-- You'd sure as HECK better be there at the visa interview!!! I wasn't at my fiancee's original interview, and she got the bum's rush after 3.5 minutes for "need more proof of validity of relationship" even though the Consul didn't even LOOK at the copious evidence that she had brought. Now, I must expend time and funds to make a special trip back down there. Regardless of whether your consulate SAYS (on its website, in advance, or anywhere) that "only the applicant is allowed in the interview," attend anyway, just in case.

Sadder but wiser. Si, man.

Oh I hope this isn't the case for everyone! My fiancé is in Ecuador, and I cannot be with him because I have to go to school in the fall. Why would you going provide more evidence for them? This is the same consulate that my fiancé has to go to...now I am scared!
I guess we will see how it goes and if I need to be there, then I guess I will go there...

I wouldn't say that it is true that a lot of the consulate in Latin America expect for the USC to be there. Brazil does not require, or even suggest, that the USC go to the interview. I went for a number of reasons - I wanted to be with my hubby, I didn't want him to go alone, we wanted to meet up in Brazil to return together, it's stressful, and we had our pre-honeymoon in Rio.
The CO allowed me to be interviewed too, he even spoke with me more than my husband.

But I've read a lot of reviews from all over LA and was never under the impression that the USC SHOULD attend as a GENERAL RULE.

OP, you're not the first couple on here that young - so don't worry as long as you're of legal age to get married (or have parental consent if needed).
As far as the USC being allowed in the interview room - it does depend on the consulate. I'm the USC and I was allowed to be interviewed with my (now) husband and the CO actually talked to me more.

K-1 Fiance(e) Visa Process & ProceduresOne Way Ticket Problem???? Help!
Do whatever you have to do to get her here. It doesn't matter if it's a one-way or round trip because she's here to stay. What's important is that she arrives safely.
Good luck to you both.

First rule... don't ask, don't tell. Second rule... well, beyond those high ranking officers, how can an American Consulate or FBI access CCP's roaster to find out who is a member and who is not?

Be careful of this because it specifically asks this question on immigration documents and you cannot lie. Secondly, my husband was asked a similar question when he had his AOS interview.

An overstay of 180 days to 12 months is an automatic 3 year ban. An overstay of more than a year is an automatic 10 year ban.

Ast stated above, they may approve you initially but you will most likely need a waiver which could take some time. See a good immigration attorney.

The petition will be approved, the visa will be refused, a waiver submission will be required.

Good answer - straight to the point.

Our petition got approved kicking.gif kicking.gif Im getting ready for the interview now and gather documents. Now i read something about the interview that better not be true. It says that i need originals of EVERY document that is in the package. Does that mean i need my fiance`s paperwork in original too or only mine?!?!?!?

=>
4.3.6)...What should I bring with me to the interview?
A...You need everything from the checklist, of course, but you also need originals of everything that was originally submitted as a copy, even with the I-129F petition (except the US Citizens passport and the original I-797 approval notice). Original birth certificates, divorce or death decrees, and originals of any documents to support the I-134 fall into this category. The Consulate has the right to ask for the original of any document, so best be prepared.

Congratulations!!

K-1 Fiance(e) Visa Process & ProceduresSupplemental employment history G 325a??
QUOTE (Christian_S @ Jun 22 2008, 05:09 PM) <{POST_SNAPBACK}>
There are five blank lines to fill in your employment history. My last five years of employment history looks like this:

Employer A- June 2008 to Present
Unemployed March 2008 to May 2008
Employer B Nov. 2005 Feb. 2008
Employer C Dec. 2004 to Nov. 2005
Employer D March 2004 to Nov. 2004
Unemployed Jan. to Feb. 2004
Company E Feb. 2002 to Dec. 2003

Should I make a supplemental employment sheet or should I just not include my periods of unemployment so that my employers will all fit onto the G 325a form?Orrrrr does anyone have acrobat pro and could possibly add two extra lines and send it to me????

