IR-1 / CR-1 Spouse Visa Process & ProceduresHow long until interview date?
You are not seeing CR1 CR2 IR1 or IR2 dates for HCMC... A bunch of us are waiting... I expect an email this week with a date mid late oct... if the queue waiting At NVC isnt longer than the list of dates that they send from HCMC then you should get one too.. if not, then they say its another month of waiting.

All of this have been sent and paid since August. They received the package on August 13. I was wondering how long do you have to wait to get a interview date? It has been 1 month and I haven't heard anything.

ours was sent a month before yours and we are still waiting for a date.

IR-1 / CR-1 Spouse Visa Process & ProceduresI got a call from NVC?
NVC does make calls from time to time. they called me as well as my ex. if anyone is going through the immigration process and a call comes from any DOS number it is advisable to answer the call. They don't call just to see how your day is going. They may have had some advice to help you in the next stage related to the RFE. At this point nobody will know why they called. They dont call to say case complete.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat are "CORRESPONDENCE INSTRUCTIONS"?

My wife and I have our CR1 visa interview in a couple weeks. However, I'm uncertain about something in the document list at the end of the appointment letter from NVC. In the left column is the name of the document and in the right column is a letter indicating document status. The first document in the list is "CORRESPONDENCE INSTRUCTIONS" and the status is C, indicating that we should ask the consulate for instructions about this document. Unfortunately, the inquiry section of the consulate website only allows you to choose from a drop-down list of questions. There is nowhere to type in a question not on the list.

Can anybody tell me what "CORRESPONDENCE INSTRUCTIONS" is?

the only correspondence with the consulate from you will be via the online form, hand deliverey, or by mail. They may call or send mail, they rarely email. All the info you need is at the website.

I was looking over the material I sent and I think I may have accidently only sent one page of the g325A per person along with the I-130. What do you think I should do, call them? just mail it in now along with the noa1, wait and see if I get an RFE? I can't believe I did this...

Brandon

Well you have 2 choices, go ahead and send them a complete (4) pages of the G-325A form for petitioner and beneficiary with copy of NOA 1 and explanation letter. or wait to see if you get a RFE. I did something simular, I did not enclose my Registured copy of marriage license, when I found this out, I sent them my registured copy of marriage cert . with NOA 1 and explanation letter, and I did not get RFE on this, but on another matter. I THINK they matched it up to my petition, and why my RFE did not pertain to my mistake at time of originally sending them my petition.
Its worth a shot, all you lose is the price of postage, and may save you a RFE. Calling them will not help.
Best wishes! But for extra insurance I did send them again my registured marriage cert. to keep from another RFE. LOL

Wow! Good to know! I always assumed that they would never get matched up, but nice to hear an experience where things did go as planned!

Yeap, that was a shocker, LOL Best wishes.

Just an update on this--I wrote a letter with the correct info and attached it with a copy of my NOA1 and mailed it to CSC as instructed by the lady on the phone at USCIS. Well, guess what, today I received the info back--the original letter explaining my mistake, copy of NOA1--CSC simply return the things that I mailed to them directly, and attached a letter saying should I have a question, I would need to contact them directly, or wait for RFE, they won't accept additional document in mail in regards to a petition with RFE notice......

So, well, at least it didn't get misplaced, but it didn't get match up with my petition neither...now I Just need to wait and pray that it would be okay...sigh...

Wow,
I read a discussion where they did the same thing you did and it got matched up.. not returned

Just an FYI for those who don't know yet, you can download a free pdf reader that allows you to save the information entered

www.foxit.com

I have used this perfectly for all my USICIS and NVC documents. I have been able to fill out any/all docs, email to my spouse and have her mail them back. This will save you alot of time with the mail service and will also save you time as you can prepare future docs.

Thanks

I should clarify... Is there any chance they will be granted their visas before she gives birth?

Hello,

I filed in June Cr-1, I called today and they told me that they are backed up until February at the california center. What does this mean timewise? I would be receiving NOa2 in 5 months?

They are just reading a script, all that tier 1 is allowed to do... it means the posted processing as can be accessed at the link above is Feb 15... That means little to nothing.. look at the average time to get NOA2 for CR1... check timelines above...

QUOTE (Anh map @ Aug 24 2009, 11:23 AM) <{POST_SNAPBACK}>
As long as you have the case number it is worth a try. Make sure that you keep a copy in case it doesn't make it to the file.

