Thanks again Saylin :) The person that wrote that page sounded very serious about it.

Keep in mind, they went through the process in 2008, that's FOUR years ago. Things have changed a lot.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 - Do I need to write details on every page on the top right hand corner?

Based on his website - http://www.puravidat...e_process.shtml

Potential "gotchas" on form I-864:
"On the top right hand corner of each page the petitoner must write (not type) their full name, social security number, and the words "Form I-864".

Is this true?

Upon VJers suggestions, I was gonna write the NVC Case Number on all the pages I am submitting to the NVC.

No, you don't need to write that stuff. Just write the case number on the top right of every page (EXCEPT the bar-coded cover sheet and your cover letter). The whole point of writing the case number is in case one paper gets misplaced. If someone finds it and it has the case number on it, then it'll be easy to re-unite it to the case file.

Or, click on the last two links in my signature. One goes to a post with links to guides and such, the other goes to a post with a FAQ on the NVC process.

IR-1 / CR-1 Spouse Visa Process & ProceduresCurrent individual annual income

On line 23 on form I-864 what should I write? The join sponsor makes 20.10$ a hour as full time employee but we dont know what to put on annual income
thanks

To calculate current annual income as an hourly wage earner, follow this formula:

wage per hour x hours per week x 52 weeks

So, if your joint sponsor works 40 hours a week, then:

$20.10/hour x 40 hours/week x 52 weeks = $41,808

$41,808 would be what you would put.

Please refer to the joint sponsor's tax return for the exact figure.

That would only work on the question asking about past year's income. The OP is asking about CURRENT annual income. There is of course no tax return done yet for 2012.

IR-1 / CR-1 Spouse Visa Process & ProceduresI864 or I864ez which one to use? or does it matterr

I don't need a sponsor so i want to send the AOS using the I864 but i been reading about the I864- EZ that got me confuse and unsure. So which is the best to use?

If you meet the three criteria for the I-864EZ, I'd suggest using it as it's much shorter, so it'll be faster to complete and less of a chance to mess up (compared to the I-864).

Download form I-864EZ from the USCIS website. At the very top of the form on the first page there are THREE questions. Is your answer to ALL THREE of those questions a YES?

If so, use I-864EZ, otherwise, use I-864.

Good luck.

Just because you answer 'yes' to all three questions, does NOT mean you HAVE to use the I-864, it just means you CAN.

IR-1 / CR-1 Spouse Visa Process & Procedureswhat next?

Greetings all

We filed I130 and were approved and i submitted all and paid all to NVC but now i am unsure what to do. How do i proceed from here? Does NVC contact me and tell me what to do next after they review all my paperwork? They received the last of my paperwork on May 31 and i have not heard anything since, will they have reviewed it by now to see if they need to send me an RFE or does this take longer? If they reviewed it will they let me know what to do next or do i need to be proactive on this? Thanks for your help...really hoping for an interview at the embassy in july at the latest but will have to see.

Thanks again
Zac and Sian

You should be calling up NVC and seeing the current status on your case. Ask them if your AOS and IV package have been reviewed and accepted.

Once both packages are accepted, then your case is complete. You'll only know about this by CALLING NVC; they do not contact you.

After the case is complete, your case is put into the queue to get an interview date assigned. This varies by consulate/embassy, but it's typically assigned within a month of case complete. You can find this out by calling, or waiting for NVC to email you the interview letter.

Thanks everyone, just after I did created this new topic, I received acceptance of DS 3032 form.

But now I am worried as my original case number was changed in 2 days,
I did sent the DS 3032 email twice within the gap of 2 days.

So Today NVC replied to my 1st email with DS 3032 acceptance of agent form. Would my another email have any impact on it?

Oh can you actually call to see if the choice of agent letter via email was accepted. I sent mines on Friday June 1 and was going to wait until this friday to check.

Yes, you can call for everything! Although, with the DS-3032, you should get a response back by email from NVC saying that they accepted (or rejected) it, so calling isn't completely necessary for the DS-3032.

Hi,
Do you guys have any experience on how long does it takes usually for NVC to review the DS 3032 email and enable to pay the Packet IV visa fee (ds 230).
I did send out DS 3032 email from my spouse account email address but still waiting for to pay the Packet IV visa fee?

