OK, so I just got NOA1 on our I-130. I paid 420 for the I-130 fee. I know there are more fees coming... how much is the i-864 fee and the IV fee? are there any other fees i have to watch out for? Just trying to be prepared...


The I-864 will cost $88 and the IV will cost $404. Then the beneficiary has to have a medical done later on, and this varies by country.

Hi to everyone i just wana ask a simple question i am just getting mixed up with all the different things on different websites

My question is after approval of I-130 what document should we sent to nvc and the orignal one or the certify copy???? (Other than the i 864, ds 230 and income supporting documents)

which documents send by the petitioner and which documents from beneficiary

Some visa info places tell us to send the i 864 in with supporting documents for income etc...but then here on vj it also tells we should send in original or certified documents of ...birth certificate...(petitioner AND beneficiary?) marriage certificate and translation, divorce decree ...

should we submite these other documents to nvc or will they be taken to interview by beneficiary?

and if we sumbit the orignal one so how can the beneficiary bring the original documents at the time OUR interview??? or will they swap the documents at that time if the beneficiary brings all copies of the originals sent?

You can send either the original or certified copy to NVC. You will receive these documents back at the interview. If any of the documents are not in English, you also have to submit a notarized translation copy.

I-864 package:

If you need a co-sponsor, submit the same documents as above for that person, plus a birth certificate or passport copy to prove US citizenship.

The AOS package is done by the petitioner.

DS-230 package:

-DS-230 (part 1 signed only, do not sign part 2)

My husband (the US citizen in our case) has a blank beside the father's name on his birth certificate as well. His biological father was really never a part of his life. When he was about 10, his mother married someone, now his step-father. On the G-325A, he listed his step-father under the information for father (name, birth, etc). Whether or not this will get an RFE for us, I don't know as we're still at CSC. But that's what we did.

If I remember correctly, after a year of no activity on the part of the petitioner and beneficiary, then the case is closed.

Can I ask why you're still in NVC after a year? Usually it's only 2-3 months.

I'm the same as you. My NOA1 is Sept 2 and my one and only touch is Sept 3rd. Nothing since then. Like others have said already, don't worry about the lack of touches. Some people receive no touches and get the approval anyways. Although none of us can deny that we want to get touched ;)

You can start calling the NVC in about a week to get your case number. Then you will need to send in $88.00 for the Affidavit of Support and $404 for the Ds-230. You will need letter of employment and 3 yrs. tax returns. I am not 100% on this as I just entered the NVC last month. 1st you pay the fee bill then send in the AOS. Not sure if they notify you when to send in the DS-230. Just a little heads up. Also S.0. should have their police clearance certificate ready so you can send that in after the AOS. Hope this helps.


The letter of employment is optional as is 3 years of tax returns. The only thing mandatory with the I-864 is the recent year of tax returns. But most people include 3 years and the letter of employment. And you send in the DS-230 as soon as the IV bill appears as PAID on the payment portal website. Don't wait for NVC to mail you anything as that can take weeks and weeks. Being proactive at this stage will shave off so much time.

It's only available in very few consulates. It's being tested out, and might one day be available to all consulates, but I'm sure you'll be long gone out of this immigration stuff before it's available everywhere.

Lol... yes, one can speed through the NVC.. but the montreal consulate is a major speed bump/brick wall. Quite possibly the most trying part of the whole wait, as it feels like your file is being used as a doorstop/desk pillow in someones office. Last year our case cleared the NVC on the 18th of October and we had our interview on the 11th of February... pretty close to 5 months.


Yeah, definitely not looking forward to the wait at the Montreal consulate. It's probably going to feel a hundred times longer than the USCIS stage.

Can SHe ( US citizen) add me on her health insurance as a beneficiary if we are already married even if I am still here in the philippines and got no SSN?. how about car insurance? can she add me too even if im nt in the USA?

My husband (the USC) had no problem adding me on his company's health insurance plan (which includes life insurance). He also didn't have any problems adding me onto his car insurance. I don't have an SSN either nor am I in the USA.

As other people have said though, it might vary with the companies she is a part of, but get your spouse to ask the varying companies to see if you can be added without an SSN or presence in the USA.

You could if you want to, but what I'll be doing when I get to NVC is apply adhesive labels on and write my case number on that. The labels can be removed afterwards with no damage to the originals.

Looks great to me. Just remember (if you haven't already done so), on the back of the passport pics, to write the beneficiary's full name, their date of birth, and your NVC case number. Also, make sure your NVC case number is written on the top right of every single paper you send in.

I received an email from my Attorney today with a copy of a I-797C, Notice of Action. Would this be the NOA1? If it is, I thought they didn't have a priority date on them. This one does. I don't want to put it in my timeline if it isn't a NOA 1. Sorry I'm not understanding all this and if they are dumb questions.

Yes, that's the NOA1. The NOA1 does have a priority date on it, but it doesn't apply for IR-1/CR-1 visas since there isn't a limit on the number of those visas per year. You should have two other dates as well on your NOA1, the received date and notice date. The one we all go by here on VJ is the notice date aka NOA1 date. Hope this helps to clear up some of your questions/confusion.

NVC has just assigned my case number and invoice I.D. number. i thought i could send my DS3032 form via email but when i visited the precribed site www.ImmigrantVisa.state.gov, i note that my country,Jamaica is not listed as one the countries to submit forms electronically. Can i submit the forms using another email addrss, like the one the NVC used to send me my letter?

Jamaica isn't eligible for electronic processing, meaning you can't submit the I-864 and DS-230 electronically, but you can email the DS-3032, every country is allowed. After I read some topics that related to tax transcripts, NVC needs 3 years of tax transcripts,But my 2007 income was $17,000. Should I wait for 2010 tax ?