If USCIS wants no gaps then you gotta give them what they want. We added supplemental sheets for employment and addresses - there is no problem with that.

LOL.. please note I didnt use the term "off putting" or "crass" ....you chose those words and you chose to bring nationalities into the debate. In my experience "off putting" and "crass" behaviours are not the reserve of specific nations I have travelled extensively and know these behaviours apply to certain PEOPLE - nothing to do with nationalities.

My point is and remains your sarcasm was neither appropriate or helpful ... it may deter posters from raising any other concerns or questions they may have ...... no matter how you try and defend your manner the point remains the same. If you really think a poster asks a question that you think they should already know the answer to ...why not just leave the thread alone?

Most effective - Only effective? no matter - YOU stated and demonstrated it as your prefered tool to communicate -
" I find sarcasm to be an amazingly effective, attention getting communication tool"

And I beleive you! I really do think you think it is effective.......doesnt make it any less sad.
Clearly we will have to agree to disagree.....lol.... biggrin.gif

QUOTE (LauraUK @ Jun 22 2008, 10:52 AM) <{POST_SNAPBACK}>
Hi, we are currently filling out the G-325A for both myself and my partner. For the fathers details on my partners form we are a bit confused on who we put. His real father died just before he was born and his mum re-married when he was 7. His stepdad has no legal guardianship of him and as put by my partner 'just a dude my mom decided to marry.' Do we put his real father or stepfather on the form? I tried searching but didn't come up with much. Thank you.

Write down his father's name and then DECEASED next to the space allotted for where he is living. My husband's mother is deceased and that is what we did.

Even is she is an overseas worker, it will be much easier for her to come directly from there. Forget about going back to the Philippines unless she needs to go home for legal reasons. The US Consulate is easier on the people that are already out of the country as they already know that in order to get their passport for work is very difficult. She will need all the police clearances for each country she has been in for more than six months and you will still need the standard medical examination. She will also need a passport that will be valid for more (I believe) one year after she arrives in the US.

I brought my fiancee here from Hong Kong in 2005, where she was employed as an overseas worker.

Same here, my papers was processed in USE-HK in 2005 and it took only 4 months (including the filing I-129f). Unlike in the Philippines, the processing is too slow (6-8 mos.) and a lot of extra payments (verification of documents and seminar?).

thanks, im new here and i was really surprised at the responses thanks alot

Yea, there are a lot of great people here. Good luck!

K-1 Fiance(e) Visa Process & ProceduresFor those of you who got a recent divorce to be with your new Fiancee
QUOTE (ILoveTan @ Jun 28 2008, 01:57 PM) <{POST_SNAPBACK}>
Hi all ... the truth is, I appreciate everyone's posts and input. Everyone has their own slant and take and it's helpful to hear all opinions, that is why I post here.

I understand pushbrk, he is very very straight-forward. wink.gif But I do also appreciate comments like from Laura-and-Nick because staying positive is also essential in this process. As a personal note to Kim & Russ - love you, love you, love you! luv.gif

Yes, we need the facts in this journey but we also need faith and positive thinking. I am not a "religious" person in the sense of the word but I do believe in something bigger than myself. I do not think God would have brought me and Tan together (in the bizarre way we met - and it is more bizarre than I have ever posted publically) and all the circumstances surrounding our relationship that are just too strange to be anything other than true destiny. He is from Nha Trang Vietnam ... even before I ever met him, I had TWO different "psychics" tell me that I had a destiny in Nha Trang, that something in Nha Trang would change my life. 2 different people said the same thing to me, 1 of them didn't even know I had ever been to Vietnam or could even speak the language. Just another white person who said the word "Nha Trang" kept coming in her head when she looked at me, and she didn't even know where that was. Yes, I know it sounds unbelievable but it's the truth.

