You have to show a bona fide relationship in any case. Its hard to use one situation to dictate the outcome of others because you really dont know all the details of that case. The CO is looking at evidence thats not posted here by the poster. In short, if you are legitimate, not doing anything illegal, then you have nothing to worry about. Sad to say I been through this 3 times already. I made some mistakes. Rushed into a marriage. I'm not blaming anyone, but I made 3 very bad choices in women and I paid the price. But I will say this, the immigration laws in USA dont make it easy to have a longdistance relationship. They kinda make you rush into some stuff just so you can be together. Anyway if this girl dont want to be married to you or vice versa , then sobeit. You tried right? It didn't work out. If she wants to divorce you and stay here she will have a hard time getting that conditional status removed from her greencard. If she is going back then any notion that you did all this to get around immigration laws are out the window. You should be ok. Now if she is going to try to stay here and lets say accuse you of abuse, then it might come back to haunt you later. But as long as your doing nothing wrong I wouldn't worry about it.

HI All,

I need to get some help... My divorce was finalized (first wife) in May 2010. In October I met a nice lady from the Philippines, we hit it off then in January 2011 I filed for a fiance visa(I129F). She was approved in May 2011 and she arrived in the US July 2011. We married at the end of July 2011. We Adjusted her status and recently received her green card (valid for only 2 year)
She became very depressed and home sick in December 2011 and decided that she should go home to the Philippines (in Jan 2012)and we should divorce. We are planning to do a quick divorce in Nevada in January 2012...

My questions are... Is it possible for my to bring another Fiance or Wife to the US after my up coming divorce in 2012?
Will the immigration folks question this or is there a limitation for how many immigrant visa's I can get approved? I'm a natural born US Citizen.
I need to know the route I should take to bring the next lady to the US - a. should I marry her in the philippines and file for a spouse visa or b. File for another fiance visa?

In either case how long after my pending divorce should I wait to file for the next visa whether spouse or fiance?

Anyone with similar experiences(Divorce and applying for another visa)?

I am an expert on this subject sad to say. Anyway yes you can bring another AFTER you divorce the current wife. After the divorce send USCIS and NVC a letter stating that the marriage ended in divorce and you will not be filing to remove the conditional status of her greencard and you wish to withdraw your petition for her. Include a copy of the divorce decree with the letter. Then your good to go. Now also, regarding a K-1 visa, your allowed 1 within a 2 year period. If its less then 2 years since you last applied for and was approved on a K-1 visa, then you need to ask USCIS for a waiver (permission to file for another K-1 so soon). I did 1 on a K-1, she went back after 2 months and we never married. The next one I married in Philippines but after she got here she went crazy lol and she took off on me, we ended up getting divorced.

I think you included enough evidence to get your petition approved. As Ryan H said, if you wish to include any more evidence, send it to the NVC with your DS-230 package. That's what I did and I didn't run into any problems. Good Luck!!

I agree. People send additional stuff to USCIS often, but I wouldn't unless they ask for it. Bring everything with you at the interview, thats where it matters most. BocaChica is correct too, send some with the DS-230, But bring all of it to Interview at the embassy.

Once you get married you will not be single anymore and you will perfectly fit into CR-1 category. 9-12 months rather than 2-3 weeks. Any other attempt will be a visa fraud if your future wife has one.

hello, i'm a filipina and my husband is american. when we filled out forms, i listed the last name name of my husband as my last name and my maiden name as middle name, no problem. Your wife must update her passport because it would be complicated if you will use her maiden name and yet your married. What I did, I attended seminar at CFO ( Commission on Filipino Overseas) to avail that certificate of attendance which is required for renewing passport ( it is only required for those women who married foriegner). Then I asked a copy of marriage certificate from NSO (National Statistic Office). When I got them both, I made an appointment at DFA for passport renewal. I used my husband's last name as my last name and maiden name as middle name. I have now my passport using my husband's last name.

Use the current legal name regardless of what is shown on any other documents. There is also space to put other names used. That is where maiden names, nicknames, etc. are listed.

You and your buddy should sit down and thoroughly read the instructions for the I-129F. If you read and understand those instructions then you will know that you can't simply file the form without the other required forms and supporting evidence. The VJ guides are almost entirely based on those form instructions.

Except for forms and documents that require a signature from you or your fiancee, you should always send photocopies of supporting evidence. If they have any questions about the original documents then they'll ask you to submit them, but that doesn't happen often.

You have to have met her in person within the last 2 years, show evidence to prove that, like copy of your passport and photos of you and her together. You send that with the I-129F. Other evidence like affadavits from people who know you/both of you and they can atest that you guys have a relationship and plan to get married as well as a letter from you and one from her stating that you both plan to marry as soon as she enters the US on the K-1. You both need to fill up the G325a forms, one for each of you and both signed. If you or her were married before you need to provide divorce records. There are several more things, you need to read the instructions. BUT dont just mail the I129F by itself. Your wasting your time and money.

You misunderstand.

