Another visit would certainly show that your intentions are sincere.

Number of visits and total time together helps show a bona fide relationship on BOTH SIDES. In the higher fraud countries, like Thailand the concern is about both parties, not just the petitioner.

Nobody can tell you how much of anything will be enough but the best evidence of bona fides is time together.

pushbrk, could you please cite your reference for claiming that Thailand is a high fraud country? I have tried searching for a list of high fraud rate countries, and was unsuccessful. I did however find a list of "high admission" countries, and Thailand was not on that list.

Thanks.

There is only one list I am aware of (attributed to a well respected immigration attorney)

Different types of Consulates

1) Low Risk
2) Medium Risk
3) High Risk
4) Lagos

K-1 Fiance(e) Visa Process & ProceduresTime Spent Together Before Deciding to Get Married?
We met a few months after I moved to Brazil to work for a one-year internship. We lived in the same city as boyfriend/girlfriend for 7 months (he unofficially lived with me for about 5 of those months). We then had to do the LDR thing for about 20 months, but I visited him - once for 2 weeks, again for 2 months, and then I met my husband in Brazil for his K1 interview. We were in Rio for 10 days for the medical exam/interview/pre-wedding honeymoon.
We got married 2.5 years after meeting.
So....we spent about 10 months physically together before my hubby moved to the U.S. He's been here for a bit over 2 years and our 2nd wedding anniversary is in 1 month from today.

Please help. My fiancée and I have been waiting for over one plus year for her to enter the U.S. so we can marry with the K1-visa. She will receive it on May 12th, but she has recently had other obligations arise and she must return to Brazil ASAP after marriage. It appears that she will not be able to return during the 90day period, even for a short time, we must marry or she will have to reapply. Therefore, can we marry once she arrives, then can she return to tie up loose ends for a month or two, will this affect the continued process? If not then she will have to remain in her country for almost three months after she receives the visa, then she will enter the U.S. and will stay indefinitely. Please let me know, hope I explained myself clearly. God Bless you all, without your help and support it would have been almost unbearable.

once the visa is issued she has 6 mos. to use it.... K-1 is a single use visa. if she enters the USA and leaves a married woman shortly after arrival and before AP you will begin the process all over again this time for a spousal visa

My not quite fiance (no ring, no date set until after he graduates from college- but we've both informally proposed to one another on numorous occasions) is a Canadian citizen and I'm an American. I'm curious as to how long I should wait to get the forms. He graduates in 2011 and has been told by a friend of his mother's whose relationship in the states didn't work out that we'd have to be married in six months. But neither of us have any idea where to start or how early to start.

Should I go get my paperwork started now even though he won't be moving here for another year? Or should I wait until the beginning of 2010? Questions questions.

I will leave to my country before 180 days. My criminal record is clean. My fiancee is the US citicen and I already have a co-sponsor. We do not have evidence of luggage stamps, nor passport stams, or trips, it's just pictures, e-mails, letters, letters from other people testfying our relationship, and that is it... We started talking online in october of '07, we met in person in january of '08 and have been together ever since, so aside from about 2 months worth of instant message archives in november and december of '07, we dont really have any "documented proof of an ongoing relationship" (there's no need to call each other or send letters or emails when we are living together, right?) Is this proof of ongoing relationship essential to include in the I-129F package? We do have photos of us from thoughout the last year, but as I said before, nothing on paper. We have all our ticket stubs from flights and what not to prove we were in the same place at the same time, does this fall under the proof of relationship catergory or just the proof of having met catergory? Is there a chance we will get denied if we dont have any solid proof?

How have you managed to be together all this time? The visa waiver is only valid for 90 days. Just curious as our K1 is taking forever! would be nice to be together too!

In the UK, American Airlines check your itinerary before you check in. They look at your passport & ask you how long you're going for & where you're staying.
I've travelled on the visa waiver programme during this K1 process twice & the 2nd time I stayed for 88 days. I've had no problems at POE but I had a return ticket.

QUOTE (V-G-1 @ Mar 12 2009, 06:38 PM) <{POST_SNAPBACK}>
Contract governs my friend--look for the following clause: "may terminate but is responsible for all legal fees for work performed/costs"

Mine had that so, she calculated "5 hours" worth of filling in a 2 page form and doing photocopies.
At 5 hours, the hour legal fee kicked in, making it $1,000 for "work performed."

Most probably, your contract has a "work performed" clause. You will have to pay for work performed (she/he will itemize the "extensive time consuming legal work" involved in filling out the form and photocopying.)

