Hubby and I are going over the AOS and we are actually confused.

He is sponsoring me and not our son, as our son will get his U.S citizenship from a consular report of birth abroad, being that his father is a U.S citizen.

For the household size, does he add our son as a dependent? I know in the instructions it states:

"21d - Enter the number of unmarried children you have who are under age 21, even if you do not have legal custody of these children. You may exclude any unmarried children under 21, if these children have reached majority under the law of their place of domicile and you do not claim them as dependents on your income tax returns."

He does not claim our son on his tax return as my son does not have his SSN yet, but he still is financially responsible for him

I think that he should count our son as a dependent, but I just want to make sure.

Any help with this question is appreciated.


I believe you'd count your son on the household size. To be sure though, call an operator up and ask.

I was laid off Feb. I agree I will also feel lot safer with a job. I am interviewing few places and waiting on next steps.

This is when they look at my 1-864 and feel that I might need a co-sponsor despite my reported income and balance?


Since it was recent, you might be ok. Perhaps in the cover letter you can explain you were just recently laid off last month and that you're currently looking for another job.

AP = Administrative Processing

AP occurs either when an officer sees a red flag and wants more evidence, or if more documents need to be sent to the embassy/consulate (such as sponsor information)

That'd be really good if you can get a job before then. If I were you, I'd feel a lot safer having a job, because they might put you on AP until you get a co-sponsor if you're currently unemployed. And that's if you don't get an RFE from NVC first.

Congrats to all the CC and the interview assigned!!

I called NVC today to see if the pictures and evidence I sent to USCIS was sent with my file and the operator said she doesn't know, but that she can tell me that my expedite was approved this morning!!

She said "I can have them pull your file to check for pictures but that would delay the transfer process". I said "NO!!!" LOL I can always have pictures printed out again.

So I said, oh well I already paid the AOS fee and it's "in process" should I pay the IV fee when it's available and she said "No, pay it directly to embassy"

Then I asked if I should send either of the packets to NVC or have him take it to the embassy, she said "Don't do anything or send us anything" She said wait to hear from embassy and take documents directly there. She said if I sent docs to NVS they will only send them back to me.

I said thank you and hung up.

I already paid the AOS fee, but that only necessary if the AOS is reviewed domestically, if AOS is reviewed at consulate the fee is not needed. Oh well. Don't care if I"m out $88 if it means I'll get to see Hubby before our anniversary.

If not for the expedite ( which I hope is a true expedite) his appointment would likely have been in late June.

Very happy but taking it with a grain of salt. U never know what could go wrong with this whole process!!

You mean cover letters? Cover sheets are what you get from the payment portals and have bar codes. If you meant cover letters, they're in themselves optional, so no, you don't need to sign them. I got my husband to sign the AOS one, and I signed the IV one, but it's completely optional.

My wife is definitely a bit nervous because she has been denied for a tourist visa in the past so that is still in her mind, but I am trying to calm her down with some positive thinking. We have all in order and tons of evidence, so I think we will be just fine :) Just gotta try and relax, and think positive..that goes a long way!

Grats on the expedite approval! Yes, since you sent in your two packages already, they'll be forwarded to the embassy. I don't think your wife has to send any more documentation in, but I don't know a lot about expedites. I'm sure someone here who also got an expedite will speak up.

If you gave your email addresses to an operator, then yes, they'll email you the interview package once an interview date has been assigned.

NVC received IV documents on 16th march. I got a checklist for DS230. When I called, it says wait for 6 to 8 weeks. WHen do you think they will finish reviewing? thanks


If you sent in your IV package on March 16, then you should get a case complete 2 weeks after that date, so it could be at the end of this week or next week sometime, if no RFEs.

If she's bringing stuff with her, that's fine. It's just when you ship things, you first have to cross the border before a company can ship your belongings. At least in Canada anyways, I'm not certain about other countries.

I don't think because of terrorism. The shipping company just wants to make sure you were able to successfully go through the border. Or perhaps to know you're actually IN the US. I'm not quite sure of the reason, I just remember seeing it mentioned on a thread in the Canada regional forum that you can only ship belongings AFTER you go through POE because you need to send them a copy of your stamp in your passport that you get at the border.

My wife needs to get a copy of the CR1 visa so she can ship her things. She needs 3 months advanced notice to cancel the lease on her apartment. She has a place to go but no way to move her things. Seems like it takes about 3 months to schedule the interview, I'm wondering if I shouldn't tell her to hang onto the apartment for another month.


Just a note, I'm not sure if it's the same for other countries, but I know for Canada that one cannot ship their belongings until AFTER they cross the border and enter the US because shipping companies need proof that you entered the US by sending them a copy of the passport with the stamp showing what date you entered.

I have a couple of questions regarding the medical. Do you have to show the interview letter to get an appointment or can you just give them the NVC # and do the medical before CC? About the vaccinations, I thought they could find out if the person needs vaccinations or not from the blood test. I am hearing that you have to take proof of you vaccinations or they will make you take again if you don't show proof. Is this true?


I believe in Canada you need to have the interview letter before you're able to do the medical. Advance medicals are only possible in a few select countries.

