Yup. As long as the sponsor is a US citizen or US resident, they can sponsor. It's in the I-864 instructions :)

They have dropped the surcharge. Again, all you're paying on the payment portal for the IV fee is $230.

We just got our email requesting payment for our IV fee.... I thought I was told the fee would be $408, however this email is saying the fee is only $230.... Now before I start my little happy dance because I have a little extra cash in my pocket, can someone let me know if this is true. When I checked the website it says the fee is $420... I am a little confused with all the conflicting information.....


The IV fee used to be $404, not $408. On April 13th, last month, the fee was reduced to $230. The $420 you're looking at must be for another fee.

In our case, the reverse of what is usually posted here has happened. My wife received her SSN about a week and a half after she arrived. However, her green card has not yet arrived; I will give it another week and then I will call USCIS.


I wouldn't fret about the green card. It took 19 days to get mine from POE and that was in May. You have to remember, it's holiday time in the US right now, so it's probably going to take a bit longer to get your green card.

It usually takes a few weeks to get the green card. But remember, you shouldn't really worry about getting the green card as the stamp in your passport acts as a temporary one for up to a year.

As for the SSN, if you don't get it within 3 weeks from POE, then go to your local SSA office and apply there.

We've been able to visit each other with no problems. Each time we're honest and bring copies of all our paperwork. We know we have a long wait ahead of us still. My question is more after he gets approved. As we don't want to make any plans until he's had his interview and is approved, he will need some time afterwards to give notice at his job and apartment. So after all the wait and he's approved but needs a couple of months to wrap things up, should he come visit me on the weekend as usual and bring his unopened envelope, thus "landing" and return to Canada after the visit to work out his notice periods for work / apartment? Or would it be best to hold on to the envelope (i.e. not leave Canada even for a visit) for the two months or so and only cross the border ("land in the US") when he's officially moving?


Well, regardless of what you decide, he'll have about 6 months after receiving the visa to actually activate it at one of the POEs.

If it were me, I'd suggest he POE with his visa relatively quick after he gets it. This way, it'll start the green card/SSN process while he returns to Canada to tie up some loose ends. By the time he gets back and actually moves to the US for good, the green card and SSN should have arrived in the mail.

Really? What was the reason of the officer?

I made extended research on this topic before deciding to visit USA during the process and I read that they let us enter the country most of the time.

I was lucky to be able to do it! :star:


First reason was my own naive fault. We hadn't filed for the I-130 petition yet and I said some wrong things at the airport because I knew nothing about the IR-1/CR-1 visa, but I was pointed in the right direction.

Once we filed for the visa, I attempted again, this time going through the land border to fly out of the US. I had done my research at this point and knew it was legal. Yet, the officer was a complete douche bag to say the least. Even though I explained we had filed the petition and knew what we were doing, and that I was only going to visit for 2 weeks, he still denied me. Said I had to wait until I had a visa to go to the US. He then finished with warning me that if I tried going through another POE with a "different story" (????) that I would get banned.

Thankfully, you've had no problems!

That's what I did for my Visa. I went to the USA with a tourist visa, stayed 2 month and got back in Paris for the Interview.

Of course, he can't work but he will be with his wife.


You have to keep in mind, moving and visiting are two very different things.

And again, it's all up to the officer to let him come in and visit. I was denied twice entry into the US.

My advice was to tell her that he can move to US during the process.


He CANNOT move to the US without a visa. It takes approximately 9 months to get one with a Canadian spouse.

He can only VISIT at this time, and that's up to the discretion of the officer to let him through customs.

He can come on a visa tourist in the USA during the processing.

That's what I did.

I got approved in one month after filling (us citizen residing abroad). Then I did the NVC things in not month and move to USA until I get my interview date. Then he will go back to Canada for the Interview & Medical examination. If he is approved, he will receive his visa in 10 days.

Just be sure to not stay more than 3 month in the USA.


For Canadians, no tourist visa is needed. We have an agreement with the US about this. And we can stay up to just under 6 months.

Although your intentions are true, please don't give advice or time frames for a different country.

I am a USC married to a Canadian citizen. We have sent off the i130 and now we're playing the waiting game. My question is once my husband receives approval, how long can he wait before moving to the US? He will need to give notice at his work, on his apartment, etc. so it may be a couple of months until he can officially move. Will that be ok? Is it best for him to "land" while visiting me and get the stamp, have the official green card mailed to mine but return to Canada to wrap things up? Or not enter the US until he's actually moving. We both want him to move here as soon as possible but it may take a bit of time.

