K-1 Fiance(e) Visa Process & ProceduresIs this NORMAL? NOA2 --> Consulate ... NO NVC
QUOTE (the illusionist @ Jan 25 2008, 09:27 PM) <{POST_SNAPBACK}>
hello VJ members

I received NOA2 hardcopy from VSC today. It says my petition has been approved and forwarded to listed Consulate.

It does not mention National Visa Center at all. I read somewhere that next step after NOA2 is NVC and then Embassy or Consulate.

Is it normal?

I've read other couples saying they'd received the same letter, but that their cases still went through the NVC. I'd imagine yours will do the same thing. Congrats.

QUOTE (LadyNoles @ Jan 26 2008, 12:24 AM) <{POST_SNAPBACK}>
Normally...they suppose to transfer your file (including everything) to NSC and then to the embassy of your country...So technically they should still have everything in it ( as the packet 3 is to informe you of what missing in your file ).

well I hope so loll blink.gif

Oh they'll have everything - but you still need to bring EVERYTHING to the interview.
We just had our AOS interview and I saw an envelope that I know was from Brazil....I don't even know what stage of our process that was submitted. Our files was BIG.

QUOTE (YMR @ Jan 25 2008, 09:21 PM) <{POST_SNAPBACK}>
You have to make photocopies of all supporting documents, do no send your originals with the application.

You can therefore bring all of the originals plus anything else you didn't send copies of (additional e-mails, snail mail letters/envelopes, presents, pictures (and/or albums). We mailed out I-129F in September and our interview was in March so we had more letters and gifts to show proof and we took that all to the interview - not to mention I was there with hubby.

I've been through everything you're discussing here and I understand completely. On the other hand, there are those (like Audrey) who will be as excited and relieved as us - well at least almost as excited innocent.gif .

Agreed with the others, don't worry about it because it is no big deal. no0pb.gif

My husband's parents didn't even know the year or month they were born, so we just left that part blank. No one mentioned it.

THANKS EVERYONE. I feel everyone should know that it is always best to do this yourself. Lawyers just take money and dont care..

...I wish people realized this before they threw their money away.

However, I wouldn't worry about the dates - especially because you said that in the area where they're from this is common. The Indian consulate may be aware of this. Even if they're not, the month and year (which are most important) are correct. The visa is not for them....

Good luck w/ the rest of the process.

I agree - no lawyer unless you NEED one.
I travelled to Brazil for the interview so include my round trip ticket, my husband's ticket to Rio, and then to the U.S....our hotel stay, out sightseeing for 10 days in Brazil...

But hubby only paid for one vaccine, nothing for blood tests or the x-ray (we got lucky).

I'd do it all over again for my husband heart.gif .

$455 for I-129F
$131 for DS-156 consulate
$1010 for I-485 in the USA to adjust status.

Vaccinations for AOS $$?
Medical exam for visa $$?
Airfare from foreign country $$?
Fee to Civil Surgeon for vaccination supplement for AOS $$?

And this doesn't include transportation to the interview, hotel (if applicable), x-rays, blood tests, etc etc.
However....it's worth every cent!!

(I didn't realize how much the fee has increased for the I-129F since we applied - wow)

K-1 Fiance(e) Visa Process & Procedurestranslations
I called USCIS to ask if I could translate documents and at our AOS interview and was told NO - both times. I was told the first time that someone who cannot benefit from our relationship (anyone but hubby and I basically) can translate.
So we had a professional translator work on hubby's BC and a friend for our e-mails/letters.

We brought a friend to our AOS interview but the IO told her to sit down and let me translate.

K-1 Fiance(e) Visa Process & Procedurestranslations
A friend translated for us - she just signed an "oath" - the one found on VJ - that she is fluent in Portuguese and English.

USCIS claims that neither the USC or his/her SO can translate, then they accept it later on - but I suggest not taking the risk - we didn't.

K-1 Fiance(e) Visa Process & Proceduresseparation time: which one is the best option?
QUOTE (Don E @ Jan 26 2008, 09:41 PM) <{POST_SNAPBACK}>
The petition process for a K-3 visa involves first filing an I-130. While that petition is pending, you would then file an I-129F. When the I-129F is approved, the beneficiary can be scheduled for an interview, and if successful, can receive a K-3 visa and enter the U.S. The I-130 might not be approved until later. That's how it worked out for my ex-wife. Now, please understand that this is an oversimplified description of the process, but I hope it will help you to understand basically how it works.

From what I'm seeing, the process (from the time the first petition is filed) seems to be generally taking a little longer for the K-3 visa right now compared to a K-1. But, that depends on so many things and may or may not be true in your particular case.

One thing that I would suggest you think about (speaking from experience) is to consider if you'd rather be living separate from your spouse for an indefinite period of time or if you'd rather be living separate from your fiancee for an indefinite period of time. Personally, I think it's more difficult to be already married and not knowing how soon you might be reunited with your spouse. Living apart can be a tough way to begin a marriage.

That's just my opinion.....your mileage may vary. Good luck to you!

I completely agree with this - that is probably the reason that we filed for K1. The separation sucks - big time - but knowing that you're working towards it by keeping busy with the visa process helps. You know that soon you'll be with your SO forever... heart.gif

Why when people just end their relationship, do they immediately talk about "can I apply for another K1 to marry another American/Foreigner"? I don't get it....

Back when I did my I-129f, I was persuaded by my fiancee to sign my name in full and make it legible (because that's what Americans do, apparently), instead of the first initial followed by a scribble I normally do. So I did. I signed the I-129F that way.

Now I'm at the packet 3 stage, I'm wondering if I should stick to that fake signature (a signature that I barely even remember), since the immigration officer will wonder why my real signature is so different from the signature on the I-129F, even though I signed both.

That's a good question. I just checked my own paperwork and I did change my siggy to something that included hubby's name. I guess you're better off with the one you already used to correspond with them.

But it's not a "fake signature" because its yours. I also signed, carefully, my entire name on all of my immigration papers, and I usually don't sign that way.
I'd suggest continuing signing like you did on your I-129f.

If you want to give away money then I can send you my bank account number - I could use the money more than your lawyer. The K1/AOS process is not difficult - we did it ourselves from start to finish (hubby has his GC) and never received even an RFE. We did of course use VJ heart.gif .

HI Everyone,

I was wondering if anyone knows the restrictions of traveling from the US once you entered it using the K-1?
Do you have to wait till your married to travel outside US? Is it possible once in US with K-1 but before you marry to travel outside US. Just wondering if anyone went though this???

Regards and Congratz to eveyone getting their noaa-2. We are still waiting.

Once you enter the US on a K1 visa you will have to get married within the 90 days.
After marrige you apply for the AOS (Adjustment of status) when you apply for this you can also apply for the AP (Advance parole) this is currently included in the fee of 1010 Dollars.
So you can either leave the US to visit another country with the AP or with the greencard itsself, dont attempt to leave the US without it,you would have to apply for the K3 visa to get back in(in the worst case)

Don't expect to be able to leave the country in less than 3 months MINIMUM (and that's probably wishful thinking).
