IR-1 / CR-1 Spouse Visa Process & ProceduresNVC Case # received !!

So finally got NVC Case # today - *whew*

I am now to send in Opt In email - but do I include the DS-3032 as well? or do I send that later?

Also feeling kinda discouraged - thought this WHOLE thing to the point of receiving my PR Visa would be around 7-8 mths? but looks like CDN's are taking up to 4 mths to get interview from point of getting NVC case #? Am I imagining this?

Grats on finally getting the case number!

No DS-3032 for you! As a Canadian, you get to fill out the DS-261 online :D So just send the optin email asap.

Read the link Ryan suggested, I wrote it ;)

And getting an interview will ALWAYS depend on how fast you get through NVC. On average, it usually takes people 2 months to get through. If you have everything prepared ahead of time, then it could be less. Then, for Canadians, from CC to interview date, it's about 2 months.

I don't know what to except next from NVC. I have complete IV and AOS package and mail it to NVC with barcoded cover sheet. How will i know that my case is closed and will they email me after they complete my case at NVC . Whats the approx wait time?

You will NOT get an email saying you have a case complete. Only those doing EP get this email. The way you can find out if your case is complete by either calling the AVR or a NVC operator.

And if there's no problems with your packages, then it's about 2-3 weeks to get a case complete. Although it can be faster, it all depends on NVC's workload.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864A or I-864 alone?

I didn't miss the A. Even though the OP and the OP's brother live in the same household, the OP's brother as joint sponsor can still complete the his own I-864. Furthermore, because the OP and the OP's brother live in the same household, that allows use of the I-864A but does not require use of the I-864A.

I mentioned only mentioned the OP's brother completing his own I-864 as a joint sponsor because that was the simplest suggestion I could offer. I know there are nuances involved with the I-864A that if I were to try to elaborate on, I would not know what I was talking about and that wouldn't do the OP or anyone else reading this thread any good.

Hmm, I had always thought that a household member HAD to fill out the I-864a. I didn't know that they had an option of filling out the I-864. Well then, learned something new today :)

OP: You will out your own I-864 (as you already know), your brother will fill out his own I-864 as a joint sponsor.

The brother fills out the I-864a since they're in the same household. Not sure if you just missed the 'a' or not...

IR-1 / CR-1 Spouse Visa Process & ProceduresElectronic Processing

The AVR told us today the 261 was received on Sept 1 and to allow 4-6 weeks for further action.

Oh whoops. In my last post when I said the AVR said the DS-261 was "accepted", I actually meant received. But essentially, since they received it, it means they accepted it. So your IV bill should be invoiced sometime this week. If not, early next week. Keep checking the payment portal as often as possible, it'll appear soon ;)
SaylinFemaleCanada2011-09-07 15:51:00
IR-1 / CR-1 Spouse Visa Process & ProceduresElectronic Processing

DS-261 was submitted on August 19, but NVC says they didn't "receive" it until September 1.

There seems to be no advantage, time-wise, to EP. I am glad we don't have the middleman of the postal service to lose our packets, but it's frustrating nonetheless.

Until they input the DS-261 info, there is no invoice. Without an invoice, there is no DS-230. Everything takes weeks. I've already paid and submitted the AOS, so I'm glad that's done.

I'm just venting, but I am curious - how long have you all had to wait for the IV bill?

That's odd that's it's taking so long for you.

I was able to submit my DS-261 (on a Thursday) the business day after our case number was assigned (Tuesday, NVC closed on Wednesday due to weather). And then the AVR changed 2 days after that (on Saturday) saying they had accepted it. By that Monday (2 days after acceptance) our IV bill was invoiced and my husband immediately paid it.

But of course, this was before NVC got this huge backlog where it turned into waiting weeks to get a NVC case number instead of a few days. Perhaps the backlog is leaking into DS-261 acceptance as well...

Do any of you know what is the required time to travel after immigrant visa is issued?

It's typically 6 months. But the expiration date will be listed on the visa, so you can double check.

Along with i-864? Can you provide with link to that info?

