Why do I just hate weekends and looking fwd. to Mondays.....?!?

Ever since my husband sent the I-130 last August, I've come to hate weekends too. Two days lost each week in which USCIS and NVC could have worked. Posted Image

thank's val & gary .. another question, is it ok if my husband didn't include the coversheet both aos & IV when he send it to nvc?

Um, yes, you were supposed to send the cover sheets in from the payment portal. That's the proof that you paid the bills and that they were accepted by NVC.

I'm no expert on the NVC, in fact we have been looking for advice ourselves (SIF excepted), but with regard to the cover sheets, if you are proceeding with electronic processing, I am pretty sure you have to include the cover sheets with barcode. Some one will correct me if I am wrong.

You have to send in the cover sheets for those doing EP and for those that aren't. Everyone has to include them.

Saylin, called NVC again and the operator gave me the beneficiary ID. Thanks alot. The Wiki doc of NVC for Montreal beneficiaries is awesome!!!

1. In the body of OPTIN email, is it enough to just include petitioner & beneficiary's info as described in the Wiki doc? Or should we add a few line to explain that this email is for OPTIN?

2. Although I got the NVC#, IIN number, when I try to login to payment portal, it shows "Sign in fail". Should I wait for a few days?

1 - Nope, you don't need to explain anything. The first five letters in the subject head (OPTIN) is enough for the system to know that you want to opt in to EP. Just make sure you include name, date of birth, and email address of both the petitioner and beneficiary in the body, that's it.

2 - Yes, try waiting a few days. A lot of people have been getting problems with the payment portal site. You should be able to log in sometime next week and pay the AOS fee. Then, once the Choice of Agent form is accepted, the IV fee will appear as well.

Dear Sir/Madam:
Your inquiry has been received at the National Visa Center (NVC).
This petition is now eligible for further processing. The petitioner, beneficiary and/or attorney of record will receive an Instruction Package regarding further processing of the petition.
If a period of one year passes from the last date of contact with the NVC (by email, telephone or mail), all submitted fees and documents will expire. In that case, your fees will need to be repaid and documents will need to be resubmitted in order to continue the immigration process.

Is this the acceptance of DS-3032 EMAIL?

I'm not sure. I think the acceptance email usually mentions the DS-3032, but yours doesn't.

My wife is from China but she is Canada PR and stays in Canada since 2010. The NVC case number starts with MTL. I think Montreal is the right one.

Just got off the phone. NVC operator gave me the IIN number, but no beneficiary ID. She told me the IIN number and beneficiary ID are same. Is it right?

The NVC lady also told me that I cannot send in OPTIN email until they notify me. Is it right? Saylin, I saw you sent your OPTIN email the same day you got your case number.

We used a lawyer to file I-130. But I would like to handle NVC step by myself using EP to speed up the whole process. I was told to send an email to NVC to remove the lawyer as choice-of-agent and list myself as the choice-of-agent. Anyone has such experience?

BTW, how to fill in the timeline? Thanks.

Ah, ok. Well, if she's going to have the interview in Montreal, then everything I said above applies to you, as well as the wiki I wrote up that's linked in my signature.

The IIN and Beneficiary ID are NOT the same. They are two different numbers. The only thing they have in common is that they're both 8 digits long. Call another operator up and ask again.

You don't need to wait for them to contact you before sending the optin email. As soon as I got my case number, I sent the optin email. It then took 16 days to accept it.

I haven't read much about removing the lawyer, but sending an email would make sense. But you're required to do the DS-261 online, so not sure how that works. Call an operator up and ask. Mention that your wife is in Canada and that Canadians are required to do the online DS-261. Perhaps just filling that out and appointing you as agent automatically removes your lawyer as the agent. Not sure.

To fill in your timeline, look at the top right of the page. Beside your user name, there's an arrow for a drop-down menu. Select 'My Timeline' and edit away!

We just got our NVC case number and would like to enroll electronic process for Montreal embassy. A few questions:

1. When we send in OPTIN email for EP at Montreal, do we just send filled DS-3023 form with the email?

2. For EP process at Montreal, which choice-of-agent form do we need? DS-261 or DS-3023 form? Where do we get this form?

Are you going through Montreal? Your flag says China... And Posted Image

If you're going through Montreal:

1 - You don't send the DS-3032 with the optin email. Just send the optin email.
2 - The DS-261 is REQUIRED, so you fill that one out. Disregard the DS-3032. It's found online.

