IR-1 / CR-1 Spouse Visa Process & ProceduresTwo Alien Numbers?

Saylin, I'm not sure if you should have received a new number or not. It seems odd to me that a CBP officer could assign an A#, I would think they could only be assigned by USCIS, but I may be wrong. As far as the 8 digits on the visa, that is normal.. My A# on my green card is the same as the one on the visa in the passport with a "0" in front which makes it into a 9 digit number.

I would definitely bring it up at POE. Hopefully someone with more information will have more advice.

The officer at the airport was with immigration, so I don't know if that makes any difference.

I'll definitely bring it up at POE then. Hopefully this doesn't cause any problems.

IR-1 / CR-1 Spouse Visa Process & ProceduresTwo Alien Numbers?
Back in August 2010, I got denied at the Trudeau Airport in Montreal. The officer there opened a file for me and assigned me an A#. He told me to use this number on all the forms I'd be filling out. So I did. On the NOA2, it lists this number above my name.

Now, I just picked up my visa today at DHL. I saw on the visa that there was a different number under Registration Number. It also has this different number on the sealed envelope as the Alien Registration Number.

Format of original A# given to me: A### - ### - ### (9 digits, not including the A)
New A# on visa: A######## (8 digits, not including the A)

And the two numbers are no where being the same. It's not like just one number is different, they're all completely off.

So, was this an error? Or was I supposed to get a new A# assigned to me after the interview? And who do I contact, if anybody? Should I mention this to the officer when I go through POE next week?

Thanks for any answers :)

IR-1 / CR-1 Spouse Visa Process & ProceduresHe hasnt been paid in one month, will i need a co-sponsor

Ok ive just sent the I130.

He works with a newish construction firm and they didnt get paid for one job so my husband hasnt been paid in one month! but is supposed to be getting paid by next Friday.

He earns $12 an hour, which i worked out would be $23,000 for the year- which is above the poverty line of $18,300. But he hasn't been paid for one month, and probably wont get that money until his company sues the contractor who owes them (no idea even if hell get the money), hes owed like 2500.

How will this effect our application? will we need a co-sponsor? as im not sure we can get one.

Hes looking for another job, if he doesnt start getting paid by next Friday hes gonna leave. But on the G235a form it wont have his new employment on it (as we just sent it off). Would we need to notify them of this change?

Thanks

You don't need to notify USCIS of his new employment. Just when you get to NVC, you're going to need to put that as his present employment.

And the fact that he didn't get paid at his old job won't affect your application at all. USCIS and NVC won't know anything about it. The only thing NVC cares about when it comes to the AOS package is if the petitioner is currently making enough money to support the immigrant and any dependents if he has any. So as long as your husband finds a job within the next 5 months and is making over the poverty line, then you'll be fine at NVC and won't need a co-sponsor.

Thankyou for your reply.

If he ends up staying with this job but doesnt get the money from this month that he hasnt been paid will it matter? For instance, we are just above the fresh hold (23,000 for the year) but if they deduct this months lost wages from his yearly earnings- then we are very borderline and they may presume that he wont earn enough.

Or is it enough to provide them with an employment letter and pay stubs to show this is what he usually earns? (and the lost wages for this month was a one off.

If you don't tell NVC that he didn't get paid, they won't know. Just send in an employment letter and a few month's worth of recent pay stubs once you get to NVC and they'll see that he's consistently being paid so-and-so per month.

IR-1 / CR-1 Spouse Visa Process & Procedureshelp on IR1 (i130 petition)

Not sure I'd agree with the K3 is dead assessment. There have been stirrings on another thread that seems to show that USCIS is now sending the K3 to NVC as soon as it's approved rather than holding it until the IR1/CR1 is approved. It also seems that if NVC receives the K3 without the IR1/CR1 they'll process it. It's still not definitive though and I'd still avoid the K3 because it seems that it slows down the IR1/CR1. Maybe as time goes on we'll see some more concrete evidence of the K3 revival.

Yeah, I've seen a few cases as well where the K3 managed to survive. That's why I said the K3 is "pretty much" dead. I just don't think it's worth applying for. But I'm sure people have valid reasons for pursuing a K3 instead of an IR-1/CR-1.