Your contract will most likely also have a "collection agency" clause. So you have to pay it...if you don't, say goodbye to that future mortgage pre-approval, or car loan.........

At least you will be able to cut it off before she accrues more "Work Perfrmed" hours

Make sure in writing/email to say "Please do not perform ANY MORE WORK" so they get the hint. Otherwise, they will include the hourly legal fee of itemizing your hourly legal fees.........All they care about is money..

Oh Dear...so it's probably not worth firing them then at this stage. $1800 not very well spent!

K-1 Fiance(e) Visa Process & Procedureshow to cancel attorney and if ok to cancel when u r in noa2?

Yeh, we are thinking of firing our lawyer. They have been completely useless so far. We did all the chasing at USCIS, my fiance contacted the Senator. Then, they didn't even know that you can call NVC to check if the petition arrived there. My fiance had to call NVC to find out if they had received & sent out out petition to embassy & they take a week to answer emails.

So today we talked about it & decided it's not worth the $1800 fee as we are doing all the work. My fiance called them & they were very defensive & refusing to acknowledge they have been in any way incompetent.
We are just worried that he will hang on to all our documents as long as possible just to be awkward. It may just cause more delays & we've waited long enough already. whistling.gif

DON'T USE ONE!!!
We hired our attorney in March 2008. It took them 2 MONTHS to send our petition! Our case was then held up in security checks at USCIS and the attorney could do nothing to help us.
They promised that they would help us in every stage of the process..even that they would help me prepare & give a mock embassy interview . Our interview is on 5th May & so far I've heard nothing from them. All they have done is fill out our forms which we could've done ourselves!

The company is John F Roth. I would not recommend them at all! Boooooo!

K-1 Fiance(e) Visa Process & ProceduresPlane tickets required at interview?
You are NOT required to show any future travel tickets or the like at the interview. Your fiancee friends may have confused the requirement to show ticket receipts from when YOU visited her as proof of meeting. You are right, don't purchase any tickets until visa is in hand and she has the ok to go.
QUOTE (NateM @ Feb 16 2009, 03:57 AM) <{POST_SNAPBACK}>
Hi everyone,

I am in Bangkok with my fiancee, and she is scheduled for her K-1 interview on the 18th.

One of the documents she received from the Embassy a while back (in the packet including the checklist, etc..), it says "***You are strongly encouraged NOT to make any nonrefundable travel plans until the visa is printed and in your passport.***

To me, this sounds like it's basically saying not to purchase any plane tickets until your fiancee is completely cleared/given the green light to go to the US. However...

My fiancee says some of her friends (who know other women who have gone through the K-1 process) have told her that she absolutely must be able to show a plane ticket or something similar - like an itinerary - at the interview, showing her travel arrangements to go to the US have already been made.

So I'm a little confused, as the two lines above seem a bit contradictory... Unless it means that you must purchase plane tickets, but make sure they are refundable tickets rather than nonrefundable tickets?

Anyway, we are flying standby from a benefit my uncle has who works for a major airline. He is supposed to send me an itinerary via email, but I just learned his wife is sick and in the hospital, so I'm a bit worried whether he'll be able to send it in time. Any advice or clarification on what the rules are? Is this anything I should be worried about? Any help would be appreciated.

Nate

I see that some applicants see that the NOA1 is issued even before they receive it in the mail. How do you do that? do they send you an e-mail or is there a website you can look up that info?

thanks a lot,

Ovi

You can simply set up an account at the USCIS website. After an account is set up you can log in and see if any progress is being made. Here is the link to set up your account. You will need your account number found on your N0A1. People know the N0A1 is issued because they sent the package with delivery confirmation from the USPS. Good luck

K-1 Fiance(e) Visa Process & ProceduresLetter that NVC Received Petition Yet No NOA2
QUOTE (tony1343 @ Apr 17 2009, 06:43 PM) <{POST_SNAPBACK}>
Okay, so this seems very odd to me.

Edit: I guess I should have done a search first before typing this all up, but looks like the same thing has happened to others at VJ. I still find it interesting though.

Today in the mail I received a letter from the National Visa Center telling me they received an approved I-129F petition filed on behalf of my "fiance." First off, she clearly isn't my fiancé but is my fiancée. So hopefully the records aren't messed up.

Secondly, I haven't yet received a NOA2 from the USCIS. I logged-in to the USCIS to check the status of my petition and it still says "Case received and pending." This seems strange. According to the flow chart, first you get the NOA2 and then weeks later the NVC receives the petition.

