I am starting to gather information to file the initial I-129F petition for the K1 visa (my fiance is in Morocco). I do not meet the income requirement on my own, so I have a co sponsor.
Do I need to include any of the co sponsor's information with the initial I-129F petition? OR Do we wait until the I-134 is requested to give the co sponsor's information?

I am wanting to give the co sponsor and idea of when we will need their documentation (like now before filing the I-129F or months from now when the I-134 is being reviewed).

I finally received my final divorce decree from my first marriage, allowing me to now legally use my maiden name. I have not yet sent my passport to be changed, so everything is still under my married name.
Now that I am ready to gather everything for the I-129F, I am faced with figuring out how to go about submitting the I-129F Petition and all followup documents. Advice is most welcome! smile.gif

Should I use my maiden name for all paperwork and EVERYTHING that requires my name (including the copy of my passport under married name), and then just send a copy of the divorce decree to the Service Center? If so, then will the entire process (including everything done at the consulate in Casablanca) be done under my maiden name?

My fiance lives in Morocco, and his native language is a dialect of Arabic, of course. However, Morocco tends to use French for business/address/etc.
On the forms required for the K1 Initial Petition, there are sections stating "If your native alphabet is other than Roman letters, please write your name/address in your native alphabet."
For those of you with fiances in Morocco, please tell me if they had to complete those sections in arabic, or if it was acceptable to leave those sections blank (as all the info is provided in the forms using Roman letters)?

The usual date format of paychecks/pay stubs here in the U.S., as being used for proof of income, give the month, then the day, then the year (MM/DD/YY), and sometimes, in rare cases it is in the format of giving the day first, then the month, then the year (DD/MM/YY). However, in conjunction with the affidavit of support, the proof of income provided is the military LES (Leave and Earnings Statement), which is basically the US Military’s type of pay-stub. The dates on the LES are in the format of year first, then month, then day (YYMMDD). So, for example, the date for today would read: 091207

Will this not be confusing to the people at the consulate? I mean, they must be able to verify that the pay stubs are recent, and they may read the format of 091207 as meaning September 12, 2007.

Have others here used the US LES as proof of income? Was the date format ever an issue?

The NOA2 was approved 08/13/09 and the packet was sent from the Visa Center to Manila on 09/17/09. As of 10/04/09 we have received no word from Manila probable due to the two Typhoons they have been dealing with.

I call the American Visa number for appointments, paid the 18 USD for a pin number and spoke to a representative. She asked if we had received anything from Manila yet. I told her no, but she said, that is ok, you have a MNL case number, when would you like your appointment? What are my choices? Anything from October 7th, on but you have to allow a week for the St. Marks medical process, so we scheduled for October 19th.

So if you are still waiting for Manila to dig itself out of the storm, you can speed up your interview process.

I'm starting to collect the information needed before I receive my hard copy of the NOA2. My question is regarding the bank statements, do I need an official one from Wells Fargo or I can just print the statements online that I can access through my online banking?

 

I had BOFA print off my main acct and I printed off the others.  Remember, do not  just send a couple of months.  Send EVERY one you have for the duration of the marriage that sahows both names or you will get a RFE like many are getting in the past few months.

I am sorry if I offended you by me not remembering. I was living in the country (Tunisia) at the time and did everything through the embassy there. Not through the mail. I do have copies of everything I did and could dig them out and let you know. I do understand it is a life altering change, as marriage is no matter where you are. Either way it was direct consulate filing. It was not a fiance visa, which is what I am pursuing now.

Having brought over a foreigner on a spousal visa, divorcing shortly after he came here, then wanting to bring another person over within months is a huge red flag. Be prepared for lots of questions at the interview, and have him bring a lot of evidence of bonafide relationship.


I was thinking it would be a huge red flag as well :( which I hate because I did not marry before with the intention of getting divorced :( But I am ready to answer any and all questions they have. Also wondering if they flat out won't do it because he is Afghani :(

Are you sure it was K-3 filed DCF? K-3 petitions can only be submitted stateside. Petitions for IR1/CR1 visas could be submitted via DCF.

Regardless, you are able to submit an I-129F for a fiancee visa.



I am not sure it was a K-3 to be honest. I just remember going through DCF. After living in tunisia for about a year.

Assalaamu Alaikum and hey everyone :)

Well, my question is, I married in Tunisia in 2009 and brought my then husband over on a k-3 visa which was filed DCF. We have since been divorced :(.

I have since met someone who I would like to bring over using the fiance visa. But can I do this if it has only been 2 years since using the k-3? Also He is Afghani but studying in Malaysia. Does this pose any additional difficulties? I will be going in April or August for one month depending on if I would be able to start the process then.

He actually has his SIV (special invitation visa) approved up until the last step...but the NVC has basically told him it could be years to actually be accepted and receive it. He was eligable for it as he was a translator for the usa military in afghanistan, and Obama has dwindled the number of those visas issued to only 50 a year..so we are thinking to stop that and go along with the k-1 visa. Any advice would be sooo helpful.

