one more super quick, and probably way too nit-picky of a question (It just seems like this whole visa process is very nit-picky.): Is it ok to use abbreviations on forms to fit everything in? Ex: CAN instead of CANADA, Dr. instead of Drive (for an address) etc?


Once you start talking out the process, it gets a lot easier (in my opinion). Also, writing out the steps helps a lot.

If it's possible, write the entire word out. It may cause confusion otherwise and I would hate to see you (or anyone else) get an RFE/checklist for something so silly.

Since you'll be filling out the DS-261 online, no, there's no reason to ever do the DS-3032 as the DS-261 is the EXACT same thing, just online.

It'll probably be a few days after getting your case number before you can log into the forms portal, so you'll be sending the optin before you can fill out the DS-261.

I have already been ALL over your wiki...That is how I found out about EP. Thanks so much for all the info! Ok, well it sounds like EP is the way to go. I just read this other wiki and it started talking about having to change all kinds of file types and sizes on your passport photos before they were scan-able and stuff. I thought it sounded super high-tech and confusing. Can we just take our passport photos and simply scan them as is? Im assuming that is ok for the regular, paper documents and forms as well.

Also, sorry to ask a million questions, but I have you right here. If we chose to opt in for EP, do we still need to send the DS-3032? That part really confused me!


Are you referring to the Chinese-specific EP wiki? Things are a little different for them. But no, just scan the two photos, no changing sizes. I didn't need to for mine.

No, the DS-3032 isn't included in the optin email. That's for those in China. For Montreal, there's actually an online form for the DS-3032 called the DS-261.

The way I read this is that you have to do the EP if you're filing with Montreal? But it does seem nice that you can send emails vs physical mail and bring your originals to the interview vs sending them in the mail and being concerned about someone else losing them.

There is a HUGE difference between EP and online forms. For Montreal, online forms are REQUIRED, electronic processing is OPTIONAL.

EP = sending packages by email
Online forms = filling out forms online

Hey guys!

I just sent in my I-130 package and it should be arriving at the USCIS today! very nervous!
Anyway, I am not wanting to get everything ready to go for the I-864. I noticed on the USCIS website, it says that it should be filled out in capital letters. I looked at an example form here on VJ, and it wasn't in capitals. Just wanted to know if it mattered if it was in capitals or not?

Also - I know I am not at this stage yet, but want to know anyway - I will be doing my interview with the consulate in Montreal. So, I have read that I would have the option to opt in for EP. Just wanted to know if this was recommended? Does it make the process go faster, or is it just as quick to send all the info to NVC by overnight mail? I was reading about EP, and it kind of seems like it would be more confusing than just regular mail.

Although it states to use all capitals, I personally didn't on any of the forms. And I had no problems whatsoever.

As for EP, yes, it's still optional for Montreal. What's NOT optional though is the online forms. The DS-261 and DS-260 are REQUIRED for those going though Montreal.

I would suggest EP, not because it goes any faster for those in Montreal, but just because it's nicer. You don't need to worry about mailing (save money on postage!) and you don't need to worry about sending your originals/certified copies of documents. Plus, you'll get an email when your case is complete; only those in EP get this.

That'd be why. DOS's site (like most government sites) are designed for IE, and IE only. They don't test (or care) if it works in other browsers.

I am ready to file my DS-260 albeit I am still waiting for police/court records which I expect to have within about 2-3 weeks. Would it be prudent to wait until all documents are available and submit everything together or submit the application now with documents to follow? I don't want to cause any delays.


Since the DS-260 isn't included with the IV package (as it's an online form), you can most definitely do the form now and send the package later. If you simply wait, you're just wasting time for them to review the form.

So Saylin- do you know are we likely to get any hassle at the border because we don't have all of our stuff to move with us? Should we tell them that we are just coming over to activate the visa before we go back home and finish up with getting ready to move? I feel like it's a bit more than tying up loose ends, we have to give notice on our apartment, give notice to work and sell or pack up our entire place... it's going to be at least another month or even two before we can actually relocate.