IR-1 / CR-1 Spouse Visa Process & Procedureshelp on IR1 (i130 petition)

Hi guys,

I am a United States Citizen and I got married to a filipina 2 months ago in Philippines. I want to bring her here in the states. But I am confused on what kind of petition do I need to file. I was really planning on filing i-130 (spouse of a us citizen) that was my original plan. But recently my wife attended a seminar in Philippines and the guy told her that the IR1/CR1 visa is for couples that is married for 3 yrs already, and the guy told her that we need to use a k3 visa instead because we are married for less than a year. Is this true that I cannot use IR1/CR1 visa for her since we got married recently?

No, that's not true at all. The guy did not know what he was talking about at all. Anyone (whether you're married for 1 day or 10 years) can file for an IR-1/CR-1 visa. The K3 is pretty much a dead visa as it usually gets closed once it gets to NVC. So go ahead with your original plan and file the I-130 for the IR-1/CR-1 visa Posted Image

IR-1 / CR-1 Spouse Visa Process & ProceduresComfort Needed - NVC
Hi,

You need to relax :) You've done everything right!

Unfortunately, I've seen NVC issue these "RFEs" for quite a few people. It seems like even though you submitted the packages already, they're saying you haven't. Let's hope they get to both of your packages soon.

For your questions, no you don't need to have fingerprints done before the interview. They'll be done when you're at the consulate for the interview.

At the interview, you just need 2 passport pictures. And for the medical, you'll need 3.

Copies of W2s and pay stubs are alright, but I'm not sure on the birth certificate. They might want to see the original. Would you be able to borrow an original or certified copy of your co-sponsor to bring to the interview? They won't keep it, they just want to verify that is indeed an original/certified copy.

Basically, right now, you have to wait for NVC to close your case. The only thing you can be doing right now is gathering all documents and evidence for the interview and make sure you have all required vaccinations for when you have to do the medical.

I've only heard of scheduling interviews online for fiance visas, so I'm not sure why your father is doing it online. As for the no appointments, if you go to the Canada sub-region, there have been a lot of threads recently popping up about there being no appointments available. Tell your father to just keep trying. If someone cancels, then availability will open up. Perhaps he'll get lucky. If not, he'll have to wait till Montreal posts more available spots.

As for you, for IR-1/CR-1 visas going through Montreal, NVC will schedule the interview for you. The only thing you have to do with the online system is select a DHL location for your visa and passport to be shipped to after the interview.

IR-1 / CR-1 Spouse Visa Process & Procedureshelp on form DS-3032

well I just sent my RFE and just trying to be proactive.

On the DS-3032 if I don't appoint anyone than I choose :

( I do not appoint an agent or an attorney to receive mail about my application.
mail from the U.S. Dept. of state concerning my immigrant visa should be sent to me at:)

now would that be my U.S.A. address or my wife's address in vietnam???

and on the below they ask ( I have already legally immigrated to the U.S. and do not need to apply for an immigrant visa. I received my GC through the _____________ city USCIS office. My A# is _______. )

I don't understand that part??? is it for my A# or do I leave it blank???

Thanks to all VJ'ers help.........

The DS-3032 is supposed to be filled out by the beneficiary, not the petitioner. So your wife could appoint you as agent and use your address in the USA.

IR-1 / CR-1 Spouse Visa Process & ProceduresAOS: Tax Transcript

Somebody who entered the US with a CR-1 visa doesn't have to do AOS. He or she would enter the US as a Lawful Permanent Resident (LPR), which is a Green Card holder. A Green Card holder doesn't need to adjust status.

AOS in this case means Affidavit of Support which all IR-1/CR-1 applicants have to file at NVC.

IR-1 / CR-1 Spouse Visa Process & ProceduresAOS fee paid. Is the I-864 mailed to me?

Title pretty much sums it up. Just paid my AOS Fee(online) and sent off the Choice of Agent too. NVC marks the fee as "Paid". So my question is; Do they send me the I-864 or do I just go ahead, do it myself and send it in?

Thanks in advance,
Gary

Just go ahead and get the I-864 form from the USCIS site. Don't forget to include the cover sheet from the payment portal.