In the instructions for the I-864 (http://www.uscis.gov.../i-864instr.pdf) last page, last paragraph. That's where it talks about joint sponsors having to send in proof of their US citizenship or residency. Nothing about the petitioner though as NVC already has proof of that from the I-130 package.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864

Do I need to send proof of my husbands citizenship with the I864 and marriage certificate??? or just taxes and employment info

Nope, the only time the USC has to send proof of citizenship is with the I-130 package. And the marriage certificate is only needed with the I-130 package and then with the IV package (and the interview as well if you want to count that).

If you have a joint sponsor for the AOS package though, NVC requires the joint sponsor's proof of citizenship. If they're not a US citizen, then proof of their legal residency.

If you don't have a joint sponsor, all that's needed for the AOS package is as follows:

-bar-coded cover sheet
-I-864, completed and signed
-tax information

Optional stuff:
-cover letter
-employment letter
-pay stubs

IR-1 / CR-1 Spouse Visa Process & ProceduresEmailing I 864

I got the confirmation email - so what am I waiting to tell me when I call?

so I fill out the D260 and then MAIL the documents? or email? do I have to wait for IV fee to be paid before I do D260? and what is the AVR??? god I am SO CONFUSED!!!

You got the auto-response email, that's good. It means that the NVC email servers received your email. I would tell you how long it should take to get to your package, but it always differs with EP cases.

You don't snail mail the IV package as you're opted for EP. You email the package, just like the AOS. And you can either do the DS-260 first or email the IV package first. Doesn't matter.

And yes, the DS-260 only becomes available AFTER the IV fee has been paid and appears as PAID in the payment portal. You won't be able to access the link until then.

The AVR is another option when you call NVC. Read about it here in my wiki: http://www.visajourn...C.E2.80.99s_AVR

IR-1 / CR-1 Spouse Visa Process & ProceduresEmailing I 864

Ok so I am happy to say a solution was found!! And files are sent ..anyone else ever have this problem remember this: re save files as jpegs and adjust the resolution - then re save as a pdf!!! FREAKING BRILLIANT... went from 36 mgs to 6! I tell you this.. my husband owes me a lot of backrubs and sweet nothings after this whole ordeal is over...

so they send an email confirming receipt of AOS I assume?? I Hope? And now we wait for IV Fees to invoice?

Wow, I am so glad you figured that out! That was one big reduction!

You should get an auto-response email (but if you don't, don't panic, some people don't). You won't be getting any kind of email though saying your AOS is being reviewed or something. You just have to call an operator every single day and ask if there's any update on your case. Plus calling the AVR won't hurt either.

And yup, once your IV fee is invoiced, you pay that. Then you can either send in the supporting documents for the IV package or you fill out the DS-260. Doesn't matter which you do first. I personally did the DS-260 within 2 hours and then immediately emailed my IV package.

Hmm, not sure about that. I was trying to find somewhere on NVC's site where it says it has to be a PDF, but I myself can't find it. It might be possible, but I have no idea.

when it's all in one file it's 37.1 mg

do they NOT take a zip file?

Wow, that is WAY too big. It should be under 10 MB to get through. How many pages do you have?

You might have to re-scan everything with a lower dpi/resolution.

NVC will accept a ZIP file with s download link from Google Docs? Can someone who has actually done this and had it accepted plz confirm?

Thanks,

Heather :luv:

You cannot send a link to NVC that leads to a site (like Google Docs). It has to be a FILE attached to the email.

From this page on NVC (http://travel.state..../visa_5163.html):

"Forms and documents submitted by e-mail must be scanned and attached to an e-mail message."

You need a fraction of that for Canada--be logical and cut it back--way back--REALLY !!!

The person that posted about having 500 pages isn't from Canada. According to their profile, they're from Vietnam. And Vietnam isn't even eligible for EP.

I think that person was just talking about sending a file to someone else, not NVC.

But yes, 500 pages (I think for any consulate/embassy) is way too much Posted Image

So I am trying to email the PDF files for the I 864 and it keeps saying it's too big - even thought I have saved them as reduced files.. then split them up - still not working. can you send more than ONE email??? or all the files for the AOS have to be in one email?? I am going on hour 3 after working night shift and near tears... please someone tell me best way to handle this

You shouldn't split them and you shouldn't email them in two messages. It should be one file and in one email message. How big is your AOS file when it's all together?

