National Visa Center (Dept of State)Packet 3 and 4 (what is this)
QUOTE (mstangie @ Dec 17 2009, 04:12 PM) <{POST_SNAPBACK}>
Maybe I’m missing something. Please can someone read this very carefully! My husband’s case was completed on Sept 24-09 he has not been scheduled an interview for January. I’m thinking I may be missing a packet 3 and 4 can someone tell me what this is, and could it be holding him up for being scheduled an interview.

Call the DoS and ask about the status of the case.. NVC could also give some insight possibly but IMO DoS is easier to deal with and dont just read scripts...

They can tell when you are about to get out of AP... if you call, ask them "when should I call back.. what day?" if they say a wek or two... you will be in AP for a while longer.. if they say call back on Friday.. good news you are likely on your way to the consulate soon...

National Visa Center (Dept of State)NVC called me?????
Calls have been placed to some folks in AP @ NVC... usually asking about a former spouse... but in those cases, we knew we were already in AP for some time...

National Visa Center (Dept of State)How long does NVC take to reply to an email inquiry?
They often wait until the file has been sent out to respond.. that way the response is easy to write..

National Visa Center (Dept of State)Emailing vs.Calling NVC!
its all about timing.. Fridays and Mondays are the busiest days.. late at night EST is the best time..
email is useless

National Visa Center (Dept of State)Whne can we file for children?
The visa category is F2B, and would currently take about 8 years (except for Mexico and Philippines). She can upgrade the petition to F1 when she get's her citizenship, which will knock a couple of years off the wait time.

Once she has her Green card she is a LPR... and can start the process...

should be sent to the consulate within a month... it could be an additional check resulting from the case being flagged due to criminal record... does ot mean it will get denied, just that they are making sure everything is in order before it is sent to the consulate...

AP...
1. Additional Processing
2. Administrative Processing

It's my understanding that all recieved petitions go through #1:Additional Processing, which means it is being bundled scanned etc. in order to be sent to Embassy. After speaking to a CS Supervisor tonight, she confirmed this is the term for "we are getting it ready to send out to a con/emb." "It should be sent in about a week."

According to another post, which I can't find now, #2:Administrative processing means they are reviewing the application/petition for some other reason. It is not being readied for sending to a con/emb. This is the "Oh #######" one.

Can anyone confirm this?

The CSR's @ NVC use the terms interchangeably.. they don't really know what is going on just that it is taking longer than normal... in a nutshell it means that they are doing something that has slowed down the case and it could be a background check or any number of other reasons... the good thing is that it usually takes a month or less...

They can do background checks at all 3 stages as well as an additional round done by DHS after the interview in some cases.
The background checks at stages 1 & 2 are usually about the USC and the rest are the SO..

I had my I-130 sent back to Vermont service center from NVC after about 6 months AP. But my I-129f K3 flew right through in a couple of weeks. I'm sure you will not wait long for a fiance visa. There is alot more to prove and check when you actually are married than a new couple from my experience.

Not correct.. they look at K1's more deeply in many countries..

Well, it looks like we are now members of the "AP Club" (womp-womp). We have sailed through the process thus far, so I guess we had to hit a snag at some point (or two - first the Juarez consulate shut down on Friday, and now today when I called the NVC to find out our status I discover that we are in AP). *sigh* It seems like the general consensus is to not pester them and things will work themselves out in a few weeks? Interesting though, neither of us has been married before or had trouble with the law - are these things generally just random?

Calling and talking to a CSR is not pestering them.. two seperate departments.. the CSR's just answer thephone and check the computer... same thing with DoS.... It can neither help nor hurt anything unless some communication has been lost in transit asking you for something additional.. you should be on to the consulate before the end of the month..

Squeaking does not help when it comes to AP... They often run FBI checks or other forms of investigations.. often when the petitioner was married before... nobody can speed up the FBI.. not even a congressional inquiry.. been there done that... its only a few weeks extra in the scheme of things... if you let this get to you, it will make the rest of the journey more painful..

could be a number of things.. been married before.. that often causes them to check the validity of the divorce... govt security clearance holders sometimes get checked out... and name checks that came up in USCIS also get redone or additional checks done at NVC... in any case.. its usually less than 4 weeeks to get done now...

I pray so it is just hard to see other people who got approved the same day as me or after me and there paperwork has already been sent to there interviewing countries and mine is still sitting at the NVC I pray that it is sent this week......

Usually within 4 weeks...

hello our case say additional processing... any one have idea what going on?

Usually happens for USC's that are divorced or for a few other reasons.. its just NVC doing some additional checks to be sure there are no problems before it is sent to the consulate... could be a few days or up to a month.. have not had any over a month for a while now...