There's always the chance you'll get a hassle, but they should still let you through. Most officers understand there's loose ends to tie up and it can take time. And those were the loose ends I were talking about: lease, job, packing, etc.

I have a question for those of you who have been through this already. We picked up my husbands passport and IV package at DHL today and when I looked at the visa it says it was issued Sept 17 2012 and it expires Oct 11 2012. I thought we had 6 months from when it was issued?? That's only 3 weeks from today?!?

I guess my question is does that sound normal? And can we just plan a weekend trip to the US to activate it and then come back to Canada to finish up our business here?


When did you have your medical? When they issue your visa, they take into consideration when your medical was, not just the interview date.

But yeah, you can just visit the US, activate it, then return to Canada to tie up any loose ends. A lot of Canadians do this.

Nope, for IR-1/CR-1 cases, NVC is the one that assigns interview dates. Once that's done, they send the cases out (most likely in bulk, yes, but it's typically the day after an interview date is assigned, so not that much bulk).

When a case is completed at the NVC stage, it gets forwarded to the embassy / consulate. I understand that the NVC contacts us when the interview date is. However, my questions are:

1) Can we change the date after they assign a date to us? Can we call them everyday and ask for an early date?
2) When does the medical exam come into play? Do we just do this on our own and have everything ready before the interview? How long
does this step take, and what are the requirements for the medical exam?

1. Once your case is assigned an interview date, you have to wait for the case to then be sent to the embassy/consulate. Once they have your case, you can then contact them and request for an earlier date. Requesting one with NVC without a valid reason will get you no where.

2. For most countries, you do the medical after the interview date has been assigned as you need the interview letter at the time of the medical. You set up the appointment yourself. NVC and the embassy don't have anything to do with it. Make sure you go to an approved panel physician otherwise your medical will be invalid. The medical should only take a few hours (possibly over a day or two), varying by country. No "requirements" for the medical. Just bring your stuff, get the tests done, and that's it.

Does anyone know about filing the DS-3032 (choice of address and agent) from overseas? My husband and i are living in australa, can we have him be his own agent? or does it have to be someone in the US who is the agent?


The beneficiary can choose whoever they want to be agent for the case, whether in the US or not. So, yes, he can elect himself as agent.

Keep in mind, if you give over both email addresses to an operator, then the DS-3032 is a moot form as all correspondence will be sent to your emails instead of by snail mail.

Hey all!! So my husband goes in for his interview in Cairo, Egypt on Oct. 9th!! We are very excited and doing a lot of looking at reviews and such to see everything we need. Since our case was origonally handled by a lawyer all the proper papers are already with Cairo, but we are also gathering a little more extra stuff for him to take to his interview with him. We have extra photos of the two of us and family, photos of our daughter who was recently born, recent phone records and conversations, his bank statement, and a job offer. Hey all,

I read the VJ Wiki guides on the NVC process and I have some questions that weren't clarified on these sites. I'm still waiting for my NOA2 but want to go ahead and get a jump and have everything in hand so I'm ready when they give me my case number (and hopefully expedite things a little). Any help would be greatly appreciated!

1. The US gov website asks for a long form birth certificate. Is this just for the petitioner or the beneficiary? I know my b. certificate is in long form but don't know if my husbands is. Also, it says (for the birth certificate) that there should be an annotation by the appropriate authority indicating that it is an extract from official records. What is this?

2. Can I go ahead and have my husband fill out the DS-3032 and mail it to me, and place the NVC barcode on it whenever they give me a case #? This way I won't have to wait on mailing time and I'll have his signed document in hand.

3. The WIKI guide mentioned to have all documents pertaining to applicants petition. Which specific documents are these? It was very general.

4. Lastly, cover letter for NVC. Where can this be found?

I would be so thankful for any advice or feedback!


