IR-1 / CR-1 Spouse Visa Process & ProceduresInterview

On a related note, is there any reason to bring all new signed originals of the I-864 and tax transcripts to the interview (on top of the photocopy of what was sent to NVC), especially when nothing has changed between filing with NVC and the interview?

If nothing has changed (no new job, didn't move), then no, you don't need a new I-864 or anything. But do bring a copy of the one you sent to NVC with you to the interview.

yes , I suppose .. I will contact Jakarta & see
if documents arrive from NVC

Yes, documents WILL arrive from NVC. NVC doesn't keep them, they forward them ALL to the consulate/embassy. No need to call Jakarta.

Bringing a set of copies is just so YOU feel safe and know that if they request it for some reason, then you have it. Better to be safe than sorry in this immigration game.

The letter NVC sent to us is a bit on the legal Jargon
side of things :) So I understand the medical process
& the forms needed to bring.. The photo yes...
Will she need the I-864 & income tax documents?
all the documents should come to embassy via
NVC right?

Technically, yes, NVC sends all paperwork to consulates/embassies, but it's always a good idea to have a copy of everything you've submitted to this point and bring it to the interview "just in case".

IR-1 / CR-1 Spouse Visa Process & ProceduresMedical Examination

My Husband will be needing his medical examination now that we received an e-mail indicating that our interview date should be expected. Now, he lives in Newfoundland which is preeeeetty much... an island. I called the NVC asking whether he can find a doctor in his area that would be able to do these procedures and they could not help me and directed me to the Interview Preparation PDF. These doctors are in Montreal.

Now, is he able to wait till after the interview to enter the States, can he possibly find a doctor closer to him that may be certified, etc.

This is quite annoying that he'll be needing to fly all the way out to Montreal twice to stay there for a day, paying for taxis.

Please help. =(

You HAVE to get the medical done BEFORE the interview, otherwise you'll be put into AP until they get the medical results and you would have just wasted time and money. So, you have four choices of panel physicians in Canada which Inky listed (2 in Montreal, 1 in Toronto, and 1 in Vancouver). Since Montreal is the closest for your husband, he should go there.

Now, you have two options for the medical. Either fly to Montreal, get the medical done, return back to Nfld, and then fly back for the interview. OR, fly to Montreal and stay there for a week. Get the medical done the first day possible. I went to Medisys and they have the results usually done within 3 days. So he can get it done a few days before the interview, then pick up the results either the day before or the morning of. This way, he'd only have to fly once. And no need for taxis, just use public transportation or even walk! Medisys is literally a 5 minute walk from the consulate. I visited the consulate after I had my medical at Medisys and it was only a few blocks over. And there's plenty of cheap hotels all around. No need for taxis at all. Just use public transport to get from the airport to the hotel.

Those are the only two options. You CANNOT get a doctor in Nfld to do the medical as there are NO panel physicians there. Sorry, but that's the way it is.

IR-1 / CR-1 Spouse Visa Process & ProceduresAny Sep NOA2 approvals gotten their case numbers from NVC yet?

Any other recent case numbers from NVC assigned? We got our NOA2 approval from CSC on 10/4. I want to know when to start calling and bugging NVC :)

Thanks!

You should start calling next week, and call every day.

Although, NVC is only around mid-September for assigning case numbers, so you have about 3 weeks to wait, but it never hurts to call!

You can if you want. But NVC is just going through a backlog at the moment. I don't know if sending a copy of your NOA2 will help or not, but you can try.

Hello, wondering if anyone who has gotten approved in sept already in NVC or still waiting for case number yet? I'm going on 8 days of calling NVC to yet see if they've appointed my case number.

According to my NVC spreadsheet (linked in my signature), yes, there's a few NOA2 approvals in September with case numbers. Since NVC has been going through a backlog since early summer, it's been taking about a month from NOA2 to case number assigned. Looks like NVC is at around mid-September NOA2 approvals. So you should be getting yours probably within the next two weeks. Just keep calling every single day!

Yes. Ours took 13days to get to NVC. See our timeline.

First off, OP is asking if anyone's gotten their case number yet, not just that NVC received their file.

And two, OP is an IR-1/CR-1 visa applicant, which is a different process than K-1, like yourself.