Any help is always great :D

It's typically taking NVC around a week to accept the DS-3032 and add it to the casefile. Once that's done, it's then another few days for the IV fee to be invoiced.

When did you send your DS-3032? Have you been calling NVC every day and inquiring updates if it was accepted and added yet?

Or will i get the appointment letter with PAcket 4 from the consulate? Also how fast do we get an appointment letter?

You do NOT get anything from the consulate as an IR-1/CR-1 visa applicant. What you received from NVC IS the appointment letter. If you open the package, you'll see the first page lists the date and time for the interview.

Assuming NVC doesn't require any additional documents. How many days does it take after they receive AOS and DS230 packets to close the case
and then schedule an interview.
I am trying to figure if my wife will get an interview in July?
Sent AOS and DS 230 docs to NVC June 4. Arrived at NVC on morning of June 5.
Hoping they can schedule an interview for July in New Delhi.

It's currently taking around a week (sometimes less!) to review packages. So, if nothing is missing from the packages, you should have a case complete by next week Posted Image

As for the time frame between case complete and getting an interview date scheduled, it varies by consulate/embassy, although typically, you get an interview date within a month.

IR-1 / CR-1 Spouse Visa Process & ProceduresSwedish citizen moving to the NVC Stage

The real (major) reason why I've been thinking of sending the papers to her is because when we got married, we got two marriage certificates: one in Swedish and one in English. The grammar in the English one is horrible, but it is an official document issued by the local authorities. I honestly don't remember for sure if we sent a copy of the Swedish or English certificate to the USCIS for the I-130, but I think it was the Swedish one with a translation attached (written by myself).

Either way... The police records/military records should be the originals, I assume. Same with the form, DS-something-something (DS-230?). Same with the personbevis (which functions as a birth/marriage certificate). Should I also send the actual marriage certificate? If so, do I send a copy or the original?

Yes, all the certificates (birth, marriage, police) have to be originals or certified copies. You also need to include regular photocopies so your originals/certified copies can be returned to you at the time of the interview. And yes, the form definitely has to be the original. NVC will issue a checklist if your signature isn't the original. I'd say in your case, you should also send the actual marriage certificate to avoid any problems. And I suggest you explain the different documents in the cover letter, as well as writing it on a post-it note and attaching each note to the top of each certificate so the reviewing officer knows what's going on.

Yeah. I'm going to go trough all my papers, cover page etc this weekend and try to get it in the mail Sunday or Monday. I've been thinking of sending it to my wife first, or will that just be an unnecessary delay?

I think she wants to get a look t my police records while she's got the chance. :hehe:

If you send it before the IV bill is appearing as PAID, it's best to send it to your wife first. Then as soon as it shows PAID, she can mail it directly to NVC.
It the bill is already appearing as PAID when you mail the package out, it's best to just send it to NVC directly. In this case, just make a photocopy of the PCC to show your wife ;)

THe IV package is only documents the beneficiary needs to send in, right? Is there any point in me mailing them to my wife and for her to then send them to the NVC? Isn't it better to mail them directly to the NVC (once the bills have been paid)?

Yup, the IV package is all about the beneficiary and nothing about the petitioner.

If you want to send directly to NVC, that's 100% fine. Some beneficiaries just prefer mailing it to the petitioner first.

If you have your whole IV package ready NOW, I'd suggest sending it to your wife now, so that way, once the fee is paid and appears as so in the payment portal, she can send it right away from the US. This might shave off a few days, but only if your IV package is ready.

Don't worry about it. I remember when I first joined here and was overwhelmed by everything too. If it's easier for you, print out the guides and highlight the important bits. I find that always helps :)

IR-1 / CR-1 Spouse Visa Process & ProceduresSwedish citizen moving to the NVC Stage

Saylin, Darnell, thank you so much for your input. I really do appreciate it.

Maybe a better way for me to look at the legal side of my marriage is this: my wife and I got married in Sweden, but the US sees it as a legally binding marriage anyway, thus no need to "have it legalized" (no pun intended) since it is already recognized as a bonafide marriage (and I assume my wife is registered as married by US authorities by now).

