Yep, anyways we are planning to call them as soon as we have her case#, because we are planning to ask to expedite the case to France. I expect them to accept due to the TSC mess. I think it's worth giving it a try

Oh, it's definitely worth a try! I wish you luck and hope the expedite is accepted!

Larareyes, Can you please tell me how you did the choice of agent for your baby's case? The email addresses you sent were yours and your husband's?
Saylin maybe you can help me too

Many thanks,
Lidia

Hmm, not too sure about a child's case. Umm, perhaps you can send the email, put in your daughter's info, and then select to have your husband as the agent. I'm actually not too sure how the process goes for a child's case. Maybe calling an operator up and asking would be the best bet.

I already called, first AVR and then operator.she said give them 20 days and I know that is not thrue.I will call everyday!

I'm glad you're not going to listen and instead you're going to call everyday! Those operators should stop telling people to wait XX days before calling again. Posted Image

She has everything she needs for the interview on Friday, Thursday Thailand time.........still need to send her $$ tomorrow to pay for processing.

Wow, that took awhile to get the documents over there! Glad your wife finally got it though!

Your interview is so close! I'm excited for you and your wife! I'll be waiting to hear the good news this Friday! ;)

saylin> What you talking about. i was explaining you that for my adjustment of status for uscis i got to send those things , and i know is FOR NVC im not a totally stuped person. OF COURSE AFFIDAVIT OF SUPPORT IS NOT AND IS NOT GOING TO BE ADJUSTMENT OF STATUS.

I DID ALL MY PROCESS BY MY SELF AND NOW IM DOING MY DAUGHTER PROCESS WITHOUT A LAWYER SINCE THE BEGINNING SO BELIEVE ME I KNOW WHAT IS USCIS, WHATS NVC, WHATS AJUSTMENT OF STATUS IS, AND DIFFERENT IMMIGRATION TERMINOLOGY. so please dont talk to people like they are stuped . thanks anyway AND ADIOS A TODOS .

In your last post, you said "uscis require tax form for 1864 for ajustment of status". The I-864 is Affidavit of Support. The Adjustment of Status form is the I-485.

Are you talking about your daughter's case, an IR-2? There is no adjustment of status needed to be sent to NVC, only the I-864 (Affidavit of Support) and DS-230 (Application for Immigrant Visa).

I've never talked to anyone on here as if they're stupid. You said something and I wanted to correct you about something. You also asked me a question, and I provided the answer. I'm sorry that you misunderstood me in any way. Next time you say something incorrect or ask a question, I just won't reply to you at all if you're going to reply like that.

IR-1 / CR-1 Spouse Visa Process & ProceduresCalifornia to Texas & Texas to California - Part 2

no im talking about the moment of my process, yes uscis require tax form for 1864 for ajustment of status. and this what said in nvc pages

Before mailing the I-864 to the NVC:

1. Verify that you meet the definition of a joint sponsor and NOT the definition of a household member.
2. Ensure that:
* All pages are stapled together in the correct order
* Each page is filled-out completely
* The form is signed
5. Verify that you have submitted proof of U.S. Citizenship or Lawful Permanent Resident status.
6. Verify that evidence of current employment or self-employment such as a recent pay statement or a statement from your employer on business stationery is attached. A letter from your employer must show the date you began employment, the type of work done, and your income.
7. IF you filed US taxes, you MUST submit a copy of your most recent federal income tax return with all supporting schedules and/or W-2s or an Internal Revenue Service (IRS) transcript, even if the sponsor filed electronically.(AND/OR)
* All pages of the tax return must be stapled together in the correct order
* If you did not have to file a tax return, attach a written explanation and a copy of the IRS publication showing that you were not obliged to file.
For general information on income tax obligations, or to request IRS-generated transcripts or copies of a tax return visit the IRS website.

Ok, first off, you're not sending it to USCIS, it's going to NVC. Second, the I-864 is the Affidavit of Support, not Adjustment of Status.

