K-1 Fiance(e) Visa Case Filing and Progress ReportsJune 2012 Vermont Filers

Same boat here. I was excited to see this one! I keep looking....like multiple time a day.....at the lists of approvals and USCIS website. I was also hopeful we could be together by Christmas or New Years, but we had no idea what we were getting involved in.

Anybody have wedding plans? tenative timelines?

Have everything ready for the next step? Police Certificates, Tax Returns ready, vaccinations, etc?

I'm way to antsy!!

Haha I already bought my dress. When my mom and I went looking around for wedding sites they advised us that everything but the dress could be done rather fast! I never thought I would find my dress at one of those "on the rack" dress shops lol

Hi everyone!

I am an Early June NOA1 and the WAIT is killing my fiance and I.
We were hoping to have our GRAND wedding early next year, but with the processing time taking so long we have no idea if we will be able to (T-T)!
In addition, since we have not see each other since April we have been slightly going crazy! Especially me since I check our status about 3 times a day lol.

K-1 Fiance(e) Visa Case Filing and Progress ReportsNOA 1 June 8th Vermont Center and nothing yet

My NOA1 is June 14th... As everyone else, I am tired of seeing, "Initial Review",... When I sopke to tier 2 and asked to put in a service request, they denied and said they no longer use the 5 month mark as a processing time.. She suggested I call back in 2 months... So I just wait and work all the extra hours I can...

OMG she actually said wait 2 months!! That is seriously scary news

Hello all, received my NOA1 on June 8th my application is in Vermont...and still nothing yet,,,so stressed, my fiance is from Costa Rica , and we are in the dark wondering why it takes so long. I have seen other posts that havent taken as long, is there anything we can do? FranknKaren thanks

I am in the same boat! My NOA1 was on June 7th and no word yet. This long wait is killing me since I have not seen my fiance since April and I doubt I will be able to see him until the entire visa process is approved because of the cost of a plane ticket/ work conflicts (T-T)

I would give them a call to do a service request! My NOA1 was June 6, 2012 and I call having a fit about being over the processing date. They put in a service request, and what do you know around 5PM the same day I got a message stating my case has been APPROVED!!!

My only advice is to just hang in there!!

My long 8 month wait to hear about my fiance's visa is finally over! Now comes the interview portion... and if my fiance is rejected after us being together over 5 years there is seriously a problem with the system lol!!

Does anyone know what we are to expect with Japan embassy?
Also what types of paperwork do we need to start collecting?

I am worried that since I am starting a new job, we could face a bit of trouble during the interview process (T-T)

K-1 Fiance(e) Visa Case Filing and Progress ReportsGot Visa ... leaving country on the 7th

I came through Philadelphia, they were scary!! Been through Chicago airport before and they were a lot more laid back (but this might depend on the person) hopefully they're all that way though.

We haven't put together any yet!) I think you apply for SSN after you're married! I should probably look into all this (have a small baby so getting things done doesn't happen much!) I'm pretty sure it comes after marriage though.

Thank you so much!! Congradulations BTW!!!

K-1 Fiance(e) Visa Case Filing and Progress ReportsGot Visa ... leaving country on the 7th

I came to the US on my K1 Visa last month, he just needs the big packet that the embassy gave him and his passport with the visa stamp inside... also, depending on which airport he's flying into, he also needs to be prepared to wait at immigration. I waited a loooong time just for them to stamp me through...and I missed my next flight cos of it sad.png

Congrats btw!

Thank you so much for the information. Do you mind if I ask which airport you came through? My fiance is coming from Japan to Chicago's O'hare airport.

Also, is there any paperwork I should be putting together now? I know I saw something about 10 days to file for SSN.

I want to double check what everything he needs to enter the states! I know he has the packet, a valid visa, and his birth certificat- anything else? Also, what paperwork should I start working on to start everything he needs once he is in the states?

I know if is a lot of things I am asking about, so thanks in advanced!!

K-1 Fiance(e) Visa Process & ProceduresCan someone help me??

Hello

This is my first time posting. I just have a general question that hopefully someone can answer for me. I have a thai fiance who is visiting me right now in california. She is over here on a tourist visa. I do not know much about the visa process. I was planning to fill out all the paperwork and send it in to get married, but my fiance was talking to one of her friends today and her friend told her that since she is already over here on a tourist visa, then the only thing she needs to do is to go get married and then change the visa?? Is this correct? All feedback is appreciated.