My wife and I have talked about having our ceremony at a place in a park in Pittsburgh, and I am fairly sure Melissa talked about having a justice of the peace precede over the ceremony. "Technically" I believe my wife and my wife's parents are catholic, but they are not practicing catholics. So we won't have a church wedding, but from my perspective, out of respect for my wife's family, I want the ceremony to be as genuine as possible, so to speak. There will be no Dr. Who or Star Trek or Viking weddings or anything like that (and I am not really familiar with Dr. Who I'm afraid). :D Even if the ceremony will have no technical legal purpose, and even though we are not going to have a church wedding, I still want it to be a somewhat traditional type of ceremony, if you know what I mean. So I guess what I was wondering if it is possible to get someone who's licensed to marry people be in charge of the ceremony. Even if it seems we could, we don't wanna grab a random person waking down the street and have him/her perform the ceremony.

And I apologize for the length of this. It may not be necessary information that you guys need to be able to help me. It's just that the whole process is confusing and there are so many details that you want to have done the right way. I just need somewhere to vent and get things out of my system, and this board (and this thread particularly) seems like a suitable place for that. I really do appreciate your time, your patience and your help. :)

Yeah, you should still be able to get someone that's licensed to oversee the "wedding". Just explain to them that you're renewing your vows and that you're already married. That should be all they need to know (plus your names :P)

IR-1 / CR-1 Spouse Visa Process & ProceduresSwedish citizen moving to the NVC Stage

Gotcha. Thanks for your input guys, I really appreciate it.

I know technically and for all intents and purposes we already are married. It really is a bonafide marriage. Maybe renewal of vows is a better way of looking at what kind of ceremony we want to have in the US.

How do you do that? We didn't have a church wedding here in Sweden, we had a civil marriage at Västerås City Hall. Can we get like a Justice of the Peace to lead the ceremony?

I'm not exactly sure how renewal of vows works. I know it can be done within a church, and you're gonna have to have someone oversee it. It might also differ by state. I honestly have no clue, sorry Posted Image

IR-1 / CR-1 Spouse Visa Process & ProceduresSwedish citizen moving to the NVC Stage

Another question. I just read a thread in a different sub forum and it sort of related to me in a way.

My wife and I got married in Sweden last year. The marriage has been properly registered with Swedish authorities - I have both the marriage certificate and personbevis (see first post of this thread) to prove it is correct, legally and otherwise. My wife also has the NOA2 for the I-130, that is USCIS/CSC have acknowledged our marriage as being a real marriage, which it is for all intents and purposes.

My question is, can we have a legally binding marriage in the US too? Or a renewal of vows or something along those lines? We had a wedding here in Sweden for my friends and family, and we want to have one for my wife's family and friends too once I move over to live with her in Pittsburgh (hopefully on the same date as our "original" marriage, i.e. June 30).

Is this at all possible. Is it allowed? We have a mutual friend who has preceded ceremonies that are not legally binding... but both my wife and I don't want an "empty" ceremony that's just for show (or however I should put it); we would prefer it to be real.

You can't get "married" again in the US, as Darnell said, married is married. But you can have a renewal of vows in the US!

My wife reminded me that I have changed my phone number since we sent in the I-130 in November. Do I need to notify the USCIS or NVC about this? If so, how do I do that?

Just put the new number on the forms. Updating a phone number (compared to an address) really isn't a huge deal. They don't call you or anything.

If you want, once you get a case number, you can always inform the operator of your new number. They should be able to change it that way. Otherwise, they'll see it on the forms you submit.

IR-1 / CR-1 Spouse Visa Process & ProceduresSwedish citizen moving to the NVC Stage

OK. Thank you for your attention. I have read guides over and over and I just cannot make sense of some things.

Here are some background facts. (I hope I remember to write everything down, but there's something I've forgotten, please don't hesitate to tell me.)

