Only they know if they will give it to you. To me, regardless of the rules, not every USCIS agent seems to have the same answer when asked. I can only suggest you try.

I wouldn't go that far... They obviously had enough evidence to show the marriage was bona fide to get the conditional green card. Obviously things fell apart since then.

I'm not trying to pressure the OP to sign the paperwork if she believes the relationship is not bona fide. I'm just saying she cannot have it both ways. If she truly believes her marriage is not bona fide then she should take steps to end it.

I remember reading sometime back on VJ that a spouse refusing to sign a I-751 while still married can be used as evidence of spousal abuse. Refusing to sign the removal of conditions paperwork without taking steps to file for divorce sends a mixed message that a good attorney might be able to exploit to allege spousal abuse.

There are two sides to every story and we don't know the facts of the case.

My advice... Sign the I-751 or cut him loose.



Yes, there are always two sides to the stories. I don't know his side of the story, but we don't live together and I didn't know where he was until recently. He is adamant that he won't get a divorce and that he'll destroy the papers or disappear if I try to have him served again. He claims he lost his GC and all of his papers and mine too. Hi All,
I believe my husbands CGC experies the end of January, I have not seen it, and he wants to lift conditions. I will no be lifting conditions jointly with him and we do not have evidence showing that we are a couple, but neither of us have filed for divorced. I advised him to lift conditions on his own and since he is so close withing the 90 period, to also sign a waiver stating that I refuse to lift conditions with him. Is this accurate?

Copy of our leases from the past years
Copy of our bank accounts, I sent 3 or 4 balance statements of every year ( example: January, September, November) , ever since we got married we got 3 shared bank accounts, 2 savings and checking and 1 CD so it was tons of papers, but I tried to organize them by date.
Copy of our tax returns.
Copy of our insurance cards, I am in his plan.
Copy of our California ID.
10 Pictures of us in a timeline since we started dating, our wedding, when we moved to United Stated, with his family, with my family, etc.
2 beautiful handwritten notarized letters from his parents.
A big fat check
The application for removal of conditions
Copy of my Conditional Green card.

So I gave my papers the blessing and I sent them overnight on September 25, I have to clarify I did get one of those return receipt thingies, the guy at the post office recommended us to get it and we did, it cost like a dollar and it felt good to know they had received it, when and what time. I got my Biometrics appointment by October 17 and for some reason like 2 days after that I got the NOA letter, My appointment was set on Nov 2 in Van Nuys and I didn't miss it, I showed up with my hubby 1 hour before my appointment , they were incredibly fast and friendly even though the place was full, it took, seriously, 20 minutes and I was on my way home, we laughed because my hubby brought 2 books, he was prepared for a long wait, hehehe.

I received my approval letter December 17 telling me I was approved and my card was on its way, and I received my card yesterday December 22, best Xmas gift ever.

So, that's my experience, I hope it helps somebody filing for removal of conditions in California.

I withdrew in 2007 and the Conditional Green Card exp. Jan 2008. We are separated and I use my own new address and he uses whatever he wants. The only way for USCIS to get my PO Box was to use the address I sent them when I withdrew my app. He doesn't even know my box number so I am schocked they would send anything to me rather than the address he used to remove conditions. As we are still married, he should have needed my signature. I can only guess he signed on his own and turned it in. Since filing for the AOS, I have never been contacted again by USCIS for an interview or anything. Nothing, nada. I see so many couples having to prove having a relationship or going to interviews and I have not had to do any. I just don't know why

Hola Jomo,

I didn't think of the option that mine might be a copy of what was sent to him. I don't know if he used my PO box number because I didn't see the application that he sent in. It would be risky to use my personal box number without my knowledge as I was not expecting to receive this letter. He has all of my personal documents "All" so I know he could have used any of those copies to file.

Hello,
I am not sure if anyone has experienced this, but I am confused about a letter I received yesterday from USCIS. Just some background information here. I withdrew my application last June after my SO had XYZ problems and XYZ things happened. I sent a letter to ICE and also spoke to them on the telephone too. As part of the letter and supporting evidence for my withdrawal, I asked that future corresponce be sent to my post office box. Fast forward to this year, my SO applies to lift conditions (I-751) on his own. I don't know when it was done, what he included in the petition nor what the details were. Yesterday I get a notice for my SO to appear for his biometrics. This was sent to MY post office box and not to his apartment nor my house. Why would I get this letter at my PO Box? Obviously they recieved my letter. Why to me and not to him at his address?

Do just what he asked. I like S.F. because it is a more modern airport and there is lots to do there while you wait for your loved ones. As for you, your family will be able to watch you snake your way through immigration before, during and after you pick up your luggage. There isn't much traffic over there either, so you won't feel like you are in a village market once you arrive.
You might even find several people who are of Filipino decent who can help you with the baby.

I've heard of two different scenarios. In the first scenario, the fiancé left Germany to return to his natal country once the process started. However, it was difficult to prove their relationship because he had to let USCIS know that he had lived in Germany. In the end, he did immigrate to the US, but it took a while. While in Germany, he had to provide a police report from there and any other country he had lived in. Germans weren't too keen on giving a report for an illegal and I am not sure if they got the report in the end. The second scenario, the fiancé had to leave England to his home country again, but didn't state why he left England.
Those are cases I have read about. It is not unheard of for USCIS to work with individuals who have been European Union hopping. Good luck and pm me for more info. If you want.

I am not sure if there is a non-resident section, but my husband lived in the UK for 10 years and had to obtain one. It was difficult as they only the payment they would accept was cash. I ended up taking the chance and sending the money to someone who then walked the application and the money over there for me. They would only issue the certificate to my husband, in Africa, and they returned all the documents that were sent with the application to him.

I am not sure how to answer the question, as I don't know what type of VISA you received to come into the US this time. If you have documents in Spanish, I would make sure they are translated to English. Also, wouldn't that information be what you would have given the US consulate/Embassy to get the entry VISA?
