I'd ask in the Mexico sub-forum about police certificates there. They'll obviously know more than I would.

And you have to make your own signature. There's not just one button to press and your timeline will appear. You write it yourself. To add: go to the top of the page, on the right, and next to your avatar, click 'Settings'. Then click on the 'Profile' tab and then the 'Change Signature' tab on the left. Then just enter your timeline and it'll appear as your signature :)

And as you said in the PM, yes, EP = Electronic Processing.

Yes, I know you're doing EP as it's required for Mexico. I did EP myself ;)

According to this page http://travel.state....5.html?cid=9684 police records aren't available for Mexico, so I guess you don't need them after all. If you did though, the beneficiary wouldn't need any from the US as they do their own national background checks.

The DS-260 is done online, so you don't submit anything else, obviously.

But you still have to submit the supporting documents for the IV package. Either before or after you complete the DS-260, you have to send the IV package with the following documents:

-bar-coded cover sheet from payment portal
-cover letter (optional)
-2 passport pictures with full name, date of birth, and case number written on the back of each
-copy of bio-data page of beneficiary's passport
-original/certified copy of birth certificate
-original/certified copy of marriage certificate
-original police certificate

Hello there GUys, just wanted to ask from your experiance with NVC Call, I know usually the talk is that it will take 20 days for NVC to process your paperwork. I am at the NVC DS-230 Completion Stage and there was some minor issue with DS-230 which I fixed and send a copy back to NVC and it will be there on Monday. I hoping to get my case complete within week or two and then get inline for interview Q. My question is how fast would NVC process my DS-230 (Update Version? If I call on Friday, will they have an update for my case or is it better to give them another week?

Second since I am a US Citizen, there will be Visa always avaiable for my wife, would we have a good change of landing an interview in September with our Priority date, your thoughts?

I believe it'll still take about 2-3 weeks for them to get your RFE. Just keep calling every day to see if there's an update.

And yes, because you're applying for an IR-1/CR-1 visa, there's an unlimited number of those visas, so there's no priority date waiting. You'll be put into the queue for interview dates to be scheduled. The wait time varies by country. I don't know the wait time in India, so it could be possible to get a September interview.

I paid AOS fee on 7/26 (still in process) but my IV fee that just became available yesterday (7/28) and paid late evening became PAID. Cant understand what the issue with AOS fee status. My accont was debit already on 7/26 and 7/28. Should I be bothered or wait till Monday to conatct NVC!


I just someone else in another thread where they paid AOS first and then IV later, and the IV bill just appeared as PAID. So you're not the first person. I'd say wait a few days, but if it doesn't appear as PAID by mid-next week, then definitely call and see what's up. They might just be backlogged for AOS, who knows. Lately NVC has been really slow with a lot of things (assigning case number, accepting DS-3032, invoicing bills, etc).

If they accepted it today, it'll probably be invoiced sometime next week. But lately NVC has been a bit backlogged, so it could be longer.

And the Philippines is eligible for an advance medical, so you can do it right away. You just need to bring proof of your case number, ie the first email you got from NVC that included your case number and IIN.

NVC first has to accept your DS-3032. Then after a few days of acceptance, the IV bill is invoiced.

You want your husband to e-mail the DS-2030 to NVC. When they receive this you'll be able to pay the AOS fee. The type of I-864 (a, ez, etc...) you need to fill out depends on your situation. Have you looked into income requirements (google I-864p) to see if you qualify to sponsor by yourself or if you need a co-sponsor?


Sorry, but that's wrong. The AOS has NOTHING to do with the DS-3032. The AOS and IV are SEPARATE tracks.

AOS is invoiced regardless if you sent the DS-3032 or not.

After DS-3032 is accepted, then the IV bill will be invoiced.

SIF is a good indication the case is complete. But remember SIF does not always equal case complete. I've seen a few cases where a person received a RFE after SIF.

Only those doing electronic processing get a case complete email. The only sure-fire way to find out about case complete is either through an operator or the AVR. But remember, the AVR is usually behind by a few days, so go with an operator :)

It usually takes about 2-3 weeks for NVC to review packages. Once it's reviewed, and there's no RFEs, then your case is complete. It then gets put into a queue for an interview date to be scheduled. After case complete, the interview date can be assigned within a few days or within a few weeks. It varies by country. Once an interview date has been set, only then will your case be sent to the embassy.

Grats! That was a fast approval!

There's currently a backlog at NVC, and instead of taking a week or two to getting a case number assigned, it's been taking almost a month. Wait about a week from your NOA2 date and then start calling NVC.

Once you do get your case number, give them both of your email addresses (petitioner's and beneficiary's). That way, all correspondence is received by email instead of by snail mail, so it'll be much faster.

In the meantime, I'd suggest reading the guides, so you know what paperwork you need for the next two packages. I'd suggest:

As a Canadian, you shouldn't be doing the DS-230. You have to do the online DS-260. And the online version only asks for the last 5 visits, so as long as you have those dates, you're golden.

The expedite you got at USCIS is only good at USCIS. You're going to have to apply for an expedite again at NVC.

