They will give her a form to fill out on how to deliver the passport with visa. Either it's deliver to her home address or she can go pick it up at a 2GO location.

Once inside, she will need to look on the board for her number to be called. She will go to the window and ask for her paperwork. Then she will be finger printed. They will tell her to wait again. Once her number flashes again, she will have her first interview with Filipino consulate. They will ask her a few questions and check and process her documents. (MAKE SURE SHE HAS ALL REQUIRED DOCUMENTS). If all is in order she answered all questions to satisfaction. She will then wait again for her number to flash again on the board. Then she will have her final interviewer US consulate. Consulate will process her paperwork and ask a few questions. If all is in order she will be told to wait again for her number to flash. Then she will go to the 2GO window where they will take her passport. They will give her a receipt (make sure to ask if they do not give one).

That's it for the USEM interview. You can now breathe a little easier.

Now if there is a problem. They will give a 221g form and state what the issue is. Now you will need to get them whatever they want in order to proceed. Now this is pull a long process when your in Admin Review. Look on VJ for Admin Review stories.

The following forms may come in handy:

Sworn statement that advice of parents or guardian has been asked. (for those who are 21-24 years old)

Consent to marriage of a person under age. (for those who are 18-20 years old)

Marriage applicants who are age 18 to 21 must have parental consent in writing, those age 21 to 25 must have written parental advice (a written indication that the parents are aware of the couple's intent to marry). The revised Family Code of the Philippines, which took effect on August 4, 1988, prohibits marriage for individuals below the age of 18.

U.S. Department of State link.

The quote above is from the section where they are talking about getting married in the Philippines. However, the CFO has been known to require parental advice or parental consent from K-1ers.

It's all on the Consular's discretion whether they require consent from a parent or guardian.

PhilippinesWorking permit for K1 and K2, how long?
In the Affidavit of Support, Item No. 11, there is a question there "I intend/do not intend to make specific contributions to the person named in item no. 3. If you check intend, indicate the exact nature and duration of the contributions. For example, room and board, state for how long and if money, state how much". In case my daughter and I are in the US, we will be staying in the petitioner's house. As soon as we (me and my daughter) landed a job, my daughter will no longer be dependent on us for money support. My question is this, how long will it take to process the working permit once we are there, so at least i have an idea on what to write in Item No. 11 of the Affidavit of Support. (I am (the co-petitioner) doing the preparation of documents for him (petitioner).

How can i delete this one? I made duplicate posting.

Varying opinions, i posted this in the K1 forum, not regional. And answers were: it will not affect the petition, nothing to worry. Also, the petitioner asked a lawyer and she said it will not affect. But in my opinion, it has an effect. Oh, i really don't know how things work there in the US. But thanks for replying although this is another topic.

Assets are only considered if they are convertable to cash within a year. a property, especially one in FL, may not qualify currently because houses there are languishing on the market so there is no guarantee he could raise cash by selling.

Oh my! What should we do then? But will still try.

He's going to have to get off his butt and have the appraisal done. The appraisal does not have to be certified by the state. The appraiser does have to be licensed by the state.

Thank you. I will tell him to get off his butt lol. Yes, i think so, if he is a licensed appraiser, his work need not be certified by the State. You are all a great help. Love you people!

Thank you for posting more information about your case. If I were in your shoes, I would go forward with your fiancée visa, and I would include your daughter. If you build a strong case, I think you have a good chance of approval. Here's why...

> The consular officer will look at the totality of the circumstances when determining whether you and your daughter are likely to become public charges in the U.S. Income is only one factor in that decision.

> Your fiancé has a reliable and stable income from his $18,000/year pension.

> His part-time job raises his annual income to roughly 125% of the poverty line.

> He owns the Florida house outright. While houses are not necessarily a great example of a liquid asset, it will definitely help your case. It shows that he's a responsible homeowner and that he can raise money by selling the house if he needs to.

> He owns the Georgia house (well, the bank does anyway!). Again, it shows him to be an investor and a homeowner...a good thing.

> He has a joint sponsor. While his joint sponsor is not a close relative and may not be accepted, at least it's another brick in the wall that you can build your case on-- even if the joint sponsor is not accepted, the fact that the consular officer is aware that you have one will weigh favorably on the CO's mind.

> Both you and your daughter are educated and are employable in the U.S. and are unlikely to become public charges.

In my opinion, it will be extremely important that your fiancé attend your interview. His attendance will show the CO that he's serious about your relationship, and it will give your fiancé an opportunity to make his case. Also, being face to face will make it difficult for the CO to turn him down.