1. For the IV package, the original/certified copy of the long-form birth certificate of the beneficiary is needed.

2. Don't bother with the physical DS-3032, you can email NVC this.

Yeah, those operators are notorious for giving out bad advice/information. That's why I suggest to call at least 3 times if you have a question as they usually always differ in answers.

According to the NVC after my case was closed (and it wasnt expedited) they told me Montreal does their own scheduling. It could be the woman I spoke to on the phone was wrong but this was the information I was given from the NVC in April when my case had closed.


The operator must have mistaken you for a K1 case. It's common for NVC operators to give out wrong advice/information.

For IR-1/CR-1 cases, each consulate/embassy sends NVC their interview schedule and availability. NVC then schedules interviews for those cases. After the interview date has been scheduled, NVC then forwards the case to the consulate/embassy.

My case was closed about a week after they received everything. As far as the actual scheduling of the interview that will not be done at the same time. I know for us my husband is going through the Montreal consulate for his interview and they do their own scheduling, so after NVC closed the case they forwarded it onto Montreal who then did the scheduling. I'm not sure if all embassy's do their own scheduling but either way it will take a little bit after your case is closed to be notified of the interview date.


Unless you had your case expedited (or some other different situation), this is wrong. NVC schedules all interview dates for IR-1/CR-1 visa applicants. The case is only forwarded to the consulate/embassy AFTER an interview date has been scheduled.

Like the other member said, NVC only sends out case complete emails to those in the EP program (although there have been rare cases where a non-EP case has received the case complete email, but don't count on it). Since Indonesia is not eligible for EP, you will not get this email. You have to call NVC to find out when your case is complete.

The interview date is not scheduled at the same time as case completion. It generally takes under a month to find out your date from case completion. Some find out within a week, others a few weeks. You can either wait for the email from NVC or you can be calling up and asking.

Hey guys, I am just curious as to how long it generally takes for the NVC to complete a case after the AOS and IV packages are sent to them. Is there an average wait time? Also, my visa here in Indonesia will expire on the 29th of September.

I am planning to leave with my wife after she gets her visa. We will send the packages on Friday. If she happens to get an interview scheduled later than September 29th is there any way I could request an earlier date?

Any links to either of those questions? Or personal experience? I know that the consulate interview waits differ, and the Indonesian consulate average appears to be about 42 days.

So, anyone know how long it might take for the NVC to complete a case? Or if I can request an earlier interview date if necessary? Thanks guys.


It's currently taking NVC around 1 week or so to review packages once received. If nothing is missing, then the case is closed.

The time between case completion and interview date varies by consulate/embassy. The world average seems to be about 2 months though. So, if you mail your packages this week, you'll get a case completion (if nothing missing) either next week or the week after, with an interview date most likely in August or early September.

You SHOULD have your interview date before your visa expires. If you don't, you can always request an earlier one (due to your circumstances), but not all requests are granted. It depends on the consulate/embassy.

I have a quick question regarding original documents at the interview.
My husband was enrolled in electronic processing so all of his documents were scanned and sent into NVC. I know he has to bring all of the originals to the interview. Will they keep all of these or give them back after looking them over?
For most of the things I could care less if they keep them or not. But I am really hoping they don't keep our original marriage cert. Do you think they will give it back? Or will they keep it?


They'll give it back after they review it. If they don't, then they just forgot, so just nicely ask for them back.

I am trying to loosely plan everything for our journey back to the U.S. I was wondering, after we go through the interview process for my wife's IR-1 visa, does she have to wait the 3 - 4 days for her passport to be visa'd like NIVs, or is she given the packet on the spot and we can head to the U.S. immediately. Don't worry, I am not doing anything stupid, like buying plane tickets before the interview, just trying to get a loose idea.


It typically takes a bit for the consulate/embassy to issue the visa and attach it to the passport. Then they have to mail it which takes a few days.