Yes, if you don't have a vaccination record, you can have a blood titre test done beforehand (at a family doctor or clinic) to see if you still have the antibodies to previous vaccines. But sometimes the antibodies won't appear, so you might have to re-do vaccines. If you need vaccines, get them beforehand at a family doctor if you have one or a clinic as the panel physicians charge a lot for vaccines.

When you say 'received', do you mean NVC just received it in the building and you know from tracking by a mail provider, or do you mean they inputted it into their system? If you mean the latter, then it's perfectly normal as it usually takes 2 weeks to input packages into the system once they receive it in the building.

Yeah, it's weird the RFE you got. Most people don't submit bank statements or anything, so it's weird they're requesting it from you.

I believe you can get multiple RFEs. If NVC isn't satisfied with the response you sent in or they found something else, then they can issue another RFE.

6-8 weeks is just a really general timeframe given by NVC and its operators. They want to cover their behinds just in case. Usually it takes about 2 weeks for them to review a package once it's been sent in.

Well, we called, and they simply want a copy of Val's bank statement for the I-864 - that is it. We sent one, but, what the heck...
They are prepared to take a copy over email, so it's not so bad.

I called a very smart lady, who was forthright in what was required, but when Val called to confirm, the operator she spoke to sounded quite confused.

I am wondering whether things are indeed like your and Ericks case, in that we have simply been shipped to consulate. I guess we'll find out soon enough. In the meantime, we'll gladly send an email copy of Val's bank statement.

AT LEAST we know they are working on our documents, and that's a relief - like your case Lara, London want the processing done at NVC before arranging an expedited interview. Looks like we are in identical situations.

THANK U GUYS BUT I ALREADY LOOKED INTO THAT. THE 6 MONTH RULE DOESNT APPLY 2 ME CAUSE I WAS THERE AS A MINOR N LEFT WHEN I TURNED 18. AND YES IT HAS 2 BE VALID FOR 6 MONTHS THE INSTRUCTIONS ON THE FORMS FOR THE BIO FORMS SAYS IT AND I CALLED NVC AND THEY SAID IT HAD 2 BE VALID FOR 6 MONTHS. THEY WONT GIVE ME THE PASSPORT EVEN WITH A CERTIFIED COPY N BECAUSE I WAS REGISTERED TILL I WAS 3 YRS OLD. THEY WONT EVEN WAIVE MY PASSPORT FOR ONE MONTH MORE....


As Erick said, I'm at a complete loss as well. Have you contacted the US Consulate in Cuidad Juarez and inquired about this? I know you said you spoke with NVC, but sometimes they're not exactly correct in the info they give out.

My wife just called me. We have RFE for missing PCC from Finland. But I have lived there only for 9 months. They are asking a statement from my wife that I have lived there only for 9 months. :wow: . But on their website is if you lived more that 12 months in another country PCC is needed. What to do, any advice?


Um, wow. I would call an operator up and ask about this. Try to speak with a supervisor and ask them to re-review your case. Asking for a statement is kind of ridiculous.

I believe (although I'm not entirely sure) that USCIS sends everything they have to NVC, and then NVC sends that along with the AOS and IV packages to the US Embassy/Consulate. But I'm not 100% sure about that.

Guys i feel devasteded. In order 2 get my Visa my passport has 2 be valid for atleast 6 months from the day of entry. My passport will be valid for less then 5 months by then. I got my passport when i was in the USA and now that I am here in Mx it is impossible 2 renew it! My birth certificate isnt in the government system. Where i was registered they have my certificate but in the capital where everything is they dont have it so technically i dont exist. The other way i can get it is with my parents marriage certificate, i tryed but on my birth certificate my moms name is written with a C n on her marriage certificate it is written with an S.... They wont give it me unless i go 2 a judge but it takes up 2 6 months 2 process everything. What should i do? any sugestions? please help im dieing here! :crying:


You might be okay even though your passport won't be valid for 6 months. I was reading interview instructions on the US Consulate in Cuidad Juarez site, and all it mentions is to bring a VALID passport to the interview. It did not mention anywhere that it has to be valid for X months. And according to this page on CBP (Customs and Border Protection): https://help.cbp.gov...detail/a_id/905 Mexico is a country that is waived from the 6 month rule upon entering the US. I believe that since you'll actually be moving to the US as a US permanent resident when you cross the border, it shouldn't matter if your Mexican passport is under 6 months of being valid. If I were you, I'd contact the US Consulate in Cuidad Juarez and ask about this just to be sure, but I really do think you'll be fine.

Saylin, I see you got your interview date. Congratulations to you and all others got interview dates. Almost end of the tunnel.

I almost finished the DS-260 and all support documents except two issues:

1. My wife's old apartment lease terminated on July 31, 2010, her new apartment lease started on August 3, 2010. She had to stay in friend's place for a few days till the apartment was ready. So, at the DS-260 page of "present and previous address information", I filled in like:
Address 1, Aug, 2010 ~ present
Address 2, Jun, 2009 ~ Jul, 2010
Then there is a message shown "There is a gap in the dates you have provided. Please include ALL addresses where you have lived since the age of sixteen. The national Visa Center may ask you to confirm unexplained gaps in residency."

