Well, I’m really glad this one is over...such a high hopes and such a low return from VSC K1 approvals...but, it is what it is...Next week will be much, much better...anyhow we are one day closer to the NOA2 approval then we were yesterday :)
Great weekend to all-Cheers!

First of all   to all of Jan filer who got their NOA2s...Now...let's play numbers again...105 filers from January is tracking here...9 approved-about 8.6% also about 70% of December’s are approved...so assuming the ratio of approvals will go significantly higher for Jan filer now I'd say if we can get to 25 approved by the end of the week, 50 by next Friday...then we have 1 in 2 chance to be approved in the next 2 weeks :wow: ...HA!!!
Can I get Halleluiah and Hell Yeah on this one?

To paraphrase Archimedes B-) who said something along the lines "Give me a place to stand and a lever strong enough and I can move the world."
Well for me, this VJ forum is that place and my lever has been all the good people with the most positive attitude ever here ....So, now It's my turn and I am on the mission to move the world and get this process over with!

My dear January filers...like everything else in this life, this is the "numbers game" ...Our lives are nothing more than statistical iteration of a higher divine plan...I do"numbers" for living and I can tell you the magic number is 134 days from the NOA1 date....So some 4 months and 1 or 2 weeks is the time for pieces to fall in to the place...Outliers are here just to confirm the rule, they truly are the exception to the rule....Within (plus or minus) two weeks from the 134 mark we all will hear the good news....So, let's stay positive and the great "AVERAGE TIME FROM NOA1 TO NOA2" will work for all of us...:) Let's keep it positive....
BTW...I'm as frustrated as you are but I will not, CANNOT, get myself down...Good things happen to the good people...And we all are, otherwise we would not be doing this, we wouldn't all be here...We would have given up or would not seek this way to do it...And to quote my favorite band of all times "UP THE IRONS"
I hope this drunken diatribe make sense...The time is near...and to quote the Maiden again..."It can't be all coincidence too many things are evident.."

Cheers!!!

we need some good news asap as my fiance is very sad today...He texted me last night that there was a break in into his mom's house in Miami and the robber stole his mom's jewellery , including an engagement ring his mom wanted to give us. The ring was pretty meaningful as it was his grandmother's and she has passed away years back... so he is pretty down today and an approval would simply put a smile back on his face! but here's wishful thinking...

So sorry to hear that...I wish i can say..."By the power vested in me I hereby declare that as of today your application is approved!"
Boy, if this works I may have the power afterall... :wow:
Head up....Everything is going to be beautifull!

HMMM Photomile, I find all of this very interesting, because my case number is no where in your 10,000. and I am a January filer with a NOA1 of January 24th. My case number is completely different... 1290270***..... ????? Makes me very curious, because when I check the ones around mine, I find they all either say, "we sent you your notice on Jan 24th (still in initial review) , or many are approved, one had an RFE dated today....

Same here...my case number is EAC-129020****
I think the only thing we know for sure is service center abbreviation an fiscal year...the rest - seems to be the guessing game

Yeah, VCS has been showing that off and on since last Thursday (I think), but the common thought is that it is either a glitch in their system or it could be referring to petitions filed recently.

Very valid politnt!! I think you are right.

I talked to my attorney and this is what he seaid, verbatim:

"I have a case that I filed in October that has not been approved. I called
USCIS in March to ask for an update since it had been over 5 months. Three weeks later I got a notice that the I-129F was being forwarded to the
National Benefit Center in Lee's Summit, Missouri for faster processing....The last I-129F that I had approved was approved in December and it only took 4 months and 1 week, so, it may not be that long afterall."

Well, we can only hope....Now let's see a bunch of December and Jan filers get NOA2s this week....

Cheers!

No it doesn't, it still shows 8.7. It shows 5 when you are not signed in to your account, once you sign in it shows 8.7! But it doesn't matter what the website shows as long as they are approving the petitions :) we are almost day, you will see! :)

Yep...You are right, I did not log in this morning, but hey...as you said, as loong as we see approvals from December and January we are golden (Happy-Happy :) Joy-Joy)

K-1 Fiance(e) Visa Case Filing and Progress ReportsUkraine/Crimea K1 Fiancee & Political Mess

Thanks for replying.  The trains have not been running out of Crimea for at least a couple of days.

UIA was flying from Kiev to Simferopol until yesterday.  But as of today all flights are cancelled through March 17th.  It is posted on their web site.  They think they will be able to resume on March 18th, but who knows if that will happen!

Turkish Airlines operates 2 flights daily between Simferopol and Istanbul, but the flights for this evening and tomorrow morning have been cancelled.  They only say to check online for later flights before heading to the airport.