Yes, we have a real love together. A love like I never thought was even possible except in storybooks. I know my letter should be, just the facts, M'aam - but (at least in the past) wasn't this process supposed to be about LOVE? But now it is to my detriment if I express that I LOVE him and he LOVES me? That makes no sense. Now I have to worry if the consulate/uscis will think I am just a naive girl getting "taken" by a very skilled Vietnamese man from the countryside? Just how stupid am I? Now I have to worry that I am older than him and that I asked him to marry me? What year is this? What country is this? It's like everything America says it stands for: equality, fairness, open-mindedness is one big fabrication.

If anyone really understood Vietnamese personality (like I do) they would know that Vietnamese men are not the "kings" everyone thinks they are. Vietnamese men are actually very shy and submissive with women. They would REALLY like to be with a strong woman who takes the role of the man - they just don't have the opportunity. They become bored and resentful having to be Mr. Top Dog in their home and turn to drinking, gambling, and even violence. But when they are satisfied and happy, they are delightful men, very very respectful, gentle and overly romantic and emotional. I am not underestimating how cunning Vietnamese can be - I know they are smarter than they look. I have never been mentally intimidated by anyone but Vietnamese would be very scary if they focused that brain power of theirs. All of this, I am aware of ... I wish there was a way to express this to the consulate. huh.gif

Tan is not a perfect person. He comes with a suitcase full of baggage, just like all of us. It hasn't always been easy dealing with his - he is a total emotional investment. He makes me happier than I have ever been in my life, but if I want him, it is not without a price. He wants 24/7 devotion, affection, and togetherness and he isn't real good about enduring time when that is not possible.

Anyway, I am rambling ... now you see why my letter is so long. hihihihi ... but I will try to KEEP THE FAITH. This is a real relationship and we BOTH love each other. I would bet money that Tan would live on the moon as long as I was there. I just don't see a way of giving "just the facts" to a consulate who doubts everything and will just ask me later if I don't answer it NOW. All I can do is write that letter from my heart because this situation is not a "government matter" it is a matter of the heart.

Thanks to everyone and if anyone feels compelled to weed through my 5 pager, send me a PM - would love to get your comments. innocent.gif hihihi
Thanks *hugs* to all
ILOVETAN

I don't know anything about the consulate in Vietnam, but five pages is a lot. I first wrote a page, and then took out all of our "lovey dovey" stuff 'til I had about a paragraph.
I don't want you to keep out anything that may help you, but if you can shorten it - the better it shsould be.

Good luck!!! good.gif

I assume you re filing for K1, right? What they need at this stage is evidence that you two have met in the last two years. As was mentioned, pictures are secondary evidence. What you need to include is evidence like boarding passes for the flights to see each other. If you don't have those, include the copy of passport stamps. As an example, we showed our IDs from the cruise line with the same date and cabin number and boarding passes for our vacation trip that showed same flight/date and adjoining seats. Anything that shows you two were at the same place at the same time will work. Save proof of on-going relationship (charts, emails, pictures) for the interview. Yes, you can include couple emails/pictures, but don't go overboard. Best of luck and a speedy approval!!!

Hello! When you say don't go overboard..well I have probably 40 emails from throughout our relationship at different times and 30 photos and cell phone records of different time periods. I guess that is too much? I just want to make sure they can see that it is genuine. I also have copies of our E-tickets for travel, unfortunately in the beginning we didn't save the actual boarding pass stubs, well I can't find mine! Thanks for all the advice!

Advice about sending a lil bit of everything (two-three emails, couple phone records, etc.) is excellent! What will be most important is the E-tickets - send copies of those. And throw 5-6 pictures into the mix smile.gif . At this point all they care about is that you guys have actually met. The rest should be forwarded to you SO for the interview.

Yea, you don't have to send proof of ongoing relationship yet. We did because it made me feel better and because it had been two years since we met...so I wanted to show that we were still in a relationship and that I had returned twice to Brasil. Most of what I sent was proof, but I included correspondence as well.

If you have your e-tickets and/or can get some kind of proof from the airlines that's great. It "puts" you in the country. You can also send bank statements with your name on it - showing you were there at the time you said you were.

