A thought just crossed my mind regarding this whole material misrepresentation thing... The same consulate that has investigators call up applicants, petitioners and thier families and lies about the pretense of the calls and who they are to ask questions about the relationship, is the one saying others have made a material misrepresentation? :whistle:

I guess since its the VN clerks and not the CO that are actually doing the calls it does not count...

We had a few wrong answers, I can't even remember how many. After the interview my husband kept asking me: "how you could forget such a thing??" :P . Back then we were already together for 7 years, and spite of the wrong answers, the CO realized that we loved each other. ;)



They did investigative calls on us earlier this week... like an interview over the phone... they asked so many questions... Thuy got confused on two address related questions when she mixed up the numbers... when I talked to my mother about it later that day, she said if they called her.. she would have missed those questions and likely many more.. my own mother... how can they expect someone that lives around the world from you and has never been to the US to answer specific details about your city and home...

You can call DoS and they will let you know if the consulate has the file... 202-663-1225... then 1 then 0 ... have your NVC # ready... they may ask birth dates for you or spouse...

Every consulate accepts co-sponsors Manila included. Ryna is correct if its Fiancée on K1 then you need the I-134. I can only assume that the CO either did not see your dads I-134 (unlikely but possible) or it was not completed/documented correctly. Did the CO mention anything?

The validity of the medical is one year.
The validity for the police records depends on the country - usually from 4 to 6 months. However, once you have submitted the package all that matters is they were valid then. So if it takes them 3 years to give you an interview from that point on, you did submit them what they asked for and when they asked for it.


Misinformation.. This differs from one country to another.. some are six months and some are 1 year.. the same applies to police certs some are 6 month and most are 1 year..

The documents are valid for the period beginning the date tehy are issued and must be renewed if additional review is needed after the interview.. this was the case for us.. our medical had to be redone an extra 100 bucks spent thanks to the consulates delay...

Because she is short on the amount needed she will have to get a co-sponsor. The co-sponsor must fill out the same information and have an income that is above the poverty line for the amount of people he/she is supporting.They must also provide proof of employment,pay stubs at the very least 4 (from what I was told) and taxes from the past 3 years.



If they have the assets to offset the shortfall (300% of shortfall)... a cosponsor is not required...

We were just in AP for 8 months.. others are still in AP a year or more.. each case is different and there is little to nothing that can be done to get things done any faster than they want to take.. at this point it is in the hands of the CO and it is up to the CO as to when you will get final approval...

Roger.. We got put in AP for a month at NVC (before the interview) as well as after.. so there can be AP before..

Joe.. Normally, I would say "Dont plan for denial".. but given the red flags that Jim noted.. you have some big hurdles to overcome.. The single visit/marriage is a huge red flag and most CO's at HCMC wiould hit you with that IMO... it can be overcome after the denial with more visits and proof of relationship, but it can be difficult to overcome at this stage if the initial petition did not already sufficiently address it. She needs to be ready for a difficult interview... she needs to know everything about you not just remember a bunch of facts.. keep things in perspective and know that this process can take a long time and its just a process.. One that we get through eventually...

I am amazed that they are handling things this way at the consulate.. When we were in AP they did a form of a stokes interview over the phone... at least thats what it was IMO.. They called Me, My fiance, her mom and my ex all at the same time(no chance of warning anyone that it was coming and it was after 11PM my time) and asked us all similar questions and I expect that they compared the responses as I could tell they were writing down the responses.. My wife was asked far more questions than the rest of us, but it was all done via phone..

:thumbs: si man it sounds like a CO from Guayaquil has been transferred to HCMC...

I would start by calling DoS on Monday and asking what notes are in the system to see if they have anything noted about the USC being asked to be present at the interview... a logical person would presume that if they are asking for the USC to be present after what has already transpired, they have some good liklihood to approve the visa. But we are talking about HCMC and I would not expect a visa just because he shows up, rather expect additional hurdles IE Stokes interview etc.... I would go if possible, or if not possible I would send an email to the consulate explaining the reason why I was not available on that date and offering to be available should they want to call... if that is not acceptible to them I could go to the local service center.. It all boils down to what you are able to do...i wouldnt risk losing my job to fly around the world on this gamble of sorts... given two+ weeks to drop everything and fly around the world to "show ones face" is unrealistic to say the least.

our interview was schedule for 930 am on that date. my fiance showed up at 8am to get in line. when he was called he saw the pink slip in his file already. he felt a little relax. our questions:
-what does your fiance do?
-what is her boss name?
-describe a typical day of your fiance?
-how much does she make a year?
-what are her hobbies?
-did you plan a wedding? where?
-where did your fiance went to college? what school, how long?
-what's her favorite food?
-who did she lived with when she comes back?
-how many times did she come back? when? exact date!
-how did you and your fiance meet?
-who introduce you guys?
-last questions: how come when you guys knows each other for 3 1/2 years--why dont you guys get marry but still do the K-1?

our result: blue
10 years residence and timeline

i mailed my back--express got to vietnam in 4 days.
the blue sheet told us to come back in June 15th. which is also a wednesday. i told my fiance to go back to the consulate on wednesday and make sure he wait.

he just got out and called me---WE GOT PINK!!!! after another 4 hours wait----we finally got it. we felt so relax and over joyed! good luck to everyone!

The visa is good for 6 months from the date of issue unless there is some over-riding factor that caused the CO to reduce the length of time.. not common... waiting a few weeks will have no effect on the process once he is here

Those two documents are often asked for in the initial blue slip if provided. Some decide to be proactive and provide the documents ahead of time to counter any potential request. Some members have had the timeline, tried to give it at the time of interview, told no and then given blue slip for the exact document in hand... it wasnt about the document IMO it was a delay tactic as something else was not completed... You can look at the interview results thread in the VN regional and see which cases had which docs requested in blue slips... from that you can see the frequency and results after the fact...

Where did they put a time frame on your 221g form? They just marked the box that said lacking documents/ further processing and then on the other sheets marked what they wanted. The only date on any of the forms was on the top of the BLUE SLIP which was the date of the interview.

Ours has a date to submit docs in the second from the last paragraph.. the last paragraph says something about having 1 year from interveiw to address the request or the case will be cancelled.

Ours had a date to submit the required documents on it... was there any date on yours? you need to contact them ASAP, to let them know you have not abandoned the petition... they can send the case back with a denial based on failure to produce requested documents if it takes too long or they don't hear from you...