Well, you've still got about 9 months roughly before your spouse is going to be legally allowed to move.

Breakdown:

~5 months at USCIS waiting for the I-130 to be approved
~2 months at NVC, paying fees and sending packages
~2 months till an interview after case complete at NVC

After a successful interview, your spouse will receive a visa in their passport. They'll then have up to 6 months typically before it expires.

At that point, with a visa in hand, your spouse can choose to activate it at a POE, essentially starting the green card/SSN proces to be issued. They can then return back to Canada to tie up a few last ends. But, make sure your spouse doesn't remain too long in Canada doing this as they have to maintain residency in the US. If it's just a few days or weeks, then it's fine.

My CR-1 Interview is in June. Since the tax year has passed, I'm going to bring copies of the petitioner's latest 2011 tax return docs. Now I have 1 question. Do we need to edit his I-864 (#25 federal tax info) and resubmit it at the interview?


I would suggest bringing a new, filled out I-864 showing 2011 tax information as the most recent year. They may not ask for it at the interview, but it's still a good idea to bring, just in case.

For my case, we were in NVC last year in February and my husband hadn't completed 2010 taxes yet, but since our interview was in May (after the tax deadline), I had to have 2010 tax information then. Unfortunately, I didn't even think about updating the I-864 Posted Image But there was no problem.

I still suggest bringing an updated form though, just in case.

I read somewhere on VJ that you just have to bring the 2011 transcripts to the interview and they won't ask you to resubmit i864. Just in case, though, keep a copy of the form you sent with you (even though it'll be in your file in the embassy too).

My husband and I are just about to send our AOS package but we're waiting on the transcript that should come any day now. I was for sending the AOS anyway and taking the 2011 transcript to the interview later but since we're expecting the transcript any day now, we decided to wait a couple of days and send it all together. My point is, it's okay to take the transcript later. :)


If you had not waited for the transcripts and sent your AOS package now, you would have gotten a checklist for 2011 tax information. It is way past the tax deadline in the US, so it's now required.

Can i purposely delay it by not submitting the documents or not paying the processing fees "on time"? I just received the notice that i can pay the $230 processing fee now and it also say there that dont let one year pass by without contacting NVC . Does this mean that I can wait until about April 2013 to pay the fee ( that is less that 1 year after the last email from NVC)? The reason being is i am going back home with her to finish my studies and I would like to finish my studies first before we all go back here in the states. Thanks! I am US citizen btw.


Yup, you can delay the process if you wish. Just make sure you pay the IV fee before one year is up (or at least contact NVC so they can extend your case for another year, if needed).

Thanks, but question 29 says "List names, Dates and place of birth, and Addresses of ALL children" (emphasis theirs), and question 31(a) asks for "Persons named in 14 and 29 who are accompanying you now" and 31(b) asks for "Persons named in 14 and 29 who are following later".

Are you saying I should leave these questions blank, because my children are USCs? The emphasis on "ALL" seems to imply even US citizen children?


For 29, you'd still list the children, but I meant for 31 you'd put 'none'. Again, accompany in this form refers to IMMIGRATING. Since your wife and children are USCs, they're of course not immigrating with you.

Hello,

Currently going through the I-130 process, and planning to start filing out DS-230. I have a couple of questions. If anyonecan help, I'd be greatful.

1) The DS-230 asks which children will be accompaning the immigrant, and which will follow later; at this stage it depends. If the visa is issued in time that we can go during July/August, which is the plan, then we'll all go together. If it won't be till Sept/Oct, then I will go with my wife, and the kids will follow later ( due to school terms etc, not so practical to come then) - my wife and kids are all US Citizens, so they won't be immigrating. So what do I write on the DS-230 in such a case? SPecifically, if I say they're coming with me, and we arrive at the POE without them (or vice versa) is this going to cause any problems?

2) Can someone describe how the POE process works - is it just a case of handling over the sealed envelope, and getting the I-551 stamp in passport, or is there more to it?

3) What is in the sealed envelope?

