of weird...

Also, I am looking for one way flights... Is this the right way to do it or is there some backwards theory by immigration that shuns one way flights?

Any feedback would be greatly appreciated.

You would be using the I-134. And yea your good on the income. Especially if she doesn't claim anyone. Just make sure you get her to get an award letter showing that the income is ongoing.

They only want to see the I-134, & tax return looking for dependents and if the income covers the poverty 2007 poverty guidelines, current letter from employer that he made $x and in good standing and how long been there, etc. and a current paystub. Also his original birth certificate. Thats all the really care about from him because he has already been probed by the USCIS and approved. If he is there with you at the interview he can just tell them that he is there to take you back with him on tomorrows flight. They will most likely give it to you then since he has clout and a citizen and a tax payer that pays their wages and hopefully nice. Normally they mail it to you which could be sent by the local guy with a horse and buggy. Be sure your pictures are proportional and show ears well. They like ears.

Not necessary to be there. But it would be nice. Also, many embassys mail mail the visa/passport to your fiance' which depending on the local reliability of courier service, could take 2 days to 2 weeks. But if your fiance is there with you they will give it to you then when you tell them yall are leaving together tomorrow to the US.

I doubt you will have to be inteviewed but do not worry about the processing time they are not reliable anyways. Like I said I was worried about the same thing too because our paperwork said they recieved it on Nov 6th 07 and it said that until they approved it on feb 29th. I used to check the processing date and they said they were working on August 07 still even now it says that. So do not look at that. If you go to www.uscis.gov and sign in and set up e-mail your case number you will see when they udate and that means they are working on your case everytime they update it.

Hey do not worry about the time you seen on the site when they received it that will stay that way until it is approved. Do not follow the date on the service center mine said August 07 too but I got approved febuary 29. So do not freak out yet. I called so many times and got no answers from them I am sure you will see an update soon. You can creat an account and you will see your case number. They will send you an e-mail when they approve it and you can check to see if your case was updated since they recieved it. I hope you read this because I went through the same worries too but everything is moving on to the next step

I'm worried because I have a trip planned to be with my fiancee in May, and that might actually coincide with a possible interview. If an interview is required, is it set by the USCIS, or do I get to choose the date?

Hello there, You should not have a problem getting it approved just check over your paper work 10 times until you are sure about it. I read on a site once your petition is approved it can not be denied at the embassy it can only be delayed from embassy and sent back to uscis for revaluation.
They say the it is very unlikely to get sent back to uscis unless your paperwork is not in order or at ther inteview they think the relationship is false.
After hearing this news I was happier to read this news about that, now that makes me work harder to get everything right so I have no problems.

yeah just wait it out a bit. I new someone who got theirs approved before me when they applied after me. I thought it was because they had lawyer and I did not but 5 days later I was approved. I am just wait for my reciept. They told me some other applicants get done faster because their background checks move faster. I was still upset because they were approved before me when they applied a month after me. I am ok now I hear it's all down hill from here because it's approved and can not be denied at the embassy only delayed or sent back to uscis.
OH do not go by the processing dates they do not help with anything only to make you worry more. My processing date said August 07 and I got approved feb 29th. Good luck and don't stress out so much.

Does anyone know if putting partially dependent where it says "The following persons are dependent upon me for support: (Place an "x" in the appropriate column to indicatewhether the person named is wholly or partially dependent upon you for support.)" will put me into a 3 person family bracket under the poverty guidlines? I only have my son in the summers and hollidays. Money is not great down in FL and I am making less then I was in CT. Does past tax records help showing you made more before?

My fiance (US citizen) and I are preparing to apply for the K1 Visa. Question 12 on the I-129F form asks for an Arrival/Departure Record (I-94) Number. I visited my fiance in the US in Jan/Feb of this year but the departure slip with these numbers on it was removed at my port of departure and I have no record of them. (The departure slip was a green form because Australian citizens are not required to have a visa to enter as a tourist for 3 months). I did not keep a record because at that point we had not read the form. How do I get these if I can and if not, what do I write on the form?

but again getting denied versus forms rejected, could be different ..

USCIS mentions strictly not to leave a blank space. if something does not apply to you write N/A. I guess it depends on how many places you left blank. one or two maybe overlooked but leaving plenty will be a problem.

At this point it is totally unclear how USCIS prioritize cases as we have witnessed ppl getting approved as fast as in 4 months. Anyway we will have to keep an eye on the time line in our case. Quick question,

My case was sent to CSC and now i am in a different state where cases go to VSC. I updated the address successfuly but can anyone tell if CSC will still process my case and wont forward it to VCS due to address change?

why do we need to send the copy of the whole packet that is filed for K1 to fiance after NOA2. Doesnt USCIS forward the original to the foreign consulate anyway? Do they actually ask to submit it before/during the interview or is it just in case sort of precaution?

I sent my original Certificate of US citizenship which is required if you became citizen thru parents. Now when I send the copy of the original K-1 packet to fiance, do I have to send the original certificate along with it? there is a very good chance that this will be lost as in my country as the post is not as reliable. Can i send the copy of it? although it is written on the certificate that copy of the certificate without legal authorization is punishable. Please suggest.

Taken from the embassy info on VJ. Follow the link above to "embassy info" and find Pakistan. Each embassy does things a little differently so you want to make sure you follow Pakistan's guidelines and not what other VJ members have experienced at their own embassy.

I'd also suggest posting your question in the regional specific section of VJ. You'll get more specific info from people who've actually been at your embassy. Much more helpful to you!

At what stage the following papers are submitted? once u get packet 3.5

1. Copy of the Approval Notice
2. Letter of Intent (same as filed earlier but directed to consulate)
3. Evidence of ongoing relationship.

Packet 3.5 check list does not mentions any of the above. Do we still need to send this out with the packet or take these to the interview?