Also, the letter says "INS Receipt Number" and then has my number. I find this odd since the USCIS hasn't been called the "INS" since when, 2001 or something?

Finally, it's only been about 2 months since I mailed off my I-129F petition, so this is really quick.

I'm not trying to complain. I just don't want to celebrate and then find out there was some kind of mistake.

Keeping my fingers crossed.

I need to get my packet and other documentation together and get it to my fiancee. I thought this would take much longer and that I'd just bring it all to her when I visit in July (though maybe now I won't be needing to go there).

Thanks for any comments.

Fiance' is generally regarded as a generic "to be engaged" term. Yes, we typically use Fiance as a future groom and Fiancee as the future bride. In the Govt. eyes, we are unisex, everyone is a "Fiance" so I would not worry.

2 months is certainly quick, but not so quick to raise a red flag. From what other VJ'ers have said is the website status is horribly unreliable and really is not an accurate method for checking your status. Also it will depend on which center you applied to. The california center is so much faster now than the vermont center. This may help explain the faster approval if you filed with california.

You are going to need your NOA2 which so far has not appeared. A call to the service center you sent the 129f to would be my next move.

Just my thoughts on the matter and best wishes....................

It is nice to be married in your home country where your family can be included. Just be sure to file the correct application! K1 visa if you decide to wed in the US, K3 visa if you marry in your home country. If you have already filed a K1, do not marry in your home country, the embassy will find out and your K1 will be rejected. Good luck for which ever visa type you decide.

K-1 Fiance(e) Visa Process & ProceduresMeeting for the first time!
Thank you for the wonderful support guys. I think Gray and Alla's 'congratulations' was the first we got as a couple and it felt good! It feels strange but comforting finally being around people who understand what we've been going through. And its good feeling like you don't have to justify the realness of the relationship simply because of its online nature or the distance involved.

The baggage tags are something I didn't think about. He was gonna just bring carry on, but maybe checking in something for that is a better idea.

As for proof of past/ongoing relationship, we have letters sent between us from as far back as 2005, years worth of phone call records/bills and skype call records which identify his numbers (when he was in WI and now MD) and my local number there (through skype), stubs of packages I sent to him with a stamp and date on them, recorded video calls which can be screenshotted I think, emails and 5 years worth of chatting on MSN and skype.

I'm a little reluctant to sign the forms and intent letter and all the documentation needed during the trip. I feel like I want to have our own little time out from the world and enjoy it, something just for us. (They could probably power up a whole country from the amount of 'energy' between us when we both finally meet hehe) The amount of red tape they make you go through and having to prove a relationship the way they do kinda goes against how natural a relationship should be, but I suppose that's just how it is. But for that one week, I'd like to not get USCIS involved so it can be as it should be. I would rather pay the postage and wait to send the documents later just so we can enjoy our time together simply for what it is. Maybe I'm being wishful but I'd like to strike a healthy balance if possible.

And after that, the chaos that is a K1 can begin.

I've been seeing trends in the progress forums that show Vermont has been speeding up, so that's good I think.

We'll put up a profile pic of us after our trip come end of March! Best. March. Ever.

K-1 Fiance(e) Visa Process & ProceduresMeeting for the first time!
Hey guys, this is my very first post so I'm a little nervous on the reception. I've been lurking in the forums on and off for some time and have seen such a strong support community here. Its great that something like this exists for such a complicated and nerve racking process (when love should be simple!).

We've been dating online for four years now, well this is the fifth year after meeting in a game back in 2004. Sadly, monetary problems have made it impossible for us to meet till now. Its been tough but rewarding and definitely worth the wait though.

I had my tourist visa denied to go see him during Christmas last year, which was heartbreaking after waiting that long to meet. So rather than try again, he is coming down here for a week (that's all he could get off work). I'm so nervous but exhilarated at the same time. Once our vacation is over, we will go the K1 route.

I do know that some things are needed to prove that we met like boarding passes, itinerary, photos, the stamp on his passport and hotel receipts. Is there anything else?

Thanks in advance guys and we hope to part of this great community.

Seriously. Pictures are not primary evidence and therefore technically not needed at all (although I think we all agree some pictures are good), but 35 is tons! You also mentioned some of the pictures that you plan on including like a pic with the hotel sign (that you have the receipt for), a pic with the keys, a pic with the staff....I really really really don't think that all 3 of these pictures are needed. Stick with the one with the hotel sign as you have the receipt and the names will match (even though most likely no one will ever notice or care about that), but the other 2, take out. I don't think we can say that you have "too much" but I think we can say that the person going over your file isn't going to look at all of those or even care that they are added since they are totally not needed.