If your sponsor is a US citizen then you have to send proof such as a birth certificate, passport, etc. If your sponsor is a legal resident, then send a photocopy of both the front and back of the green card.

And the second thing you bolded shows what you need to send in. Either tax transcripts OR tax returns plus W2s.

IR-1 / CR-1 Spouse Visa Process & ProceduresCalifornia to Texas & Texas to California - Part 2

hi saylin , i dont understand , for uscis i send it like that...so i have to have all w2s for all 1040?

What do you mean you sent it to USCIS? USCIS doesn't require any tax forms. Yes, you're going to have to have all W2s. Why don't you just order the tax transcripts from the IRS? You just need to send in transcripts that way, no 1040s, no W2s.

Yup, all done at NVC as of last week. Just have to wait for an interview date which I'm hoping gets assigned this week. Posted Image

**note: I included the BC for my cosponsor to show citizenship but not too sure if it's necessary.

Yes, BC of a sponsor is absolutely necessary if they're a US citizen. Otherwise a copy of their green card if they're a legal resident.

hey saylin: good news , i got the coversheet today , wow , they working jajajajja, i send the ds230 package today , they gonna receive that on wed 16 , and the AOS im gonna send it tomorrow . yeiiiii .

i have a simple request. here im gonna send you all the documents that i have for the affidavit please can you tell me what im missing or what i have wrong.

AOS FROM PETITIONER
form i-864
2010-form 1040
2009-form 1040
2008-W2
birth certificate
last pay stubs

AOS FROM JOIN SPONSOR
form i864
2010-1040
2009-1040
2008-W2
COPY OF THE GREEN CARD

Grats on sending out the DS-230.

For your AOS, the petitioner doesn't need to include their birth certificate. And if you're not submitting tax transcripts, then you need to include the 1040s AND W2s. Also, is your joint sponsor a lawful permanent resident or a US citizen?

Call an operator, give your email addresses over. Get the Invoice ID Number and Beneficiary ID number.

If you're going to do EP, then send the optin email.

If you can log on, send in the DS-261 (Choice of Agent) online.

Yeah I thought about printing the NOA2 also but the date on the NOA2 would have to be the earlier day. Maybe they just mailed the NOA2 today. Thats another possibility. What I believe is when they enter the approval into the system and send out texts and e-mails they have already printed the NOA2.

Could be. Who knows how USCIS does it. Posted Image

Has anyone gotten a touch a day after approval? I did and I wonder what it is. Can it be that they mailed it to NVC?

My NOA2 date was 1/25, I only found out through text and email on 1/26, and when I went onto the USCIS site back in January, the last touch was on 1/26, so the day after the approval. It might just mean they've printed the NOA2 and sending it to you. I suppose it could mean they're shipping it to NVC, but not sure.

Grats on getting your case number!

Remember everyone, when asking for the IIN from an operator, don't say 'IIN', ask for 'Invoice Identification Number' or the operator will probably not know what you're talking about. Do not use abbreviations with these people Posted Image

IR-1 / CR-1 Spouse Visa Process & ProceduresCalifornia to Texas & Texas to California - Part 2

Hello,

This is my first post but I have been reading and following for a long time. I sent my husbands I-130 in Aug to CSC and like most of you was transferred to TSC and then transferred back to CSC in mid Feb.

I've been silently following this thread/journey waiting for my approval. I got excited once I saw that people were starting to get approved. I was deeply saddened when I received a notice for a RFE on 2/17/11 and then didn't get it in the mail until 3/2/11. (they wouldn't tell me on the phone what they were requesting). Once I got the letter they were asking for the usual (evidence of a bana fide marriage: deeds, bills, etc...) He lives in India, I live in Cali, so I sent as must evidence that I could the very next day.

Yesterday, one week after they received it I was approved. I am vary happy and looking forward to moving onto NVC.
I just wanted to share since so many of you have helped me get through all this.

