Someone please tell me if I have understood this process correctly: My I-130 will eventually be sent to NVC. NVC will send out a packet to my spouse overseas requesting various documents (I-864, DS 230, DS 3032, originals/certified copies of divorces, marriages, etc., etc.) are gathered and brought to U.S. Embassy where interview will take place. But if spouse completes the DS 3032 allowing me to act as her agent, does all paperwork/requests for documents come to me here in the u.s. and then I forward it on to my spouse where she combines her certified documents with my documents and takes all to the u.s. EMBASSY????


First, if you give both email addresses to an operator once you get your NVC case number, then all correspondence is sent by email, not snail mail, which saves a lot of time, especially when the beneficiary lives far away.

Second, the AOS (I-864) and IV (DS-230) packages are sent to NVC, not the US embassy/consulate.

AOS package = forms filled out by petitioner (US spouse)
IV package = forms filled out by beneficiary (foreign spouse)

So, you send the I-864 to NVC. Your wife can then send the IV package directly to NVC, or she can send it to you and then you can send it to NVC.

I'm a bit confused, as they do ask for copies, but I just saw this online in a guide:

Original Documents

USCIS no longer requires original copies of documentation submitted with your petition. You MUST however submit an original I-129F and G-325A's as well as the originals of any certified translations. Any signatures must also be in the original, not a copy of.
Note: An adjudicating officer may request the original of any document submitted if it is deemed necessary.


I have certified translations on the marriage cert., etc. So do I just copy those translations for the initial and keep the originals?


For the marriage certificate (and divorce certificates, if any), just send a copy. Do not send the original as you might not get it back and it's needed for the NVC stage.

As for the translations, it states in the paragraph you just quoted to send in the originals. Obviously make a photocopy before sending in for your files. If you're unsure about this, you can always call USCIS and ask.

I am preparing the paperwork my fiancé will need for his interview in Juárez. As part of the Affidavit of Support, a letter from my employer is required/recommended. What should the letter include? Does anyone have any links to good samples I could show my employer?

I need to get this letter done before the 10th of June (I'm a teacher and my District Office will be closed for most of the summer.)

Your AOS should be invoiced soon. And after you email the DS-3032, it'll be accepted within a few days and then the IV bill will be invoiced. If you have all packages ready now, you can have everything mailed out by the end of next week for sure. Then another 2-3 weeks to review the packages, and if no RFEs, then a case complete.

Ok..
We have received our NOA 2 and letter..and I am wanting to get the NVC process going and completed.

There seems to be some conflicting advice over the next steps, especially based on the embassy.

What can I do now as I wait for the letter for the NVC?
(I have already received letter from the USCIS, but it has no NVC number)

Also, there is absolutely no way to mail my husband anything in Nepal. He never gets anything i send, unless it is by DHL or special courier service.
I am afraid whatever the NVC has to mail to him, he will not receive! Can it be mailed to the embassy instead? And he can pick it up there?

About a week after your NOA2 date, start calling up NVC and see if they have a case number assigned. You'll have to give them your USCIS receipt number, so have that handy. As soon as the case number has been assigned, give them both your email addresses, that way all correspondence will be sent by email, and not snail mail.

I interviewed in 2009 and even back then NVC was sticking to the "second week of the month" line. Funny I also got my interview date the fourth week of the month. At that time I waited 6 weeks after NVC completion to get a date which was 6 weeks ahead, so a total of three months after case completion.


Thankfully Montreal has gotten rid of some of their backlog and interviews aren't so far apart from case completion as it was in previous years.

We were just wondering if there has been any recent experience with Vj'ers on how long it took to get an interview date after their case was completed at NVC?
We understand interview dates are given out the second week of the month until the dates are full and then you have to wait for the next month. We were wondering approx. how long this process could take???? :-):whistle:

Our case was completed back in March and our interview date was 54 days between CC and interview. While I was waiting for an interview date, I was looking at other Canadians' timelines and from CC to interview, it was between 40-60 days on average.

Also, please do not listen to the scripts given by the operators that interviews are only scheduled during the second week of each month. It's a LIE. If you want to see proof, look at my signature. I was scheduled on the 25th, the FOURTH week. You can get your interview date any week during the month, so continue calling NVC and DOS if you want to know right away.

