Help for a friend

Your friend wasn't denied because of a disability, it's because they don't meet the minimum income requirements. Unless they find a joint sponsor, there is nothing anyone can do. They are not going to allow someone to immigrate if the petitioner has no way to support the beneficiary. They will not risk letting the beneficiary becoming a public charge. There are disabled people whose family members get-approved every day, myself included. I petitioned for my husband and he was approved, I am above the minimum income requirements. So they need to look a little harder for a joint sponsor or the visa will never be approved.
As Belinda stated, immigration is not a right, it is a privilege. It is very clear that they were not denied because of a disability, but because they don't meet the income requirements. Why you and they don't understand that is beyond me.

The last sentence was not needed. What is beyond you is that this is a forum to ask questions even if they seem stupid to you. You dont need to be insulting. I am grateful for any question answered but you can keep the insults to yourself.

Help for a friend

I have a friend who was married in Tunisia in 2011. She made it almost completely through the immigration process with her husband. She hasn't been fully approved due to no sponsor, she needs more income because hers doesn't meet the requirement and she can't get a sponsor. There was a point brought to her attention that maybe this could be in violation of the Americans with disabilities Act of 1990. Because of her disability and inability to work she is being denied her husband ( because she cannot sponsor him). I was wondering if anyone could give me more input on this? Or even if they heard of a case involving this issue and the immigration be processed fully because the sponsor was disabled?

When sending a Senator the privacy act release form

I just got the privacy act release form from my Senator to fill out and return so i can be updated on my case... there is one part that asked the federal agency or department involved.... now i know USCIS but i wanted to be very sure to just put this or is there something more I put that I am missing? Thank you

We got a weird RFE and need help

Letters from family and friends are perfect. They should write in at the bottom of their statement that they are signing that their statement is true (kinda shows that they are signing their name saying they are not writing fictitious information). They should include their address and phone # (that makes the statement that they are providing contact information should the govt feel they would ever ned to contact them for legal reasons to verify the legitimousy of your relationship). Everything has to be translated, but the statements do not have to be notorized.

Notarized affidavits from parents, relatives etc. to show that they knew and participated in the marriage. Third party letters with date, name, relationship, contact phone#, address etc., those who attended the marriage mainly from parents, relatives, friends etc.

Personal notarized affidavits that describe how the relationship is evolved like first meeting, who arranged the meeting, how long you knew each other before marriage, how is the relationship until now etc.

We got a weird RFE and need help

On February 11, 2014 we received a RFE about our third party affidavit's from family and friends about our relationship and marriage. The Nebraska service center now wants affidavits from people present in the wedding.... I went to Tunisia alone and got married on 12-12-12. So the only people present were my husband's family and friends. My question is will they accept affidavits from his family and friends, and translation needed? (I am also unsure they even have notaries from the USA in Tunisia??!!) If I cannot get it notarized what would be the process to make it legally acceptable?

I know it is usually the case to have the police record and medical done by your souse and taken with them to their interview. I am being told this has changed and you have to mail the police record to the NVC instead? The country it is coming from is Tunisia. This doesn't sound correct. I was wondering if anyone could give me a better idea?

More police record questions

The NVC got the package may 30 th but it didnt have the police record in it .... so should we wait for the rfe or send it ? Also does it need to be the original and translated? The NVC said it could be a photo copy with no translation....but i dont feel comfortable with that answer

Red flags

My husband and I are awaiting an interview date for the spouse visa. We were preparing for the interview and going over possible red flags and one red flag really seemed to bother my husband. We got married the first time we physically met and I havent been back to visit him since, due to having three school aged children, and financial difficulties (as I am sole provider for three children). Can anyone give some advice about how to handle this in the interview?

you can call NVC and get update or go through your state senator and fill out a release of info so they can call about your case. Otherwise you wait ... which is what this whole process is ... the wait game

Travelling with CR1 visa??????????

My husband is trying to book a ticket from Tunisia to the United States..... so I have a few questions.

On the website ( where my husband was trying to the the ticket) he found this..

You must have an electronic VISA (ESTA) to enter any U.S. airport. You have to complete your booking and then receive your ESTA code from the website of American Embassy. You must have your ESTA code with you at the airport or else you will not be allowed to check in.