Also, give enough time for review. I would not assume that your document would be instantly added to the file and reviewed. If possible a week or two before would be wiser.

Thats the worry that I had, handing it in and them not getting it to the file... as soon as they get PKT 3 they should have the case #... one has to wonder if they would look at the material dropped off before the interview.. before the interview... or if they would actually accept it or say no bring it back.... I can see the person asking WHY ARE YOU DOING THIS? but a simple response of, so the CO has time to look everything over before the interview. It could be a good strategy if they accept it, but if too many people do it, they would likely put an end to it... the next question is.. just the timeline or everything from pkt 4 before the interview?

Not sure if this is a good Idea or not.... I was wonder should I turn our time line to the CO at HCM a couple day before the actual interview. blush.gif tongue.gif

Have her slip it in with the rest of the stuff when she goes for the interview... and the word is, to be nice if the dont take it at first.... have he explain that everyone is being required to submit it so here it is...

Technically I guess one could drop off the paperwork at anytime before the interview at the specified time and days... I dont know how a CO would react to that...

Its a requirement for the visa.. if you dont meet the requirement either through his income or a cosponsor.. then no visa...
The only way to try to get around it is apply for a waiver... not likely to get approved since they have already made an issue, but its worth a try.

It all boils down to the same thing. International kidnapping. Without the bio fathers quit claim or a court order taking his parental rights away.. the child can't be removed from the country legally. I am not the first one to say this.. thats why I posted those links.... Based on your previous posts your are trying everything you can to sidestep the law. If you get caught trying to be slick and not going by the book, you could end up in prison for a long time...

When does the NVC schedule the interview appointment date before or after the package is sent?

Who (NVC or Embassy) sends the letter?

Any idea where the 8 weeks comes from? I don't see that as a processing time based on the immigration time trends...

Thanks for sharing unsure.gif

Your packet is likely there already.. You should get an interview date of mid to late Nov. Email the consulate with your file # and request the interview date...

IR-1 / CR-1 Spouse Visa Process & ProceduresExpedite Interview and Case due to pregnancy
It is possible that the consulate may give an earlier date, but someones family planning decisions are rarely a good enough reason for an expedite in the US immigration system. The UK consulate recently granted an early interview date for another VJ member, but that had to do with a terminally ill relative wanting to be at the wedding...

IR-1 / CR-1 Spouse Visa Process & Proceduresapplying for CR_1 enough evidence
As has been said.. "A properly prepared case is the key"... this is done from the onset. not at the interview. Did you have a Dinh Hon or Dam Hoi prior to the Wedding? Only 1 trip before the wedding? That will likely be a red flag that will require extensive documentation of a growing relationship between the 1st trip and the wedding trip...
Go through your relationship and try to identify any red flags that HCMC may identify... addres them in the initial filing .... The consulate will focus on what is in the initial file more than what she brings to the interview... so if the picture is clear when they get the file.. he interview will likely be more streamlined rather than a hurdle...
contrary to what folks from other consulates may think... submitting the bare minimum just to get through the initial petition is not a good idea when dealing with HCMC... several hours of research and interaction here at VJ can potentially save you months or years in your journey...

The grants and scholarships apply toward academic expenses.... the students loans are just that, loans and NOT income... the money must be repaid.. with only a few exceptions.
neither will apply when they look at income for the I-864...
they are looking at actual earned income or gains... do not count on money that is given you for your education as income when it comes to immigration...

@Scott: Thanks for the link :)
@Bernie: What a useful timeline. I think if we write the time-line like yours, it's easier for CO to follow than writing an essay. I thought of writing an essay, but now I change my mind...:) . Thanks again
Ah, Can I get it notarized at the bank instead of notary public? Is it possible for me to send the time-line with IV Package? (of course I have to request them to put it in my files for CO to review it later) or I have to send it separately?

Bank is easiest for me... Send in your timeline with the rest of the paperwork so there is a copy in the file when it gets to the consulate. keep an electronic copy and continue updating it until the interview... that way if they ask you have a fresh one ready to go.. have the second version notarized and ready the day of the interview just in case...
Keep in mind that the timeline is a way to explain your relationship with your SO.... it has been said that photos and chat logs dont give quite the same description of a relationship to the CO as a well written timeline... and be sure your SO helps you write it as she will be the one questioned about it...