And don't even bother adding the CD with videos. THEY WILL NOT LOOK AT IT. No one will ever look at it. So don't even bother. If someone included a CD with video and then got approved quickly, this was coincidence. End of story.

I included a lot of extra stuff in my packet too and I think we probably had about 15 pictures that were taken from the different range of times we saw each other. Also, a 2 page answer to question 18 is IMO too long. Maybe others have different ideas. You don't want the person who is going over your file to get bored and pissed off because it's so much to read! You want them to see the point of your story, to see how you met, identify that it was a legitimate meeting within the last two years and move on. If they have a problem with the age difference that will be address at the interview. OR, you could include another letter in the packet talking about that...but I think that you have question 18 too long.

And when you say 6 months of proof for the call records what do you mean? You mean you printed 6 whole months or calls out for each year!? huh.gif I would pick like a week every month or something if that is less or I don't know...that just seems like a lot. But, whatever I guess.

And as someone else said, make copies because while it should be at the embassy, I never saw any of our evidence that we sent with the original packet again. That is not to say they didn't have it, but I didn't see it. However, I did have a copy of our entire I-129F packet in my backpack at the interview.

Good luck!

To answer your questions/issues: Well the pic of the keys actually shows the lodge name very clearly. That's why we included it. It was a different lodging from the place we took the pic by the sign. As for the 6 months, yes 6 months of printed skype calls each for 2007 and 2008. Not really sure how to separate it into weeks since its all printed at once. Same goes for verizon which is in spreadsheet format. I suppose we could take a page off each month but we had included it all so it didn't seem 'incomplete'. We will probably take out the CD then since I'm hearing so many say the same thing. We included 35 pictures because our meeting was extremely short despite the number of years we've been together due to him not being able to take more than a week off. So we tried compensating the time with more pics.

We will have a perfect replica of the original package sent to USCIS which he will send to me before my interview along with the affidavit, original documents needed then.

Thanks in advance.

Thanks for all the answers guys and the heads up.

After TBoneTX's suggestion, we expanded our answer for Question 18 on the I-129F form to included the time line of the past 4 years, how we met online and in person, the reason why it took that long for us to meet, how our communication evolved over the years, addressing the age difference issue, how our families reacted. We basically combined the time line letter suggested with question 18 since they have to read that anyway. Its about 2 pages long.

I'm wondering another thing though. For those that front loaded the initial petition, how many pages on average did you send in? What is 'too much'? Or is there 'too much'?

Ours is organized neatly, so the evidence for relationship will be at the back of the petition after the forms, letters of intent, passport photos and evidence of meeting, so it wont really confuse or clutter the package per say. I'm just wondering of the average page number for those of you that sent the petition in with added evidence and if having too much is a bad thing. And what exactly is too much. I think we're looking at maybe 150 pages here MAX as receipts for us meeting was already 13 pages. He doesnt have a back for his birth cert and its an official embossed copy but in black and white, so we're including all pages of his passport to avoid an RFE incase someone gets cranky at the center. There is also 6 months of skype call records in 2007, and 6 months in 2008, 6 months of verizon call records etc. So if they want proof, we have plenty of proof. Just wanna make sure they receive it and don't have a chance to pull the plug on everything by 'asking for more proof but not wanting to see what you bring to the interview'. I always wondered how that worked. I read the interview with the ex-USCIS guy but I'm torn between not overloading them and regretting not doing it if problems arise later.

This is the most important thing in our lives right now so we want to make sure we do it right the first time, cover all our bases and squish any problems that might arise through preparation.

Hmm, so in a nutshell how many pages on average for those that front loaded their petition?

May seem like obvious evidence you didn't include on your list, but be sure to include any and all flight itineraries from visiting each other, flight ticket stubs, pictures of passport stickers, and that kind of stuff.