But before you can file the petition, you should register first your divorce decree with the Local Civil Registrar of Manila. With the house not having a mortgage you for sure don't need to muddy the waters with a co-sponsor, but I also think with between the pension and part time job all will be fine.

Thank you for this information. Once her feet is in the US soil. Somebody told me that the clock will stop ticking for my daughter's age once we receive the NOA1 of the AOS. I requested for an expedite for reason of aging out but was denied. Now I can relax with the age issue. Thanks again.

He filed his 2011 taxes so his part time job will show up on his tax return being he started working there in November 2011, from there it can be explained in a letter that he only started in November and then have current pay stubs and an employment letter to verify the yearly income. Havng the appraisel of the house is good but you also need a copy of the mortgage amortization to show that current balance in order to show equity.

The house is fully paid.


Your situation is similar to mine as I am retired also, but I do not have a part time job. I did bring an appraisel on the house, etc but didn't really need it.
But at least your pension is above the poverty guidelines right? By the way, I am the Filipina fiancee speaking. Sorry for putting the name of my petitioner in the account. I thought he would like to join here but he is not "savvy" according to him to this kind of forums.

Income tax time starts on January 1. However, employers do not have to send employees their W-2 wage statements until January 31. This could cause a problem because your fiancé would not be able to file his income tax return until January 31 or later.

Here is a good idea: Do not cancel your interview. I say this because you can go to your interview and submit your fiancé's 2011 income tax return and his current paycheck stubs along with the other requirements. I realize that you may not be able to submit your joint sponsor's documents at that time. However, there is a good chance that you will be approved based upon your fiancé's current sustained income which exceeds 125% of the poverty line.

If you receive a 221g at your interview (for not meeting the income guidelines), then you would still be allowed one year in which to submit documents to show your fiancé's increased income. Then you could submit his 2012 income tax return and your joint sponsor's documents. You would not have to go back for another interview, so it would save you some time.

I am not very familiar with the aging-out issue, so I can't be of much help there. If you are feeling a time crunch there, then it would be a good idea to attend your interview and let the cards fall where they may.

I am a court stenographer by profession and my daughter is in her 4th year civil engineering studies.

3. If your fiancé has any liquid assets, he can document those assets and use them to strengthen his case. Liquid assets are assets which can be converted into cash within one year. Money in the bank? Money market accounts? Retirement accounts? Submitting a professional appraisal of his house and proof of the outstanding balance on his mortgage will help if he has a lot of equity in his house.
We have the professional appraisal of the house and lot he inherited from his mom fully paid with appraised amount of 32K to 40K. No money in the bank, no retirement account, no money market account.

4. Have your fiancé attend your interview. Not financially possible.

The other thing you could do is to postpone your interview until January 2013 until after your fiancé has filed his 2012 income tax return. Then you can use his 2012 income tax return during your interview.
When is the filing of 2012 ITR in the US begins? My concern also is about my daughter's aging out. She will turn 21 in April 2013. So I need to move fast also.

I tried to schedule my interview earlier (December 10) because in case we will be approved, there are cheaper flights after the Christmas season. Flights in January is way too high and we could not afford it.

But then, again, i am very thankful for the recommendations and suggestions Tahoma. I appreciate every advise from all of you here. You really help me see the complete scenario of where we really stand with regard the CO. I already copy paste this topic to my petitioner so he will also be informed.

The joint sponsor can fill out either an I-134 or an I-864. Traditionally, Manila is looking for an I-134, but has accepted I-864's. An I-864 is a better idea because it is legally binding and it's also the form a joint sponsor would provide for you when you adjusted your status.



The I-864 must be an original, not a copy. The supporting documents can be scanned/copies.



His 2011 income will not be enough for a household of three to exceed 125% of the poverty line. However, the good news is that the consular officer will also look at his current sustained income based upon his current paycheck stubs. His current sustained income exceeds 125% of the poverty line for his household size.

I always advocate playing it safe when it comes to incomes which are close to the poverty guidelines. That's why I would recommend:

1. Attempt to submit your joint sponsor's I-864 and it's supporting documents to the Filipino pre-screener. If that doesn't work, attempt to submit them to the consular officer. There is no need for a co-sponsor as your fiance's income is adequate for a family of three, part time job or not, if he has been doing this job for a time and it shows on his latest tax return all is good. Never DO-DO when DO will DO.



He only started with his part time job last November of 2011 and he has no tax return yet for 2012 showing his part time job. We will only submit his pay stubs for the year and the certificate of employment. We have the tax transcripts for 2009, 2010 and 2011 (without the part time job yet) and we will also submit the appraiser of his house and lot for back up. I like the way you said it. What is your petitioner's household size? Count your petitioner, yourself, your petitioned children, his unmarried children under 21 years old, and any other dependents your petitioner claimed on his federal income tax return.