And by the way, there's a current backlog at NVC. Some people from late June and most of July are still waiting for their case numbers to be assigned.

The benefit of calling every day is that you'll find out right away if a case number has been assigned. The AVR is usually behind by a few days. And the initial information package you'll get from NVC is usually received a few days after the case number is assigned.

Hello,

We are stuck on question 35 on form DS-230. It asks to list dates of all previous visits to the US. My wife is from Canada and by this time has probably crossed the border literally hundreds of times. We live about a half hour away from each other and we always spend the weekend in the US. To cross the border to visit for the weekend requires no Visa, only a passport.

Do we really need to list EVERY visit to the US she has ever done? If yes, how do we get that information so we're not making it up. It's impossible to remember how and when she's been here.

Please be aware that if you're applying for an IR-1/CR-1 visa and are in Canada, you're REQUIRED to submit the DS-260 online. And the DS-260 only asks for the last FIVE visits. So as long as you have those last 5 dates, then you're fine :)

hello all, its been 10 months now got 2nd RFE on july 11, and i just sent in my second RFE ( bona fide marriage ) on july 26, the 1st RFE was for my divorce decree and i sent that in on may 11.
I filed in OCT 16, 2010. Wish USCIS had asked that in the 1st RFE. MY divorce was 5 years ago if you're wondering. I also spent 6 months in vietnam last year.
So this wasn't like any red flags but still got 2 RFE.........I'm 33 and my wife is 26.
Now I just hope it won't be much longer. I am self employed this year, so just to be safe I my sister will help me co-sponsor.
My question is she does not live with me and I live alone, will that be a problem ??? and what do I need from her? (I already got her USCIS cert and 3yrs W2 as well as last 2 paystups)


The co-sponsor doesn't have to live with the petitioner. So it won't be a problem.

What you'll need from the co-sponsor:

True, it can depend on the consulate/embassy and their COs, but that'd be at the interview. At NVC, they consider the current income to be the most important, as we've both said. So, the AOS can be accepted at NVC, but depending on Honduras and the CO, the AOS might not be accepted at the time of the interview. But I don't know anything about how strict Honduras is...

Working with a lawyer to get my husband's greencard and we're stuck on the affidavit of support. The lawyer says I currently fulfill the financial requirements, but he wants a joint sponsor for the 3 previous years. I recently graduated from college, got a good job right after we got married, almost a year ago and I am wondering how important my previous tax transcripts are. Obviously trying to go the fastest route with this, the lawyer says they may reject my AOS alone, but I want to send the application now rather than waiting for another person's documents to be collected. I haven't been able to find anything that says the financials for the past 3 years must qualify, but maybe I missed something.


My husband was in the same situation as you are. He was in college during 2008 and only had a part-time job, so he was under the poverty line. For 2009, he finished college half-way through the year and had a full-time job for the second half of the year, but he just barely made the poverty line. And then mid-way through 2010, he got a really high-paying job which put him over the poverty line. NVC looks at current income. So as long as you're making over 125% of the poverty line now, then you shouldn't need to find a co-sponsor. We didn't and our AOS was accepted without problems.

Yes, I see people getting invoices frequently here. Neither my husband or I received anything from NVC in that respect. Thankfully we were both logging onto the payment portal very often to see when the bill would be invoiced.

It's been 53 days since my petition was approved and 22 days since I received my case number from the NVC. I still have not received any invoices, the only thing I've received so far is a letter saying my I-129f was administratively closed and an email sent to my wife on August 5th that says our case is now eligible for further processing and that the petitioner would receive a packet with further instructions. I just don't understand why it's taking so long to receive the invoices from the NVC! when i see other VJers receive their invoice in 1-2 days!


I never received any invoices while at NVC. I just logged onto the payment portal and the bills were there. So my husband paid them when they became available.

Have you tried logging onto the payment portal to see if your bills were invoiced?

I fully understand what you meant - it is definitely better not to send additional evidence than to send incomplete additional evidence, as such additional incomplete evidence causes a RFE and delays the process.

I also beleive it is good to load the documents before the Consulate CO gets to review the document before the interview - as you may not get a chance to show those at interview and such additional documents help the CO to make a quick positive decision.


Yeah, I've heard of people from certain countries sending in additional evidence at the NVC stage, so the CO will see them before the interview to help with their decision. For Canada, it's not such a big deal as it's an easier consulate due to it's low-fraud.

I sent additional documents that evidence continuing relationship - copy of 401K beneficiary & joint lease with DS-230 and it was processed alright. This way the CO gets to see these new evidences before he/ she makes any preliminary conclusion based on the docuemnts.


Well I didn't mean that the officer will refuse to review the IV package if there's evidence of relationship, but it's not required for the IV package and most people don't send anything besides the requirements.

You're not supposed to send any evidence of relationship, that should have been sent with the I-130, plus brought with you at the time of the interview.

I'd suggest calling a NVC operator every day starting a week after the NOA2 date. This is the fastest way to find out your case number.

2.if we pay nvc already how we can tract it if they receive our payment or we just wait for the email from them?