IR-1 / CR-1 Spouse Visa Process & ProceduresDs-230 and I-864 processing

Hi everyone I sent in my I-864 and ds-230 packets on tuesday and it was received Wednesday morning at 11:30 a.m. by the NVC. Is there anyway to check on the processing of those? Because everytime I call the NVC to ask, the operator doesn't listen to my question and just says allow 20 days for review. I KNOW THIS!!! I just want to know if they have started reviewing it or anykind of info like that. But the operators don't listen to my question lol they just say 20 days, allow 20 days. I wish I could get fthe operator Lulu everytime she is easily the best operator she always answers my questions thoroughly

If your packages were just received this week, then of course the operator won't have anything useful to tell you. It takes quite a few days for your package to work its way to an officer's desk for review. Just be patient. In about a 1-3 weeks, your packages should start to be reviewed and that's when an operator can tell you more. The operator you got was responding to your question, although their timeline is exaggerated by a bit as it usually doesn't take 20 business days to review.

Just keep calling every day and ask if there's any update on your case. You should also be calling the AVR to see if there's any update there (although I found that the AVR was a few days behind at times to update).

my petitioner paid AOS 88 DOLLARS

THEN WE RECUVE THIS

When the IV fee payment status is PAID, each applicant must submit an Application for Immigrant Visa
and Alien Registration. If your case was initiated after October 4, 2010 and your case number begins with
AMM, ATH, BGH, LMA, MEP, or MTL you must submit your visa application form online. Otherwise you
must submit the paper version of the form.
l To submit your application form online, click DS-260 then log in to the Consular Electronic Applications
Center and follow the instructions displayed.
l To submit the paper version click DS-230 and follow the instructions displayed.

i think DS260 IS FOR MAKE APPOINTEMENT IN EMBASSY ?

CAN SAMEONE MAKE ME UNDERSTAND

Like DanTes said, the DS-260 is the online version of the DS-230. Only a few select countries can use the online forms though. You can find the list here: http://travel.state..../info_5165.html (table at bottom). Tunisia is NOT one of those eligible countries, so you'll be snail mailing all forms and you'll be submitting the paper DS-230.

If you just sent the I-130 package a month ago, then you still have about 4 months to wait. It has to be approved by USCIS first. Only after that, does it get sent to NVC.

First off, pay stubs in themselves are optional, so you can submit as many as you want. But if your pay stubs have year-to-date income on them, then technically you only need to send in one.

IR-1 / CR-1 Spouse Visa Process & ProceduresUsed Maiden Name Throughout CR-1 Process

Hey all,

All of my wife's paperwork for CR-1 was completed under her maiden name. Are there any issues with this at the time of interview (which is next week)? We figured after the process is completed and assuming all goes well with the interview she could just get her name changed on her Green Card and Social Security card.

So, just wondering if anyone else went this route.

Thanks!

S

I used my maiden name throughout the process since I hadn't changed my name legally and had no issues whatsoever. I'm just gonna wait till citizenship to change my name legally as it'll be free then.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-260 details

So, the DS-260 is finally available for my cute lil' beneficiary to complete, and we're stalled out at the dates of attendance for his secondary schooling. He attended two high schools and two colleges, so there's a lot of info.

Considering they're happy to just accept years in other places, we were surprised they want the exact Month and Day AND Year of school attendance.

Is it okay to guesstimate? Does anyone really know the exact start date of their ninth grade year, for example? We can say it was probably Aug - May, but we have no idea as to the days.

Anyway, I guess we have some time to ponder, because the police certificate came back with a stupid spelling error on it (street name spelled wrong), so he's going to order a new one, and it'll take a week to get it back

Progress!

Does your spouse not have report cards or anything? That's how I determined the dates for my schooling. I also went to two high schools (but just one college) and I found the dates both through report cards and my blog (in which I talked about my first day of school Posted Image)

But if there's no report cards or any other way in which you could figure out the dates, then I'm sure best guess would be okay. I'm not sure how much they delve into the data, if at all. Just do your best, that's all you can do.