Please look at the first link in my signature. It will help you with EP and online forms (only if you are in Canada)

So, after being out of the loop for three weeks, our AOS and IV fees are paid, and our documents have probably arrived at NVC today.

Can anyone (Saylin!) bring us up to speed as to how we check what is going on at NC, and what procedures are followed by NVC from the stage we are at onwards.

They have promised us supervisor assisted processing due to our expedite direct to consulate once they have processed the docs. How can we trace what is going on? And does the SIF mean everything is done and finished.

Thanks all! Posted Image

The only true way to know what's going on at NVC is to call an operator up and ask. The week after I submitted my last package, I started calling an operator every single day to hear what's going on with my case. Make sure you mention your expedite every time you call and see if anything's being done about speeding up your case.

You can also try logging into the payment portal. When you get a SIF, it's usually a good indication the case is complete at NVC. Call an operator to confirm that the case is indeed complete.

Take it from someone who has worked in the US Government for 18.5 years. You will NEVER see instructions that tell you to fill out in black ink and sign in blue.... NEVER. As a matter of fact.... black ink is the preferred color for most forms. In the military, we can ONLY use black ink. Blue, green, red, and brown ink is used by the "top brass" ONLY. Just relax, I wouldn't worry about it. Like someone said earlier... they can look at the back of the document and see the imprint. (just my two cents.)

Yeah, I doubt I would see instructions to fill out in black ink and sign in blue. But I remember seeing one or two people get RFEs from NVC because they signed in black ink and they thought it was a photocopy. That's why I suggest signing in blue. but you're right, they can simply see the imprint on the backside (if they're competent enough to even look for that).

How long does it usually take to get an interview date after CC? And after CC how soon should I expect to get smth from the embassy?

Getting an interview date after CC depends on the embassy/consulate. As soon as an interview date is assigned (or shortly after), you'll receive the interview letter from NVC.

When it rains, it pours...........................

We have hit a freaking roadblock and I am pi$ed. Wife called about an hour ago, pretty upset so I had a hard time understanding what she was saying.

Eventually I figured it out, for one, they said they do not have the divorce decree that I sent, the original and a copy. Christ!! She said that they said I could scan and email it to the Embassy.

Secondly, they are saying she was an OVERSTAY on her K-1 Visa even though we were married well within the 90 day window. We did not file AOS right away as I was laid off soon after we married. I made an INFOPASS appt back then to see what the requirements were for filing AOS and I was told there was NO time frame to apply. Good...........Long story short, unemployed for 5 months until I took a job across country in Florida. Due to the move and our son due 3 months after arriving, we delayed AOS once again. 4 months later I was laid off again, went a few months until I found work only to be laid off for a 3rd time. Needless to say, no income, no AOS. The economy really screwed me when it came to finding a damn solid job!!

Well, now we need to file an I-601 (Application for Waiver on Grounds of Inadmissibility) and pay an additional $585; they are expediting this. I am waiting for an email back from the Embassy since I cannot call and speak to anyone in the Visa Unit to confirm what my wife had explained to me. I am going over the I-601 and it is pretty straightforward, all 11 pages!! I'll email it to my wife and she can show up at the Embassy on Monday or Tuesday to continue this NIGHTMARE.

I want to BREAK something right now!!

Wow, just wow... Posted Image I thought you guys were golden and would get the visa at the interview. This process is so ridiculous sometimes...

If you have the 2010 1040 and W2s, you're good. And form I-134 is filled out by K-1 applicants, it has nothing to do with IR-1/CR-1.

HI Saylin,

I saw this now, on l-864 and l-864EZ instructions,

HOW SHOULD I COMPLETE THIS FORM?
- print clearly or type your answers using CAPITAL letters.
- use BLACK INK
- If you need extra space to answer an item:
......................

Maybe this was Dantes talking about :)

That's just telling you how to complete the form, like in the boxes. That has nothing to do with the signature.

Saylin! When I read this, I wanted to cry..
I just received the mailed documents from my kids (IR-2), and actually ready to send to NVC both the IV and AOS packets tomorrow morning. They signed in black ink ( page 2 of DS 230 and the I-864W for AOS).
When I checked, they do look like photocopies..OMG! I am still sending them both out tomorrow, and PRAY I don't get an RFE.
I paid my IV bill since March 4..

Let's hope the officer that reviews your packages doesn't pay much attention to the signatures! Good luck!