You can only pay the AOS ($88) and IV ($404) fees once a case number has been assigned. The AOS bill is invoiced first. And after acceptance of the DS-3032 (which you have to send after getting your case number), then the IV bill will be invoiced. You pay these two bills online at the payment portal. You can then see on that site whether or not your payment has been received and accepted.

3.and how long it takes usually to get nvc case number?

It used to only take about a week or so to get the case number. But over the last two or three months, there's been a severe backlog where it's been taking a month or more to get a case number. Unfortunately, you have awhile until your case number is assigned.

4.how long nvc process case before move it to the assign embassy?

Well, it'll take about a month to get a case number (due to the recent backlog). Then you have to pay fees and send in packages. Once you have a case number, and if you're on top of things, this part can take as little as one week. It'll then take another 2-3 weeks for NVC to review your packages. If they accept both packages, then your case is complete. If they issue an RFE, then depending how long it takes you to respond, this can add a few additional weeks to the process. You're probably looking at 2 months minimum till your case is complete. And it'll be much longer if you're slow or receive an RFE. And the case is only sent to the embassy once an interview date has been assigned. And the length of time that takes varies by each country. For Canada, it's usually a few weeks. I don't know about yours.

Unless your case is complicated, no. Most agencies/lawyers actually end up screwing the client (you) over by taking much longer or not knowing the steps.

HI there, thanks for the response.. I thought I had seen a comparison of the two and the bullet points were different. I just checked the uscis website and can't find the page I was reading yesterday so possibly I was reading the one of the wikis here and the inforamtino is incorrect.. I'll keep looking for it :)

The uscis site says this:

All sponsors must submit the following documentation with their I-864:

  • Proof of current employment or self employment
  • A photocopy or an Internal Revenue Service-issued transcript of a photocopy or an Internal Revenue Service-issued transcript of your complete Federal income tax return for your most recent tax year, or an explanation if it is not submitted. Your W-2s and/or 1099 forms may also be required, see the I-864 instructions for details.
The previous paystubs I assume would be OK as proof of current employment?




If you read the PDF for the I-864 instructions, it mentions to send in pay stubs and/or an employment letter if you think it will support your case for proof of current income.

If you have your 2010 tax returns completed already, that would be good proof of current employment. If you have pay stubs available and/or can get an employment letter, I would suggest sending them as well, just to show even more proof that you are indeed making sufficient money to support the intending immigrant. Just make sure the amounts match though on both the I-864 forms and the documentation you're providing or else you can get an RFE.

Greetings good people!

I have started going over required documentation for the NVC phase (hoping it will be mid-july to early august) of the IR-1. the "AOS" packet requires either the I-864 or the I-864ez. Looking at the requirements (only one relative on the I-130 - no children, using only W-2 for income) I qualify. When I look at the requred and suggested docs they are different than the I-864... Specifically the I-864 requries past tax returns, recent paystubs, and a letter of employment. The I-864ez only asks for the last three years W-2s and the last three years of tax returns. Nothing is mentioned about recent paystubs or letter of curent employment..

Am I reading that right? If I simply give them the I-864ez, tax returns for 2008, 2009, 2010 and W-2s for 2008, 2009, 2010 am I covered or do I need to include recent paystubs and proof of current employment as well?

Pay stubs and an employment letter are OPTIONAL for the AOS package. I'm not sure where you read that it's required for the I-864, but it isn't, it's optional. If you don't want to send in pay stubs or an employment letter, you do not have to. People send those in as additional proof of current income, especially when the most recent tax return hasn't been completed. For example, my husband hadn't filed 2010 taxes when we got to NVC, so to show proof of 2010 income, we sent in pay stubs and an employment letter.

Will we get any of our documents back at the end?


You'll get your originals given back to you at the time of the interview, but that's it.

Everything else (forms and documents) get sealed inside the envelope which will be sent to you with your passport, then gets handed over at POE and sent to USCIS. You'll never see them again.

I just got email today for Ds-3032 but I didn't get letter for I-864 fee....both letter come together or not?


I never got an email for the AOS fee. I just signed onto the payment portal often to see if it had been invoiced yet or not.

Thank you Saylin.... I am so crossing my fingers the interview will be the easiest of this whole journey. We are hoping for a POE on Thanksgiving weekend (Canada) at the Highgate Springs bordercrossing so we can activate the visa. As it will take about a month for both this Greencard and SSN to be received, he is going to continue working in Ottawa until Thanksgiving (American) and that will be his move date. If the stars can just line up.....


The interview really is easy. Sure, I was extremely nervous about mine the morning of, but after it was done, I was like, really? That was it? I was only asked two questions!

And ohhh, Canadian Thanksgiving weekend. My birthday is around then as well :)

Hopefully the passport gets returned quickly, so you can move that weekend. I remember a few months ago, it used to take on average 6 days to get the passport back. But since mid-May, there's been a slight backlog. Although I just read today that someone got their passport back in 2 days! So you might be one of the lucky ones who get it back super fast. Myself it only took 3 days to get back. Good luck!
