Agreed 100% Gary.. Since USCIS requires meeting in person within 2 years... this can be a very difficult hurdle to bypass... it may take getting married there and filing a CR1...
I am very curious as to the culture/religion that prevents one from meeting the bride before the wedding... we all learn something new each day..

I think you're sending a bit much, we only sent (along with other documents) about 5 photos printed on one page, airline ticket, boarding pass, dinner bill and just got approved a couple days ago. I would save the skype stuff and emails for the interview.

If you end up in AP or run into problems such as them saying you did not provided enough evidence of bonafide relationship while at the same time refusing to accept evidence at the interview.... you would likely wish you had loaded it on the front end.... just because you had enough to get an NOA2 does not mean that was the best decision in the long run... best of luck to you in your case, but the OP's SO is from a different country and they are not all the same when it comes to consulates..

I followed the example cover letter, and #2 may be something to point out there. I do understand after I re read it, sorry today has been crazy at work. My entire document is 62 pages including everything. Is that too much?

Each filing/case is different. Add to that, each consulate has different policies.... So dependant upon the situation at hand, one case may be very small and another may exceed 10 lbs. USCIS only cares if you are free to marry and meet the criteria to be eligible for the petition... the consulate has a different perspective all together.... Some consulates can be a real pain and can make it difficult to submit evidence of a bona-fide relationship... many here suggest that the file be frontloaded with everything that will be needed at the consulate stage to show a bonafide relationship... it is up to you as to what you submit beyond the minimum requirements... I suggest that you go through the regional forums for your specific country and see what others say and take that advice to heart.. someone from another country may not have the best ideas given their inexperience with your specific country/consulate and could possibly direct you down a bad path..

My fiance signed a letter of intent while I was with her this weekend, but the date says today, when we had no contact. The rest of her forms state 1-1-10. Only that form states 1-4-10. Is this an issue?

the date is the date she signed teh affidavit, no requirement to be together on that date...

Welcome to the group Eric. As Roger said, frontloading can be a real asset... When you are getting the initial filing together.. look at it from the big picture.. rather than just submitting what you need to get USCIS's approval (the minimum), submit a packet that addresses any issues that may be present in your case and make a clear case that you love each other and show that it is a bonafide relationship... by taking a few extra months in the front end getting everything in order.. one can save themselves possible years of heartache in the long run...

Go through the topics here and look to see what the Consulate will be looking for and see why others have been denied... this will give you a good idea of what to expect... think as if you are the CO that will be making the decision and keep in mind that they think everyone is a fraud until they prove otherwise...

As others have said.. frontloading can be a great thing in a high fraud country... organization is more important that quantity... make sure that the relationship is well documented and a coverpage contains a clear outline that even an idiot could understand and get through with great ease...
If you just dump a bunch of info into thier laps it may not make much of a difference... dont waste your time or thiers... I can't emphasize enough that organization and a thorough documentation of every facet of the relationship is the best bet... given that you are dealing with Cuba.. don't go bare bones on it...

HCMC will not allow a cosponsor 99% of the time..don't count on a cosponsor. you will need assets valued at 3 times the amount you are short on your income... will your income be low in 2010 also? was it low prior to 2009? HCMC is a difficult consulate to get approved through so I recommend that you do alot of reading in the vietnam regional discussion... frontloading the petition is advised by many when it comes to HCMC...
money in the bank, stocks, a home, cash value of insurance.... they look at real assets...

I'm helping a friend bring his fiance and her child here in the US. He is filing a K1 visa and I am wondering where do we put the name of the child in the I-29F form? The child was born out of wedlock and didnt carry his biological's father last name...
what are the child's requirements we need to submit with the initial packet? How do the adjucator know that they are also filing a k2 visa for the child?? is there a seperate form to submit with the k1 requirements?

Do they just include the name of the child on the DS forms that they will bring the to embassy on the interview??

I was recently engaged in South Vietnam, our Khmer ceremony was the same as a marriage, except we have no license from government. We call each other husband in wife in our letters to each other or on the phone. I too will shortly send in my k1, I hope it's not a problem either, I will have my Lawyer address it if he thinks it necessary. I think it comforts us emotionally to call each other husband and wife. Think about it, we live several thousand miles apart and these are some of darkest days waiting for some stranger to decide our fate. I would think or at least hope the Consulates would take that into consideration if our applications show no sign of fraud. Good luck my friend.