IR-1 / CR-1 Spouse Visa Process & ProceduresCR1 Social Number

Hi well I have finally made it into the US.

But now all the admin starts, to get our lives rolling.

I would like to get my social number as soon as possible. Will they send this directly to me or do I have to go to the office.
What are peoples experience with this?

Also, I would like to get a bank account setup and all other stuff like that. If i don't have a social number is it not possible to do this?

It has always been said that with the CR1/IR1 visa you can work and do everything immediately, it this strictly true? as you have to wait for things to arrive in the post?

Thanks

If you checked off for a SSN to be assigned to you on the DS-230, then wait a few weeks. If you don't receive anything in the mail after 3 weeks from POE, then head to your local SSA with the appropriate documents. This is what I had to do. Then, 10 days later, my SSN was in my hands.

As for the bank accounts, for my bank here at least, they didn't need a SSN to open. So, when I found this out, I had a checking and savings account, with a debit card, in my hands a few days after arriving in the US. The only thing you absolutely need a SSN that's bank-related is a credit card. You NEED a SSN for that. And when you do get your SSN, make sure you tell your bank so they can add it to your bank account(s) as they do need it, but not right away when you open it.

And you can work as soon as you have your SSN. The stamp in your passport acts as a temporary green card until the plastic card comes in the mail.

shall i write each instance on where it says list down all the places you have lived after upon reaching 16 y.o.

do i need police clearance for that? i only stayed at most 2 months per visit

for educational background, shall i include schools which i attended to even during elementary school?

i really need your advise guys, please help. thanks and bless always :D

Re-read your first sentence. You said you STAYED there and it was VACATION. The question on the DS-230 asks about places you LIVED and RESIDED. Vacation does not count!

The same thing applies for the police certificates, it's for places you LIVED and RESIDED, not those you just visited.

And for the education question, just go from high school and up.

Thank you...now it is just waiting for the interview...some people say NVC schedules interviews all throughout the month, but the operator says that they only schedule during the second week. So, it is just a waiting game.

Yeah, don't listen to the operators when they say they only schedule during the second week. They're reading from a script and it's a LIE. If you want proof, look at my own signature. Good Afternoon fellow VJ memebers...has anyone recently filed their DS-230? I recently sent my husbands DS-230 and it was delivered to NVC on 10/7/11. My question is, does anyone know how long it takes to process the DS-230? Also, this is our last filing, so how long after DS-230 is processed does it usually take for interview to be scheduled? Thank you for all responses.

It's been taking about a week or so for packages to be reviewed. So you could hear either the end of this week or next week :)

As for how long it takes to get an interview date scheduled after case complete, that varies by country. Some people find out a day later, others a few weeks, and for those in Ghana and Cairo, a few months! Unfortunately, I only know Canadian time frames, and not Nigeria.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 & DS-3032 Packages

Well, I haven't actually wasted the week...I'm still waiting on getting the signed DS-230 from my husband which should be here by the end of the week and he also renewed his passport which will not be ready til the 20th and I have to wait to get the copy of his biographic page and expiration date. But, I thought I had read somewhere on here that even though I've already printed and filled out the forms, I should wait til I received the packets before I send it in. So, you are saying I don't have to wait? As soon as I have everything, I can go ahead and send it in?

Oh I'm glad you weren't just waiting on NVC and you're waiting on documents.

But nope, don't wait for NVC to send you anything. Otherwise you could be waiting awhile. I never received anything from NVC about sending packages in. Many, many, many people here send the packages as soon as the bills appear as PAID. If you want to wait for notice by NVC, go for it, but I warn you, you might be waiting a few weeks. Don't waste any more time and send them as soon as you have all the documents/forms ready. If you've got the AOS package ready, then I'd suggest sending that. Then once you have the remaining IV documents, send the IV package.

Good luck!

Hey Saylin

I have a few queries regarding my CR1 upgrade. Recently my approved I-130 application has been upgraded from F2A to CR1.

I spoke with a NVC representative last week she told me that I have to wait for certain forms that NVC will email me in a week or two and then only I can send the filled forms back to NVC.

- Can I download the forms from some websites and send it?

- Could you kindly let me know what are the documents that I need to gather so that I can work on it proactively.

