pretty much the same thing.... different name in different places.. as long as it wasonly 1 you are OK... the consulate may take an extra look because of it, but they are always looking for a reason to take an extra look... that fungus will follow you fo-evahhhhh :blink:

She only needs to provide a copy of the visa in the passport. You may run into a residency issue when it comes to tuition rates... One must reside in many states for 1 year to be considered a resident when it comes to college tuition.

my sister filed taxes last year joint with her husband and include there daughter.so thats house hold of 3.they both make around 28.000 for the year 2011,so its over the poverty federal line,
so now,do they have both to fill out and sign each form i-134?
or just needed from one of them?
am really confused.
my sister made by her self around 17.000 or more in 2011.because she start working the mid of 2011.
and in this time she makes around 40.000 a year.
so do you think if she filled the i-134 by her self would be enough?even if she filled 2011 taxes joint?

Yes you do have the right for him to be your husband, but there is no right provided by US law for him to be here just because you are married... US citizenship is a priveledge and must be earned by going through the proccess. All criteria must be met or immigration will be denied. Immigration Atty's can be really expensive depending on the situation...

Hi Marc.

I was always under the impression that when CSC said "Your petition has expired. You can file again." that it was a good thing. I figured that meant you didn't have to worry about responding to a NOID for the first petition, and could just go ahead and file a new petition, this time armed with the knowledge of why the first petition didn't succeed at the consulate.

So, consulates were actually sitting on the second petition waiting for USCIS to make a decision on the first petition, even after USCIS had told the petitioner that the first petition was expired and dead? Or, were consulates only sitting on the second petition if the first petition hadn't been laid to rest yet by USCIS? I'm just trying to wrap my head around why it's good thing that the first petition will come back to haunt you when you file the second petition, even though USCIS told you the first petition was dead.

I am reading the "good thing" as the fact that CSC is almost quoting the CO in the NOID and that will give the petitioner the ability to address the issue straightaway rather than rolling the dice and hoping they addressed it. So instead of just letting it die and saying try again blindly, they are essentially saying pay the fee again and we will tell you what you did wrong last time...

we were in AP for 8 months and were never told why and I dont know of anyone who was told specifically why..... The good sign is that they kept the passport and said it would only be a short time... when it comes to AP all that can really be done is inquire as to the case status.. it can be done through the congressional reps or through an email to the consulate... both take a little time for a response...

You need a four page G-325a completed and signed by both parties and you need a finacee letter of intent signed by both parties (original signatures) the sample fiancee letter of intent here at VJ is a good one, you can change the names and otherwise use it verbatim. You do not need photocopy of your SSN. You need to provide an explanation of meeting in person at least one time in the last two years (question 18) and primary and secondary evidence of meeting (photos, passport stamps, boarding passes, etc.) Cover letter is optional. Copies of divorce certificates (if applicable).

Your Birth certificate copy (both sides, even if the back side is blank) proves citizenship OR photocopy of your entire passport.

Proof of meeting one time in the last two years (minimum) must be provided with the petition. Proof of "ongoing relationship" is presented at the interview which will include much more.

Maybe I misunderstood the OP. I took the question to mean "how many copies of each photo" do they need. ONE of each. If you want to send 10, 20, 11, 23, or 100 photos, it is fine, you only need ONE of each.

FWIW I sent ONE photo of us together for the petition, I had about 200-300 for the interview and they only looked at four. I took the others home with the visa approval



I think you were on the right track but I disagree with the response.. I think 3 copies of each photo are needed.. 1 for original submission of 129F sent to USCIS , One for duplicate sent to beneficiary and 1 for duplicate kept by Petitioner... I know that many say to have 1 extra copy of the packet in case something happens or it is needed later, but I feel 2 are needed as something could happen the backup if mailed to beneficiary... as we see in many cases USCIS can and does lose packets.. so the petitioner needs an extra ready to go if that happens...

Ohhh good to know that, I just check my status online and is the same Pending. I was worry it hasn't been touch in two months, but i think the average is three months and then I should start getting worry? It shouln't take more than 3 months right? unless is misplace or under something right? At least a RFE right?

Tier 1 has a specific script to go by and they get in a bunch of trouble if they deviate from it... Tier 2 has some latitude but not so easy to get to that level... all this as per USCIS website Ombudsman Q&A...

she moved but had the address forwarded to the new place so that all mail sent to the old place would be sent to the new house, then last week she changed the address online to the new address.Today she got the notice in the mail of change of address.

it can take some time for forwarded mail to get there and the RFE may be a "do not forward" parcel. In that case it would be returned undeliverable... As I said earlier.. if it isn't there this week.. call...

all you can do now is get an atty and prepare to fight to get it back to HCMC and be ready to wait as it takes time for the coming steps... its a shame things were not addressed earlier... its not going to be easy at this point.. but it can be corrected... there are several others here that will add to this post that have been through the exact same thing you are going through...
