I sent for 2007 tax transcript today. Do I have to get 2005 and 2006 transcripts too? I would have to send to another state to recieve it because I live in another state the prior years and I do not know if they will come in around the same time. Is it alright to send 2007 transcript with 2005 & 2006 return copies with w-2?

Well I called and talk to the sevice center plenty of time and one was for this very same reason. I was told that if they get any type of hit on your name they have to wait for it to clear and sometime that takes a week. I did not get too many answers myself but they also said that it depends on how your paper work is presented if everything is in order and easy to find. I think sometimes they mess up your paper when they get and takes them longer to reorganise it.

Yes our common-law marriage is recognized by Canada. We called the consulate here in Calgary a few times asking for information and we were told that the common-law marriage does not exist once we move to the U.S. Honestly, the person we spoke to seemed to be unsure of anything we asked and rushed. Which then led us to drive 3 hours to the closest border at Coutts/Montana and we then spoke to an officer there who advised us to file for the K-1 I-129F visa.

Again, thank you all so much for the help. I feel a bit better knowing I can have my parents sponsor him. I'll be sure to continue reading the guides!

Hello,

I really need some help with trying to bring/take my Fiance to the U.S. I am a U.S. citizen and he is Canadian. We have been together for 6 years and have finally decided upon making the marriage official. Problem is I am worried about our chances of being approved for the visa after the interview. I am currently putting the I-129F together for mailing and whilst looking for recommendations to send in with it, I came across the future interview needing an Affidavit of Support, proof of income.

At the moment I have been with him as his common-law spouse in Canada, and we want to move to the U.S. The concern isn't so much with us living in Canada, once we cross the border, immigration is a totally different situation. I was told at the U.S. consulate our best bet was the I-129F Fiance Visa (as we are engaged). While I have been here as his common-law spouse, I have been unemployed and he has been sponsoring me. Now it will have to be the other way around in order for us to move to the U.S. But I am unemployed obviously and I am wondering just how hard this is going to be? I have been unemployed for 4 years, basically living as a stay at home "wife". I have savings and my family is willing to sponsor him if needed. If anyone can give me any advice on this it would be so greatly appreciated! All of this is so overwhelming, a bit confusing, and has me worrying if I should even continue sending it in. sad.gif Thank you! huh.gif

Hi Kathleen, yes, you need to contact the USCIS center where you filed your petition and give them a change of address
for the beneficiary. I think you can do this online on their website. Do not just call and change the address over the phone. This is
how I got so screwed up and am still in this process. Then you may want to call afterwards to make sure they changed your SO address. My finace who was in Vietnam moved once I filed the petition back to Nigeria and I had a very hard time getting his case moved to Nigeria after it left California service center.

I will be travling there on may 18th 2008 for 5 day i have been there 9 times of the past 7 months i travel there about ever 4 to 6 weeks. Hi,
I just had a quick question concerning the DS-156. On question #36 it asks, "Has anyone ever filed a immigrant visa petition on your behalf?"
Does this question only apply to American visa petitions or any at all? My fiance was previously in another relationship with an Australian. An approved visa petition was issued for Australia but he turned it down. If I have to say yes will it hurt our chances? I appreciate any advice on the matter.

Ok lets see if i can explain this question right. I was involed with someone in Cambodia last year we started the K-1 visa prosess ( the only thing we compleated was the 1-129f and suporting Docs) It was aproved in Feb. However the relationship ended in early Dec. I wasnt aware how serouse this was. Me and esbert had been friends online for many months befor the relastionship ended but after my relationship ended with the girl from Cambodia (btw she imigrated to Au. already to be with her family their and has no plan at all of coming to the USA ever) Any ways after that ended my friendship with Esbert really started moving pass friendship and into relationship whistling.gif I sent this along with my I-129f packet to USCIS:

Socheat Kang it was approved on Feb. 27th 2007 but we had already ending the relationship. We ended the relationship due to disagreements that could not be resoled in December. Her family had already (before we met) had started the process to immigrate her to Australia. Despite us meeting and the time we spent together she then decided it was best for me also to immigrate to Australia which is not possible as I have strong ties to the USA and do not wish to leave. Being unable to resolve this issue she left Cambodia and immigrated to Au. I have not been able to contact her at all to cancel the first I-129f form that was approved. Me and Esbert had already been friends and the more I talked to her the more I wanted to know more and over the next few months we began to become closer and decided to met only to find that we were much more than friends. I hear-do formally request to waver the 1st I-129F form for Socheat Kang receipt number WACXXXXXXXXXX to be null and void. I ask that this petition I-129F be approved and grate me the honor of happiness and love from Esbert Ignacio.

As for our ongoing relationship we sent 5 e-mails, a birthday card, used phone cards, a phone bill, AMEX bill showing we bought a PIN to call each other, and an affidavit (letter) from a friend.
The pictures and boarding passes also are proof of our relationship because I travelled to Brazil a couple of times. We saved some stuff for our K1 interview.

Thanks! Just for good measure I sent a color copy of passport will all stamps etc in it. Oh and the phone bills ... about 30 pages of it all to Louis' cell phone. I think the pictures of me, him and my daughter in St Lucia are pretty good, I sent 8 or 9 I think. If they ask both his mom and my aunt and mother will write a letter.
Also planning a trip in April if VT isnt done by that time. We opened him an e-mail account that a mutual friend will help him with... when your bathroom is outside, internet is not an option! :-) And we have just written each other an actual letter! LOL All this for future and furthur proof.
If only the people could actually see us together - we have known each other our whole lives.

Don't stress too much - just send a little of each. We sent only 6 pictures, 5 e-mails, one phone bill, a couple of used phone cards, one birthday card, but all stamps/visas/plane tickets...etc.
If you already have bought your plane ticket or made a reservation for your trip in April you can include that.
I made a scrapbook of photos and brought it to the interview, along with some presents and envelopes from letters we'd sent to each other.

You'll need proof for the K1 interview, the AOS (for your fiance to become a resident), and then again when he removes his conditions off his green card....

I disagree with the OP. I've been "into" this K1 process thing for a couple years now and I don't see any rhyme or reason with anything. We just finished up with the AOS process and it's the same thing there too.
We have to remember that we're working with people and I think that a lot of what happens with our petitions has to do with whose hands it's in.
But that is just IMHO.

My husband and I met in person, lived together in Brazil, dated for years before we got married, hubby came in on a K1 visa, and it STILL took 8 months for him to get his residency. There were people who were approved without an interview in 2 months.

What do you mean NO? YESSSS - of course you do.
My husband and I submitted 5 e-mails with translations. USCIS says you cannot do it because you're biased, so ask a friend. Some people say that USCIS allows someone in the relationship to translate - but do not take the chance. I was allowed to be my hubby's translator at the AOS interview (for examples). But we brought a friend just in case.
Anyway, EVERYTHING that you send to USCIS needs to be in English. For the interview it's different because you're in Brazil. Good luck.

She needs to be honest, though that may lower her chances of being approved. If you decide to apply for the K1 later on they ask if you've ever been denied a visa to the U.S. If that were the case later on, she shouldn't have a problem, but it could bite her in the a$$ if she is dishonest.