Oh, I neglected to mention it because it was obvious tongue.gif

But for future reference, we are including this:

7.1 E-ticket / flight itinerary – Asiana Airlines
7.2 Flight Receipt – Asiana Airlines
7.2 US Passport Visa Date Stamps
7.3 Boarding Passes - Asiana Airlines
7.4 Paid Hotel Bill, Beringgis Beach Resort, Papar, Sabah, Malaysia
7.5 Paid Hotel Bill, Tempurung Seaside Lodge, Kuala Penyu, Sabah, Malaysia
7.6 Paid Hotel Bill, Promenade Hotel Apartment, Kota Kinabalu, Sabah, Malaysia
7.7 Other receipts
7.8 Photos of Leo and Farah in Sabah, Malaysia

We are including 35 pictures, each marked with name and date and place. Our evidence documents our every movement, theres pics infront of the hotel sign, holding the hotel keys that have the hotel name on it (was a nice keychain too), pics with staff of the hotel restaurant that were nice to us etc. We also have receipts of his money exchange in Seoul, boarding passes from and to everywhere, even a receipt for the dinner we had with my family. Receipts for when we went to the zoo, a picture in front of the zoo sign, the shuttle receipt that took us there and the taxi that took us to the hotel from the airport with the airport and hotel name on it. Included in the hotel receipts are also our restaurant receipts which we signed to our room. We both signed them so it shows our names and room number on multiple receipts along with what we ate. It worked out pretty well that the hotel had a system like that which included restaurant receipts with the main bill.

Hey guys,

Posting again. We're currently working on our K1 package but there's a situation we are unsure about.

I've been hearing that when a possible red flag is around, to front load the initial petition. Leo is 9.5 years younger than me and we've been dating online for 4 and a half years. I'm 30 and he's 21. Its never been a problem between us online because I matured late and he matured fast, so we met somewhere in between. In person there was never a problem either. We often forget about it to be honest but reading about it possibly being a red flag puts me on the defensive. Being reverse age, I'm afraid there will be discrimination. I also read that it might be a problem in high fraud countries. Is Malaysia high fraud?

Anyways, we're planning to front load the petition with extra proof of our relationship because when I went there for my tourist visa interview before, the lady refused to see any evidence I brought. So to avoid them blindly denying us without giving me a chance to show more proof, we thought it safe to just front load it so they have no choice but to acknowledge it.

The evidence we are including in the petition is:

1. Stubs of packages I sent to him from Malaysia to USA over the years. Ranging from 2005 till present. We can't find any stubs of packages he sent me.
2. Chat window and web cam screen shots taken of MSN conversations taken in 2006 (we stopped using MSN to chat after skype was discovered)
3. Skype chat windows of voice and web cam snapshots (We don't have any decent ones as of now, so we're gonna take them soon before the package)
4. His company owned video chat client web cam snap shots (all recent)
5. Long distance telephone records. Phone records from US cellular and Verizon showing a detailed bill of him calling my local SkypeIn number there and me calling him and bills and receipts of skype showing the calls I made to his numbers and the numbers I own in US.
6. Emails between us dating back from 2005 (4 each)
7. A CD-RW including videos taken when we met recently (I have heard that they dont accept electronic media but I read a member from South Korea including this and getting approved in a month, so what the hell)

Cant think of any other evidence to send. The original petition pictures of us meeting includes him with my family at dinner.

My question is, if we send this proof with the original K1 petition, will it be included in the package forwarded through NVC to the embassy? I read somewhere that they disassemble the package at the service centers and throw away what they don't need but still some people front load things. So a little confused on the matter. For those that front loaded their evidence, did it turn up at the embassy when you went for the interview? I will be bringing the originals with me but the main concern is making sure they have proof included incase they refuse to see what I bring.

Thanks in advance.

Actually now that we thought about it, its maybe better to just apply for SSN after getting married, unless the SSN is needed somewhere between entry and after marriage. Only thing I can think of is needing it for marriage license but maybe my passport will be enough.

Don't mean to hijack this thread but my plan later on is to register SSN, get married, then change SSN to married name BEFORE filing AOS as I don't want my long #### maiden name to be on joint accounts, joint tenancy, EAD, insurance and all that. I'm not sure how long it takes to change your name on SSN to married name but however long that takes is however long till filing AOS. One of the reasons why we might not make the 90 day mark from entry to adjust status.

By the way, anyone with experience know how long it takes to change name on SSN?

Another cheap alternative that documents calls, duration, date and numbers is skype unlimited country.

We've been using Skype for years but unlimited country only recently came out middle of last year. Basically, for about 6 USD, you can call any mobile number in the country of your choice (some countries only allow landlines but US allows mobile numbers) from your computer using skype. It also includes a local skype number in the country you chose so your SO can call your local number from his/her mobile which will be received as a call on your computer with local charges to his/her bill.

It says unlimited but the fine print says something like 10,000 minutes a month. Which is plenty good for 6 USD a month. In any case, my skype local number gets printed on his monthly phone bill and there is a monthly skype call history you can download and print.
