IR-1 / CR-1 Spouse Visa Process & ProceduresG-325A QUESTION!

Hi everyone, I`m sorry for the possible dumb question but what should I put on form G-325A when it`s asked "This form is submitted in connection with an appication for: Naturalization ; Status as a Permanent Resident or Other: (Specify)" for the Petitioner and for the Beneficiary?

Thank you!

Put the petition that you filed in there.. for example.. if filing for fiance visa.. "129-f, K-1 fiance visa petition".

better?
They are for specific circumstances..one if you are married, the other if you are planning to marry... if you are married, you cant file K1.. the CR1 is easier after POE than K1...

IR-1 / CR-1 Spouse Visa Process & ProceduresDo I NEED to attend the interview process?
Going to the interview and being able to attend it are two seperate things... You can go to the consulate, but many times only the beneficiary is allowed in as they dont like to manage two people at the same time....

The bigger question would be if you would be allowed into the specific UK consulate..

IR-1 / CR-1 Spouse Visa Process & Proceduresomg these operators r not transfereing me to supervisor???
I talked to my congressional rep last Friday.. They were in a conference with NVC and USCIS all last week and one of the topics was the front line CSR's managing the customers(us), not going off script and dealing with cutomers at that level... it could have resulted in a more difficult time trying to get escalated...

IR-1 / CR-1 Spouse Visa Process & ProceduresPlease update your timelines and not just your profle "signature."

There might be a better fix for this. One solution I can think of would be VJ.com sending emails every month to all user who have opted to have a timeline. Each user then will need to follow a special link. They will need to click on one of 3 options:
(1) There was no progress yet on my case, I want to continued to keep my timeline.
(2) There was progress on my case, I want to update it
(3) I am no longer interested in VJ.com timeline, and I would like it abandoned.
Based on the answers above and other criteria, and of course some programming logic, I think the timelines can be made more accurate.

Ewok sends email regularly... some people go to visit loved ones and dont have internet access for long periods of time....

As long as the cosponsor meets the income requirements it should not be a problem unless you are really unlucky and get a tool of a CO that feels she may be likely to become a public charge... odds of this happening IMO are low... should be fine with Pop's in the equation

IR-1 / CR-1 Spouse Visa Process & Proceduresvisa denial
Some bad info provided in this topic... there are a great many reasons that the CO can deny a case, real reasons or ones they made up... depending on the consulate I would be affraid that the CO wasnt having a bad day... or that the translator didnt like the applicant...

Best advice is to become familiar with the consulate, its requirements and be as prepard as possible... have everything well organized.... dont let the CO's questions rattle the spouse... dont be surprised if the questions become what many would consider inappropriate...

Given that the misperception on Indigo's part has been identified and resolved.. the name of this topic is so misleading and can cause noobs to possibly freak out for no real reason... there is no documented increase or decrease in approvals at this point...

only a documented increase and decrease in the volume of case processed from one month to another

IR-1 / CR-1 Spouse Visa Process & ProceduresA significant reduction in I130 approval
The data you have, only shows you the volume coming into the system and being output by the system. There are fluctuations in applications over time as are there fluctuations in processing.. We all saw the push last year which is evident by the data... there was a report out there last year with more data, I would have to spend the time to find it again as I dont remember its exact location, but it says how many petitions are pending by category... I just tried looking for it but no longer see it there..
If I come accross it I will post the link.. it included input, output, pending and denied... by qtr..

They don't like to show denial or reffusal #'s.... DOS has been really good lately showing their throughput, but dont show refusals much either...

IR-1 / CR-1 Spouse Visa Process & ProceduresA significant reduction in I130 approval
You may be missing something here...

Not sure why you would be concerned with them having more NOA2's than NOA1's in the past year.....
It goes to show that they have reduced the number of pending applications over the past year... its a good thing... it goes to show that they have been working to reduce the lag in the past year since they instituted the 6 month guidelines...

Let me clarify this for you.. they had 280,282 NOA1's in the past 24 months and issued 532,533 NOA2's or completed over 500k cases.... working much harder in past 12 months...

Applican'ts employment last 5 years. List present employment first.