My wife (USC) and I married in Västerås, Sweden on June 30, 2011. We finally sent in our application for me to become a permanent resident in late November if I remember correctly. Our Priority Date at any rate is December 2, 2011. On Monday May 7, 2012, my wife got our NOA2 in the mail from the USCIS, saying that we were approved and that the CSC are forwarding our petition to the NVC. The Notice Date is May 2, 2012.

That's as far as we have gotten so far. I have started the process of obtaining the required documents. I have sent in requests for police records and military records and I expect to receive them in the mail within two weeks. I have also obtained something that in Sweden is called Personbevis, which according to the Country Reciprocity Schedule for Sweden http://travel.state....5.html?cid=9711 works fine in place of a Birth Certificate and Marriage Certificate. The personbevis as well as the police and military records are in English. I also have my passport of course. The other documents listed are not applicable to my case (never changed my name, have never been married before, have thus never had a spouse who've died, and I have never committed nor been charged with any crimes).

From what I understand I will receive a package from the NVC which states exactly what documents I need to complete the visa process. So maybe I'm jumping the gun by asking this here, but what I'm wondering right now is, am I supposed to send these documents to the NVC, or do I bring them to the interview at the embassy in Stockholm?

I apologize if my questions are not necessary, it's just that I have read the guides a million times it seems, but I'm still not clear on certain things. So any help that you guys can offer me would be greatly appreciated. Thanks guys, you rawk!

For IR-1/CR-1 visa applicants, the IV package (documents about the beneficiary) are sent to NVC; they're not brought to the interview. The same applies with the AOS package (documents about the petitioner). These are sent to NVC as well.

I highly suggest you look at the last two links in my signature. They'll bring you to the current NVC monthly thread and the first two posts have a plethora of links to guides and such, as well as an FAQ I created. You should find what you need there.

Oh and another thing. When I get my police records transcript, should I leave it un-opened in the envelope, or is it ok for me to open it?

If it comes in an envelope, you can open it, that should be fine. You should verify if everything is correct. The only two things you do NOT open in this process are the medical results and the sealed envelope from the consulate/embassy after a successful interview.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about item 9 Form I-864

I am sponsoring my wife (CR1). If the visa is approved, my wife will bring our son with her to the US. My son is a US citizen with his US passport. My question is: at item 9, form I-864, should I check or uncheck. It said "I am sponsoring the following family members immigrating at the same time or within six months of the principal immigrant named in Part 2 above. Do not include any relative listed on a separate visa petition". As I understand, my son accompanies my wife to the US but he is not considered "immigrant" because he is a US citizen, so I should leave it unchecked. Is that correct?

Yes, leave it UNCHECKED. As your son is a USC, he is NOT immigrating.

You will need to include him as part of your household size though.

what I-864 forms do we have to fill out? i-864a? i-864ez ect??

so i know i have to fill out a i-864
and my dad has to fill out i-864a? or i-864ez?

also he is self employed so is there anything else he must
do?

You both fill out an I-864. And you both include tax information (either tax transcripts or tax returns, W2s, and all schedules). Your dad will also have to include proof of his US citizenship/residency. Also including a copy of your birth certificate (to prove he's your father) would be recommended.

NVC has to start with only a few countries before implementing this program world-wide. Every few months, a country or two is added to the list. Online forms were only introduced in 2010, yet it's already available to 8 countries. It might not seem like a lot, but NVC has to slowly introduce it so there are no issues.

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling Married Joint for my taxes, will ITIN affect her petition?

Thanks for everyone's response. As for the W7, does it have to be an original copy with her original signature or can we use a scanned copy sent via email?

Original form, original signature.

Thanks for the info :) What do we need, aside from the W7 form, to apply for an ITIN?

You need to send in proof of her identity and such. Read the W7 instructions, it says what is needed.

Also, I was looking at the W7 application and it looks like she needs to sign it and we need to provide proof of her ID and residence outside the US. Does she absolutely need to sign it? Can I sign it on her behalf? There isn't much time to send docs back and forth with April 15 looming over the horizon and I'd want to avoid having to file an extension if I can.

It has to be her signature. You can't sign anything for another person unless they're a minor. Email her the necessary forms, have her sign it and then mail it. As for the deadline, all I can say is you really shouldn't have waited until the last second. You can always file for an extension if necessary.