I suggest sending a little bit of each - that's what we did.
This is what we sent as proof of meeting:

Copy of Brazilian visas from passport
Copy of stamped entries into Brazil
Copy of teaching certificate from Brazil
Copy of both sides of Brazilian residency card with translation
Copy of Flight Coupons and the itinerary from last trip
Receipt from hotel and business card with translation
Pictures (6) from 2004 to 2006

Then I sent 5 e-mails with translations, one phone bill, a copy of an AMEX bill showing I'd bought on-line calling cards, one letter from a friend, copies of a few used calling cards...etc.

And on average how many photos of the two of us should we provide, I have about 30 right now! I think that might be too much. And are the affidavits necessary if you have a ton of other evidence? Thanks for all your advice!

Two passport pictures.
We sent 6 pictures of us together with our I-129F. I had originally separated 45 but then decided that since they're all pictures of us, it was better to send only a few. So I sent a few - from our first picture together to the most recent. I tried to find some that were from different locations as well.
We did sent one affidavit, though we didn't need it, because I thought it would be a nice addition. My friend is a really good writer and her letter was beautiful (*sheds a tear smile.gif.

We are now starting the process of getting him here on a K1, I hired a lawyer, but am not sure if I should fire her or not. She's wonderful really, it's just a money issue. The reason we hired her is because I will have no time, I work full time second shift and I go to college during the day and hardly have time for my boyfriend. I just didn't want to get stressed and get tied up in the paperwork and fine details. But I need some advice as far as costs, and how much is too much etc. Any ideas???

Thanks!

TOO MUCH!
Unless you foresese some potential "problems" with immigration, you don't need a lawyer (IMO).

I am not sure about China but in Colombia they want 'fresh' birth certificates (less than 3 months old or so) - there you go to the notary where your birth was registered and they print out another one for you for $5 or so. Good Luck

A birth certificate does not expire.

Exactly. Unless you've passed away I guess.

lol They don't expire first because the nature of the document itself as a one time record of birth and second because the information isn't subject to change. "Correction" yes, change no.

Most people in China don't have a birth certificate. What they submit is a product of the Gong Zheng Chu attesting to the contemporary information provided being accurate. In the USA, it's a copy of an actual document recorded at birth. In my daughter's case the family falsified a new birth certificate (again, not really a certifiicate of birth) so she could start school a year early. They forgot to change it back later so all her records now show her as three months older than she really is.

laughing.gif

Yea, I was joking about it expiring at the time of death.

I don't understand why people would think it would expire.

I'm just wondering if USCIS is really processing the applications on first-come-first-serve basis. does any one have any idea? The reason i'm questioning that is because i see some people have filed their application later than others but still they get their approval sooner (assuming that there is no RFE and docs are all complete). do they get stuck in FBI or something that takes more or less? or some stuff such as, making sure all documents are sorted and putting more evidence may actually help to reduce the time?

Just a curiosity question here. As part of my "evidence of relationship", I sent about a half-dozen pictures of my fiance' and myself with her family. I wrote place, date, and event on the back of each (with mom, dad, aunt, uncle, grandpa, cousins, etc.). There were also pictures of the two of us in different recognizable places. I see some of both kinds of pics posted on the various forums here, and wondered if the family photos were better evidence of a real relationship.

I think so. We were going to include a picture of us with friends, but the one I liked came out to dark.

I wouldn't send too many pictures with the petition though, if I were you, I think it's better to send a little bit of everything. We sent 6 pictures in all - from over a two-year period.

K-1 Fiance(e) Visa Process & ProceduresDrug Use
The TRUTH behind drug testing
Hello everyone, I am a new member, but I have some experience that I think (And hope) will clear up a lot of the misinformation (And flat out money wasting) I see on this board.

My name is Brandon and I used to work for a medium sized drug testing firm located in North Carolina. We provided everything from record keeping, laboratory testing to legal compliance and on-site test kits.

Here are some basic things everyone needs to know about drug testing.