4) Has anyone used Shannon or Dublin as a POE - I believe they have a US Border there? Would this complicate things (as the packet has to be sent to the US) or could it make it easier (I'd must prefer to relax on the flight know I'll arrive in Domestic not International, and Immigration is out the way)

5) What would happen if someone passed through immigration at Dublin/Shannon, and then didn't board the flight; would the Green Card still go through? I'm not planning on doing this, by the way, but wondering nevertheless.

1. The question you're referring to on the DS-230 is asking about people IMMIGRATING, not just accompanying. So, if you're the only beneficiary (person to receive a visa), then you'd put 'none' on those two questions.

2. That's pretty much it. You hand over the sealed envelope, they'll go over the files, they'll confirm that the address to send the green card to is still correct, they'll take your fingerprints (and maybe a picture), then give you your stamp in your passport if everything is in order. You can read my POE review (click on my timeline then scroll all the way down). The process might be a bit different doing it in an airport (mine was at a land border), but the essentials are still the same.

3. It's everything you've ever submitted to USCIS/NVC/embassy. So, the I-130, I-864, DS-230, etc. Whatever you do, do NOT open this sealed envelope. The border officers will not accept it if it's been opened.

4. I'm not from Europe, so I've obviously not used those preclearance locations. But, it won't make a difference if you do your POE at a preclearance location or actually within the US. It'd probably make you a lot more comfortable if you cleared it before hand (so in Ireland) so you don't have to stress about it for the entire flight.

You're probably thinking of the DS-230. And the DS-260 is the online version of the DS-230, just with a few changes (notably that it only asks for the last five visits, and not ALL visits).

Hi all, just wondering if anyone else has run into this issue doing ds260. As we have a border city relationship, I cross into the US from Windsor an average of once per week to visit him. The ds269 wants to know the dates of every time I've entered the US. This seems impossible, I have no way to recall the dates since we started dating 1.5 years ago, let alone since I was a child crossing with my parents. Has anyone had this problem ? Is there a way to obtain these records or will NVC use discretion and realize this?

The DS-230 form HAS to be signed (just part 1 though, part 2 has to be signed at the interview in front of the IO). If part 1 is NOT signed, then NVC will issue a checklist.

Hi All.

I'm an American citizen. My husband is Japanese. We've been married and living in Japan for over two years now. Unfortunately, the whole visa process changed last year and we can no longer file everything through the embassy. I followed the process and already submitted all forms (except the Affidavit of Support and Immigrant Visa Application) and proof of relationship to the NVC. I got the notice of approval.

I was under the impression the AoS/IVA were processed at the local embassy. When I emailed the NVC for an update, I was surprised they asked for me to pay the fee for both of these forms and to submit them to the NVC instead of the embassy. I paid the fees online.

I know this sounds like a very stupid question. Where do I send the forms? To the NVC location in NH where they're processing our application?

Am I allowed to email them asking where I should send it?

The AOS and IV packages are sent to NVC, in NH. The address for each package is on the bar-coded cover sheet from their respective bills on the payment portal.

The only time you send packages directly to the embassy is through DCF, but this is no longer an option in many countries as they stopped that last August.

I just need to know few things as below:

Is it necessary to sign form DS 230 by the beneciary (who is non US citizen)and if already submitted by petitioner on behalf of him then would NVC returned it to the petitioner?

Further other documents like police certoficates, original birth certificate and marraige certificates if not submitted at the time of form submission then should we wait for NVC to send us the query?

Moreover, how long does they take to feed in thier system that they recieve the docs because its been a week and they have updated? how long does they take to schedule an interview with the consulate?

If part 1 of the DS-230 was not signed by the beneficiary, NVC will issue a checklist in which they'll ask for DS-230, part 1, to be signed. NVC does NOT return any documents to either the petitioner or beneficiary.

If the other required documents (marriage certificate, birth certificate, police certificate, etc) were not submitted with the DS-230, then NVC will issue a checklist asking for those documents. They will have to be sent in as well.

Lately, it's been taking NVC a week or so to review packages.

Only once a case is complete (meaning both packages reviewed and accepted) is an interview date scheduled.

You have to call up NVC and ask if your packages have been reviewed and accepted. Once both are, then your case is complete. Then NVC has to schedule your case an interview date. Only when that happens is your case forwarded to the consulate/embassy.

How will I know when my case is complete at NVC or when it will leave NVC for Consulate in Montreal? Will they send me an email? Is there anyway to find out this info on their website? Any help with my question would be greatly appreciated! Thanks!