Start now by downloading all packet 3 forms for a fiance visa. Start collecting all information requested in these forms. Take pictures of each other and save airline tickets etc. (proof of meeting in person). She will need to take this information back with her to the Bangkok Embassy eventually. Make copies of everything!

This is the fastest, easiest, legal, and most honorable thing to do. You will find everything you need on this site. I did this with my wife and the time went by very fast. Contact me if you need my help, or go to the "Sawasdee 2" topic and ask.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestions about Adjustment of Status. I-485?
QUOTE (YuAndDan @ Aug 21 2008, 12:09 PM) <{POST_SNAPBACK}>
CR-1 visa holders ARE immigrants, they get a GREEN-card that is valid for 2 years, UNLESS they are married longer than 2 years BEFORE entering the USA on the visa, if they are married longer than 2 years before green-card is issued, then the card will be a permanent 10 year card.

Immigrants DO NOT file I-485, I-485 is only used for persons adjusting status from NON-IMMIGRANT to Immigrant in the USA, that is typically a person entering the USA on a K-Visa or some other visitor's of NON immigrant visa.

You are talking about removing conditions on the CR-Green-card, this involves filing an I-751 within 90 days before the card expiration NOT 6 months.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestions about Adjustment of Status. I-485?
Hello Everyone,

I have a few questions and hope you can clarify them for me.

My husband entered USA on March 29, 2007 on a CR-1 Spouse Visa. He received his green card a month later. I heard somewhere that you have to apply 6 months before the expiration date on his green card, which it will be on March 29, 2009. Is this true? When am I supposed to file for the Permanent Residence green card?

• Is form I-485 the correct form to file for a permanent resident?
• Do I send form I-485 together with Biometric G-325A form and Affidavit of Support?

If anyone has gone through this process or can help me, I would appreciate it a lot. blush.gif

Thank you

IR-1 / CR-1 Spouse Visa Process & ProceduresPlease Helpgetting married and filing for the I-130
Hello Everyone,

I have a friend from Hungary; he is an international student, actually just graduated. He wants to marry his girlfriend however does not know how to go through with the process or what he is allowed to do while living currently in USA, and neither do I.
My questions are:

Can he get married here in the USA? I am asking this due to the fact that he is an international student who actually finished school. He is looking for a job right now.
If can get married, can he apply for the I-130 here in the USA without being sent back to Hungary.

Please advice me in anything you can. He is my best friend and I myself am going through a lot with immigration from Albania and I don't want another couple that I care about to go through the same thing. :help:

Thank you so much for any replies you can give me.

IR-1 / CR-1 Spouse Visa Process & Procedurestravel to Germany
Hi Everyone,

I looked into this and I got very different informations. My husband is a legal resident (green card holder) and he wants to travel to Germany for about 10 days to visit his sister. Do you need a travel visa for Germany if you are a legal resident in the United States. I looked into the website of German Counsular service and it seems that you need a visa and they require a lot of things to get this visa. Health insurance, employment letter and to have a certain amount of money in the bank. However, I am hearing from different people who have traveled overseas with a green card and they keep telling me, my husband does not need a visa if he is a legal resident. I am planning to call the German Embassy here but I wanted to hear from you as well.

I would appreciate it a lot if you know anything more.

Thanks a lot

K-1 Fiance(e) Visa Process & ProceduresI am worried, please advice
Hello Everyone,

I have a question, and I apologize if I am not clear about it, this is the only information my sister has given me. My sister's fiance came to the United States on K1 on April 4, 2007. On May, she got married, however she just noticed that on I-94 it shows May 3, 2007 and his passport shows September as the exp. date.
What does the "May 3,2007" on I-94 mean? When my sister went to get the employment letter for him they told her she cannot have it because of the exp. date on I-94. She is filling the AOS for him currently but is worried about I-94 saying May 3, 2007 as the return date.

I would appreciate any advice or information you can give me.

Thank you

Good Afternoon!

I have a question about sending regular mail to Morocco. I have sent two letters via regular mail to my fiance. (I dropped it off at the post office just to make sure the postage was accurate). I sent one to the address at his apartment and one to the address at his family's house, around the end of April and the first of May.
Both letters were never received. I did not get them returned back, which makes me think they at least made it into the country of Morocco. Both addresses are in French using Roman Letters. I thought maybe I just did not format the address properly, being that it was going to another country. So this is how I had the address written (not the real address, I just made up the street name & #s hahaha):

Name of my Fiance
Rue El Frog Appt #1 Imm #1
Pepiniere Frog
11000 Sale
Morocco

From now on I plan to send everything to my fiance via DHL, so we can track our packages. But I was just wondering if I am the only one who had the "mail never received" issue.