Thank you so much for your sound opinion and a detailed one. That relieves me a lot. I am not sure if he can come to be with me in my interview because of financial constraints. He sold his boat to finance my expenses in this journey. We will talk about your suggestion and try to look for means so he can come over here again. Again, my thanks for being such a great help and relief. God bless!

I know they will accept the certified appraisel and probably the assessed tax value also, doubt they would accept Zillow listing.

but you should be fine as someone took the time to look up the requirement and its 3 years.

Yes and thank you for taking the time and lending a hand. I count a you people here in helping me. I am very much relieved with the answers and assurances. Thank you again.

An Appraisal from a LICENSED APPRAISER in the State of Florida. Include it in the I-134 pile.
LICENSED APPRAISER in the State of Florida - this is a particular title of a particular type of Human residing and working in Florida. The appraisal has nothing to do with assessed value for tax purposes. He must find this human, a LICENSED APPRAISER in the State of Florida, and pay for the appraisal work to be done. One of the outcomes of this work, is an issued document that is certified by the State of Florida, showing the appraised value. This document is called an appraisal document.
---
so you got the math wrong a bit, using the 1/5 rule and not the 1/3 rule. Why did you choose to use the 1/5 rule instead of the 1/3 rule?

lets see...

[step one] 23,862 <= 18000 [income] + (1/3)* 20,900
[step two] 23,862 <= 18000 [income] + 6966 [asset value using 1/3 rule]
[step three] 23,862 <= 24,966
-------

So using the house in Florida, making the assumption on the value, you can see that his income + the house gets you over the threshhold amount.

Yes? You can see that? or no ? Let me know, either way.

I got it. Very well laid. Thank you so much. I will then ask him to look for a licensed appraiser so he can have that appraisal document certified by the State of Florida attached to his I-130. Any idea how much would it cost? I guess i have to google it. BTW, I am the one preparing everything for him. I was the one who prepared the petition and just sent it to him for signing. And i am counting on the VJ'rs like you in helping me coz i really don't have any idea at all. I am learning a lot from the people here who are always there to lend a hand. More power to all of you here!

there can be other assets, besides the house, such as a savings account, stocks, bonds, etc.
his asset on the house in florida is a good asset to use, IMO, because he has TWO houses and he can show that selling it would not be a hardship on his lifestyle (no house to live in) as he's got the house in Georgia.

Since it's his asset, the 1/3 rule applies in making up the difference on the amount he needs .

study the I-864 instructions, the VO at the IV unit will use the math outlined there in computing HIS I-134.

re: current market conditions/price - nope - he needs an appraisal from a licensed appraiser in Florida.

Good Luck !

In the I-864 instructions, the multiplier is only 3 and not 5. So by 3 that means we are short of 17,586 which will be covered by the value of his paid house. Licensed appraiser.... their appraisal is what the embassy would require? Is that what you mean?
eternalcompanionMalePhilippines2012-05-06 09:53:00
PhilippinesIncome Requirement

The paid for house would probably be more than adequate, you need only to cover the difference between what he makes and what is required over 3 years (I think, not sure if it 3 or 5 years without looking it up). but I am pretty sure its 3 years so with the paid off house you should still be in excellent shape. To use the house you will need to get a certified appraisel.

Don't think I would delay with your daugther as once she turns 21 the rules change.

What document will the embassy be accepting, one from the certified appraisal or the property tax assessed value?
If we will use the Zillow listing, the value of the house which is 29,000 will meet the x5. But if we will be using the property tax assessed value, which is 20,900 for the year 2011 then we will not meet the income requirement. The household for 3 is 23,862 less 18,000 so we are short of 5,862 x 5,that's a total of 29,380. We are trying our best and praying that the visa be approved before my daughter turns 21. Otherwise, she cannot go with me.

The assessed market value in the Zillow listing is 29,000 but in the property tax for 2011 the assessed value is only 20,900. His house in Georgia is not yet paid and he has still a $75,000 balance and the assessed value is going down for this year, its 54,000, much lesser than what he owed

I have to agree with Tacoma also, the Manila embassy is very funny about accepting a co-sponsor. Your fiance is very close, http://www.uscis.gov...form/i-864p.pdf You need $18,912 for two people, if his pension is $1,500 ... with that alone you are only $912 short, his part time job should be more then enough.

I think you are good to go.

Our initial plan is to bring my daughter with me who is 20 years old, an engineering graduate. I am a court stenographer by profession. Reason why we are trying to hit the 23,800 income requirement. Can we try to take chances of including my daughter and if in the interview it would not be possible, can i tell them to forego with her. Is that possible?
eternalcompanionMalePhilippines2012-05-05 22:00:00

I would have to agree with Tahoma.......