Even if flights are restored next week, the way the US Embassy in Kiev works right now is that they keep your international passport and send it to your home by courier.  I do not think my fiancee will be able to return to Simferopol without her international passport since Crimea will probably consider Ukraine a foreign country starting next week.  Maybe the embassy will make an exception and let her pick up her passport there.  Have you ever heard of them doing that?

My wife is in Nikolaev currently, as we wait through the NVC backup.  So I've been watching this closely as well.  Right now, it looks like only Aeroflot flights are going to Crimea.  It might be worth sending an email to the Embassy in Kiev, and asking.

I hope she can get out of there without any hassle.  I asked NVC about an expedite today, but they didn't sound real positive about it.  Hopefully this all gets worked out in a peaceful way.

IR-1 / CR-1 Spouse Visa Process & ProceduresConfused.com
I am a British Citizen marrying my American Fiance in the UK next September, after which we are planning to live in the USA. We are planning on apply for the Spouse visa, but I am very confused about the process and timescales, I've been given a lot of conflicting information about how it works. Can someone explain in plain English how it works. Thanks.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about passport
I'm marrying my US fiancé next month and we are then planning on applying for the spouse visa almost straight after while I am in the States with him after the wedding, now my question is, my current UK passport has almost 6 years left on it and is obviously at the moment in my current (maiden) name, will I need to get my name changed to my married name for the purposes of applying for the visa or will my passport be accepted under my maiden name. We obviously want the process to go as smoothly as possible so if having my married name on my passport will help with this then I'll do it but it means paying £72.50 for the sake of a year or so if I do.

IR-1 / CR-1 Spouse Visa Process & ProceduresVisiting US-Proving strong ties to UK

Okay, he lives with his parents but he pays them rent bi-weekly. I could ask them to write him a letter saying he pays rent and expect him back. He has a phone contract in his name and pays for it out of his own account. No car or car insurance.

We can also take pictures of his room before we leave for the airport. It'll still have all his bigger belongings (such as bed, sofa, computer).

Thanks a lot for your help. Hopefully this will be enough to let him in, they did last time with way less but again, it was a huge hassel and took hours.

No he doesn't have to show up every week for his benefits or "sign on" to anything. He will still be able to claim the benefits while he's temporarily out of the country.

From the list of documentary proof you posted for me he has the following;

Return ticket

Copy of the I-130 packet made and if we get a NOA during out wait (not leaving till October) then we'll bring those as well.

Other than that nothing. It does say on the list "If you do not appear to have the means to support yourself while in the U.S. a letter from whomever you will be staying with stating that they will be financially responsible for you during your stay." Do I need to write a letter for him since I will be supporting him while he's in the US with me? I would imagine not since I'll be at the airport with him, going through customs as well. I'll just be able to tell them face to face that I'm supporting him and I'll have proof of my finances with me to support the claim. Should I still write a letter though?

K-1 Fiance(e) Visa Case Filing and Progress ReportsMy Sydney K1 Visa Interview Experience

So, few weeks back I was given my interview date for my K1 Visa, and I was over the moon. I immediately started researching what I was to expect and what I should ?study? for. I found one documentary on VJ to be really really really helpful, and I will be eternally grateful this persons account of the day. I thought I might also do mine, so more people can read along and get a better understanding of their interview day and hopefully de-stress a little bit. As well as bring it up to 2014 :) I was an out of towner, so a lot of extra stuff is included as well.

This is the help I am talking about:

http://www.visajourn...erview-process/

And this part of VJ is also helpful but I didn't find it until I was prompted to review my interview:

http://www.visajourn...?cnty=Australia

My background is that I met my fiancé online playing a game (Puzzle Pirates). We had been talking to each other since 2010. And I have met him once when he came over to Australia to visit, and proposed to me before going home. He was here for 5 weeks. When I write it out like that, it seems a little crazy, but so is love I guess. I am Australia, I was born in Queensland, and I had lived in the Philippines for 5 years when I was growing up. I also have no convictions or criminal history, and no communicable diseases etc etc I?m assuming I was basically an easy case. I had already seen the doctor for my medical check too.

My interview was at 10.45am in Sydney at the MLC Centre.I live in Brisbane, and I had to fly into Sydney the day of my interview and fly back out because I had to work days either side of the interview.  I planned on getting there very early, having some breathing time to calm down and go over things and go to the toilet etc. My flight left Brisbane at 5.30am on time, I had already been awake for an hour and a half at this stage. We landed at about 8.00am, and I turned my wristwatch ahead for daylight savings. I assumed my phone would automatically do this as well.