An affidavit accompanying the emails that explains the relationship and the use of the terms, could prevent a huge problem due to misperception.

I have been married, widowed and divorced a total of 4 times.....with this K1 visa it would be #5. I am wondering will the folks looking at my application give me a issue over this or am I being paranoid.



Its not supposed to matter as long as you are both free to marry, but some countries handle it different than others and not every CO sees things the same... It could come up and you could be asked for proof that you are no longer together with your ex... My Fiance and I both had to provide documents aside from the divorce decrees showing that we were living apart from our ex's. I had to show it for both of my previous wives.

A petition is valid for four months from the date of NOA2. The consulate, NVC and USCIS can extend that date, but the petitioner and beneficiary can't...
Read the NOA2 form from USCIS.. The consulate often extends the date to meet thier needs... usually 3 months at a time...

Up until now things have been going pretty well. We're applying for the K1 Fiance Visa. I filed our case late in January, it was approved in February and I got a letter from the NVC on March 4, 2010 saying that they had received an approved case from the USCIS and would, within the week, be sending it to the Ciudad Juarez, Mexico Consulate.
They said in the letter that my fiance should be expecting a package with instructions about the interview.

Does anyone know of a way to track where the application is and how it is doing?
How long does it typically take for Juarez to send out the packets? I noticed on here that there are more than one packet, do they send more than one?

If something is wrong or if it is lost we'd like to know.
Any help would be very, very welcome.

don't worry too much yet.. it almost took to weeks to send a document from the us consulate in amsterdam to the us consulate in frankfurt. keep calling/emailing them though to find out.

DoS told me that the consulate had our file a few days after NVC sent it.. (that was the electronic version) the hard copy took almost a month and the consulate refused to do anything until the hard copy arrived.
It could take weeks as others have said

Too much that is not clear here.. did you actually file a K1 or just think you filed a K1? K1 is for unmarried couples only. If the attorney knew it was your 'wife' from the start then I don't suspect they would have filed a K1, maybe a K3... If the attorney in fact filed a CR1 / I130 fom the start, then the result is likely that you re in AP...

contact your Attorney and ask specifically what petiton was filed, K1 or CR1.. or maybe K3... from there we will be able to get better feedback for you.. calling DoS could yield some info... my bet is that they will say its under review or undergoing AP...



I have heard of the VN consulate approving a visa and then second guessing things before... been a few years though

Hi I am a new member, have read threats/topics, but there is little topic about a Mandamus. I am interesting to file mandamus.
Here short version of my story K1. My wife had interview on 12/15/2011, received blue slip. 1/18/2012 sumitted additional documents, then OC collected my wife and children passports and informed them that the visa will be sent out to you within 2 to 3 weeks. A week later 1/27/2012, OC called my wife home phone stated that they can not issue visa to you at this time, you want to pick up your passport in person or we will mail it to you. On 2/3/2012, my wife received an envelope, inside included passports and another blue slip, stated that your case required additional processing, you do not need to submit further documents. We will contact you when we have finished your case. On 2/14/2012, I had my lawyer and senator email inquiry to consulate office Ho Chi Minh City. A week later, Senator/Lawyer received an email stated that they can not operate out of sequent according to us law.
My questions: should I wait until 120 to 150 days before file a mandamus? I know all of us have been dealing with this process. Please your advises will be thankful.




They can delay the case for a year or more if the CO wants.. take a read through of the AP pinned topic in the VN regional.. a WoM cn take well over a year to get heard and rarely get any results... All the CO has to do is say that they are performing an investigaton... There is no time requirement... Nobody, and I mean by law, nobody, no senator, no lawyer etc. can make the CO issue the visa...

We used that for my wifes K-1 filing and my stepsons CR2.. no troubles with it .. We also had paper clips on sections for when they disassembled the ACCO fastener. I put a cover sheet on it with a note explaining what the filing was and an index of what was in it.I put tabbed dividers between sections... It may appear as overkill but for me I like to be organized and make things easier to navigate for them.

You are not seeing CR1 CR2 IR1 or IR2 dates for HCMC... A bunch of us are waiting... :blink: I expect an email this week with a date mid late oct... if the queue waiting At NVC isnt longer than the list of dates that they send from HCMC then you should get one too.. if not, then they say its another month of waiting.
