No, you don't need to submit the entire petitions again, just what they asked for in the RFE. I believe the blue paper (the actual RFE) needs to be attached. Since it's just one item they are interested in, I doubt a cover letter is necessary. Did you get married in the US, Nigeria or a third country? Hopefully where ever you got married won't give you any hassle. Best of luck to you!

 

Yup! The blue paper that comes attached to the RFE has to be sent back with any evidence you send back.

It takes about 2-3 weeks from NOA2 until NVC enters your case into the system. From then it's about 30 days to get a case number and IIN. Then about 2 months (58 days is the average now) til case complete (if no checklists). Then about a month or two til the interview (54 days is the average now although it's country specific).

 

Well - so much for having this done with before I give birth! That stinks.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

I am OH SO EXCITED about this! Congrats on getting your response so quickly to CSC. Ours won't arrive until Thursday or so (Serbia doesn't offer express mail....the entire country...) but I am looking forward to seeing how quickly they are. So far I'm happy with CSC. Did they send you an email informing you they received your package or did you have it tracked? 

Thanks. I just did express mail so I got a tracking number but it got received the next day and signed for. I got an email from USCIS yesterday saying:

 

Your Case Status: Request for Evidence Response Review
On March 31, 2014, we received your response to our request for evidence. This case is being processed at our CALIFORNIA SERVICE CENTER location.

 

So hopefully the approval will come quickly! I didn't even respond to my RFE for i-129f (k3). It was the same exact thing and hubby and I decided to just ignore it. Going to try to close that petition this week, no point in pursuing. Just want the i130 to get processed as quickly as possible. I can keep my baby in my belly till July but no longer! So I need my hubby here!

Just wanted to update, I sent back the RFE I received with the new printed marriage certificate. It was received at their PO box yesterday. So hopefully we can get our approval soon!

Just to clarify, by "printed certificate" I don't mean a photocopy of the handwritten one. I mean a certificate where the information is computer printed and not handwritten.

Okay I just went and looked, its a photocopy of the handwritten one! So that's probably what the problem is. I'll send hubby to the office to see if he can get a printed one!

I'm not even sure how to define where in Ft. Worth! Ha. I live in the Northeast (HEB, NRH) area.

As for clearly legible handwriting, I would imagine so! Looks fine to me..):


 

USCIS... Sigh... If they can't read an original certificate of marriage from England what can they read?

 

I have one handwritten certificate they gave me on the wedding day and some extra certificates they mailed a few weeks later with the same information printed. I feel both are legible but then again, I don't work at USCIS.

 

Did you send a handwritten certificate or one of the printed ones?

I sent one of each.

Finally received my RFE hard copy in the mail today. I'm actually pretty confused.

It says: "Submit a legible copy of the marriage certificate for X and X. The certificate must indicate that after the marriage ceremony, it was registered or recorded by the county, state, or province."

 

What..? I sent them a certified copy of the marriage certificate (as well as a scanned copy, just in case). So..what's the problem? They want another one? And what does it mean by it has to indicate it was registered or recorded by the county? We got married in England.

 

Ideas? I'm not sure what to send at this point.

Just got email for RFE - this time for the i130 paperwork! Gah! I sent them everything I could think of! Even stuff I'm sure they didn't need. It says additional evidence. What the heck else am I supposed to send?! Jeeeeeze. Hopefully they only want like, a recent picture or something equally simple. Sigh.

Ahh I see. I know what you mean.. I hate that they're not actually processing K3's separate from I-130s sad.png I put all my eggs into the K3 basket before finding VJ.

Anyway, I'm sure he can come visit! As long as he shows a reason to go back, he should be fine.

That's the problem! He's staying with his parents, pays no bills, and has no job. We have a joint bank acct and we've both been living off my paychecks. So I have no idea how he's gonna show that he plans to return. We'll just have to cross our fingers really and hope for the best.

 

We're in the same boat, our 'offcial' wedding is in Oct, hoping to be done by then for the same reason, you'll have to keep us posted =-) We were told not to bother with the k3 by the attorney though so the CR-1 is all we got
Course a birth is a bigger deal then a wedding, best of luck to you!