Hey, folks!

I'm just about to start scanning all the docs for NVC (well, petition is still being processed by USCIS :blink: ).

My question is: can those scanned docs go on separate .pdf files, like i-864.pdf, 1040.pdf etc?

Because, I have not seen requirements for sending all scanned papers in one big file. In addition, it would be much easier to track the forms if they are not piled in one file and go separately.

One more thing: when you take all the papers with you to the interview - should you also have photocopies of all originals (since the embassy might ask for copies)?

I would suggest putting the whole AOS package in one pdf file and all the supporting documents for the IV package in one pdf file, and then they're both emailed separately. I'm not sure if it's mandatory to do it like this as I've not seen it anywhere on NVC's site, but that's what I gathered here on VJ months ago and that's how I did it.

And yes, when you go to the interview, make sure you have the original packages as well as a photocopy for your records. They'll ask for the original AOS package. For the IV package, they're going to want to see the original/certified copies of the marriage certificate and birth certificate. They'll give these back to you. They'll also ask for the police certificate which you won't get back.

I have already submitted my AOS and IV packages. The only thing I am getting from the NVC phone robot is: "A packet of information was sent.....blah, blah, blah". Has anybody received any info yet from the NVC??


I got the same AVR message on Feb 10, and it only changed 2 days ago, so almost a month. I have yet to receive that "packet of information and documents" from NVC. I'll end up getting it after CC, I'm sure Posted Image NVC is slow.

:help: i sent the 1-864 around march 31, 2011 and the ds230 around april 12 2011 i payed both fees and i still have not heard anything i've called the 603 number and the oprator said they have not received anything i called my lawyer and he said everything was sent off that i have 2 be patient but i feel like im getting really stressed i jus had my son on april 5 2011 and i have a 3 year old daughter on top of that i was going to college but i failed 3 out of 4 classes and i had NEVER failed before im very upset and dissapointed i'm barely going to start working again and my husband is having a hard time getting a job in mexico because he has tattoos and noone wil hire him so im struggling to send him money so he can survive this is very very hard on me and i really need my husband home so this nightmare will be over. sorry i jus needed to let that out i dont have anyone to talk to. So my question is how long after all that is sent off does it take to get a response?? Thanks in advance.. :help:


You do realise that you were supposed to submit a DS-260 (online form) instead of sending the DS-230? And if your case starts with MEP, then you're also required to send both packages by email, not snail mail. This is what may be holding your case up as instructions weren't followed correctly.

Haha, don't worry. I think everyone's brains become mush at least at one point in this process.

Usually when you get a SIF, it means a case complete is close, if not already, so there's a very low chance at getting an RFE now, but there's always still the possibility.

Today received sign in failed at NVC.

People generally say the next day you will receive case complete. And as I understand it the embassy schedules interviews for the following month, the 2nd week of the current month. So im PRAYING im in time for a july interview.

What do you guys think?

Grats on getting a SIF. You can call now to see if you've got a case complete.

And NVC schedules the interview, not the consulate/embassy. The consulate/embassy sends NVC a schedule of available dates and from that, dates are given out by NVC.

And don't listen to operators when they say they only schedule interviews during the second week of each month for the next month. It's a lie. If you want proof, look at my own signature. My interview date was scheduled during the FOURTH week of the month as have many others been scheduled during other weeks, not just the first.

Yes, you got the initial information package which inclues the DS-3032 (Choice of Agent form).

To save time and money, I'd highly suggest emailing the DS-3032 instead of mailing it. Follow the instructions and template here: http://www.visajourn...il_DS-3032_form Most people here email it and then receive an acceptance within a few business days. Much faster than snail mailing it.

As I was preparing my IV packet, I copied a "cover letter template" from a WIKI on this website. I am now a little confused at this (was in template):

" Original/Certified Passport Office Police Certificate for Beneficiary and a copy

Original/Certified Police Clearance Certificate and a copy"

Which is which? I didn't know I needed two different police searches... ??

What I did was go to my local police office and request a police check. Apparently the check I had done is commonly done for people who are opting into volunteer jobs, etc. Did I even do the right one?

