Oh man you need to chill there is no way everyone gets to NVC that quickly. It can take 1-2 weeks so relax it will happen now you just have to wait.


it can take over a month.. from time to time, cases are put in AP @ NVC and it can take a month or longer to get the case # and forwarded to the consulate/embassy

USCIS did not deny the visa in that case.. the Cairo Embassy did.. far different from the 129F petition being denied...

USCIS wont tell why they got denied? They should give them some reason why they denied the case in my opinion.



They do tell you.. they just say it in writing...

I've read one case where K-1 visa was denied during the interview. It was denied because of the age difference between the beneficiary and the petitioner which was 30 years.

USCIS has specific guidelines the must follow.. Many here have had the petitions denied over the years based on not meeting specific criteria such as having met in person in the past two years (most common)

:blink: The HCMC consulate called my wifes employer asking questions about me since we met when I was lecturing at the University there and the University was her employer... As Penguin said this is not common and usually only happens when a case is undergoing AP... the odds of it happening before the initial interview is so small that you should not worry..

To make a blanket statement saying they don't is not totally correct as under some circumstances(after the interview) it could happen...

Wydaje mi sie ze oni to od razu przesla do Warszawy z NVC. Kazdy udziela innych informacji. W konsulacie w Krakowie powiedzieli ze petycja przyjdzie do nich bo narzeczona mieszak na poludniu a oni pozniej przesla do Warszawy, ale moze ta osoba co to poweidziala sama nie wiedziala. W NVC powiedzieli ze od razu do ambasady wysylaja petycje, czyli to jest Warszawa. Na NOA 2 pisze ze to consulate byla przeslana czyli Krakow. Ech... Jeszcze skubance zbieraja pienaidze za zwyklad informacje.

Jak NVC przesle do Polski petycje, to oni dadza mi jakis Tracking Number na DHL zebym mogl sprawdzac gdzie ona jest? Jeszcze raz dziekuje za pomoc. Pozdrawiam.

Her ex was based in Nigeria, but had she petitioned for him to come to the US? If so what were the results? I have to agree with everyone who has noted legal consul is advisable in this case and one familiar with Nigeria would be a great help... its not impossible at this point but there are some serious red flags waving already... best of luck... :thumbs:

@ScottThuy: Thanks for your response. I do recall that the lady at the embassy did say the divorce papers she filed with were "fake". You said it could be a big issue. How big? I would appreciate it if you could give us an idea of what we're up against..and an idea of what to expect.

If they said that she knowingly submitted falsified documents, then there is a possibility that she could be banned from entry... What did the decision document they gave her say? The wording could really help depending on what section of the code they cited as the reason for denial... if it was just that she was not eligible for a visa because she was not free to marry that could be a good thing...

You mean next year? not likely that they will wait that long... it would be best if you obtained a cosponsor in the next few months... the longer you wait the more likely they are to send the file back to the states...

for some reason they are using DS 260 rather than DS 230... I also noticed the introduction of the DS160 at many consulates .. the fact that it is an E form makes it impossible to select an accurate title....

You are planning on the Embassy accepting the Co-sponsor if you can get one? Your BIL is spot on.. not worth the risk to his livelyhood... On a K1 there is the potential that they would deny the visa based on insufficient financial support even if BIL agreed... double whammy then.. Many consulates/embassy's do not accept cosponsors at all for K1 visas.. the rest (including PI) accept them in cetain circumstances...

Got back from the embassy and it was the package with all the instructions on what to do next!!! I asked the lady and she said, well your petition got approved and the most important thing is that the papers are here now, don't mind not getting the note!

So now I'm going to run to finish everything quickly!

Great news but...

Woah..... hold up there a sec... you need to contact NVC ASAP and let them know you did not get the NOA2.... you have to have the NOA2 later on down the line and it will cost you money if you dont address it now... it is possible it is still in the mail on its way to you but dont forget that you need to have it...

I think you are approved u just dont know.. Call USCIS and tell them about this, if you are approved tell them to send your noa2.

if your SO lives close to the Embassy then have SO go there to see whats up... else call USCIS to find out whats happening.

IMO dont include it.. the only thing that it shows the CO is that she is relying on you financially... read through some of the VN regional discussions as this has been a topic of a few but from the interview standpoint when one is expected to show proof of ongoing... at the initial petition there is no requirement to show proof of ongoing only that you have met in person in the past two years...

as was said By C&A It is common for A CSR @ NVC to tell someone a case is in AP or AR with no actual review being undergone.. Our case was in AP as they were doing some checks on our case at NVC.. Most take less than a month and recent cases have taken a couple of weeks.. Just keep calling every few days until you get the response that the file is forwarded to the consulate/embassy... dont let this get you down its just a delay..:thumbs:

There are certain degrees of felony, and it may not be a felony of the highest degree..murder for example.. but it was a serious enough crime that it involved possible years in prison as a punishment... A crime that society says is so serious that one should be put away for years cant be considered minor

I dont remember where the case was transfered to when it was fast tracked from NBC without a need for interview... Every Embassy is different but I don't think the age difference will be an issue.. As for your divorce.. They are not the moral police. As long as you arre both free to marry and satisfy the meet in person requirements you should be fine.

Vietnam is somewhere I have always wanted to visit. Growing up with the war and having spent so much time as a young infantry officer studying It I would love to visit it one day.

Good luck. Where in Vietnam did you visit. I told my wife that next time we go to the Philippines we are going to Vietnam.



Please do not rely on the adviceof this poster as the US consulate really looks at recent divorces as a huge red flag... They have been known to ask questions like why did you start a relationship with this person when you were married? They went so far as to call my ex wife and ask her about my current relationship and how things went when I met my now wife...

Two paths are available depending on if they were documented as FTJ in the K1... as long as they were included in the K1, you only need to contact the Embassy letting them know that you want to start the proccess for the children. The proccess is different form one country to another. The visa must be issued within 1 year... so keep in mind that it takes time from when you let them know until they schedule the interview. We went through this and were told that sine I sent the original I797 in with her AOS that we were out of luck so we are heading down path 2..
FTJ is far cheaper...
Path 2: filing an I130...
to correct some misinformation provided above, once you get the 2 year GC you can travel using that greencard and can be outside of the US for up to 6 months without causing any issues with YOUR immigration status. So as soon as you get your 2 yr GC you can head back to PI and work on the FTJ...