I should surely hope that USCIS gets it together by October!! That'd be insane. I'm sure you'll both be reunited by then! Good luck and hoping for the best for you!

Btw, if the RFE is for your K3 and not your I-130, I think you can just ignore it. I think someone else got the same thing a while ago and just let it be since they'll close your K3 soon anyway. It's up to you though. Good luck smile.png

I imagine its for more evidence of a bona fide marriage. I hardly sent anything in with the k3 paperwork, just some basics. I sent all the good stuff with the i130 packet that I sent off! I have no idea what to do with it haha. If my i130 moves along shortly with no problems, then I'll probably just skip the k3. I was just really hoping the k3 would come through so hubby could be here in July for the big day with no issues! Now we'll have to test our luck with VWP and customs...sigh..lol

Oh also, is there a way I could maybe use our pregnancy as additional evidence? I can't provide a birth certificate because she's not born yet (JULY!). Would a letter suffice? Could I just write USCIS up and be like "Hey, we're having a baby, due in July. So speed it up!"? Sounds like solid proof to me! Maybe we'll get a sappy officer overlooking our petition and they'll be like "awwe! a baby! approved!" hahaha. I think I'm just experiencing crazy pregnancy dreams/daydreams.

 

Anyways, should I write a letter with my RFE response saying we're having a baby? Can't hurt, right?

Hello everyone,

 

I'm leaving in the morning to meet my wife for a week.  This is likely the last time we will see each other in person, before her interview at the Kiev embassy.  Since I'm the one that's been putting together all our proof of relationship stuff, and she has all the original documents from Ukraine, we are going to try and make sure I have everything that needs to be sent in the IV package, and she has all the stuff she will need for the interview.

 

Help me out, if all this sounds right, kind of a last check list, since I've been scrambling to get ready to leave tomorrow, I'm a little fried right now.

 

Things I'm going to give her:

 

All our Skype logs/screen shots

Relationship photo album.

Our travel documents, boarding passes, receipts from trips together, copies of my passport stamps, etc.

All the receipts for flowers/gifts I've sent her in Ukraine.

Information showing her as my spouse for my benefits at work.

Moneygram receipts from when I've sent her money.

The ORIGINAL affidavits from my friends, about our relationship (copies of these were included with our I-130 package).

 

Things she will be giving me, to send with the IV package:

 

The following ORIGINAL documents:

Our marriage certificate.

Her birth certificate.

Her divorce decree, from her first marriage.

Police Certificate.

Three photos.

 

Am I missing anything?  Does it all sound right?

I broke down, and called last night.  Was told our AOS was under review, and that we would probably receive a false checklist for the IV package.  Sure enough, got the IV checklist today.

 

The days drag by now, waiting for our CC.  I'm still hoping for a June interview, but I'm not holding my breath.

Joanna, he can add you to his insurance.....my husband did that last year!

I think it depends on the Insurance and/or the employer.  My company is self insured, and Blue Cross Blue Shield administers the plan.  They wouldn't let me add my wife during last years open enrollment period, because she couldn't show six months residency in the US.

I called today, to confirm that they had received our AOS and IV packages.  I sent the AOS a week before I sent the IV, both FedEx.  She told me that that had received "mail" but couldn't tell me what package it was.  Going by when it was logged in, it's the IV package.  Should I just re-send all the AOS stuff, or is it possible that they were logged in together?

That's probably the reason. Looking at your signature, you didn't fill out a DS-261, so they must have sent some form with the I-130 electing themselves as agent, so once the file got to NVC, they were automatically selected as agent again.

We filled out the DS-261 ourselves, and designated me (the petitioner) as the agent.  And still ended up able to pay both fees at the same time.

After my personal record, of 57 minutes on hold tonight, I was told they are still "reviewing our documents".  He did say that our AOS package was approved on the 28th, and that we had been sent a checklist (false) for the IV documents.  But couldn't confirm that it was indeed our IV documents that are still "being reviewed".  The package that contains our IV documents was logged in on the 21st.

 

So close, but yet so far away?Looks like a July interview at the soonest for us.