NVC doesn't "need" all three. The only thing that is mandatory to send in is the recent year, 2009. The other 2 previous years (2008 and 2007) are completely optional. And don't worry about previous years you didn't meet the guidelines. NVC only looks at your current year and income. That's what they're concerned about. They don't care if you wouldn't have been able to sponsor two years ago. They want to know if you can sponsor NOW and in the future.

I received DS-3023 form from NVC, and also it attached a NVC #s. I paid $88 online last night. First off, it's DS-3032, not 3023 :P

You don't need to send in a hard copy of the DS-3032, you can just put the needed information in an email and send it off. Link: http://www.visajourn...il_DS-3032_form

Don't wait for NVC to send you any forms or it could take weeks. You need to be proactive and fill out the forms yourself and send them in. Once your I-864 bill on the payment portal appears as PAID, you can mail in the I-864 package.

Greetings VJ Members,

Is there a specific ordering that the paperwork needs to go in for the I-130 packet? My husband and I were looking and didn't come up with anything. Maybe being a little nervous but I'd hate to come across an issue just because we didn't put our marriage certificate right after his birth certificate, etc...

There's no specific/mandatory order, just as long as everything that's needed is there. I used the following order: G-1145, check, cover letter, I-130 form, G-325a form for petitioner, petitioner's pictures, G-325a form for beneficiary, beneficiary's pictures, copy of petitioner's birth certificate, copy of petitioner's passport bio page, copy of marriage certificate, copy of beneficiary's birth certificate and passport bio page [which I found out later is not needed, oh well], and evidence of our relationship in a small bag. Whatever order you do it, make sure it reflects in the cover letter. The cover letter isn't necessary, but makes it clear what documents are included and makes it look "neat".

For date and place of marriage and for prior marriages, do they require the city AND country? City/State/Country? There is not a whole lot of room for this.

For mine, I just put the name of the courthouse we got married. If you want to put city, state, and country, just write it in by hand since there isn't a lot of room.

Also, "applicants last address outside of the United States of more than one year". My husband lived in England while he served in the US Air Force. Although he was in England he was "on American Soil" what would he want to put there?

"Last Occupation Abroad". Does he need to list his military service abroad - again although he was outside of US he was serving for the Air Force...

Lastly, "This form is submitted in connection with an application for"... Other: I-130???

That's what we put on the G-325a for the petitioner, Other: I-130.

I'm not sure about the address and occupation ones, sorry. If anything, I'd put the address in England, and for occupation, list US Air Force. But that's just my guess.

I did that because I'm currently in the US and don't have the originals with me (I forgot them in Austria), that's why, and my husband only has copys here, for insurance and so on... But well, it got approved, I mean I got my NOA 1, so... Anybody ever had a problem with anything like that?


You only need to send the original in when you're at NVC. A copy at the USCIS stage is completely fine.

When filing taxes in the USA, you need a tax ID, and for those that don't have an SSN, the ITIN is a substitute. It takes longer for those applying for an ITIN than those just filing regularly cause there's an extra step involved., thus 6-8 week wait (or more during tax season). The only thing you'll be getting in the mail is your refund, along with a paper I'm presuming stating what the ITIN for your spouse will be. After sending in the 1040 with the W7, you don't have to do anything else except cash in your refund ;)

Have your spouse fill out the W7 with her information, have them sign it, and then mail it to you. Or if one of you visits each other, get it then.

Does anyone fully understand how this ITIN stuff works? Obviously, I'm in the same boat as many of you and wondering WTH do I do? Seems like the best way is to fill as married and include W7 form with the return. Now, I don't fully understand if this is all it takes? IRS website is confusing saying that "If you qualify for an ITIN and your application is complete, you will receive a letter from the IRS assigning your tax identification number, usually within six weeks." So what do I do with this number when I get it? Tax return should be already submitted with W7 form which is the application for ITIN. I'm totally confused. :bonk:


Ok, hopefully I can help you to understand this.

If you file 'married filing jointly', you attach a filled out W7 to the front of your filled out 1040. Don't forget to have your spouse sign the W7 and the 1040, their signature is required and your signature is required only on the 1040. You then mail it to a special address. The IRS will assign a number and then mail it off to another department to finish with the 1040. During tax season, it then can take 8-10 weeks to get your refund.

If you file 'married filing separately', you do NOT need an ITIN. You just have to write in 'NR' or 'NRA' (for Non-Resident Alien) in the SSN field on the 1040 when it asks for your spouse's information. Also, the spouse doesn't need to sign anything, you just need to sign the 1040.

In both cases, you'll have to fill it out by hand.

I had an hour long discussion with an IRS agent all about this on Wednesday.

I think I can not use Married filing seperately, since in that also IRS asks for spouce's SSN

Is there any drawback in filing for an extension ?


For married filing separately, you can put NR or NRA (for non-resident alien) in the SSN field. But you have to fill it out by hand, not online. You only need an ITIN if you do married filing jointly. I just talked about it this week with someone at the IRS.

If I understand correct, I do not need the birth certificate for my wife to file for the CR1, but rather she will need at the interview. Is this correct?


It would help if you said who your wife was, the petitioner or the beneficiary.

Either way:

-when you submit the I-130, you need to either include a copy of the petitioner's birth certificate OR a copy of the petitioner's passport to prove US citizenship

-when you submit the DS-230, you need to include the original or certified copy of the beneficiary's birth certificate

Just the DS-230. A few lines above the instruction package, there's one for when you received the I-864 (aka AoS) package.