Everything I have sent to my groom made it to him in varying amounts of time...EXCEPT our first anniversary card...which of course sucked! You have written the address correctly except maybe the state...46300 Youssoufia, SAFI.....which I don't think would make a difference.....I do think the tangible things are important for them at their interview. So, I would keep trying. How much is DHL???

DHL is a little expensive, but I always believe that paying extra is worth the peace of mind. smile.gif Tell me about the state...Morocco is divided into states? (wow, I feel stupid asking that. HAHA) My fiance lives in Sale. I have seen people write something like "Sale / Bettana". Could Bettana be the state?

THanks!

IR-1 / CR-1 Spouse Visa Process & Procedures287 Days for AOS Approval
The AOS package was received 01/05/2010

Our AOS interview was 04/12/10 in Orlando, Florida with an RFE which was fedex'd and delivered 04/29/2010.

On August 3, 2010 I contacted the USCIS Customer support number and asked why my case was 7 months and holding. USCIS sent me a letter with the type of service requested (Outside Normal Processing Times).

The letter stated, "Your case is currently under review. You should receive a decision or notice of other action within 60 days of the date of this letter."

On October 4th, 2010, I contacted the USCIS Customer support number and asked why my case was 9 months and holding.

Tier 2 USCIS said they would inform the office to update the file.

On October 5th, 2010, I started an INFOPASS appointment for October 18,2010.

On October 18th, 2010, We spoke to a person in the main lobby (did not get to speak to our interviewing agent) sitting behind a cubicle and he admitted that it was too long to process and he would speak to his supervisor. He stated we should now leave and check the USCIS website for Status.

October 19 2010 10:19 AM, Received email approval for the I-485.

I wonder if 60-90 days could have been shaved if I used INFOPASS in the beginning.

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling in Different country

OP, when the time comes for you to fill out the I-130, you will list his address in Malaysia on the form. Also, on question #22, the two lines on the right hand side of the forum, you would write Kuala Lumpur, Malaysia. You will send the completed I-130 and accompanying documents to the lockbox based on where your residence is (Chicago or Phoenix).

Thank you so much :) I am very excited but nervous at the same time! The usual feelings I suppose

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling in Different country
My fiance and I have decided to go ahead and get married and go for the CR1 visa. However we are a little confused where we should file when the time comes. He is an Afghan National but residing in Malaysia while attending University. He will be there for the next 2 years and this summer I will be going there to marry and will stay in three month increments (to keep my USA residency) But we are not sure if that means we should file in Malaysia? Or will he need to travel back to Afghanistan for the process? I searched through the forums but maybe didn't use the right key words because I couldn't find anything.

Thank you for any advice you may have

PhilippinesPETITION APPROVED, NOA2 (K1)

Now things will move MUCH faster (if you so choose)

Here is some (hopefully) helpful links and info:

For the NVC:

Check on your embassy case number:

Give them 7 - 10 days before calling. Call after 4:45 PM eastern time for shorter wait times K1's are not tracked through the AVR, ever. They are processed like an immigrant visa, but they are NOT immigrant visas, so they fall into a completely different class of their own. Therefore you need an operator. To get there:

1-603-334-0700 Operator assistance is available Monday through Friday from 7:30 AM to 12:00 AM (Eastern Time)

Press 1 for English
Press 5 for an operator

NVC CONTACT INFORMATION:

Website: www.immigrantvisas.state.govwww.immigrantvisas.state.gov

E-mail: NVCInquiry@state.gov (I found NVC to be very quick responding to emails)

REQUIRED SECURITY INFORMATION:

You are required to provide the following security information with each inquiry to receive a case specific response:

* NVC Case Number or USCIS Receipt Number (Place in the subject line of the e-mail).
* Petitioner's name and date of birth.
( NOTE: If the visa petition is employment-based, include the employer's company/organization name instead of the petitioner's name and date of birth. )
* Principal Applicant's name and date of birth.