I don't know of any consulate/embassy that issues the visa and sealed envelope on the same day of the interview (although there might be one).

Don't assume that all embassies and consulates act the same. Manila can be one of the pickier places.

The OP is asking how to verify current and continuing income. Can't just take a sponsor's word for it.

Some sort of proof of income claim is going to be needed. $150K was last year. What is needed is assurance of what is being earned presently.

Statements from clients and bank statements showing corresponding deposits sound like the only thing available to support the income claim.

The question the OP posed was about the AOS package and the NVC stage and I was answering to that. I know consulates/embassies differ and some are pickier than others, but the OP didn't ask about the interview part.

Just going to second these responses. This appears to be a currently self-employed sponsor. Self employment income is not "income" in this context, until it is reported on an income tax return. If an "employed" sponsor is available, that would be a better choice.

To Saylin.... All sponsors need to show evidence of current income. For the "employed" a current pay stub and/or an employer letter, is how this is generally done. Those with histories of good employment income often get by without providing this evidence but I would never advise anybody that providing it is "optional". Which option you choose is a choice but choose one.

Specifically, in this case, the sponsor's past tax returns are going to show them as employed by XYZ hospital but their affidavit will show them as self employed. It is possible that Manila will consider the "current" self employment income to be zero BECAUSE it has not yet appeared on a tax return. Business "revenue" is not the same as business "income". Income is the profit left over at the end of the year after subtracting the expenses from the total revenue. You could have a million or more in revenue and still have no "income".


Everywhere I've read in the I-864 instructions though states that pay stubs and employment letters (to prove current income) are just optional for the AOS package. Where in the instructions does it say it's required? Cause I'd like to read it.

omg are you sure? because I was thinking that is the major proof that the sponsor is still earning in the present and can support the beneficiary that can be seen in her recent paystubs.. well if thats what you say sooo.. whew! thats a relief! :D :thumbs: i pray now that after sending it w/o paystubs. they wont ask for RFE (paystubs) :blush:

Yes, I'm sure. Did you not read the I-864 instructions? Please re-read them (or read them for the first time, which I hope isn't the case). It states in the instructions that an employment letter and pay stubs are optional, they're just to prove current income.

Hi everybody.. since my income didnt reach the poverty guidelines of 5 family household..since I didnt work fulltime due to staying for so long in the Philippines.. so Im going to get my mom as a secondary joint sponsor ( shes an RN) and she earned $150k last year which is good enough for 5 family household (me,my mom,2kids and for the beneficiary my husband) BUT... if time comes theyll ask for affidavit of supp.. she cannot provide recent paystubs for this year because she decided to work as a PDN(private duty nurse)because the pay is higher but theres no w-2/1099.. she receives her salary now through direct deposit in her bank from the patients funds..
so my question is.. if we submit the 864 affidavit of supp. form together w/ her last year tax income..do we really need to submit also a recent paystubs or the 2011 tax income of 150K is enough..im afraid they might ask.. and if its really needed. do I have to look for another joint sponsor that has recent paytubs? thank you! hoping someone will help me with this prob of mine. :)


Pay stubs are OPTIONAL in the AOS package. You're fine!

After the AOS bill appears as PAID in the payment portal, you can send the AOS package.

The AOS and IV are two separate tracks at NVC and have nothing to do one another.

I keep hearing 2 months average processing time from bill pay to sending to embassy.


You can't estimate time frames from BILL PAY. You need to send two packages. You can only estimate time frames from CASE COMPLETION. And before a case is even sent to the consulate/embassy, the case needs to be assigned an interview date.

So:

-Pay bills
-Send packages in
-Case is completed
-Interview date is assigned
-Case is forwarded

Those are the time ticks you'll be looking at. And since paying bills and sending packages is all dependent upon the petitioner/beneficiary, there is no way you can estimate time frames from those time ticks.