I am wondering now if those of you who have recently gotten their approval are seeing a quick response from the NVC (getting a case #) or are they back logged due to all the recent approvals. (I would be up to date on this considering I always follow this thread, but when I got notice of the REF I was too sad to follow and can't seem to catch up on the 3 weeks of pages I missed)

Hoping/praying for a speedy process for all of us here,
M

Grats on getting your approval!

Getting a case number for most people here seem to take longer than usual, on average 20 days. But it's gotten faster over the last 2 weeks or so. You'll either get it next week or the week after. In the meantime, read the guides and get all your documents and forms ready ahead of time, if you haven't already.

Great! I appreciate your help, Saylin! Well, it's impossible to notarize any of those documents, so we'll just go with 'married filing separately', I did not think about that option because I thought that ITIN will be required anyway. Thanks again

Too bad Ukraine won't notarize or certify any of those documents.

And no, an ITIN is not required to do 'married filing separately'. You just have to do your taxes by hand though as most tax softwares won't let you continue with the SSN field not filled out and they only allow numbers to be put in. Your refund will probably be less than it would be if you did jointly, but if you want, when your spouse comes to the USA after the interview, you can amend your tax returns (I believe you have up to 3 years) and change to filing jointly, and you'll get more money back that way.

IR-1 / CR-1 Spouse Visa Process & ProceduresCalifornia to Texas & Texas to California - Part 2

Hi guys, a tough question: my husband is a non-alien resident, we need to file tax return jointly, so we need to get him ITIN, right? Well, here's the problem. To get ITIN we need to fill out W7 form and attach an original or a notarized copy of his foreign passport. We need the original for the interview, so it's the option. But it's absolutely impossible to notarize his passport there (in Ukraine) because they don't notarize any documents that have a photograph. So no passport, no notarized copy. Do you have any suggestions? Why can't they accept a photocopy of his passport, they do it at NVC... :help: Thank you!!!

The passport isn't the only proof of evidence you can send in for the W7. Most people do though since it acts as proof of both foreign status and foreign identity.

Go here: http://www.irs.gov/pub/irs-pdf/iw7.pdf On the second page, there's a table listing what documents you can send in. Since you won't be able to use the passport, you're going to need to select two more documents from the list, one from the foreign status column and the other from the foreign identity column.

If you can't get any of those notarized or certified, then you're going to have to file 'married filing separately'. That way, you don't need to fill out a W7, you just need to put 'NRA' (for Non-Resident Alien) in the SSN field.

Hey guys, another question :help:
When filing I-864EZ can I use my 2009 federal income tax form because I'm still working on the tax return for 2010? It just says the most recent, so I have some doubts... Thanks!

Right now, the only thing that's mandatory is 2009 tax returns/transcripts. Then you can also send in those for 2008 and 2007. To prove current income though since you haven't filed 2010 taxes, I'd suggest sending in an employment letter and/or pay stubs. All of us will most likely have an interview after April 18th, so we'll all have to bring 2010 tax returns to the interview.

I think that after 15 March you must have 2010 tax return. Hope that you will have answers from others members confirming. Good luck.

The only thing I care about on the NVC spreadsheet is when you send the AOS and IV packages and then case complete. Not concerned about when you pay bills or send the CoA :P

yes of course, i decided to send a money order , because i first paid the AOS online, but i identified myself as the petitioner , and at the moment to put in the information of the account i put my information and my account , that reject the payment because im not the petitioner and block the option for the AOS online payment. so i had to send a money order.no other choice. that sad.
but i still can not believe they last 2 or 3 week for that men.

Then it must be something with your case if you tried all that. Wait till Monday, and if it's still not working, like I said before, call an operator up.

Yes, you have to send either the original or certified copies of civil documents, plus you have to send a photocopy of each one as well. At the interview, you'll get your original/certified copies back and then they'll have a photocopy for their records.