If I had waited for NVC to send me the I-864, well, I'd still be waiting. They never sent it to me.

IR-1 / CR-1 Spouse Visa Process & ProceduresNoA2! next steps to take? (Canada Beneficiary)

Hello,

My husband got an email the other saying that our I130 has been approved! :-D There are a lot of topics inquiring "what to do next" (and I did some looking around) but I decided to just go ahead and start my own thread, Canada specific (if it makes any differences on the whole?)

Police certificates: Can I start those now or should I wait awhile? Other than a one year residence in another province 10 years ago I have always lived in the same city/province.
I assume the police check needs to be recent? 6 months, 1 year?
Does anyone know how long they take to process in Canada and how much they are? More important, how long are they valid?

Birth Certificates of myself and my children: My children will not be immigrating with me at this time but I understand I need to provide birth certificates for them. Do I need to provide just the basic ones (the new ones in BC are pretty specific and state parents and child's names) or do I need something else (ex. the actual registration copy? (we needed when our daughter was born - when we applied for her US citizenship)

Vaccination stuff: I have 2 old records from getting rubella and tetanus and the like, but i don't have any other records proving I have all the required vaccines. Should I be looking into this now or do I just wait until a later time? If now, what do you recommend?

What kind of fees will we be looking at for the next batch of paperwork (just so we are prepared)?

It would be really nice to receive all this stuff in a few weeks and know what we are looking at so we can send it off right away! Thats the goal anyways!

Is there any other advice or thought that maybe I have missed that would help and that you think is important? If there is a list of such answers somewhere and I have just missed it, could you link it?

Thank you so much for your time!

Grats on the approval! Since you're in Canada, I would highly, highly, highly suggest you read a wiki I wrote that's linked in my signature; it's all about electronic processing and the mandatory online forms for NVC.

For the police certificate, I would highly suggest you get it asap. It doesn't matter if you've lived in another province or not, the police certificate in Canada does a nation-wide check. The PCC is valid for one year, so it should still be valid at the time of your interview, if you don't take your time in NVC. The prices vary by each province. In Quebec, I got mine for $40. You can get them done at many places: RCMP office, local police station, or an agency. Again, wait times will vary depending where you go. Mine took about a week or so.

For the birth certificates, I'm not sure. I would suggest calling up an operator at NVC and asking this. And don't rely on just one operator. Call at least three times and see what the average answer is. You'll soon find out not all operators are consistent with answers.

If you don't have any record of previous vaccines, you have two options: either get all the required vaccines again, or get a titer test done. A titer test will check your system for any antibodies.

For fees at NVC, there's only two: $88 for the AOS and $404 for the IV. After your case is completed, you're then looking at one final cost which is the medical. And this varies depending which panel physician you go to. Medisys in Montreal costs $215.

IR-1 / CR-1 Spouse Visa Process & ProceduresConsulate DHL

Will I need to send anything to the Consulate or do I just play the waiting game? I hope signing up for DHL before being done with the NVC isn't a problem...Thanks for your response!

No, you don't send anything to the consulate. Once your case is complete at NVC, they'll schedule an interview date for you, and then ship your case to the consulate. So, just a lot more waiting.

IR-1 / CR-1 Spouse Visa Process & ProceduresConsulate DHL

Hi everyone!

I'm having some confusion with the DHL service website. My wife and I are in Canada and I'm a US citizen. We applied for the CR-1 visa and our case is being reviewed at the NVC now. I opted in for electronic processing so everything has been scanned and sent. My question concerns the steps after filing the DS-260. I following the directions to the Embassy/Consulate specific instructions page and was direct to a PDF for Montreal's Consulate. It tells me I must go to the csc website and register for DHL service, which I did. In order to do so though I had to say I was authorized to schedule the appointment, which I'm not. The website said that the NVC will schedule my appointment but according to the csc website, one is scheduled. I don't know exactly what that means or even if I need to register for DHL since our case is being processed electronically. I understand they use that service to send the visa to you but is there anything I need to send them before?

Thanks in advance!

As far as I know, you're only supposed to sign up for a DHL location only after your case is completed at NVC and they have an interview date scheduled for you.

Doing electronic processing has nothing to do with DHL. Everyone in Canada, regardless of doing EP or not, has to use the CSC website to sign up for a DHL location so the consulate knows where to send your passport, visa, and the sealed envelope to after the interview.

I have the steps here on how to sign up for a DHL location: http://s128.photobuc...mmigration/DHL/ Each picture has a description below it (once you click on an individual picture). This is how you should have signed up (although you should have waited until after you had gotten an interview date scheduled as you have not finished with NVC yet).

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 AOS Package Pay stubs

I wrote in another thread earlier today that for at least the last 20 years, nearly all pay stubs show the year to date income, so ONE current pay stub is sufficient to document "current income". At least one tax return is required as well but that's about past income, not current income.

Oh, that's very true that they show year to date income. Completely forgot about that. Then only one is necessary and not six months (or any other amount). Although the pay stub itself is not necessary to begin with.

Pay stubs aren't mandatory. The only thing that's mandatory is the I-864 form and tax information (either tax transcripts OR 1040s and W2s). You can still send in just 2 months of pay stubs if you want to.

If you mailed it, it will probably take awhile for NVC to get it and look at it. Once it's accepted, the IV bill will appear on the payment portal for $404. For now, you can't do anything except prepare the IV package.

Again, please read the guides, especially http://www.visajourn...p/EZGuideSpouse so you know the steps and what's needed in the packages.

Do you mean the barcoded cover sheet that you print off from the payment portal site? Because NVC states to include it in the package. I'm not sure if NVC will look at your package without it. If you didn't include the barcoded cover sheet, I suggest calling up NVC and ask what to do.

Yes, the DS-3032 has to be sent (by the beneficiary). That's the only way the IV bill (of $404) will appear.

Since you paid the AOS bill a month ago, I'm sure by now it appears as PAID in the payment portal. Just print off the document cover sheet (has a barcode on it) and attach that to your AOS package and mail it off.

Once you send the DS-3032, the IV bill will appear once it's accepted. Pay that. Once it appears as PAID, you can then mail off the IV package.

Please read this guide to know what to include in both the AOS and IV packages: http://www.visajourn...p/EZGuideSpouse

Do the documents need to be translated? Such as the marriage cert, birth cert? I have seen some people saying yes, some saying no. I also asked NVC and have not received a response yet.

Like you, I've seen people say yes and also no. Some have sent them to NVC not translated and got a case complete. But I've also seen some people send untranslated documents and then get an RFE. If I were you, to save yourself from a possible RFE, get all documents translated to English.

OK, I am at the point now where I have the IIN, and will be paying the fees shortly. I completed the AOS and have all the supporting documents in order and ready to send. My wife did the DS 3032 and emailed it in.

Now, regarding the DS 230.....Do I send in Originals of all these things or only copies at this point? I went through the Visa process before and I thought we had to have the originals in hand when we went to the Embassy for the interview. And if I do need to send in the originals at this time, does that include her actual original passport?

And is this the time to include information regarding the proof of the relationship, marriage, etc. or do we just bring all that to the Embassy?

This morning I sent my girl an email telling her to send me all the things she has to me via DHL and I would sort it all out what needs to be submitted at this time and what we will need in hand for the Embassy. I will be going to the interview so no problem bringing the things in hand.

Oh, one more thing....I have read some things about how guys are sending scanned copies of the documents to the NVC, but what about things like the sealed DAS report?

Thanks for any information. Sorry if these are questions already asked from other people, I just want to be sure I have the latest info and do not want to take for granted that CR1 process is exactly the same for all countries.

Yes, you have to send in all original/certified copies of certificates (birth, marriage). You'll get the originals back at the time of the interview. But you don't send in the original passport. You just scan the bio-data page which has her name, country, and all that.

You bring all proof of relationship evidence at the time of the interview. It's not requested in either package.

Don't worry about the beneficiary ID as it's only needed for those doing online forms and Georgia is not eligible country.

IR-1 / CR-1 Spouse Visa Process & ProceduresApplicant Status - At Consular Section

Hi;

We had successful interview in Montreal on May 12the and we have been waiting for passport and visa to arrive ever since, yesterday night we got email
from DHL that your Passport has been picked up with Waybill Number.