Company A: 11/2006 (should be 2005) -- Present

9/30 is one of the worst days of the year to have an interview.. it is the last day of the fiscal year.. they are not thinking about your case on that day.. they are thinking about all of the loose ends and reports that must be addressed.. it could just be a delay due to the end of fiscal..

For sure there is no level playing field... when it comes to how they handle cases.. its like throwing dice... or like Mr Gump says.. "like a box of chocolates.. you never know what you'll get"
DoS# 202-663-1225 press 1 at the first message and then 0 after the next prompt... this will get you in the queue to a live person.

The consulate wont get the file until after the date has already been sent If I remember correctly... Getting info from the consulate via email is like leaving a bar and asking a stranger for a ride to your house.. the odds of getting what you want from them is slim to none... the usual response is a copy paste standard response..

The folks at DoS are friendlier than NVC IMO.. usually easier to get a little info from them than NVC...

She will not interview at the embassy.. That is in HaNoi and they dont do family immigration there.. only at the consulate in HCMC.

Its too late to frontload your petition.. I tried to do what you want to do and the info never got put in the file but was recieved by USCIS.... its a waste of time and $.IMO.

on another note.... if it did make it to the case folder, by the time the file gets to HCMC, the CO may see the late addition and wonder why are you adding more info.. is there some issue in the case that you are tryng to compensate for...

all you can do now is get it together with the interview paperwork and hope they look at it... they are well known for not accepting evidence or even looking at it at the interview in HCMC...

IR-1 / CR-1 Spouse Visa Process & ProceduresCase Completed, waiting for Interview date
Great news on the case completion.. dont look forward to a Dec interview given how slow HCMC has been lately... it will happen, just that it will happen when they decide... this is a tough time of year since there are so many holidays and many CO's may be taking time off to go home for the holidays and limiting the number of CO's working.. And HCMC has another new year holiday a few months after the US one that will be observed as well.. just another reason to take time off of work...

IR-1 / CR-1 Spouse Visa Process & ProceduresConsulate Question
At the consular stage they can say what they want when it comes to them getting the "hard copy" of the file.. I had the date that our case was sent and tracked it knowing when they got it.. it was several weeks later before they admitted they finally had it in hand... in any case, they will eventually get it and log it into the system as recieved... If you call the DoS # they will be able to look in the system to see if the hard copy has been logged in at the consulate...

IR-1 / CR-1 Spouse Visa Process & ProceduresHow soon can you gather/request certain documents???
Birth certificates dont expire.. Police certs do.. usually 1 year from the date it is issued and its a consular time limit not generally stamped on the doc, but there are exceptions at some consulates as they may limit it to 6 months or less..
the medical results is another timed document and that can be a pain... dont put these off to close to the interview but make sure they can be obtained before the interview and that the visa isnt held off because a doc is missing...

IR-1 / CR-1 Spouse Visa Process & ProceduresHow to obtain history of getting out and in U.S?

I met my fiancee in 2009, but I didn't love her until I met her again in 2010 in VIetnam. So, I wasn't planning about the engagement in 2010. I didn't keep the boarding pass in 2009 but I did keep all the boarding passes in 2010 though. I also have invoices and statements that I paid for my plane ticket in 2009 and I have a letter from Vietnamese authority to prove that I did live temporary at the address near my fiancee where she worked in 2009. However, I'm afraid it maybe a little weak in evidences there.

check your passport again.. the guys at immigration in VN are not one to miss putting a stamp in the passport.. if you tried to leave without an entry stamp they would likely give you heck......you will have one when you enter VN and one when you leave... usually the page opposite the visa sticker..

Answer the phone every time and be polite with them.. likely was someone from NVC doing a check.. I got a call from NVC asking for my ex.. they denied who they were...
When we were in AP @ HCMC they called me at 11PM and asked a bunch of questions.. initially would not say who they were but when I said I need to know who I am talking to at that hour and about the questions being asked.. they fessed up..
They downright lied when they called my MIL...
They can call at any stage of the process... if they call its because they need to find out something... If you ignore them.. they wont find out what they want and it could end up costing you a great deal of time waiting for them to get the answer they want...