1. It is an entire industry formed on mis-information that's only exists to make money. Margins on drug tests are very high, especially when compared to other types of medical testing. This means companies like LapCorp and Quest Diagnostics earn more per drug test than any other test they perform, so they obviously aren't going to complain.

2. Drug tests do NOT detect THC. You could drop a bud into water and stick a drug test in. It will read negative. Every time. Drug tests look for the byproduct of THC consumption in your body, not the drug itself.

3. The detoxification industry is just as shameful and money oriented as the drug testing industry. Almost every detox product out there requires you to drink copious amounts of water prior to your test. It's the WATER, not the product that dilutes the sample and lowers the Ng/Ml (nanograms per milliliter) concetration of cannibinoids. Your system cannot "flush" all of the cannibinoids just because some product claims it can. Cannibnoids are stored in fatty cells, and I think everyone wishes they could magically "flush" fatty cells from their body

4. Laboratory testing is actually on-site (rapid read, quick scan, dip card. Whatever you want to call it) testing in disguise. Here are the economics:

The NIDA 5 (Cocaine, Meth, THC, Opiate, PCP) dip cards cost $1.10 wholesale (For a decent, american made card). They are much cheaper if you go with the Chinese imported version (remember, this is a money motivated industry. Most people use the cheapest they can get at the time)

Lapcorp charges the company anywhere from $14-$39 per "Laboratory Test" plus a "collection fee" of $10-$15. That's $25 per test at the least.

GC/MS (Gas Chromography/Mass Spectromity) testing actually costs a lot more than what they charge. GC/MS normally costs close to $100 per test. Anyone can obviously see the problem is every single test was run through GC/MS. Lapcorp would loose money. This is obviously not what happens.

ALL lab samples are "screened". They know that 99% of all of the tests are going to come up negative, so they hit them with the same $1.10 test that an onsite kit uses. If it comes out negative, it's reported negative and never sent to GC/MS. If it's positive, it heads over to GC/MS for quantitive verification.

All you have to do is be able to pass an at home kit and you are golden. Here is where the magic comes in. Drink WATER and take a B Vitamin. This will re-yellow your urine, which will pass visual inspection.

These companies are all about making money (on both ends, testing and "detox") Everyone knows drug testing is Bullshit (Penn and Teller should totally hit this for an episode). The truth is it's a multi-billion dollar industry, and the industry wants to keep it that way. Lapcorp, Quest, etc make a substantial amount of their profit from drug testing. They aren't going to deliberatly damage that.

The point of this post? Save your money. Chances are if you are looking for a job money is tight already. Add in gas prices and time wasted at interviews and driving all over town to be tested and $30 is a lot of money. Drink water, and take vitamins.

Well, I researched a litle more and someone from Jan/08 said, Cairo Embassy did not allow her to use a co-sponsor and was denied. She said, the USCI told her Cairo would accept a co-sponsor, but then they refused it.

Has anyone filed in Cairo for a K-1 and was able to use a co-sponsor? I don't see that info on the K-1 info page concerning a co-sponsor.

K-1 Fiance(e) Visa Process & ProceduresCan you use a sponsor with K-1?
I am looking over the guides and I know if you dont meet the affidavit of support requirements, you can get a sponsor with marriage based immigration. Looking at the K-1 i didn't see that option avaliable and was wondering if we didn't meet the support req. what choice does one have?

I'm trying to decide which is best for me to file and I will need a sponsor as I won't meet the affidavit of support req. Thank you and please someone answer me if you know the answer or direct me to the answer. smile.gif

K-1 Fiance(e) Visa Process & ProceduresFiling K-1 when to file/send G-325a?
O.K. I have decided I will file for a K-1 visa and I visited the USCIS homepage. I didn't see the G-325a on their site or mentioning of having to send it in with the I-129f. On VJ I was reading the check list for sending a K-1 and it has the G-325a included as if we should send that with the I-129f.