If your petitioner's household size is larger than three people, then I would go with the church couple who offered to joint sponsor, even though they are not relatives. An 80 year old aunt might not be seen by the consular officer as someone who would be a viable sponsor a few years from now.


We are only a household of 3. He has no dependent. My 20 yr old daughter is coming with me. I'm just worried that the CO will look at the part-time job as an unstable income so I decided to have a co-sponsor. And i will have the couple sign the I-864 not I-130 right?

Co-sponsors are always a ####### shoot with a K-1 at USEM, there is nothing that specifies that the co-sponsor needs to be a relative. If you do the co-sponsor route complete the I-864 also.

I have a 20 yr old daughter coming with me. He has no dependent. Total of 3 households. I am worried with the part time income, meaning unstable. Having a co-sponsor i think may help, for back up.

Since my petitioner has only an income of around $25,000 annually (19k for retirement pension and 6k for part time job), we intend to get a co-sponsor to be sure of an approval with regard the income requirement. We have two choices; a couple who are members of the church we belong and very much willing to be co-sponsors but are not blood relatives or the petitioner's only one surviving auntie (sister of his deceased mother) but in her late 80's, who is also willing to be a co-sponsor. Who do you think is best to be a co-sponsor? A younger couple who are not blood relatives or a blood relative in her late years? Both have enough income and assets.

Your case is simpler than you think. You are free right now. Since you are planning to pursue either a fiancée visa or a spousal visa, and since you are planning to interview at the U.S. Embassy Oslo, the issues you have raised are not relevant. The U.S. Embassy Oslo likely will require you to submit a CENOMAR. When you request a CENOMAR from the NSO, they will issue you a CEMAR (Advisory on Marriages) which will show that you were married in the Philippines. You will also be required to submit your divorce papers which show that you are divorced. The U.S. Embassy Oslo will accept your divorce. Because you are going to interview in Oslo, you will not have to attend the CFO, so you will not run into any problems regarding an annulment nor a recognition of foreign divorce by a Filipino court.

I know how to get a Consular Authentication Of Judical Divorce decree in US.
How do I use it to get NSO to fix my record so we can get CENOMAR for myself as required by civil registrar.

Why not secure a Cenomar first so you would know if your marriage is really recorded at the NSO. From there, you can start to look for solutions. If it is recorded, you can ask the NSO people what is the next move. If they cannot give you an answer, seek the advice of a lawyer. In my opinion, if your past marriage was recorded at the NSO and you were able to get married in other municipalities without the Cenomar, you will also submit a Cenomar later when you will have to file a petition for your wife.

But I am also thinking, your past marriage and divorce took place in the US and was just recorded at the NSO for passport purposes. I am not sure if the Philippine law has jurisdiction over your case. I will ask my Judge about your concern. I am working in a Family Court, we handle annulment and judicial recognition of foreign judgment and adoption cases.

I will post it here after I confer with the Judge and other lawyers about your case.

Good afternoon to everyone here, fellow VJ members. We received our NOA2 last November 4 and the MNL case number after a few days and NVC told us they forwarded our case to USEM November 11. I scheduled my medical and passed it and scheduled my interview December 10. Now I realized and asked myself, Is our case with the USE? I never got the chance to call the USEM. I am all ready with the interview together with my daughter in Monday. Have everything ready except that I forgot to call the USEM to check of our case. I tried to call the office after 4:30 and its already closed. Now i am worried.

Good day to all of you VJ members.

Yesterday (December 10) was our interview date with the USEM. Me and daughter went there at 6:30am, one hour before our interview time. At the interview, the Filipino consul told us that one copy of DS 156 of my daughter was missing. I replied I submitted complete DS forms in Window 38 and 39. He then later told me to wait for our number again. This time, with the US consul and after asking me and my daughter several questions, she encircled an entry in the paper she was holding and told me to wait for my number again. In Window 74, the guy told me that a copy of the DS-156 of my daughter is lacking. I asked him if we can download and print a copy and bring it back to him again and he said yes. At 1:00pm, we went back to the USEM with the DS-156 and the guy told me, we can go home and if there is no more problem with our documents, we can get our passport. Now, I am wondering if we are approved or not? By the way, they never asked for DS-230 but i prepared two copies each for me and my daughter, just in case.

Hello VJ members Merry Christmas! I am presently looking for a flight via Delta Airlines going to Melbourne, Florida. I want to leave on the 30th of December with my daughter. I packed three 23 kilos checked-in luggages and two 7 kilos handcarry. Are we okay with this? And what is the most that I can bring with me as money allowance? We are on a very tight budget. Another thing. When I look on the websites for flights schedules, the last leg of the flight, Atlanta, Georgia to Melbourne Florida, have no available seats. What's in there are "preferred seats". I have no idea how this works. :help:
