so basically the AOS pckg and the ds-230 pckg, right?

Just the DS-230. A few lines above the instruction package, there's one for when you received the I-864 (aka AoS) package.

IR-1 / CR-1 Spouse Visa Process & ProceduresBirth cirtificate needed?

I read these 2 topics and it is different from each other about birth certificate for I-130 from.

http://www.visajourn...tent/i130guide1
http://www.visajourn...tent/i130guide2

I wonder which one is correct?

And what are the differences between IR-1 / CR-1 and K-3???? Im so confuse.

If you looked at the title of each guide, the first one is when the spouse is outside the US and the second is for when the spouse is in the US.

And the K3 visa is administratively closed. Your only option is IR-1/CR-1.

IR-1 / CR-1 Spouse Visa Process & Proceduresspeeding upp the i-130

I was just wondering if anyone has any advice on speeding up the i-130 spouse visa. My priority date is JULY 23,2010 it was transferred from CSC TO TCS on NOVEMBER 2,2010. its been 6 months and i still didn't get any feed back from them but their promise time is 5 months

Since you're one of those that were transferred from CSC to TSC, you're not the only one that is waiting for an approval for over 5 months. You should seriously check out this thread: http://www.visajourn...service-center/ It's all about those have gotten transferred back in November. It might help you.

Can someone please post a link to the current income requirements/poverty guidelines? I'm trying to help out a friend who's currently filing for her husband. Thanks!

For whatever reason, the 2011 poverty guidelines were taken down. Before they did though, I saved a copy to my computer. I uploaded a copy here: https://docs.google....wNDU5OTZk&hl=en And you can always find the 2010 poverty guidelines here: http://www.uscis.gov...form/i-864p.pdf

Is it necessary to have a copy of my birth certificate if i have a copy of my passport in there? thanks for the tip about the cover letter! I will use it!

No, it's not necessary to have both. But on the guide we were using back in August last year, it said both, so we submitted both. Plus, if they're not happy with one to prove US citizenship, they can use the other Posted Image

IR-1 / CR-1 Spouse Visa Process & Proceduresi-130 put together...

My i-130 is put together, I'm not sure what order I should put everything in.... any suggestions?

I have the petition itself, our marriage certificate in urdu and english translation, copies of every page in my passport, my divorce certificate from my ex, our g-325 a's, our passport size pics, affidavits, a letter from myself describing how we met, photos, chat logs, and call records... anything im missing?

This was the order we had:

-G-1145
-check
-cover letter
-I-130 form
-G-325A of petitioner, then petitioner's picture
-G-325A of beneficiary, then beneficiary's picture
-petitioner's birth certificate
-petitioner's passport
-our marriage certificate
-our evidence

Do you have your own cover letter written up? It'd be a good idea to add at the beginning, so the officer can clearly see what forms/documents you have and what order they're in.

Hi everyone:

I have a question about 125% of income for household. It's just me, so that's one person. I qualify as one person for 125% of income, however, with my spouse, now my household is 2 people, and we must meet the 2 people requirement? So you add one more to your household? I'm sure this is an obvious question, just wanted to know how it went for you all.

Has anyone had severe problems with this?
Thanks!

If it's just you and your spouse, then yes, you have to use the household size of 2.

Hi, what's your exact NOA1 date? Can you either fill in your timeline or say it here? Thanks.

mine was shipped back to CSC!!!!!!!
Confirmed by Angela,

"i haven't forgotten about you. The file was shipped and I have confirmed that it was recieved at CSC. This is good and means that within days it will be on an officer's desk. I know that the waiting is difficult, and I appreciate your patience."

OK, so I got another touch today (no text or email), and the status now says this:

"On February 10, 2011, we transferred this case I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN to our CALIFORNIA SERVICE CENTER location for processing and sent you a notice explaining this action. Please follow any instructions provided on the notice. We will notify you by mail when a decision is made. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283."

Which is exactly the same message I had before, except that before it said I was transferred to CSC on February 7, 2011. Hmm. Maybe they just sent it today and are correcting it? Or maybe they're just not keeping track of who they've already contacted!

I wanted to say that I called NVC at 7:30 am (10:30 am eastern) and I got through to an operator in about 3 minutes. I'd recommend don't call during lunch hours or after work hours. I don't know for sure if this is true since today was my first experience with the majestic NVC.

Google Voice actually isn't available right now anywhere EXCEPT the US. But there's a work around of course. You have to hide or disguise your IP then you can sign up. That's what I did. Otherwise, I wouldn't have been able to sign up. I used these exact instructions (http://www.mycellpho...work-in-canada/) and had my Google account set up within a few short minutes! The only thing is, you need a US number to set up Google Voice. If you don't have one, use your spouse's number in the USA ;)

you really have to wait that long to talk to an operator? Ouch.....any other way to find out? lol

Yup, that long to get an operator. You can always find out through the AVR, BUT my AVR only updated about my NVC case number TWO days after I had gotten it from an operator. I would highly suggest calling an operator, despite the wait, since they'll know way in advance of the AVR.

Yeah, weird thing is, it always says the wait is five minutes....Posted Image

Saylin - How did you get your case number from NVC - u said u called an operator... who did you call and what did you say?

Hi,

My NOA2 date was on a Tuesday, the following Monday I called an operator. No case number. I called the following day (one week from NOA2) I was able to get the case number from an operator.

All I did was call an operator, and when you get connected to one, the first thing they ask is for either a CIS receipt number or a NVC case number. So I gave my CIS receipt number and then they said my case was just inputted in the system and I asked for the NVC case number.

If you want to speak to an operator, call 603-334-0700, press 2, then 1 for English, and then 5 for an operator. Then plan to wait for about 20-30 minutes.

And another August filer has gotten transferred back to CSC. Hmm...

The % of the 36,000 may be a bit higher since some of those on your spreadsheet are probably approved but not reporting. As I recall, most of the sample was July anyway, and most of the previous approvals were August up until now. So maybe it's mostly July that's left.

True the percent of the 36k might be different.

Looking at the bottom of my spreadsheet, 27/66 July filers have gotten approved (41%) whereas only 16/62 August filers have gotten approved (26%). So, I'd have to say otherwise to what you said. There's definitely been more July approvals than August.

Although there's only been 6 transferred back to CSC, here's the NOA1 dates so far:

July 16
July 19/August 5 (K3)
August 3
August 5
August 24
August 31

2 July filers and 4 August. Perhaps they're sending back August filers and approving the July filers?

Just looked at the dates of NOA1s that received an approval this week:

July 2
July 6
July 9
July 17
July 17/August 18 (K3)
July 21
July 21
July 21
July 26
August 11
August 14
August 21
September 6

Definitely looks like a lot of July filers got approved this week. 9 July filers, 3 August, and 1 September.

Fermat, you asked the approval rate in %. Just checked the spreadsheet, there's been 44 approvals out of 135 transferred. So, about 33%. But of course, this only reflects those approved/transferred from this thread. I don't have the % for all 36,000 cases :P