IR-1 / CR-1 Spouse Visa Process & Procedurescontents of brown envelope

My wife entered usa yesterday and when the immigration officer opened her brown envelope all he gave her was the passport when does she get her ss card and green card so she can go to work?

The green card will probably arrive in a few weeks in the mail, but could take longer. Depends how long it takes for your POE location to send the envelope to USCIS.

For the SSN, if you checked 'yes' on the DS-230 for getting one, then it MAY arrive in the mail. If it doesn't after 3 weeks from POE, then you should go to the local SSA office and apply there. That's what I had to do.

IR-1 / CR-1 Spouse Visa Process & ProceduresGreen Card, SSN after entry into the US

My husband just arrived from Ireland via the Chicago O'Hare airport. Exhausted, he's having a hard time remembering what, if anything, the Immigration officer told him at his Port of Entry.

They took his sealed brown envelope, stamped his passport and wrote an A- number. The envelope and its contents were not returned to him.

So, I'm wondering a few things:

1. Should we expect a Welcome Letter in the mail? I've heard some people get these in the mail after entering the US.
2. Should we expect a Green Card in the mail? If so, what's the usual wait time? (I assume this is his official Alien Registration Card/Conditional Residence card.)
3. Once he gets this Green Card (assuming he gets it), he can then go apply for his SSN?

He entered on a CR1 visa that was good for six months. He was told in London that this meant he had six months from the visa's date of issue to enter into the US, otherwise we'd have to start the whole process over. He is my spouse, not fiance. I'm American.

Any info is greatly appreciated! (Sorry I don't have the whole list of steps and dates at the end of this post that most members have. I have not figured out how to do that in a simple way.)

Hi,

1. Yes, you should be getting a welcome letter in the mail within a few weeks.
2. Yes again, the green card will arrive a few weeks after the welcome letter. And yes, it will be the conditional permanent resident card (if you've been married for less than two years)
3. If you checked off 'yes' on the DS-230 to get a SSN, then it MAY arrive in the mail. If it doesn't, wait 3 weeks from POE, then go apply at a local SSA office. He doesn't need the green card to apply for the SSN. He just needs his passport as that acts as a temporary green card until your actual, plastic green card arrives. When I had to go apply at a local office (since 3 weeks had passed from POE and I hadn't gotten it in the mail), I actually had my green card at the time, but I just used my passport instead.

And if you want to put your steps and dates, then follow these steps: scroll up to the top right. Next to your picture, there's a link that says 'Settings', click that. Then click on the profile tab and then click on 'Change Signature'. Then add whatever you want in the textbox :)

"Please be advised that the case that you have attempted to access is not eligible for further processing by the National Visa Center at this time. Please contact the National Visa Center if you believe that you have received this message in error. "

Does anyone know what it means? Does it mean that my case is completed at NVC and being forwarded to the consulate???

Please advise

Thanks
C

If you've sent in both packages, then getting the SIF message is a real good indication that your case is complete. Call up NVC asap and ask if your case is complete. Good luck!

And remember, your case is only forwarded to the consulate ONCE your interview date has been assigned. So it'll still be awhile for your case to be shipped.

When paying bills, always stick with IE. Other browsers are incompatible and I always see people having problems with Firefox, Safari, Chrome, etc.

You're probably getting the SIF message because NVC hasn't inputted your case fully and that they're generating the bills. As soon as the SIF message disappears and you're able to log in, then bills should be available to be paid. Just keep checking the payment portal as often as you want. Hopefully you can sign in by the end of the day so you can have some progress before the weekend!

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230 CHECK LIST

I found this website. I hope it helps http://usinfo.org/en...applying_in.pdf

I wouldn't suggest that PDF at all. It says to only send in part 1 of the DS-230 which is WRONG for IR-1/CR-1 applicants. It also then says you only bring the original/certified copies of documents to the interview which is WRONG as well. You send them with the IV package.

If you follow that PDF, you're only going to get an RFE, and a big one.

It was made in 2005, so maybe that was the process back then, but it's definitely not the process now.

IR-1 / CR-1 Spouse Visa Process & ProceduresCR-1, what to send to the NVC? And confusion about police certificate as well...