Which is the correct way to do this.. send ONLY the I-129f and later I will be instructed to send the G-325a or what? I'm sorry if i've misunderstood any of this. I appreciate your answers. smile.gif

K-1 Fiance(e) Visa Process & ProceduresNeed Help Plz with K-1.. Got a situation unsure of.
Also, Cheryl, I have an Itinerary for each trip except the first one I made to egypt in Jan. What I do hjave from the Jan. trip is a copy of my boarding passes. I do as well have my boarding passes from the other flights as well.

I have also, copies from phone bills where I called him from Feb, May, and June visits.

Here is what I have so far to prove having met and having a relationship.:

3 - different pictures of us together.
Feb, May, and June phone bill showing calls to egypt
Chat log from skype during May/Jun visit to the states.
Emails from May/ Jun visit to the states.
Jan, Feb, May - All boarding pass copies.
Feb. and May - Itinerary - lost January.

I would think these lengthy visits would be solid proof. It's not like we met once in 2 years, for 2 weeks and havent seen each other since. sad.gif If you can think of anything else I may have and havent thought of please ask. smile.gif

** OH!! I forgot, but I also have the Marriage Affidavit from our Embassy and had it certified by Egyptian Authentication Office. The Consular Afairs also say this on their website:

Persons wishing a religious ceremony may arrange for one separately, but it is the Civil Ceremony that establishes the legal marriage. wink.gif

K-1 Fiance(e) Visa Process & ProceduresNeed Help Plz with K-1.. Got a situation unsure of.
Thanks, Cheryl, for sharing your info with me. Since I arrived in egypt in Jan, I made a 3 week trip back to states in Feb. and in May/June for 1 month and 1 week. The rest of the time we have lived together here in Egypt. Since my acct got hacked, I only save chats for one week. My daughter uses this computer, as does her father when he comes to stay with her. I think my conversations between my fiancee and I are private and not what I want my ex to read. So, I delete automatically after a week.

On my last visit in May/Jun I did copy off some of the chats we had on Skype. As well as emails to each other when we both werent on the game. LOL I only have 3 pictures of us together, the rest of us separately. We thought we'd ramble around Cairo and take a few more of us together.

I still think it's the right thing to try and explain as best I can about the Orfi. Honesty is the best policy, but people have been punished for their honesty too. sad.gif I will see if anyone responds and has had exp in this situation.

K-1 Fiance(e) Visa Process & Proceduresk1 visa
HELLO EVERYONE, I HAVE A QUESTION REGARDING MY PETITION. I USED AN IMMIGRATION ATTORNEY TO FILE MY K1 VISA BACK IN MARCH 18 2008. IN THE K1 VISA PETITION PAPERS THAT MY ATTORNEY SENT TO VERMONT SERVICE CENTER, THE ATTORNEY DID NOT INCLUDE AN COVER LETTER, HE ALSO DID NOT SEND A LETTER OF INTENT FOR EITHER ME OR MY FIANCEE, BUT EVERYTHING ELSE WAS SENT , ALL THE IMMIGRATION FORMS, ALONG WITH EVIDENCE, AIRPLANE TICKETS,PICTURES OF US TOGETHER, BIRTH CERTIFICATES AND ETC.MY QUESTION IS, WILL THIS BE AN ISSUE WHEN IT COMES TIME FOR VERMONT TO APPROVE OUR CASE?

HI GUYS, I HAVE A QUESTION TO ASK, ON MY I 129-F APPLICATION FORM QUESTION # 18, HAS YOUR FIANCEE MET AND SEEN YOU WITHIN THE TWO YEAR PERIOD IMMEDIATELY PRECEEDING THE FILING OF THIS PETITION? BY MISTAKE, I CHECKED THE NO BOX ON THE FORM, BUT I CLEARLY DESCRIBED HOW WE MET IN THE LAST TWO YEARS BEFORE FILING THE PETITION, AND I ALSO SENT ALL THE PICTUTRES OF MY PREVIOUS TRIPS TO SEE HER, ALONG WITH ALL THE NECESSARY PRIMARY EVEDINCE INCLUDING AIRLINE TICKECTS, BOARDING PASS, HOTEL RECEIPTS AND AMT WITHDRAWALS IN HER HOME COUNTRY. I ALSO INCLUDED A LETTER DESCRIBING HOW WE MET IN THE LAST 2 YEARS PRIOR TO FILING OUR PETITION. MY QUESTION IS WILL THIS ERROR GENERATE AN RFE? I WOULD APPRECIATE YOUR INFO ON THIS.