Will his house as an asset be counted? What is the multiplier? Is it times 3 or times 5? He own a house in Florida fully paid which i asked him now to check the market value. And one house in Georgia still under amortization. But the market value of the house in Georgia is going down and is now less than on what he owed on it. The value is nose diving fast the past several years. Before its 120,000, then 79,000, then 65,000 last year and now 54,000. He owed 75,000.

What is his total monthly income, including both his pension and his driving job?

It varies because he is an "on call" driver. He sometime takes home 500, sometimes more sometime less than in a month. He works 2 times or 3 times in a week. Sometimes 8 hours but usually 4 to 5 hours. His pension is 1,500 a month. Our "would be" co-sponsor is a church member, not a relative or family who has 40,000 income.

Typically the Manila embassy has accepted joint sponsors that are close relatives of the K visa petitioner. In the past year or so, it's seemed that the embassy has been accepting more joint sponsors that are not immediate family members.

You should do more reading here in the Philippines regional forum to get a sense of what has been accepted recently.

Yes, that is why i posted here. I wanted to hear from others who had gone thru with the same situation. Since my petitioner is already 67 years old, it would be difficult for him to find a regular job. He is on a part time job of driving but not enough to meet the income requirement of 23,800 which is 5,800 less of the 18,000 he is receiving as pension. I told him to try to look for a regular job until after our petition is granted. I will be helping him when i get there.

Hello everyone. I was bothered when i read the other day, May 2, that a Filipina was denied visa because of income requirement and her ready co-sponsor documents were not accepted. I tried to send her a mail asking her how much is the income or pension of her petitioner so at least I have an idea but she has no response. I am worried because my petitioner has only an 18,000 pension and we will be using a co-sponsor. I received some advise here to go on because hers was below the poverty guideline and used a co-sponsor and was approved. Others say my chances would be very slim and should take the spousal visa. We already filed our petition last April 30, 2012. Any advise is greatly appreciated.

She has to file an adoption proceedings in court. Since the boy is a relative (her niece by her cousin), it would be very easy for her to adopt him. I am working in a Family Court and we have those cases here. There are cases in our court that petitioners are biological parents but DNA test done at St. Luke's does not match so they require the petitioners to undergo adoption proceedings. Have no idea if the doctor would state that in his medical report. Anyway, good luck to her!

Philippinesi need an expert advice
This is my advice, why don't you try going to DFA and have your passport's family name changed. You will have to bring your marriage contract, the divorce decree and the death certificate. From there, people from the DFA will tell you if these documents are enough to change your family name. If not, they will advise you to do the legal remedy. You can start from there. If they will advise you to file a judicial recognition, then its time for you to secure the services of a lawyer. Just my opinion, as I am working in a family court that handles annulment and judicial recognition cases.
eternalcompanionMalePhilippines2012-05-15 21:18:00
PhilippinesHow to Marry...
Once she gets a divorce in the State of Virginia, she can file for judicial recognition of her divorce decree in the Phils. That would make her divorce in the US binding to the Philippine law. Her marriage in the Philippines will be annulled by virtue of the judicial recognition. The process is much faster than the annulment. She can have a written interrogatories done in the Philippine consulate if she cannot come to the Philippines to testify. But she needs a law digest of the State of Virginia allowing divorce for Filipina attached to her petition. That is very important and one of the crucial documents to be submitted together with the petition for judicial recognition.

Sorry i was about to edit or delete my earlier post but i cannot do it anymore. So I am correcting it thru this one. The first one should be "No Derrogatory Record" and the second one should be "No Criminal Record". This is based on what was explained to me by an NBI chief in our locality.

But my NBI clearance and my daughter also shows "No Record on File", I would understand mine because I got hits under my name, but confused with my daughter because she has no record at all but just the same her NBI is "No Record on File".

I hope i didnt confuse everyone with my earlier posting, sorry i was not able to edit or delete the same. My apology.

PhilippinesNBI again!
This is what I got when I asked an NBI chief here in our locality regarding that annotation in the NBI clearance and this is what his answer was: The "No Record on File" shows that you have no criminal record at all, meaning you are clean from any criminal record since your birth. The "No Criminal Record" shows that you had previous cases before but was terminated or dismissed already. This one needs an explanation or sort of affidavit of what kind of cases did you have before and how it was terminated or dismissed. I helped one of a friend of mine regarding his work visa in Canada, and he has previous cases of vehicular accident cases way back 70's and was dismissed already. We prepared an explanation or affidavit of the circumstances of that case and how it was terminated or dismissed. His NBI clearance has "No Record on File" annotation. I hope this would help you.