I am afraid this might trigger an RFE. But I have no idea how to deal with it. Any one has experience or work around?

2. My wife has an expired passport and replaced by the present valid passport. Should we send biographic data pages for both passports, or just the present valid passport?

Thanks! So happy I finally got the date.

I have a friend that had the same issue with getting an error about a gap. You have to have the end month and start month to be in the same month. So just put address two ending in August 2010 and address one starting in August like you have it already. When my friend did that, the issue was solved.

You just need to send in a copy of the present passport. I also have an expired passport from years ago, but they don't want that. They just want to see your current passport.

nice larar! My poor wife went to her physical/med exam today and had to get 4 shots: MMR (she only got Measles when she was about 3), Varicella, Tdap, and Influenza...all in one day. That is just insane. TB results came back negative and everything looks good, but I doubt she will be feeling great for her interview with all this ####### in her system.

OK IV payment shows PAID and I started filling out DS-260 for Electronic Processing

The education section is COMPLETELY gone. U.S. last visits are there with exact days of entry and how long of a stay but they only want last 5 visits. Previous address section of addresses lived since the age of 16 only asks for month and year and I believe that hasn't changed. The rest I beleive is the same as the paper version.



You're now the third person I know to mention that information requested is changed or all together gone. So, sometime between February 8th to March, NVC must have changed the DS-260, probably to make it easier for people to fill out. Lucky you :P I spent a few hours one day trying to get exact dates, and education info, and supervisor names and such. I'm glad NVC made the change though.

Also, the bit about them requesting only the last 5 US visits, that was the same for me too when I filled out the DS-260, even though I had collected months ago a lot more than just 5 since the DS-230 wants all trips.

Just called an operator at NVC now. According to operator John, it was sent out today, March 28. The AVR hasn't updated yet though. Most likely tomorrow. I've noticed it takes a day or two after an event for it to appear on the AVR.

I'm not sure, but I believe the AVR updates to when it has left. I've been calling the AVR a few times a day, but it's still on the case complete message.

The best way to know though is calling an operator up. I'll be calling an operator up later myself to see if my case has left and on its way to the US Consulate in Montreal.

You're welcome. I had read about DOS months and months ago. Ever since I got CC, I was calling up both NVC and DOS each day.

Note, DOS isn't open as long as NVC is. DOS's hours are: Monday to Friday, 8:30am to 5pm (closed on Wednesdays from 11am-noon) EST.

Yes, CC is usually after SIF. If you have a SIF, call an operator to see if you have CC. The AVR will also update (albeit a couple days later) on when you get a CC.

There's a very, very low chance of getting an RFE after a SIF. I would like to say 0%, but you never know with NVC.

DOS = Department of State. You can call them at 202-663-1225. Press 1 to get to the main menu, and then press 0 to speak with a visa specialist.

So now when I know my interview date, should I expect something to be mailed from the embassy? What about those packet 3 and 4? Do they apply for CR1 visas?



Packet 3 and 4 are for K1 visas. Packet 3 contains the DS-230 and a few other forms specific for K1. Packet 4 is the interview letter as well as what documentation is needed at the interview.

IR-1/CR-1 visa applicants technically do get packet 4, but we just usually call it the interview letter.

I got an RFE on 3/23. I asked them to re-review it. Login Failed and Case complete on 3/25th. I only checked the AVR this morning.
I could not believe how sometimes we get RFE's for documents already sent. It breaks your heart and your emotions. I know my case is IR5.
I felt like staying in this forum with this group since we all went through the TSC journey.
After all we have gone through why don't I feel happy also hearing this message? This journey has caused emotional stress and now I don't even trust anybody.
Saylin, my spreadsheet guru please guide me what should I be doing now to get the interview date.

Grats on getting CC! It's good that you asked them to re-review your RFE. I've seen some really ridiculous RFEs lately.

All you can do now is continue calling NVC, and start calling DOS, to see if an interview date has been assigned.

Does NVC will email me that my case is already complete or i need to call the operator?

You'll only find out about case complete through either an operator or the AVR. Case complete emails are only sent out to those doing EP as they're sent out from an EP email address, and not NVC Inquiry.

We received email from NVC that has appointment letter with interview date and time, that must be printed out and presented on the day of the interview and also we got other information like what documents to bring, saying we should do medical examination before the interview and they provided a link where to check online other requirements. Hummm... so seems like there is nothing else to be received from he embassy, correct?


Nope, that was the last piece of correspondence you'll ever receive. The US Embassy/Consulate never sends out anything to IR-1/CR-1 visa applicants (unless you do DCF), only NVC sends out things to IR-1/CR-1 applicants.

The cover sheets I printed from the online payment system instructed me to send them to the same address (31 Rochester Avenue Suite 100) but different Attn: one was (CMR) another was (CMR AOS). I guess I will just ignore this email then. Thanks for setting me straight.


Yeah, same addresses, but different Attn, so I'm assuming the packages go to different departments to get processed.

And yes, just ignore the email ;) Call up an operator next week to see how your case is doing and if there's any updates.