I am in a difficult situation. When I filed my fathers I-130 I was employed and making good money. Last month I got laid off and only have paycheck stubs until Feb. I have few leads and hoping to finalized within week or so.

Saylin you kind of answer my question regarding waiting to do AOS after I start new work. I just paid my Immigration process fee $404 to keep the ball rolling. I am planning to do a I-864EZ since I will be the only sole provider and support for father.

Is there negative effect if I wait 2 or so weeks even though, I just paid my processing fee.

Nope, no negative effect. The AOS and IV are separate tracks. If you want, you can even send in the IV package first when it's ready and then send in the AOS later. As long as NVC gets both packages, they don't care what order they get it in.

Since the instructions specify BLACK ink, I don't think you will have a problem. I used black ink on all the forms submitted to USCIS and NVC with no problems. An original signature leaves an impression on the back of the paper that would not be present on a photocopy. If I worked at USCIS or NVC I would give a RFE for those signed in blue ink for not following instructions.

Ok, I looked all over the instructions saying you had to sign in black ink, but couldn't find it. Can you help me out? What page on the instructions did it say? Can't believe I missed it saying that you had to sign in black ink...

For writing the case number, you can write in whatever color you want, it doesn't matter.

BUT, when you do signatures, make sure it's in blue ink. If it's in black, NVC might assume it's a photocopy and issue an RFE. So, always sign in blue ink.

Hey everybody! I haven't been around for a while because I've been busy with work, etc., but I've mostly caught up on this thread and the March NVC thread. Congratulations to Saylin for her CC!

I sent out my IV and AOS packets together on March 7 and they were delivered on March 9 (side note: I would recommend using the USPS Priority Mail flat rate envelope... it's only $4.95, so you save a fair chunk of change as opposed to Express Mail, it only takes one day longer, and you can get free delivery confirmation if you pay online). I guess now I just have to wait for my SIF and hope for a CC soon! It looks like I'll have to wait about two weeks from when the package was delivered, right?

Thanks! You should be getting a CC soon, in another week or so, if no RFEs. Wow, pretty cheap and gets there quickly!

yeah, the thing is...I never sent any documents to NVC. I just paid all the fees, and requested an expedite about a week ago...and now when I called NVC, they said it was shipped to Bogota for further processing. Im happy, but at the same time, a little mad at myself for not waiting longer because I just sent all the documents to my mom so she could ship them out for me (Im living abroad with my wife). I also was planning on moving back to California before the interview, but now I am pretty clueless on what Im going to do.

Once the case arrives at the embassy, I believe they'll then send you packets to fill out (AOS and IV). Either you mail it to them or you bring it with you to the interview. I'm not completely sure how the process goes after you get an expedite granted at NVC. I'm sure you'll be hearing soon from the Embassy on your next step. Since the expedite was approved, you may want to stay abroad until your wife's interview and then move with her back to the USA. Sucks you already sent the documents to your mom already and paid for that and now they just have to be sent back to you.

I just got this email response after I requested an expedite:

Dear Sir/Madam:

Your inquiry has been received at the National Visa Center (NVC). The NVC has completed its processing of the visa petition you mentioned in your letter and has forwarded the petition to the assigned US Embassy/Consulate General for further processing.

Please be advised that further forms and/or fees may still be requested by the US Embassy/Consulate to complete the processing of this case. Any further inquiries should be directed to the assigned US Embassy or Consulate General.

You'll either find out about your CC through an operator or the AVR. Just keep calling an operator every day. They'll know when a package has been received and when they're reviewing it. What dates did you send in the AOS and IV packages?

Grats on CC!! Posted Image

I'm not sure about other countries, but I know for Canada we can get interviews assigned any day during the month, not just the second week. And sometimes the interview is a month from when it's assigned, or two months. So, bottomline, an interview can be assigned any day and for any month; they're not necessarily scheduled the second week for the next month.

I have another question on DS-230 concerning question #23 : List all educational institutions attended
i put the primary school and im not sure what to put on Course of Study
i put primary school on Degree or Diploma

Any suggestions?

I'm not exactly sure what primary school is (we have different systems in Canada), but under course of study you can put 'academic' and if you didn't receive a degree or diploma, just put 'none'.

When I filled out the DS-260 online, it had a few instructions for education. It said to only include high schools and college/universities. And for high school, put 'academic' in course of study and for colleges/universities put whatever the course of study was. For high school, put 'high school diploma' if you received one for the degree or diploma column and for colleges/universities, put the name of the degree or diploma you got if you received one.

