US Embassy and Consulate DiscussionMore info on our K3 deny
Ok, I have more information now. My wife went to pick up her passports today and was told that the reason for the denial is that she lives with the father of my stepson. They questioned him without her present she was at the hospital with her sister. Ok the man that they seen at my wifes house is her brother and was never asked any thing and her mother was there also. My wifes brother is staying with her temporary untill he finds a new job. Ok the consular gave her no type of notice or any thing he just said it was denied and that her visitor visa i being revoked and she is baned from applying for 10 years ####### and that the petition is being sent back the the US and there is nothing we can do. She said that this is very young guy and i think that
he has just been hired. I think that this is BS and none of the proper procedures where followed. I have written many emails to ask to speak with a supervisor but to no avail. I wrote my senator and to the Ambassador in panama I guess i will have to wait more... Also they said she couldn't tell them if i have been to Iraq I work for the national guard full time. I don't talk much about my military career because i do not wish to remember it. I am a civilian now with the department of defense and she knew that and what i did. I guess i need to find an Attorney and sue.

US Embassy and Consulate DiscussionOur K3 denial
No they didn't give her any papers just returned her passport and told her they are sending the petition back. But from what i understand is when the petition for the K3 expires they only send notice of intent to revoke and then it's a long period from the time you answer to get a discussion the one lawyer said they can drag it out for over a year.

US Embassy and Consulate DiscussionOur K3 denial
Ok I hope in asking in the right place. I posted about our K3 denial in panama consulate. Ok after talking to lawyers and they telling me many different things i need some help on decisions. One tells me he would reopen and rebut the denied K3 3000.00 dollars. The next guy Say's Your K3 petition expires on Aug 18 so they will not look at it until i get a notice and send evidence to reopen. He said he would take the case for 5000.00, well the next one said just go through with the CR1 because you I-130 are approved and re interview for the CR1 with more evidence to prove your case. I don't know exactly what to do it's driving me insane with all the different advice from lawyers. I just want to see what people here thought.

US Embassy and Consulate DiscussionConsulates Returning Petitions to the United States via 221g
"QUESTION: How can an applicant prove his/her case when the interviewer refuses to look at the additional evidence that he/she is sitting there holding in his/her hands? Almost everybody that is applying for a K-1 has lots more additional evidence that the consulate folks could look at--if they chose to do so. AND, if nothing else, they could at least pretend to be looking at it. At least people would not feel that all of these decisions are made before the applicant even arrives at the consulate.

And, sorry, rudeness in these embassies is totally wrong, no matter what the interviewer feels toward the person. After all, aren't these folks working for us (as in the U.S. interviewers)??? "

I tend to believe this statement because most of the interviewers are newly hired foreign affair officers and they are there by a mandatory 1 year term to advance to the next level and they would love to show they have caught many fraud cases to look good. They then tend to ignore the evidence you have. They just tend to deny and mean while they are gone by the time everything is reviewed.

I know i don't want to get my hopes up but i do have hope. I haven't received any type of notice or anything form them since October last year. I spoke with two different customer service reps and one put me on hold and came back and told me it appears it has been approved I explained it had been returned for review she said the information she is looking at it was approved. So I don't know. I will feel more at ease when i have it in writing. I did send more evidence to the state department and the consulate in panama. They may have included it when they sent it back.

OK it's been a long time since i have posted anything. Well my petition was sent back last year in October. I called this week and the lady took my info and submitted a customer service inquiry. Today i got and email and this is what it said.

"Type of service requested:
-- Outside Normal Processing Times

The status of this service request is:

Since the date we received your request, we have approved your I-129F case and an approval notice was sent on 04/19/2008 to the address we have on file. If you do not receive the notice within 30 days, and you want an official duplicate for your records, you will need to file a Form I-824 Application for Action on an Approved Application or Petition. You can download this form by visiting our website at www.uscis.gov.

If you have any further questions, please call the National Customer Service Center at 1-800-375-5283.

Please remember: By law, every person who is not a U.S. citizen and who is over the age of 14 must also notify the Department of Homeland Security within 10 days from when they move (persons in "A" or "G" nonimmigrant status are exempt from this requirement). If you have moved, please complete a Form AR-11 and mail it to the address shown on that form. If you do not have this form, you can download it from our website or you can call the National Customer Service Center at 1-800-375-5283 and we can order one for you. If you move, please call us with your new address information as soon as your move is complete. If you have already called us and given us this information, you do not need to call again.

I called them and the lady told me well if you received and email saying it's approved then it will be sent back to the department of state. Well when i check my on line case status it shows an update or touch as of January 11 2008 but still says under review.

I don't know what to think but at least this gives me hope.

K-1 Fiance(e) Visa Process & ProceduresK1 Timings Confused

Ok, so my K1 is underway, cheque is cashed, now waiting for NOA1.

BUt what I dont understand is, the USCIS California say that they are now processing K1s sent in in July 06 on their official list.

So how come there are lots and lots of applications past NOA2 that were filed after July 06 through the California Service Center?

I know this is not vital as long as mine is moving but am I getting the wrong end of the stick somewhere?

Thanks,
ROb.

I don't know about the usic computer's but I work for the DOD and the computer will kick out the oldest work order in the system. So in short if your case is a simple one it sould go with no problems. Were as a case with problems is going to list as the latest job being prosseced. It could be wating on more info or other problems. So the computer is going to say that that is the current work being done. It won't list every one. Hope that makes sense.