I informed them it was for immigration purposes and paid my $50.00.

I was asked to list my address for the last 5 years, my maiden name, current address...


What is Passport Office Police Clearance? Am I to understand now that I require 2 (two) separate police checks?

Super confused.


In some countries (like India) a passport clearance is also required. For Canada though, you just need the police check, which is what you did. You're fine :)

RE: Scans... I was making sure that all the documents I have scanned did not need to be first notarized or the like. Just being over paranoid I guess. I tend to over analyze things some times :P

I did try a program on my mac to downsize the packet. It brought it down to 1mb but upon opening it, it looks horribly grainy so I'm not sure if that would be appropriate (I assumed not).

And if it comes out grainy, then it's definitely not a good idea. The reviewing officer needs to be able to read the forms and such. Perhaps you can try scanning the documents again at a lower dpi/resolution and see if that helps.

Hi again. I just posted a new topic but I was hoping I could ask you? :)

In your wiki, you stated that the electronic process cannot exceed 10MB. Is that information direct from NVC, or is this your guideline? I ask because...

Our i864 packet is complete but it is 24MB o.0... We use a MAC and I don't have Acrobat as mentioned in your Wiki, so I am not sure if I can make it smaller?? Any ideas?

Also (forgot to ask this earlier)... Do the images we have need to have any notarized/certified stamps on them upon scanning? (I have printed the complete "physical" packet and have it sitting in a envelope in case). I have a feeling I wont need to go to a notary but I would hate to make any mistakes given all the time involved!

The packet is laid out like so (in this order):

Cover Letter (signed, dated)
Cover Sheet (as sent by NVC)
i-864 completed
2010, 2009, 2008 Tax Transcripts
Letter from employer
6 months pay stubs

The 10MB is simply a guideline. There's no where on NVC's site (that I know of) that states the maximum, but I got this estimate from another EP wiki. But it makes sense since I know a lot of servers have problems when receiving attachments that are over 10MB.

Originally, our AOS package was 21MB, but I was able to downsize it through Adobe Acrobat to 8MB. I would highly suggest either getting Adobe Acrobat to downsize or find another program. You can always try sending your 24MB file, but it'd be a risk as I'm not sure how NVC's servers would handle it.

And what images are you talking about? The only time a notary should be involved is when making translations or getting certified copies of certificates.

For your order, the bar-coded cover sheet has to be the FIRST thing, not the second. It has to be the first thing that NVC sees.

Does it make anyone else angry when you hear that people have been paid 10 - 20,000 dollars to do this process? and they get it! AFter all the heartache, blood, sweet and tears we put in it...that kinda upsets me..that you can just go pay for it...and we have the REAL thing and it could be denied... :-(

Glad you finally got some answers from NVC!

When you're talking about paying 10-20k dollars, do you mean to a lawyer? If you do, remember most lawyers I see mentioned tend to screw things up and don't focus properly. So whether you use a lawyer or not, it can still get denied, no matter what. Paying a lawyer thousands of dollars does NOT guarantee a visa in the least. They just help you fill out paperwork and such.

No no, what I meant is that an interview date can be scheduled the very next day, not that the interview is the next day. NVC wouldn't do that. It's usually always a few weeks ahead of the actual interview date.

If they just confirmed they got it on Monday, then it should have shown up by now. I'd suggest calling NVC and asking about it.

Remember, the AOS and IV are separate tracks, so getting the IV bill has nothing to do with NVC receiving your AOS package. When did you send the DS-3032? And was it by email or snail mail?

You get an interview date first before leaving NVC. But the time between case complete and scheduling of interview dates varies from each consulate/embassy. I've seen people get dates the very next day while others wait a week or two, and then there's some that wait months. It always depends on the embassy/consulate. If you're curious enough, track down other people from your country and see what the average wait time is between case complete and an interview date being scheduled. That's what I did :)

Yes, they both appear on the payment portal on the same site. And you use the same invoice ID number to log onto the payment portal.

Yup, the entire AOS package has to be in one pdf file! Mine came out to be 31 pages if I remember correctly.

I'm not entirely sure if NVC would refuse to look at separate files, but I'd suggest compiling them into one file just to be safe.