Depending on the office saying AP they can often be interchangeable... AP usually means they have something they need to do before they are done with the case.. AR usually means they need someone higher up to review the case to sign off on it... they both mean it will take some time before they decide or are finished with the case...

Is additional processing the AP you guys are talking about in this forum? because they told me I was under additional processing not admin Review

Yes that is what AP stands for in this forum..

great news bro.. you are out of AP.. when the case is done at NVC they send an electronic version to the consulate.. the paper copy follows by mail/DHL courrier.... it takes a week or two for the paper file to get there.. then they will start doing what they do at the consulate... you should be getting everything ready for the interview.. paperwork I mean.... check with others in the Thailand regional forum to see what you need to have ready for the interview so you have all of your ducks in a row...

The duration has decreased in the past months as there have been fewer petitions... its not a manditory 30 days it just averaged 30 days for along time... best of luck... you should be on to the consulate in the next week or two

You should hear back from them before the end of the month. It is impossible to speed up an FBI background check... A senate or congressional inquiry will get a staus report, but can't move the process along any faster... they have been getting them done quicker this year as there has been a lighter load coming through...

Tried NVC again tonight .... nothing. Tomorrow I think it is a call AND a visit to the congressman's office. I had read that occasionally they will pull a random file for additional checks .... honestly, they being the government .... I can understand it ..... but do it BEFORE approval for crissakes !! To approve it and tell you it has been sent... AND then tell ya again it is "enroute " ...... I don't know, it just chaps my #### !!!!

we got pulled for an additional check at NVC and it took about a month.. they lose files, they send files out for extra checks.. delays can be found everywhere... they likely left your file sitting on a desk or in a box somewhere at USCIS and they just realized and sent it on to NVC...

Scott,, I can't imagine being stuck in NVC for AP....then on to the embassy and hitting AP again.. I hope you get out of there soon... Posted Image

Thanks.. I suspect some time next month or May... It was really our own fault as there was a problem with 1 of the documents that they did not explain the issue initially and when we resubmitted wrong again then the guy explained why it was wrong... that was our last chance to get approved without having to go through another AP... we submitted the correct document a couple of days latter to hear.. thanks, go home and we will send you a letter...

<br />Yeah...I think they just misplaced your file...which is a bit unsettling since those files have tons of private info.. <img src='http://www.visajourn...fault/blink.gif' class='bbc_emoticon' alt='' />   Feel free to vent away...  That's how we survive this madness!  You'll probably call them one day and they'll just out of the blue...say...ohhh you're file shipped to the embassy today!!!  And they'll of course have NO reason why it sat there for a few weeks.... <img src='http://www.visajourn...lt/headbonk.gif' class='bbc_emoticon' alt=':bonk:' /><br />

<br /><br /><br />

A couple weeks is alot better than a few months.. I have seen others files get lost between USCIS and NVC for months and in 1 case a couple had to go through USCIS and get a second NOA2...

Yeah, I called again today....you know thinking....best 2 out of 3 answers??? Well...today she (Alice) said...ohhh you're in additional processing sir. And she started explaining what AP is....and I said ohh you can skip the script....can you tell me how long..approximately?? She said...No, sorry.. I said is it in between 1 month and 1 year?? She said..I don't know. I said...ummm can you say why it's there?? She said...we have no case info. I think if they just said....30-60 days, I'd be ok. You know, USCIS says 5 months, so we assume 5 months and hopefully we can get results sooner. But we have a baseline. NVC just says...we don't know, it's really like a black hole with no answers. Posted Image

Expect 30 days or so... it cant be rushed.. My congressional rep inquired and was told it was an FBI check and there was nothing that could be done until the FBI was done. If you call ask them when should I call back... and if they say call back on Friday or any specific day for that matter.. expect that the case is back from FBI and about to be sent out to the consulate... dont let them frustrate you.. they are only allowed to say what is on that script and nothing more... they can get in trouble if the go off of the script...

ok .... 24 hrs later ..... I call back and talk to Kelly. As I am approaching 3 weeks and/or 15 business days ( tomorrow ) she tells me to scan the NOA2 and attach it to an e-mail to nvcresearch@state.gov.

Now WHAT THE HELL does that mean ??? They CAN'T find it !?! Posted Image

Well NVC today says I'm not in AP.....but she couldn't say if I was being shipped out this week or not. Crossing my fingers. Posted Image

Wow that is quite odd. Since NVC has the standard response of AP if the case has not left for the consulate yet... If it is really not AP, then it is likely heading out to the consulate in the next 48 hours. Keep calling and the truth will come out eventually.