The K-1 has a validity of six months in which you must use it to enter the US. It is a one time use visa. Upon entry using the K-1, the K-1 is cancelled and replaced with a I-94 visa which is valid for 90 days. You must get married to the K-1 petitioner within this 90 days of entry or return.

This is what started off the confusion because it is not correct. I-94 is not a visa and It doesn't cancel out a K-1.

Adjustment of status does not convert any visa. It results in a green card, that is used instead of a visa. CR1 is both a visa category and an immigration status. A K1 visa holder who files a timely application to adjust status is granted CR1 status, not a new CR1 visa.

I-94 is not a visa. When you enter on a K-1 you have 90 days to get married to the petitioner. Then you file Adjustment of Status form I-485 and the K-1 is changed to a CR-1 visa.

No you wont have a problem in the future as long as you do nothing wrong and dont use the visa for anything its not suppose to be used for. Now if you want to use it and come here and with intensions of getting married to him but no marriage takes place, then you need to leave before the 90 days is up, and then still you will not have a problem in the future .

Thanks a lot for your reply. I am really panicking right now. It takes 15 working days to have my passport here and my visa expiration is on Feb 1, 2012. I was supposed to leave for the US on Wednesday (Dec 14th). :(

Bring your current passport with the missing page with you to DFA and explain what happen, maybe they can rush a replacement for you , even if you have to pay a little extra fees. Embassy wont give u the new visa until u have the new passport. Worse case scenario = U may end up in delaying your departure a couple of weeks

The MNL number will be on the letter you get from the embassy or you can call them and ask if they will give it to you but it wont be established until they get your files from NVC. You still have some time to go yet. They want originals and copies of divorce papers, they will give u back the originals and keep the copies. Read the packet they will send you or you can download it from their website, it tells you what originals and copies they require. Your on a K1 so I can tell you they want originals of CENOMAR from NSO, NBI clearence, birth certificate, passport, divorce papers if any. You can give copies of like tax returns, evidence etc.

Thank you everyone. I'm going to be attending the Interview with my fiancee in January 2012. I'm still unemployed, and will be using my Father as a Co-Sponsor. I have savings in bank and bonds. My fiancee is only 18, and I'm 23. What does everyone think? Approved? :D

And, I'll also bring an I-864 along (even though it's not required by Embassy; it may help out my case).

Your best bet would have been Marrying her there and then using the I-864 from your dad. Then I would say Approval. But in a K1 situation I'll go with a 50/50 approval/denial.

While our immigration law does not disallow joint sponsorships for K nonimmigrant visa applicants, the mere submission of an I-134 Affidavit of Support from joint sponsors is not sufficient to establish that the alien is not likely to become a public charge. :thumbs: I was going to say that the I-134 really can NOT be enforced in a court of law, only the I-864 can be. So for example, your father co-sponsors the fiancee and then she goes to the US and becomes a public charge, they cant make your father pay. But they address this in the letter that Tahoma shared.

This is consulate specific. In other countries you can get the vaccines at any doctors office. The lesson is to follow the instructions for the particular consulate you are using.

Thats very true, and a little heads up for anyone going thru this process in Manila. In Manila when you do your medical, whatever shots you dont have or if you dont have records, they give you the shots at your medical, its included in the medical fee.

It is not a general rant with the embassy. It is a question about anyone else has been surprised at the interview by the interviewer demanding items we were not told to bring. As to the little girl, you can look at her at two years old and at 7 years old and unless you are blind, can see it is the same person. In addition, she looks just like her mother. All I seem to get from this group is criticism for some reason. If no one has had this experience and how to deal with it, don't bother to post your unwanted comments. There were reasons for the wait to bring her over and we still would not if her caretakers had not died. Her mother wanted her to go to school in the Philippines but now it is not a safe situation so we are taking over.

I really feel for you guys, and I'm sorry about what is happening, but I can see the Embassy's side on this looking from the outside. A real sticky situation for everyone. The child really doesn't know the petitioner and to be frank, doesnt really know her mom either right? I mean she was 2 when mom left. My earliest memories in life start from about age 4 1/2 . The CO has a notion that maybe this little girl is not really her daughter. I mean I believe you , but you know, you have to be 110% sure. Anyway , why cant you get the DNA test done there in Manila? There's got to be a way? As far as the Embassy goes, waiting for instructions/email from them can take a month or 2. There is absolutly no one you guys can trust in the Manila area to takecare of the little girl while Mom comes home and works for a few months while getting this whole DNA test thing fixed/set-up? I wish I can help you. If I lived there I would say leave her with me and my wife, I would watch her for free even because I know its a big expense just traveling back and forth. I am about to start the process, but there is a slim possibilty I could get relocated to the US with work while K1 is going on. If this happend, I would still plan to get married as I am madly in love like most on this forum, but i would want to switch and move through my employer as I would not have to quit my job which is well paid and the visa costs would be taken care off.

Can you canel the process?
How would you do it?
How long would you have to wait before applying for a new visa through an employer?