THANK YOU.

K-1 Fiance(e) Visa Process & ProceduresAddress and divorce date ?
Hi,

I just returned from Saint Petersburg. My fiance filled out the forms necessary
for the K-1 visa. I am living in Kentucky right now and have been intending to move
to New York. I am not sure if I should have her redo the paper work with the New York
address or just send everything in as is.

Also my fiance is divorced. She filled out the forms online. I didn't notice until I was
filling out my forms. But, the date was changed to the date when she was filling out
the paper work. The only reason that I noticed is because the dates were changed on my forms too.

Thanks for some advice,
Ed

K-1 Fiance(e) Visa Process & ProceduresFiling Fee $455???!!!
QUOTE (~Laura and Nick~ @ Mar 26 2008, 01:58 PM) <{POST_SNAPBACK}>
Yes, the filing fee for the K1 is $455 dollars.
Then there are other expenses in between, the medical for example ranging from $180 to $400 dollars depending on country.
Then the $131 is paid at the actual interview.
Then once you get married you file for AOS (Green card, Work Authorization and Advanced Parole) which costs $1010.00.

It's an expensive journey but oh so worth it.
Check out the K1 Guides here at VJ, they will help to get you organized!!!
Best of luck! smile.gif

Hello,
Does the fees for $1,010.00 come fast or over a time period? I just wanted to know because I will be paying a lot for fiance just to travel and for our marriage here I just wanted to know how much time I have to pay it after our marriage? I do not want to run into any problems. I am just so happy my fiance will have interview soon and be with her soon after.

K-1 Fiance(e) Visa Process & ProceduresWhat happens with foreign fiance's passport?
QUOTE (Steve and Amara @ Mar 28 2008, 09:47 PM) <{POST_SNAPBACK}>
Just found out the following information:

Your foreign wife does not need to get US cistizenship if she does not want to. I believe she needs to wait 3 years before she can apply for US citizenship. Until she is approved for citizenship is are still considered an citizen of her coutry and need to travel on that passport.

Once she gets her conditional greencard (when the AOS is granted), she will then need to carry that with her when she travels outside the US.
She will still be traveling on her countrys passport (NON US PASSPORT) and will need to get visas for countries that require them (as stipulated by her coutry, not the USA).

90 days before your conditional greencard expires (on the 2 year anniversay of the AOS being granted) she will need to apply to remove the conditions on your greencard (in the two years she will be on a "conditional green card).
When she gets approved for that she will get a 10 year greencard.
In the third year of being married to you, she can apply for US citizenship and thus a US passport.
So to answer your question, yes, she should renew her passport, but it doesnt matter if she does it now, or when it expires, as she will have a conditional greencard--that is the form of VISA evidence not the passport.

Hope this helps!

Cheers!
biggrin.gif

Yes that helped a lot. Thank so much.

Do you happen to know when we are married if we we get treated the same when we travel over seas? Or do I have to do a visa for her when it's not required for me. She is Vietnamese so she has to have visa for travel anywhere I only want to know if that will changed after we are married and she get a temp greencard?

Should my fiance renew her passport before she comes to u.s.? Her passport expires in 2009, will she still have to use this passport after we are married? Or does something replace this for her to travel?

I would have to send to another state to recieve it because I live in another state the prior years and I do not know if they will come in around the same time. Is it alright to send 2007 transcript with 2005 & 2006 return copies with w-2?