Since you mention express posting the IV package, I'm assuming you didn't do electronic processing then. Which means that you will not get an email indicating your case is complete. To find out in your situation, you're going to have to call NVC.

You'll also have to call them if you want to know when your case has left for Montreal. But remember, they only send out your case once an interview date has been assigned.

My tax transcripts won't be ready because spouse just got ITIN issued May 25. It seems IRS could take a weak to 12 weeks to process tax returns sent along with ITIN and issue a refund.
Tax transcripts can only be issued a week or two after refund has been processed.

But my AOS invoice will be issued anyday because the NVC has assigned me a case number and invoice number on thursday.
So I will probably have to send the tax return copies/w2s etc.

But now the issue is that I didn't keep copies of tax returns that the accountant sent to IRS with mine and wife's signatures.

Should I send my wife the tax return again for her signature or is it ok to send NVC the tax returns without our signatures??


You can try sending NVC what you have now with all W2s, schedules, attachments, 1099s, etc included and see if they accept it. If they issue a checklist, then just request a transcript. It'd be faster than sending something to your wife in India and for her to send it back. Last year, when we were at NVC, my husband sent his tax return (including the application for an ITIN for myself) in mid-March, and his return was processed within a month, and had a tax transcript by the end of April.

Thanks Saylin. My question basically was if NVC send RFE if only 1 year tax return is submitted rather than 3 yrs. I understand the requirements and instructions of I-864.

2nd question:

Do the tax return copies required for affidavit of support have to have signatures. Ifiled taxes through an accountant. He sent the originals with me and spouse's signatures to IRS and printed me a copy from the computer that does n't have our signatures. It has a COPY stamp on it.
Do I need to send tax return again to my spouse in India to get her signature because we didn't keep a copy of tax return with her signature.
or it is ok to send NVC the 1040 with our signatures...???

Since 3 years is optional, of course NVC wouldn't issue a checklist for it not being included.

If it's possible, I'd suggest getting the tax transcripts from IRS. They're free and usually arrive within a week. NVC much prefers these over tax returns, W2s, 1099, schedules, and attachments that you'd otherwise have to send in.

I made very little money for 2009 and 2010 because I was a student. I got a real job in Jan 2011 and now have a decent income.
2010 returns I filed single (didn't know i had to file married) now I have sent an amended return to IRS don't have a transcript for 2010 and 2011(long story applied for ITIN- just issued ITIN on may 25 so tax returns are in process with IRS) and my AOS invoice will be generated anyday now. already sent in DS-3032

so I was thinking of just sending the 1040 and W2s for 2011.

Do you think NVC will ask for 2009 and 2010 anyway?


Again, I repeat, it's up to you whether to send one year or three years. It states this in the instructions. Please re-read the I-864 instructions again.

Does NVC accept one year tax return with AOS along with employment letter and paystubs for 2011 - with income much higher than than poverty guidelines?

or they always require 3 year tax returns (2009, 2010, 2011)

Anyone with personal experience of sending just one year returns?
Does NVC always generate an RFE if only 1 yr tax return is sent?

For the AOS package, it's either the most recent year, or the last 3 years. It's up to you.

Whether you send in 1 year or 3, you STILL have to fill out the question asking for your income from the last 3 years.

Can someone clarify for me when making payments for your AOS and IV Bill through the NVC portal do they take debit cards, credit cards or do you HAVE to have a checking account?
I am not there yet so have no idea what it looks like just want to prepare and be ready so there's no delays. Thank u


Like cathy has already said, NVC does NOT accept credit or debit cards. Only bank accounts.

does anyone know time frame it takes to close out at the NVC and send it to the embassy(nigeria)?

i have sent all required documents just really cant tell how long it takes to close at NVC by looking at some people time line..

It's currently taking NVC around one week to review packages. Once NVC has both your packages and have been accepted, then your case will be completed at NVC. Your case is then put into a queue for an interview date to be assigned. The time frame for this always depends on the consulate/embassy you're going through. Most people find out within a few weeks, but could be longer. And then, once an interview date has been assigned, NVC sends the case out to the consulate/embassy, typically the business day after the interview date was assigned.

Keep in mind, they went through the process in 2008, that's FOUR years ago. Things have changed a lot.