Yes you can cancel it , all you do is have the petitioner send USCIS a letter requesting it be cancelled, include your names and reciept number.

about question 11 is referred to if he is giving you money to support you while in the US. And if it is not the case, he or she (co-sponsor) should mark NO 'cause he's not going to give you money or housing or whatever to support you.
My fiance marked NO and no questions were asked about that.

This is a weird question on that form, its confusing. I filed one of these forms several years ago for my then fiancee. I wrote on question 11. I intend to provide food, housing, and whatever money required for daily living for my fiancee.

Think about this question? Like where is the fiancee going to do , live in a car? have no support? just be on her own? So anyway thats what I put and it was approved. But the question is strange if you ask me.

As far as the name goes that will be ok. For now on leave the middle name blank and just write Lu Lu in the last name slot. Either way I dont think it matters since you dont have a middle name . I know a girl who has 2 first names and no middle name , she wrote the 2 names in the first name spot. She was ok too, no rejection.

Well I would agree with that Gary. Since this topic came up again, I went back and did research on this site and pulled up nothing significant to convnince me either way for my situation. Personally, I am only concerned with the Philippines because we all know that all Embassies are different.

I took the task of emailing and conversing with recent Visa beneficiaries/petitioners that have gone through Manila in the last six months that are now here in the U.S. They all sent money in differring amounts but the indication I got from these recent awardees was that it was a non-issue and in many cases not asked for. It's got to be viewed on a case by case and above all by the specific Embassy you are going through. The only reason I was so interested in it is because sometimes our beneficiaries need dental care, their laptop dies and needs to be replaced... if we send money and there is good reasons and you have receipts/documentation it shouldn't be an issue as long as you are balanced with much more convincing documentation.

I been through 3 interviews at Manila over the years. They asked If the petitioner provided support to the beneficiary all 3 times and we said yes and handed them the western union stuff . They barely look at it but they did ask to see proof. Thats all I can say.

The previous post of bullet points of the major events make good sense. As far as western union receipts, I think that would raise a red flag if you didn't send them. Every man I have spoken to has sent money to his fiancee.. so if you had no reciepts they would view it as
1.) You don't care enough for her
2.) You are lying about sending her money.

Neither of those assumptions are good when the petitioner makes 25-50 times more annually than the beneficiary. Some money transfers are expected.

Bring them with you to the Interview to show support. They ask to show monetary support. We brought all of ours to interview and they looked at them.

I wrote the date, who is in and where the picture was taken. But I'm not sure or think it matters if you put the exact dates. Try to atleast put the month/year to be safe.

Its really hard to say. Did you fill up a form for the courier service who will deliver your k1 visa pack? There is a tracking number on there, keep checking on the courier's website if they have a package in route to you using that tracking number. They might take a month before you hear something, maybe even longer because its Holliday season now and I think the embassy in manila is closed (limited operations) during last 2 weeks of Dec and 1st week of Jan.

Letter of Intent to Marry Upon her Arrival withing 90 days in the USA

However, I you choose not to listen about Cover to Cover Passports, Choose to not listen about sending more than one Passport Photo of each of you attached to each 325-A then do that. (Send 2) And get extras for later in the Process.
Even VJ for a 129-F does not tell you to send all this ####### for a 129-F Petition.
PS. Have fun and take pictures and save reciepts on your trip.

Color Copy of passport cover to cover is strongly advised. go to office depot etc and make several copies cover to cover. It can also establish you were there in her country to meet. ALL PAGES , even the blank ones. :thumbs:

This is what we did a little over 3 months ago and is solely based on our experience.

Your fiance should already be gathering her Birth Certificate, NBI Clearance, CENOMAR, Police Clearance if she worked overseas for more than 6 months from the country where she worked, Annulment (if applicable).


You as the petitioner should prepare I-134, employee letter, pay stubs, and tax transcripts for 3 years (you can order tax transcripts from IRS website for free), evidence of ongoing bonafide relationship, money remittance, and anything else that proves a genuine relationship, and then send it all to your fiance as she will need these things for the interview @ USEM.

You can pay the visa fee through BPI it is $350.00 but will pay in peso based on the exchange rate that day. Be sure to have your passport when paying for the visa fee and keep the receipt. Wait til the next day and schedule your interview online. You do not have to wait for the eligibility letter from the USEM. Otherwise, you will be waiting for awhile. When you are scheduling online, you'll need manila case #, passport info, and the receipt # from BPI. Give enough time in between interview date and when she plans on getting her medical done when scheduling. There is no need to schedule an appointment for medical since it is walk in. You can register through the SLMEC and fill up the registration online and this will save you an hour and a half. if you don't fill it up, they will make you fill it up on the spot @ the clinic.

A CFO sticker is needed to be affixed to your fiance's passport. If you do not have this, they will not let her board the plane. This can be done in advance and once you have the visa in hand, you can go back to the CFO office in Quirino Avenue and obtain it. Or, you can wait until visa in hand and then attend the CFO seminar and get the certificate the same day.
