Ok I just received my NOA1 for my I-130 packet, but I don't know if I should start a packet for the I-129F or should I just wait for the I-130 to get approved? I am completely new and this and feel frustrated because everytime I call USCIS I get different information. One rep is like no you should wait because its cheapier and the other says that the I-129F is faster, but once my husband gets here we will have to adjust his status which is like $1500 or something like that. That really doesn't make sense....Can anyone please help me?

Also, if you're a green card holder, the I-130 will take years to be approved and a visa # will not be immediately available. Your best bet is to become naturalized and then have the I-130 upgraded.

Hello. I am new at this process as well, but I followed the guides. The best bet would be to turn in the I-130 and wait for NOA receipt. After you receive that, then turn in the I-129f. The fee is $355 for the I-130. Once you receive your NOA for the I-130 you won't have to pay the fee for the I-129F.

Hello All,

Right now I seriously feel like venting. I really want to know if anyone is in this position or has been. You know it really sucks being a student and in love. It kills me that financially I am not able to sponsor my husband alone. Even as a student, working two jobs (one paid internship and the other on the weekend), it really isn't enough. I wish things weren't so hard to bring a loved one here. Yes, I get it. We don't want to be allowing our loved ones to be public charges. Ugh!!!!!!!!!!!! I just wish I was at a better time in my life, (although I am happy), just wishing I was more financially stable.

Being that I will be starting grad school in the summer of 09, and will be solely taking on full-time retail positions up until that point. I was wondering if the co-sponsor has to be a household member or can it be any relative or friend that agrees to the terms? Does it look unfavorable if the sponsor is unemployed? All advice and comments are well appreciated.

Hello Everyone,

I will be sending my I-129F on Wednesday and I think that I have everything copied and ready. The only thing is I feel like I have tons of evidence that shouldn't be in there. Maybe too much isn't an issue, but I am wondering if some of this stuff should be held off until the interview. I includeed, print-outs of my tickets for each trip, emails and instant message conversations, phone call records, wedding photos, letters confirming our relationship. Should I be sending these sort of things now, or should I wait for the interview?

I called the congress womans office AGAIN today and asked them to find out why the June, July and August transfers are getting approvals before the VSC leftovers are being approved. I'm not comparing my situation to yours, but last month I made a $7000 payment on my credit card. I looked back at my online payment history...$60,000 to my continental mastercard this year!!! Because I visit my husband every other month. Not to mention having to get a whole wardrobe, toiletries, etc to keep in my apartment in Amsterdam. Even things like pots and pans...they all add up when you have to live a freakin double life!!! I feel sorry for those who are struggling making 2 rent payments or 2 mortgage payments, when they could be living together and saving that money for their future!!!

Hello, I believe the form is the I-1864 not the I-134. I thought the I-134 was for the K1. Check the guides because the one I just checked, for married couples and using a co-sponsor you use the I-1864.

First, stop freaking out! That won't get you anywhere and you say you have a co-sponsor, so relax.

Your SSI is your source of income. Yes, you will also need to submit an I-134 and state that SSI is your income and show a tax return and any other income documentation you have. There is NO REQUIREMENT that you or anyone else "have a job", you need to have INCOME (or a co-sponsor) to qualify.

If you (and our co-sponsor) have income exceeding the 125% it is NOT POSSIBLE for him to become a public charge and THAT is the point. Verifying your income for the K-1 and later the AOS disqualifies you or him from receiving public "means tested" aid. No food stamps for you for the next ten years!!!!



SSI is considered need based income and they don't count that as income on either the I-134 or the I-1864. There is a section, at least on the I-1864 in the instructions that talks about that. I think if it is not used for the I-1864 the same would apply for the I--134. I also get SSI that is not reported on a tax return. You can get a print out from social security saying how much you get each year, but disability based SSI is not reported to the IRS. If you work at all then report that, if not then you can't include it. They will go based off of your co-sponsor's information

School enrollment is not necessary - just send information proving that you still have a bona fide marriage. What about any joint credit card accounts, health insurance, policies with both your names (auto insurance, rental insurance)? Also, I didn't blank out any information on any of our forms. USCIS will have your social security number so if they really wanted to do something dirty, they could. If you blank something out they may send an RFE if they're feeling picky. Best of luck!


Thanks. As I thought about I just left it alone. I got to the same conclusion. I did send in joint credit account stuff, all the health insurance and car insurance info. Everything you could think of I sent except some of the unnecessary stuff that I listed earlier. Glad I posted this.

I dont think you need a letter for your internship or your pay stubs. don't forget to include a photo copy of his green card front and back, copies of drivers license if they have the same address...since you have an internship and he goes to school you probably do not have any 401k or anything like that! best of luck :)



I no longer have an internship. Just verifying I did and when. I work for the VA now and do have retirement plans and all of that stuff listed on my paystub.

How about Sworn Affidavit from Friends (at least 2) it is required for ROC.


I do have 2 sworn affidavits, but only from family members

Okay So we are up to removing my husband's conditions which I know is cutting it pretty short as his card expires November 7th. I am overnighting the package and sending it today with the following:

1.) Rental lease for old apartment in 2009 and for the new apartment in 2010-2012
2.) Auto insurance listing both of us
3.) Medical and dental insurance listing him on family plan
4.) Joint tax returns for 2009,2010
5.) Bank account info: joint savings and copies of transfers between both of our checking accounts to each other. Not sure if I should be blacking out the full account number and just leaving the last four.
6.) Letter from my internship in 2010 regarding finances and current letter from employer.
7.) Last 3 pay stubs for both my husband and I
8.) Mail with both of our names
9.) School enrollment for my husband (not sure if they need this)
10.) Pictures of us together with my family, don't have a lot with my friends though :(
11.) Notarized letters from family acknowledging our marriage

Don't think I am leaving anything out, but any information and/or advice would be greatly appreciated. Oh and add me to the November filers list I guess since I probably won't get an NOA until the first or so.

Hey Everyone,

I am on a sky high right now. Hubby was approved for his IR and will be getting his 10yr greencard within the mail in 60 days.....I am so excited. Man and we just called USCIS on Friday and they threw out that bull of still working on August and prior to that applications. Whatever happened in between those few days, I am all for it because someone got on the ball. Won't be dealing with immigration for 10yrs or until Aziz decides he wants to do his citizenship soon. My guess he will hold off for a while.