"Using a pencil or felt pen, lightly print your name and Alien Registration Number on the back of each photo."
This is from the instructions of N400 Application for Naturalization

A passport photo has to be printed on photo paper which is like plastic so nothing would leak to the other side. So a Sharpie should be OK.

I have also read that passing a clean eraser on the back of the photo makes it easier to write with a pencil afterwards. And #4 and #6 pencil is easier to write with and the tips should be rounded. hahaha this is like rocket science

Yeah, I'd still never use a Sharpie, I'd be so scared it'd leak through. I'll stick with a blue pen. :D

I didn't know that that happend so much but if you do a search on VJ there are a lot of cases where people got RFEs for documents not being "official" or NVC saying they don't have them. I doubt that so many people would have the same RFEs if we all followed the same guides. It's just really discouraging. Even you Saylin, did you say that NVC said that "they never got your form" It's such BS. I'm going to give up obsessing now.

I cried to her telling her I'm looking at the photocopy of what I sent in to them and how it IS the original certified copy and that I'm sure of what my marriage certificate looks like. She said she can't see what I'm talking about and can only put in a service request to have a document reviewer look at my file. She told me I should wait until I get the letter from the NVC (hahaha I haven't even officially received an RFE) but if I want I can send in a new (the f*cking same) marriage certificate today if I want and it wont delay my case. It just turned 6am and I've already talked to three NVC customer service reps. I'm glad I didn't let Sarah discourage me because Jay was awesome (and sounded like she was 17 she kept saying the word like). Gonna send in the RFE marriage certificates today. They'll get them by tomorrow and input them in two weeks. :bonk:

Also Sarah told me that I could write a letter stating that this IS the document and the only version. So I'm sending in that letter with another marriage certificate. A photocopy of it. A photocopy of what i originally sent it. and this French thing called a bulletin de mariage that is state issued saying that you got married (not a marriage certificate but it comes from the town hall) WOOF!

Wow, that's ridiculous! I've heard of a few cases where the original or certified copy weren't accepted by NVC even though it was the original or certified copy of the certificate. It's complete bull****! I hope the service request works, someone looks at it again and realises that it's the certified copy. Those reviewers need to realise that not all marriage/birth certificates look like the ones from the USA and they don't all look "official" even when they are.

Can I write NVC case no. on DS 230 and copies of the original certificate?

Yes, it's suggested to write the case number on ALL pages of the package (minus the cover sheet and cover letter). If you don't feel comfortable writing on original documents, you can always use sticky notes. That's what I was planning on doing.

Can I start and mail the Affidavit of support form its showing Paid now.
Do I have to fill out anything else or wait for the $404 to clear.

AOS $88.00 PAID
Select 15-MAR-2011 17:14 IV $404.00 IN PROCESS

If the AOS is showing as PAID now, yes, you can mail off the AOS package! Make sure you include the cover sheet from the payment portal and put that as the first paper in the package.

I read somewhere that you're supposed to use a permanent marker like a Sharpie.

That'd be a bad idea. Permanent marker would most likely leak through and would be visible on the other side.

Got my case #! And it only took 2+ months.
Today is a good day.

Grats! It's about damn time!

You guys should check your Embassy Facebook page and see if they have what Bangkok has.

Immigrant Visa Q&A By US Embassy Bangkok

Just checked if the US Consulate Montreal has a Facebook page. Nope. There is a US Embassy Ottawa page, but no one goes through that in Canada for immigrant visas. Oh well!

Just don't end up one like this:

http://www.ocregiste...initiative.html

The reported of that story is the one that interviewed me. I got a text from her today saying she was on vacation, the article should be in print and online next week.................yeah, right. I've heard that before.

Posted Image I definitely wouldn't want to be a fake immigration attorney. I'd make sure I was qualified first :P Although, unless my husband moves, I won't be able to. So, I'll just stick with helping here on VJ :D

Wow, that story hasn't been printed yet? Jeez...

Thanks Erick

Thanks Saylin. I think you can be in immigrant lawyer. hehehhe

You're welcome.

Hehe, thanks. A lot of people have been saying that lately Posted Image But, unfortunately, the town my husband lives in is super tiny (only 25k people) with no law school, thus I wouldn't be able to become an immigration lawyer. It would be pretty cool though being an immigration lawyer!
