If she wants her visa (and thus green card) to come in your last name, then yes, she needs to get a new passport with your last name. The visa (and thus green card) is issued in whatever name is in the passport at the time of the interview.

Dear VJ community, 

 

Hello, my wife is currently filling out the DS260 while we wait for our AOS to clear (its taking a while but trying to stay positive!) and ran across a question that was a little confusing. 

 

On the "Family Information: Spouse" section, There are two questions. 

 

--Is your spouse immigrating to the US with you?

 

--Is your spouse immigrating to the US at a later date to join you?

My question is: I am currently living in Japan for work, but will head back to America in late August. I am an american citizen (my wife, Japanese) is filling out the form, and she will probably be returning to america after I do, until the visa is completed. I will be returning to the US in August, which is before my wife, not after. So I am not sure whether she should answer yes to the second question or not.  Or, because Im an american citizen, and just returning home, no immigrating, are both of these questions "no?" 

 

Any help would be greatly appreciated! thank you so much!!

 

The answer would be no for both. If you're an American citizen, you're not immigrating to the US, you're simply moving back.

Hi Everyone,

 

We submitted DS-260 on September 19 and Mailed our Civil Documents to NVC on September 20. Civil Documents Showed up in NVC's System on September 23.

Today we got checklist from NVC that they are waiting for Civil Documents from us to review DS-260 form. We dont understand why they are asking if its already with them.

 

Have anyone been though this? We will really appreciate your thoughts and comments on this issue

I'm betting it's a false checklist based on them reviewing (and accepting) your AOS package the other day ;) The thing is, when NVC reviews packages, they quite typically issue a "false checklist" for the other package, even if it's in the building already (they don't bother checking to see if it's there).

I have established email communication with NVC , Case number and process was emailed to me ( the petitioner ) , today I paid the AOS fee online

my question is can scan and email the AOS and IV packages once payment is clear or I do have to send it by mail to the national visa center

 

I'm currently overseas visiting my wife ( the beneficiary ) so DHL is my only option ...

It's been nearly two months since I paid my invoice. I've been delaying sending my package because a) I want to send it with the IV package which has not been invoiced and b) my co sponsor finally mailed all their details but now I need them to re-mail something that was not properly filled out. 

 

I want to make sure I'm not shooting myself in the foot by waiting.

How long does it usually take NVC to review checklist response after receiving it? Do I have to wait another 30 business days or is it less time? Everything else has been reviewed and approved. I only need my AOS checklist to et reviewed and approved to have my case closed at NVC. Please if you have gone through these stupid checklist stages let me know please. Thank you!

 

It takes ~30 business days, just as with the original packages.

Although pay stubs and/or an employment letter are optional (according to the instructions), it's still highly recommended to send them as they can be requested, either by NVC or later on at the interview by the embassy/consulate.

Our case has been at NVC since last month and we are trying to fill up I-864EZ but I have a question to ask...

 

There is a place you have to put "my individual annual income currently" (No 18 on I-864EZ).

I know that is going to be my husband's yearly income but he was an active duty in the US army when we applied I-130 on June 2013 but got out of the army on Oct 2013 and didnt have a job till April this year.

He just started working from April so we dont know what his annual income is going to be and what we should put on it.

 

Is there anybody who had the same situation like this?? 

 

 

It's how much he's making RIGHT NOW. It's not based on previous years or on any tax information. So, disregard anything about 2013, that doesn't matter.

 

If he's salary, put that amount. If he's paid hourly wages, then calculate the yearly amount by: wage x hours worked per week x 52 weeks (or however many weeks he works per year). Put that amount.

Hi,

Hope everyone is doing great and getting closer to the end of the journey.

I have a particular situation I would like your help with. We are currently at NVC waiting for case complete. However something unexpected has come up and we would like to delay the process, but I'm not sure if there's anything that can be done so far along in the process.

I know earlier on we could've have delayed by delaying submitting the forms and paperwork, but not sure if there's anything that can be done at this point.

How long do you want to delay? Cause, you still need to get a case complete. If July 7th was the last date you sent a package, that should be coming up this week (if you don't get a checklist). Then getting an interview date scheduled may take a couple weeks. Then, barring any checklist, your interview will likely be in October. And from there, once you get your visa, you'll have about 6 months validity to do POE. And depending on what your reason is, you can still do POE to get the green card/SSN process started, then return back to Canada (as long as it's not that much longer after).

My husband and I have filed for the I-130 and while I'm waiting for the approval, I wanted to get everything ready for NVC. I have a question about the police certificate though. I'm a Canadian citizen, and when I was 16 years old, I moved to the USA with my mother and sister under an L2 visa. I was there for only two years before I came back to Canada to start college.

I know I have to get a police certificate here for Canada, but do I need to get one as well for the USA? And if so, how would I get one if I'm currently in Canada?

I called up Customs and Border Protection and talked with a woman on the phone. After explaining my situation, she suggested I don't visit at all while it's pending since I don't have any strong ties to Canada. I don't wish to spend $600 on a plane ticket just to be denied entry again at the airport. But I don't want to be apart from my husband for so many months. I'm not sure what I should do.

Samoray, I never actually filed anything yet. I told customs that I was planning on filing forms once I returned to the USA.

As for having proof on intent to returning, I live with my father so I don't have any mortgage or lease to show. I'm unemployed and waiting to get one in the USA once all of this is over. I was going to school last semester here in Canada, but didn't register for any classes this semester since I was expecting to be in the USA. All I have as evidence would be a return ticket. Would that be enough?

Here's my story:

I'm a Canadian citizen and I met my current husband, a US citizen, online in January this year. I met him in person in March and knew he was the one for me. I visited him again two more times in April, getting engaged on one of those trips. We decided to marry on my next visit which would be for the summer (halfway through May up until the beginning of August). I came back to Canada about two weeks ago. I was planning on going back to the USA yesterday, but was denied entry by customs/immigration since I had the intent of immigrating without having a visa. I was told by the officer there to file for either an immigration visa or a K3 visa. But when I researched these visas, I'm looking at a 5+ month wait. I don't want to wait that long without seeing my husband.

My question:

Is there something I can apply for that will let me visit my husband while the I-130 is pending? Or should I file for something else that can let me stay in the USA while it's pending?
He's willing to visit me, but he works and can't take that much time off, while I'm unemployed at the moment and can stay abroad for longer periods of time without having to worry about work.
I'm not concerned about costs. I'd much rather pay more money if it means I can be with him.

Since IR-1/CR-1 visas are always available immediately, you need not worry about the priority date at all, but focus on the notice date, aka NOA1. So in your case, September 16th.

You don't have to send in the DS-230 by snail mail if you're doing electronic processing, but as I said above, there are very few places that can opt-in for this service. And it's not electronic signatures, it's just a photocopy of the signed form that's sent in by email, and then the original form is given in at the interview.
If you can't or didn't opt-in for EP, then yes, you have to send the DS-230 by snail mail with a receipt of payment.

You can't send the DS-230 in by email, unless you're doing Electronic Processing and that's only available for those in Montreal, Canada and Guangzhou, China. And then EP is required in Ashgabat, Turkmenistan. Since you're from Guyana, you're unable to use electronic processing. Sorry!

The only form everyone can send in by email is the DS-3032 (Choice of Agent). Other than that, all forms are mailed in.