And I also have a couple of questions regarding my Police Clearance Certificate and choice of representative:

- I am an Indian Passport-holder and currently residing in Toronto. I have a PCC issued by The Indian Consulate, Toronto, Canada in August 2011. But from the last 1.8 years I am living in Canada. Kindly suggest do I need to apply for a Canadian PCC and these PCCs are valid for how many days?

- My second question is in the form 3032 I need to mention the name of a representative. Does this mean if I am mentioning my attorney's name on it then he has to accompany me to the interview? In my case, though my attorney helped me in filling my F2A, he lives in California, USA and my interview will be in Montreal, Canada. It will be very expensive on our part if the same attorney is going to accompany me to the interview. And i would prefer a local attorney who deals with CR 1 Cases in Montreal. Kindly, advise!!! And please, let me know if anybody knows about a good attorney for CR1 visa type in Montreal Canada.

Thanks in advance.

Best Regards

Jullieta

Just a tip on forum etiquette: don't ask a question on a thread that is not related at all. Either create your own thread with your question, or ask a member through PM.

Anyways, here's my answer:

You can download the I-864 form from the USCIS website and since you're going through Canada, you'll be doing the online DS-260, which you can only fill out once the IV bill has been paid and appears so in the payment portal. I would suggest reading the wiki I wrote linked in my signature as it will help you with electronic processing (optional) and online forms (required).

If you're a resident of Canada, then yes, you need a PCC from Canada. Go either to your local police station, the RCMP, or a local agency that does PCCs. For Canada, the PCCs are valid for one year.

As for the DS-3032, you'll actually be filing the DS-261, an online form, required for Canadians (or residents in Canada). And no, the representative does NOT go to the interview. If it's an attorney, they'd actually NOT be allowed inside the consulate (well, I suppose if he's a US citizen, he'd be allowed as it's a US consulate, but not for the reason of accompanying you inside for an interview, but rather for emergency citizen reasons). And honestly, unless your case is EXTREMELY complicated, do NOT hire another attorney, it's so pointless throwing all that money away when you can get all your questions answered here on VJ for free.

Do I need copies of the passport pictures in the package of supporting documents that gets sent electronically for the DS260?

I have scanned copies of the following right now:

marriage certificate
birth certificate

Do scanned copies of passport pics need to be included or simply taken with to the interview? Or both?

You need to scan two pictures and include it in the supporting documents. Although I brought these pictures to the interview, those weren't required. They do require two pictures at the interview though, so if they're within 6 months of being taken, you can just use them for the interview.

IR-1 / CR-1 Spouse Visa Process & Procedureselectronic for i864/ds230

The I864 is the Affidavit of Support, and it, along with its supporting documents (tax transcripts, bank statements, pay stubs, letter of employment and cover letter printed from payment portal) is scanned in and emailed.

The IV package supports the DS260, and includes the passport photos, BC, marriage cert; it is scanned and emailed to NVC as soon as possible after the DS260 has been filled out and submitted at the document portal.

I agree with your answers except for one tiny detail. The DS-260 isn't submitted WITH the supporting documents. It's completed online and submitted on its own. The supporting documents of the IV package are then emailed (if doing EP). The DS-260 isn't included in the IV package.

Yes, you can submit everything electronically (AOS and IV packages).

But remember, you're REQUIRED to fill out and submit the DS-260, an online form, similar to the DS-230.

MissDinaDee, above, suggested a wiki that I'd also highly suggest reading as I wrote it. It'll go over everything about EP (electronic processing) and the online forms.

The NVC has told me that my case is approved and that all I can do now is wait for an interview date. Interviews are only done the 2nd week of each month. How long have people being waiting to be interviewed at the Montreal Consulate?

When the operators tell you they only schedule during the second week of each month, it's a LIE! They schedule ALL month long. Want proof? Look at my own signature. I was scheduled during the FOURTH week. And go to previous NVC threads and you'll see a bunch of people getting interviews in weeks besides the second one!

As for the waiting time, it's on average two months from case complete to actual interview date. So if you just got your case completed, then your interview will likely be around mid-December.

IR-1 / CR-1 Spouse Visa Process & ProceduresHow Accurate is NVC?