Manila Embassy:

NOW THAT YOU HAVE YOUR MNL # (don't need to wait for the letter from the embassy )

(NOTE: When getting NSO certified copies of your Birth Certificate get 4 - 6 extra copies for bringing to the States with you. You will need them from time to time)

http://manila.usemba...v/wwwh3023.html

Once you have your MNL # :

You can pay your nonimmigrant visa application fee with cash or debit card at any Bank of Philippine Islands. Before going to the bank, you must print the applicable U.S. visa application deposit slip available below on this page. Take the printed deposit slip with you to pay your fee. If you print a deposit slip in advance of the day in which you plan to make your payment, please take note of the expiration date on the deposit slip. If the expiration date passes prior to using the slip to make your payment, simply return to this site and re-click the appropriate link below to generate a new deposit slip. Bank agents will NOT accept payments based on expired deposit slips. Upon receiving of your payment, bank will issue you a receipt. Save your receipt. It cannot be replaced if it is lost. You will not be able to schedule an appointment without your receipt number.

http://ustraveldocs....paymentinfo.asp

Select the deposit slip that matches your visa application fee from the list below. Values are shown in U.S. dollars and native currency. This page has more information about the different visa application fees.

http://ustraveldocs....visafeeinfo.asp

For K-1 the fee is $240

After you have paid the visa application fee, keep the BANK receipt for your records. It cannot be replaced if it is lost. You will not be able to schedule an appointment without your receipt number.

If you have an account with either Bank of Philippine Islands (BPI) or BancNet you may choose to pay your visa application fee online using their online bill pay services. Click on either of the links below if you are a BPI or BancNet customer and wish to make an online payment.

If you are paying for more than one applicant, please DO NOT make a lump sum payment for all the applicants. A UID/receipt number is required for each visa application fee payment for EACH applicant for scheduling an appointment. After you have paid the visa application fee, please keep the fee receipt for your records.

Receipt Format

Note: If you have a Bank of Philippine Islands receipt, your fee receipt number should be your passport number. If something other than your passport number appears in the circled area on the graphic, use that information as your receipt number. This receipt number verifies your payment and allows you to schedule your visa interview

When scheduling online with the embassy you need to use the receipt number as shown on the payment receipt from BPI.

Priorty Date; this is the date the NOA 1 was accepted.

Make sure to print two copies of the interview confirmation page as you will need one for St. Luke's and the other (maybe, they might mail the interview letter) for the embassy.

Required documents & "OTHER DOCUMENTS" they ask for at CFO: copies of; CENOMAR, certified birth certificate, bio page of passport, visa page from passport, pictures together. From USC - bio page of passport, birth certificate, divorce decree (if been married before) are the most common requests. The "other documents" clause can be ANYTHING with those nit-wits at CFO.

** From the Family Code of the Philippines: it's 21-25 years old for advice and 18-21 years old for consent. (Some are posted on VJ that they were not asked for this, yet others have been asked, so be prepared)

PhilippinesPhilippine debt
There are two kinds of cases filed with debts. Depending on how the debt was incurred. There are criminal and civil cases. Criminal cases such as estafa, bouncing checks if he issued the same, are criminal actions where warrant of arrest are issued depending on the amount of debt. There are also debts filed as civil cases where no criminal liability is involved. This would not prevent someone from going out of the country. After the civil case is decided all the sheriff can do is collect the money from the debtor, if he has nothing to pay, his property will be levied or auction. Hold departure order are issued in criminal cases. But most of debt problems are resolved out of court, thru compromise agreement. Most companies in the Philippines would always prefer to enter into a compromise agreement rather than pursuing the case, as they know it is a long process and would take a lot of their money. I hope this help a little.

They will give her a form to fill out on how to deliver the passport with visa. Either it's deliver to her home address or she can go pick it up at a 2GO location.

Once inside, she will need to look on the board for her number to be called. She will go to the window and ask for her paperwork. Then she will be finger printed. They will tell her to wait again. Once her number flashes again, she will have her first interview with Filipino consulate. They will ask her a few questions and check and process her documents. (MAKE SURE SHE HAS ALL REQUIRED DOCUMENTS). If all is in order she answered all questions to satisfaction. She will then wait again for her number to flash again on the board. CFO link.

The following forms may come in handy:

Sworn statement that advice of parents or guardian has been asked. (for those who are 21-24 years old)

Consent to marriage of a person under age. (for those who are 18-20 years old)

Marriage applicants who are age 18 to 21 must have parental consent in writing, those age 21 to 25 must have written parental advice (a written indication that the parents are aware of the couple's intent to marry). The revised Family Code of the Philippines, which took effect on August 4, 1988, prohibits marriage for individuals below the age of 18.

U.S. Department of State link.

The quote above is from the section where they are talking about getting married in the Philippines. However, the CFO has been known to require parental advice or parental consent from K-1ers.

It's all on the Consular's discretion whether they require consent from a parent or guardian.