When I look at my usvisa-info (CSC) account it say " APPLICANT STATUS - AT CONSULAR SECTION " what does it mean ?

Does that mean we are approved they have sent visa and passport ????

Any who has recently received their visa please share your opinion

Thanks
Chman_Zinga

It looks like the passport and visa are still at the consulate, probably waiting to get picked up by DHL. But the CSC site is slow to update, so it might be behind. I would suggest taking your waybill number and looking on DHL's site as that would be way more up to date than CSC.

Hi, That's great! Go to www.dhl.com to track that waybill number to see where the package is at this point, Sounds like it's your passport/visa in it. Keep us updated :)

It's actually dhl.ca not .com

IR-1 / CR-1 Spouse Visa Process & ProceduresHow do I know if the DS-3032 has been accepted?

just wait , if u did pay the 88 dollars...and its been PAID then wiat a couple of days, the IV bill will be generated

The AOS and IV have NOTHING to do with each other. They're both separate tracks.

hi...so for my case,...i already have the nvc and case number...can i just go ahead and email the choice of agent email form ? coz they told me to wait in the email for furhter instructions.

You can try emailing the DS-3032 now. But they might not accept it until they're ready for correspondence. How to know when they're ready? When they email you (if you gave over the email addresses of both petitioner and beneficiary) the initial information package which contains your case number, IIN, and an expired DS-3032.

You should get an acceptance of your DS-3032 email. Also, the IV bill will be invoiced after the DS-3032 is accepted. You might have sent the DS-3032 too early, so you can try sending the DS-3032 by email again.

IR-1 / CR-1 Spouse Visa Process & ProceduresBarcode's

doesn"t AOS and D2230 package get sent together. I know they both have cover sheets..I was going to have table of contents etc...

Some people send the AOS and IV together, some send them separately. It's up to you.

You have to include the AOS cover sheet to the AOS package and you have to include the IV cover sheet to the IV package.

If you do send them together, like magical said, make sure they're clearly separate, ie paperclips or put them in their own envelopes within the larger envelope.

And a table of contents is always a good idea, but don't assume that the reviewing officer will look at it.

IR-1 / CR-1 Spouse Visa Process & ProceduresBarcode's

Where you get the barcodes.. I have received nothing from NVC.. Just emails and My I-864 is paid and the $404 visa fee is paid.. They have never mentioned anything about barcodes

The barcodes will be available at the payment portal site once each bill appears as PAID. It's called 'document cover sheet' on the site.

IR-1 / CR-1 Spouse Visa Process & Procedurestotal fees/costs for ir1

i see the guides and and have found all kinds of pages here and there at travel.gov site but don't see one location where i can see all fees for the ir 1 visa.

can someone help?

i have done through AOS, i just have the ds230 left which is 404, is that correct?

or am i missing some fees left before the process is over...?

Yes, the IV costs $404.

The only fees left are the medical. I had mine done at Medisys in Montreal and it cost $215 (plus I needed a flu shot which was an extra $20 or so).

And also any costs on moving to the USA.

IR-1 / CR-1 Spouse Visa Process & ProceduresOriginal or Certified Copies of Documents To NVC

Someone please tell me if I have understood this process correctly: My I-130 will eventually be sent to NVC. NVC will send out a packet to my spouse overseas requesting various documents (I-864, DS 230, DS 3032, originals/certified copies of divorces, marriages, etc., etc.) are gathered and brought to U.S. Embassy where interview will take place. But if spouse completes the DS 3032 allowing me to act as her agent, does all paperwork/requests for documents come to me here in the u.s. and then I forward it on to my spouse where she combines her certified documents with my documents and takes all to the u.s. EMBASSY????

First, if you give both email addresses to an operator once you get your NVC case number, then all correspondence is sent by email, not snail mail, which saves a lot of time, especially when the beneficiary lives far away.

Second, the AOS (I-864) and IV (DS-230) packages are sent to NVC, not the US embassy/consulate.

AOS package = forms filled out by petitioner (US spouse)
IV package = forms filled out by beneficiary (foreign spouse)

So, you send the I-864 to NVC. Your wife can then send the IV package directly to NVC, or she can send it to you and then you can send it to NVC.