My case was closed on 14th october 2011. And NVC told me that they are done scheduling interviews for November due to limited compacity and only schedules interviews on the 2nd week of the month for the following month. However, I have seen somewhere; a case can be closed after that two weeks window and still scheduled throughout the month. I am not sure what to predict but wait. It is so fraustrating and painful to wait at this stage. I called them today, and two operators (two diff time) I've spoken to told me that, the interview won't be in November for my case. Is anyone experiencing the same thing?

Thanks in advance!

Don't listen to those darn operators. They're reading from a script when they say they only schedule during the second week. That's a big fat LIE! They schedule ALL month long! Proof? Look at my own signature. I was scheduled during the FOURTH week. And if you go look at previous month's of NVC threads, then you'll see more people get their interviews outside of the second week.

And as for a certain month being full, again, they're reading from a script. Sure, that month can really be full, but the operators are just reading from a script. Unless they actually take the time to check in their computers whether the month is full, then don't believe them.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhen can I expect medical/interview for my wifein Canada?

Thank you so much Saylin, You are awesome!

What documents do I need signed by her for the NVC? Just the choice of agent form? Can that be done before receiving the NOA2?

Well, since she's going to be interviewing in Canada, you're required to do online forms. One of which is the DS-261 (Choice of Agent form, DS-3032 but online). Now, some people required to do online forms are still sending in the email template of the DS-3032 and it being accepted. So that option is still open for you. The other online form is the DS-260 which is MANDATORY. It's the equivalent of the DS-230. The DS-260 is done online as well. So there are no forms your wife has to sign. Only you have to sign one form (I-864).

I'd suggest reading the wiki I wrote (linked in my signature below) that describes the NVC process for Canadians. The online forms are required, but electronic processing (sending packages by email) is still optional for Canada.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhen can I expect medical/interview for my wifein Canada?

Hi, new to the forum.

I got married to my wife in Toronto on July 24th 2011. She is a Pakistani citizen and a Canadian Perminent Resident. Since then I have filed for I-130 in September 13th and subsequently an I-129F for a K3 visa but I am told that most probably that route will be closed. I have received NOA1 for both in september (please see timeline). I have the following questions:

1. Will her I-130 take longer for approval because of her being a Pakistani citizen?

2. What kind of dates can I expect for the interview? I am guessing some time around May or June 2012. Is that about right?

3. What is the process for the medical? Can this be done prior to an interview being set? My wife plans to go abroad in February for a month and I want to know if that would impact anything. What does she need to have completed before that?

Thanks for all your help.

As you know, yes, the K3 will most likely close, and NVC will continue processing with your I-130, making it a CR-1 visa.

Anyways, no, her being a Pakistani citizen will most likely not affect this part of the process. The I-130 focuses more on the petitioner as USCIS has to make sure you're eligible to petition for a foreign spouse. But if her name is similar to those on the government's "hit list", then additional checks might be needed, and might take longer.

As for dates: if you filed in September, and it takes average 5 months to get approved, you're looking at getting the NOA2 in February sometime. Then, if you're on top of things at NVC (with all forms ready to go), then it should take about 2 months there, with a case complete around April. And for Canada, the interview is about two months from case complete to the date, so the interview would be around June. Of course, this all depends on when you get your NOA2. If you get approved faster, then the timeline will change. Also, if you're not prepared for NVC, or get an RFE, this will also affect the timeline.

As for the medical, in Canada, you have to wait for an interview date to be set before you can schedule a medical. So, going with the above timeline, she'd be having her medical probably in May.

So her trip in February won't affect much, as long as you get approved sometime in February. If you get approved sooner (and by sooner, I mean like a few months early), then there might be an impact.

IR-1 / CR-1 Spouse Visa Process & ProceduresW-2s needed?

I am about to submit my papers for I-864. I have IRS transcripts for my 3 most recent tax returns. Am I required to submit W-2 forms as well? I've read conflicting information.

Also, does anyone have a cover letter example they could share so I know what all to include on it?

Thanks!

The only time you need to include W2s with IRS transcripts is if you filed jointly and need to show your own income. Other than that, no, you don't need W2s with IRS tax transcripts.

And here's a sample cover letter: http://www.visajourn...29_Cover_Letter Some things might not apply though, especially if you don't have a co-sponsor.