PhilippinesMy 20 yr old daughter K2
Update of our request for expedite on reason of aging out. We called the National Customer Service Center last week and told us we will get the reply to our request thru email after 5 days. 5 days had passed but no email so we called again today and informed us it was DENIED. The reason the lady gave us is we have enough time to process, as our petition will be approved by October as per their processing time.

You will get your approval around the end of october should you not receive any RFE's it will take about two weeks from that point to have your paper work shipped to the NVC in washington DC whom will give you a case number and then forward it to the embassy in manila after that you will have to under go the st luke medical and then the interview at the embassy if that all goes well it should take about 6-8 weeks so all told from the month of may your petition should be approved and your interview done in manila around 7 to 9 month from the month of may when you turned in your paper at the vermont service center that should bring you to february that only leaves you two months to get your daughter AOS papers in to the chicago
lock box so you must move very fast and be very very good at all of your paper work no mistakes can happen or she will not be able to go with you if she misses this opportunity should you have to put a i 130 in for her it will take her over a decade to get there so be very carefull about how you fill your paper work out and make sure you push to get your interviews on time and also write the uscis and tell them your story and ask them to experdite your case because you have a k2 child that will time out if they dont move fast on your case call vermont service center and ask to speak with a terr 2 manager and tell them your story or she will lose her opportunity to be with you Good Luck should you need more info on this please feel free to write me

Can you kindly give me the number of the Vermont Service Center so I can tell my petitioner to call and speak with a terr 2 manager? Appreciate very much your help.

PhilippinesMy 20 yr old daughter K2
My question is about my daughter who is 20 years old and listed as my K2 and will be 21 in April 2013. I am a May 2012 filer of I-129 petition. Will she be able to come with me in the US just in case my visa is approved. I am just confused from what I read in the CFO where the age for children is up to 19 only ".... The Peer Counseling Seminar is a special session for those with ages 13 to 19 years, which aims to prepare them emotionally for the adjustments they will have to take."

Please enlighten me on this. Thank you for any information that you can share.

PhilippinesExpedite Request
I read from past postings here that "aging out" of a beneficiary's child is one of those consider in granting expedite process of K-1 petition. So i thought i can request one based on that ground. And i did, but was denied. I believe i dont have much time if my petition will be approved by October, since from there I only have 5 months left. I will have to undergo medical and interview and the whole process until the AOS and NOA1 to the Chicago Lock Box. Exact approximate time without delays.

PhilippinesExpedite Request

If the petitoin is back in the US it is in the review cycle and it is doubtful that you will get it back to the embassy and an interview veru quick. When does your daughter age out ?

My daughter will turn 21 April 2013. I am a May 2012 filer so probably October 2012 I will receive our NOA2. Can we call again for a reconsideration? Is that possible?

PhilippinesExpedite Request
Hello VJ members, we called NCSC and requested for an expedite processing, for reason of aging out of my daughter. It was denied for reason we really don't know. They said it was emailed to my petitioner, but nothing in his email. My question is, is it possible to ask for a reconsideration of their decision. I asked my petitioner to call again NCSC and explained it again in full details our reason. And ask the help of the congressman or the senator in his State. What's on your mind?

PhilippinesCorrection on Birth cert. NBI clearance and CENOMAR affected?

hey guys its late here in the Philippines now but Im still up and damn WORRIED upon knowing that corrections on birth certificate could mean I will need to have my NBI clearance and CENOMAR have my previously misspelled name and my corrected name on them. I have heard I could get a 221g on my interview if I will only bring an NBI clearance and CENOMAR under my CORRECTED NAME. Things like that here in PI aren't that easy.. Employees in gov't offices can be very mean and bastards sometimes so I have no idea what to do. Can someone who had the same situation before help me?

In getting NBI clearance, can I request for a clearance having my corrected name together w/ aka my previously misspelled name? ex. jane cruz aka jean cruz?

About the CENOMAR, i made an inquiry online a while ago and they told me it wasnt possible to have a CENOMAR w/ aka on it. So what should I do? should I request for two copies? One w/ my corrected name and one w/ my uncorrected name?

Oh boy, I need help badly!!! Im freaking out though we just had our petition approved... I just dont want to have any delays coz we've been waiting to be w/ each other for years!!! so a few delays will be very UPSETTING!! :help: :help: :help:

Yes you can get an NBI with your corrected name and with an AKA. About the CENOMAR, as they are not issuing with AKA on it, your NSO copy of birth certificate with the annotated correction will do. Just my opinion.

PhilippinesWork clearance
Hello VJers. This question is for ladies who had gone through this situation. I am in the government service. I have not decided yet if i will retire or just take a leave once my K1 petition and visa are granted. Will the US and Philippine immigrations ask or require clearance from my employer?