1. Do we need the ESTA or is the CR1 visa all we need?

2. HIs flight is through Quatar does he need a transit visa?

3. What issues do people face using the POE ( where he first enters america) as Washington DC?

Shocked when I shouldn't be

My husband went to his interview appointment today to be told, they didnt receive the package yet and took his contact info and told him they wold contact him once it arrived. The package is in transit??!!! So has this ever happened? what happens if the package is lost? I'm shocked but by now i should expect this... Im so mad :ranting:

Yesterday after this incident I had contact my senator's office who has been working with me in getting my case moved along, and they have called the NVC and have someone contacting the embassy to get this taken care of. So by next week I should have some type of answer

the nvc made the interview appt which was sept 4th my husband went and they didnt have the packet (that was sent aug 5th) so they took my husband's contact info and told him they would call once it came. I have checked the web site given that shows if the packet is recieved or not and it states the acket is still in transit. I dont have the DHL tracking number, but have been told there is a way to track with the date which i tried and still couldnt get it to work. So it is a wait game on when they have our packet. My husband was told it should only be a week.... but as everything who knows or sure, that why I needed help with anyone who can use the DHL site and find our packet.

My wife is about to lose her mind!!!

I feel your pain had the interview day of sept 4th just to be turned away because they didnt have our paperwork ... in fact they did but didnt do their job of entering it in the comuputer got the senator involved and has since been entered but with no new interview day ... now my husband will be going to the embassy to try to get some answers since they dont return phone call answer phones or emails ..... yes it is frustrating all you can do is make contact and or wait. In your case I would try to be patient and make sur eyour wife has everything she needs to move make her focus on being ready and preparing for interview.

Need some serious advice

I called and they just transfer to a line that doesnt answer takes messages and never returns calls but my husband is going to embassy tomorrow and made appt to see someone there so fingers crossed .... During this process I really wasnt as stressed as I am about this ...... I just want to to start having a normal married life with my husband......I miss him too much

Need some serious advice

I have been posting about how my husband had his interview for CR1 visa on Sept 4th and was turned away form the American embassy in Tunis Tunisia saying they didnt have our paper work from the NVC yet, and they would contact him once they received it. Well I got the senator office involved and they found the paper was accepted on Aug 14 and just wasnt entered into the computer... then the next day sept 11th after i found this out the CEAC site was showing our paperwork was there in the embassy and ready for interview .. but we havent been contacted. I have called emailed even the senators office and no contact. This was their over sight and seems to be more then just our case they are delaying in this way... what course of action do I have? I can obviously wait.... but I would like to have this interview appt made....

The light at the end of almost two years

Me and my wonderful husband got approved today finally. This was our second interview day because the embassy had our paperwork but claimed they didnt, so someone wasn't doing their job. After getting the lawyer, senator, and a trip to the embassy ( called in a favor to a friend ) they were convinced to finally give us this day as another appointment day. My husband went did his interview and at the end they requested another copy of 2011 and 2012 taxes.... so I got a phone call that I had two hours to get my husband scans of this to his email.... needless to say I was so angry after all the delays and hoops, but I did what I had to do. He took the paperwork needed back to the embassy, and called to let me know we were approved. After the stress they put me through I was crying for anger and happiness. I was told the NVC already approved our affidavit of support and that this was unnecessary what they wanted..... but end result is WE GOT APPROVED AND ALL MY THANKS GOES TO GOD FOR ALWAYS MAKING A WAY FOR US TO BE TOGETHER. I understand people will complain about these posts that are still waiting, but to those people I have been in your shoes, and I watched many people approved that file before and after me. I haven't seen my husband in two years and I am going to be happy no matter and I wish nothing but the best to those who are suffering as I have wanting to be with their significant other. KEEP THE FAITH YOU WILL BE APPROVED. And for the fellow Tunisian/ American users there will be a detailed post in the portal about the embassy and how our interview went. Thanks to everyone here and thanks for those who unknowingly helped me stay positive through their posts and encouragement and making me feel like Im not alone in all this... thank you to all.

Question Regarding Notary on Affidavit from Friends

I recieved an rfe from sending the affidavits becaue they wanted some from my hubsands relatives, sometimes including them make more issues.... but certainly make sure you get them from his and your friends and family if including them... and his needs translations (btw i had everything notarized)