I'm confused and would really appreciate some advice here please! (F) (F) (F) :help: :help:

My husband applied for a K3 visa (yes it's silly and more expensive but we can afford it, we just want to be together as fast as possible...even if it's just 2 weeks or so difference...we miss each other too much), but we are aware that the chances might be that our I-129F (K3) might be closed and our application changed into CR-1. AND in case this happens, would really appreciate some clarity in:

1) Does NVC want us to send original documents to them (my birth certificate, police certificates, our marriage certificate etc) OR are these documents required only at the interview in my embassy in Helsinki, Finland?

Did try reading the guides of CR-1, but didn't get my answer to this from there. Feeling confused...

2) Do I need a police certificate from a country where I have been visiting as a tourist several times, but never stayed more than 4,5 months per time (or less)? Altogether, when calculating all my visits there together, Ive been there more than 12 months.

Did try to ask this straight from NVC but haven't, yet, got a clear answer from them.

So would appreciate the guidance, if somebody has more clarity/experience on these topics!

THANK YOU

1. Yes, NVC wants either the original or certified copies of the beneficiary's birth certificate, marriage certificate, etc.

2. If you were only visiting, then no, you don't need a police certificate for that country. You have to be LIVING there for them to want a PCC. You can see the instructions for police records here: http://travel.state....195.html#police (scroll down a tiny bit to see the table).

IR-1 / CR-1 Spouse Visa Process & ProceduresAlmost done with the AOS Package

Hi all,

So I'm putting together the 864 package together. One thing I learned from the advice of others' on this site is to double check everything. So I'm hoping that someone out there will help me verify before I seal the envelope. :)

Barcoded Cover Sheet
My own cover sheet
Dated, signed 864 form.
Last year's 1040 with a copy of W2s. (No need to send any state related schedules/forms, right?) I'm not including any transcripts from two previous years since they are below the poverty lines and won't help me out at all. Especially in 2008 I have a loss listed in Question 25 for (-$1,365). I hope this won't get me in any sort of a delay. I know they mainly look at the most current year but I don't know what will they say once they look at it as $20K in 2010, $7K in 2009 and -$1,365 in 2008. Is it something I should worry about?
Copy of paystubs for the last six months It's a pain in the neck to get an employment letter for me. My company works with theworknumber.com so my manager is giving me a hard time with the letter. Hoping it won't be an issue.

Am I missing anything?

Looks good!

And you don't need any state forms, just federal tax info is what NVC wants. And yeah, NVC puts importance on the last year and recent year, so you should be fine as long as your current income is above the poverty line.

The employment letter is optional, so it's fine that you won't be sending it in. And for your pay stubs, if they have a year-to-date box on them, then you really only need to send one.

Er, the OP is applying for an IR-1/CR-1 visa. That link does NOTHING for them as that's for K-1 visa applicants. Posted Image

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 approved in 2 weeks

Paris is taking about a month after they receive the file from NVC to send out packet 3. After you get packet 3 returned, anywhere from two to three weeks to schedule an interview. They have had a slow summer and I believe they took some of August off with the usual French holidays.

The OP is applying for an IR-1/CR-1 visa, NOT a K-1 visa. IR-1/CR-1 visa applicants have to go through NVC first, and after case complete and an interview date set, only then does the case get sent to the consulate/embassy.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 approved in 2 weeks

Our situation: I am a USC married to a French citizen. We have a 7.5 month old daughter. We are currently abroad in France.

Our I-130 was approved in two weeks. How is this possible? Also, approximately how long does NVC and Consular processing take for a CR-1 visa?

Thanks!

Grats on the fast approval!

It's rare, but there are some cases where they receive a faster approval, compared to waiting 5 months. You were one of the lucky ones ;)

There's currently a backlog at NVC where it's taking just one month to get a case number. Then, if you're on top of things, another month or two to pay bills, send in packages, and wait for them to be reviewed. So, in total, NVC will take about 2-3 months, if no RFEs and you pay/send things right away.

As for the consulate part, I don't know France wait times. But after your case complete, either a few days or weeks later (varies by country), an interview date will be scheduled and then your case will be sent abroad.

Read these guides while you're waiting for a case number from NVC:

Yes, I agree, it's better to be safe than sorry :)

That's definitely a good saying during this immigration process! Posted Image