We completed the DS-261 right after we were approved for the electronic OPTIN (June 3) We did get an email back saying it was accepted and then shortly after the $88.00 fee appeared, which we paid. It is the IV fee that has not appeared yet to pay.


Hmm, if you completed the DS-261 on June 3, then it's been a bit long. Have you called up NVC yet and ask about this?

Pretend it's one of the immigration forms :P Because this time around, I will be issuing my own sort of checklist to people who incorrectly fill my form out. Trust me, you don't want to get one  :no: So, to summarize, only fill out the new request form if you're serious. All others need not apply. This new spreadsheet layout can still be found on the same link as the old one, it's just the second tab on the bottom, labelled 'New 2014'. If you are on the old layout (whether you have a case complete or not), you can still transfer to the new one if you wish. Just fill out the request form and choose 'Add'. I'll happily switch you over. Just make sure to fill out all the new dates! The link to my new request form can be found here.

Hey all, sorry for being quiet as of late. I've been busy with some personal things. And tomorrow I'm moving, so I won't be on VJ until Monday (when I keep up to date on this thread at work ;) ). And I know I haven't updated the spreadsheet in a couple weeks, and there's now like almost 100 requests (:P), so I'll try to get to that early this upcoming week!

 

Congrats on all the many case completes the past few weeks! Glad to see NVC has been making some steady progress :)

 

Now to finish up packing my clothes in the dryer, and then to pack my dear computer  :lol:

Can anyone tell me if they know any apps that an call NVC for free? Magicjack no longer offers free calls to NVC :(

 

Google Voice! I used that while I was at NVC and never paid a cent to call :)

I called NVC this morning...Rep said my AOS documents were reviewed and accepted, but not my IV package. He said the "other team" needs to review those. Is this normal? Do they really have two teams? Scan date of 20 Aug.  Thanks.

 

There's an AOS team and an IV team.

Does anyone know what the criteria for expediting are? Same as the criteria for USCIS

What is the process for expediting? Call up NVC and an operator should explain everything to you

Is it worth expediting the case if I've already submitted all my documentation and now waiting for CC? Expected next month Yes, you could get a sooner interview date

Does expediting the case cause further delays if it's not approved? Or do you resume your position in the line? No, you stay in the line and nothing happens (as if you never requested an expedite to begin with)

Once they get a new joint sponsor?..does this mean that the paperwork goes back to NVC or does it mean that the consulate will deal with it.

 

Nope, the file should stay at the consulate and they'll review the new paperwork there. I would think they'd be able to review it right then and there, but I'm not entirely sure. If anything, they'd just be put into AP while they review the new paperwork.

The rep didn't seem to have a clue and didn't know my case was even expedited....  I think I'll get hold of Montreal. Thanks Saylin!  Enjoy your Northern turkey-day!

 

Either try calling again and speak with another operator, or just contact Montreal. Might be a few days before you hear back from them though, haha.

Ok so i need some ideas/help.

 

one of my friends ( a very close and special one), she got through her NVC phase about two weeks ago (with a case complete) and just have a date for interview in late november. She just found out her husband (a USC and the one who filed for AOS and made good money), lost his job yesterday (was laid off). he is looking for a new job and they are really stressed. What can they do under this predicament? Their case is already through NVC and an interview appointment date is set?..can they just go ahead with it or is their case lost? Any ideas?can they get a joint sponsor (her husband's brother) at this stage???

Even if he could find a job before the interview, being that he'd only be working there a few weeks, I'd say go with a joint sponsor regardless. Get all the paperwork done from the joint sponsor, and then have the petitioner re-do an I-864 for themselves as well (updating the employment section and current income). Then they just need to explain what happened at the document intake window and hand over all the new paperwork.


Anyone understand the process for an approved expedite?  

 

My DS260 has been completed and submitted. Am I waiting to hear from NVC or should I be looking for communications from Montreal?  As usual, NVC rep was completely clueless!

 

 

 

Well, for most expedites, once it's approved, NVC closes the case and sends it to the embassy/consulate. Do you know if NVC has sent it already? If they have, I'd contact Montreal, explain what happened, provide your case number and such, and ask them what you need to do now and if an interview date has been assigned.
