Hi!

My fiancée flight is on oct 19.. Next week.

Anyways I noticed on my fiancées passport a "cancelled without prejudice" stamped onto her visa page, but on another page is the same thing but without the stamp. She has her CFO sticker and is ready to go .. But I'm very confused why one has the cancelled stamp and the other is fine

Different issue dates, and the earlier one has the cancelled stamped

A marriage date is not required for the petition. The only place I've seen it explicitly asked for, is on the cover letter for the return of immigration forms to the Embassy. Of course, our case is London specific so I'm not sure if it applies to you. As for the engagement, we only included the ring receipt and an email from my fiancee's parents about the engagement.

You're welcome. For the W-2s I sent one original and one photo copy of each. For the 1040 all I did was printout the return that was filed through the site, express1040.com, which is where I submitted my return. I sent her two copies of the return.

I'm not familiar with either form 8879 or IT-201. I've also never heard it mentioned as a requirement. My understanding is that a W-2 and the 1040 form constitute a complete tax return. Or you can of course use the tax transcripts which replace the need for either the W-2 or 1040. I personally sent my fiancee the W-2s and 1040 for 2012 and the tax transcripts for 2012, 2011 and 2010.

I'm a tad confused. I just checked out the London Embassy website and it happens to mention this: "From September 1, 2013 the DS-230I & II and DS-2001 is replaced by the form DS-260"

I have a general question regarding the expiration date listed on the NOA2. If I remember correctly (since I don't have it in front of me) our NOA2 will expire around the end of November. How exactly does the expiration date relate or affect our case? We are currently waiting on our appointment date, but since November is not too far away we're curios to know if the date will have any bearing.

You would need to check with his bank.  I use a credit union, and they would not put my wife on my account, without her having an ITIN or SSN.  We did get an ITIN, so we could file joint taxes.  They also required a "wet" signature on the application, no faxed, or emailed copies were allowed.  

 

Natalya will finally be here on Friday (woohoo!), so we held off on doing anything until she gets her SSN.

I just want to make this easier than his last visit, he was given such a hard time in customs and they almost didn't let him in cause of his lack of ties to his home country. He does collect benefits from the UK, would showing proof of that help his ties to the country since he has to actually live in the UK to receive them?

My husband and I just recently got married in the UK (yay!) and I've been in the UK with him since May 30 2013. I was allowed to stay here for six months on my marriage visa so I'm planning to leave in early October. We are filing the I-130 paperwork at the end of this month so he can come to the US and live with me. Here is my question;

My husband is going to come back to the US with me, same flight and all, in October. He is using the VWP and he's just going to come visit for a little while (under 90 days). We're hoping we'll find out his interview date while he's visiting and he can fly back for that (whenever it might be, within the 90 day span). If we don't find out that's fine as well and he'll just stay for the alloted 90 days. How can he prove strong ties to the UK to prove he will be coming back to the UK. Just saying "oh well he's coming back for his interview at the consular office" doesn't seem proof enough to me so I'm sure it won't be for customs. He has no job in the UK, he isn't in school anymore. He doesn't own or lease anything, he lives with his parents. All he has in his name is a phone bill and bank account. I can't really think of anything to help prove strong ties. I can show them the receipt for the paperwork we're filing to prove that we are doing it the right way. Will it help him in customs since I'm there with him? Last time he came to visit (on his own) customs held him for over 4 hours (he was still using VWP). Eventually they let him come through (we weren't married at the time). I'm unsure if us being married is going to make it even harder this time.

I can prove financial stability and I'll be taking full responsibility of him while he's here. I have a full-time job and am a full-time student. What can I do to help him get through customs and prove strong ties? Thanks.

My husband and I just recently filed our I-130 and received our NOA1. What I was wondering is; is there a way to give USCIS more evidence after we've already filed? If we receive an RFE could we send in extra evidence as well? We just opened a bank account together and a few other things so I'd like to send it to USCIS.

 

Also, how do I know which service center is handling our petition?

Hi everyone. So I'll try to briefly explain myself first.

 

My husband and I got married June 28 2013. We filed the I130 in September. In October we filed for the K3.

We will stick with the I130 if it gets moving before the K3. If the K3 gets accepted first we'll go that route for AOS.

 

We recently found out that I am pregnant (yay!). I am due in early July (2014), and I want my husband here with me during the course of the pregnancy and (obviously) the birth of our first child.

He currently is on the VWP and has been using that to visit me. Here is our recent visits.

 

My husband was in America (my country) from early Oct to early Nov (2012).

I was in England (his home country) from late Jan to mid Feb (2013).

I went back to England from late May to early September (2013).

My husband was in America from early September to early December (2013).

 

We were thinking of having him come back to America on his VWP for another 3 months (just under the 90 day limit) in late January or early/mid February.

We were hoping that either the I130 will have progressed or the K3 will come through by May 2014 or shortly after he returns.

 

All this being said, I want him here when the baby is due, absolutely, above all else. Would bringing him here in the second trimester ruin his chances of being here in the third trimester and the end? Will he have spent to much time in America and possibly get denied entry?

I'm going to try to make this as brief as I can. I am a US Citizen (naturally, not legally) and my boyfriend is a UK Citizen (England). We have been wanting to get married for a long time now and we want to live in the US. I wasn't entirely sure how to go about doing this so I did some research but just ended up confusing myself more. I ended up going to see a lawyer (I live in TX) and he told me that we have two options. Go through the K-1 Visa options or do something called a 30/60 rule? Where apparently my boyfriend just needs to come to the US and visit me and stay for 3 months, but after 60 days we can just get married and file for AOS. It sounded so simple but now I'm just not sure anymore, in TX to get a marriage license you need a SSN which clearly my boyfriend doesn't have. Also he is on the visa waiver program (which the lawyer knew) and on the VWP website it says that you cannot change your immigrant status on the VWP. I do not want to risk getting him banned from the US. I've looked at the K-1 process and it looks so complicated and I'm not entirely sure we would be able to fulfill all the requirements to get married (such as proof of relationship). I mean we have pictures of us together from our visits and receipts from stuff we've done together but that's not exactly proof of a relationship. I'm 20 yrs old and my boyfriend is 23. Neither of us currently have a job, but I'm in college.

Basically what I'm asking is; is the 30/60 thing legit? Would that be our best option? How do I go about this? If not, what can I do to ensure we can get through the K-1 visa process then AOS?

hi everyone! i've been reading on this site for a while now and it has given us great tips and "aha" moments. My boyfriend and i have been in a long distance relationship for almost 3 yrs. now and we want to settle down soon.

I am a filipina and currently living and working in Thailand as a teacher. Initially, we have agreed to have our fiance visa processed here. But lately, I have been thinking of going home to the Philippines to have a long and break and eventually have our K-1 visa processed there instead.

My question is, how true are the allegations of red tapes and difficult processing there? Many have told me that it's easier to process outside of your own country? :( :( :(

Dude uscis is driving me crazy, this is the fourth time I've talked to someone about this alien registration number ..and it was for another problem..and this is just ...ugh haha. First they told me, it looks fine, 2 other times they told me they know for sure it's a glitch, then today while talking to a guy about the other problem ..he said he SEES my fiances alien registration number now...they drive me crazy ccrazy crazy. But still it doesn't mean I'll get approved now...just have a number..I give up anyways I just learned to wait and not care about that update :)


So if he says he sees your A# that means its not a glitch and you'll receive a fast noa2?