I landed, left the QANTAS terminal, went down the stairs, turned left, walked past all the baggage claims since I only had carry on and went down the stairs to the subway and purchased a one day ticket to Market Place. It cost around the $16 mark from memory, or it could have been $19. Make sure you pay with EFTPOS or have change (you can get notes split up by a seperate machine) as the ticket machines don?t usually have enough change to give you if you stick a $50 in, and that is where most of my lunch money was consumed tongue.png. I purchased Market Place because they have MASSIVE basic maps hanging about, and it seemed closest to the MLC centre. I asked the barrier lady which platform and she told me to ?Get off at St. James and walk up? so I?m sure that?s also viable, and probably easier since I had to get off at Central and swap to a Town Hall service, and then swap again to a Bondi Service to get to Market Place.

Eventually got to market place and a few kind Sydneyites pointed me in the right direction, it was basically exit the station turn left to a set of lights and the turn right and you?ll see the MLC centre right there. Here is a picture so you know what you are looking for.

Despite the run around on the trains in peak and having no idea where I was, I made it there in half an hour and had lots of time to burn. I walked around a bit. There is a huge food court, with lots and lots and lots of food to choose from, and due to said abundance, coffee and food seem to be cheap. I couldn?t resist a coffee and eggs benedict (since I?m a benedict addict) and sat down at one of the fancy cafés above the food court. Once I?d polished off my meal and coffee, I ordered another coffee and chatted on FB to my fiancé. I went over paper work with him, and a few of the questions that I thought would be tough to answer with great detail on the spot when I?m nervous. Questions like ?Why do you think you are ready to get married? and ?What do you love about your fiancé?. You?re probably thinking they are easy questions for you, but I don?t usually have a way with words when I?m on the spot and I needed a mini mental script for back up.

All in all that day I had with me:

  • Extra Affidavit of Support info (my fiancé had only just gotten employed after graduating from Uni when this info was requested, so it was a little lack luster)
  • Receipt of the $240USD visa payment
  • The extra copy of the packets my fiancé had sent in for the application
  • Two passport photos as requested (I got mine done at Officeworks for $9.95)
  • My Australian Passport
  • My fiancé?s W2 ? a form that shows his SSN and employment details
  • Our wedding invitation
  • Photocopies of receipts for our wedding venue in the US
  • Envelopes and photocopied letters I received from my fiancé
  • About a dozen printed out photos of us together
  • Print out of our FB ?relationship? page (We couldn?t figure out a way to get our FB or Skype logs)
  • The report from my XRAYs (I didn?t take the xrays with me as I was told I didn?t need them and would only need to take them with me when I fly out to the States)
  • Immunisation sheet
  • And photocopies of his boarding passes

It was a lot and in some ways not very much, as I have seen people?s lists of things they took and mine seemed pale in comparison. I none the less felt prepared, and also I was over it, drumming up any more details was not going to happen! That morning I also made sure my ring was extra shiny J

So I was going thru it all. Went to the toilet half a dozen times, both for nerves, and the coffee I think. The time was 9.45am and I decided to go up and ask if I could go in early. I went to the front desk of the MLC centre, and asked the man sitting there; he turned to me and said? You?re late, it is already 10.45am!  MY PHONE DIDN?T CLOCK OVER AND I HADN?T BEEN WATCHING MY WRIST WATCH THAT HAD!!!!!!!! I went into crazy nervous mode, ran up to the lifts, jiggled the button and jumped into the lift swearing at myself.

I got out of the lift on Level 10, walked all the way around to my right and into the security screening area. I explained that I was late, and they said don?t worry, its ok, you have plenty of time, calm down etc. They checked my passport and ticked me off on a list then I had to remove all ?electronic devices that could be disguised as a bomb or bomb parts? which included my headphones and pen. My bag was then scanned. I stepped thru the metal detector. I was asked to remove my wallet and keep it with me, and to keep any documents I needed, I was given a ticket. I asked if I could take my bottle of water up with me, and they requested I take a mouthful in front of them, which I did. They directed me to a seat over to the left side of the room. One of the guards pushed the button on the lift for me while I waited. When the lift was ready, she came over and got me and pushed the button for the 59th or 60th floor, and I was whizzed up.

When I got up there, I was again asked for my passport and was ticked off on a sheet, and then went thru the door into a waiting room. I got another ticket from the machine. Just a little waiting and I was asked to come up to a window, where I had my fingerprints scanned and I submitted the requested documents, and my packet 3 stuff was returned to me, including my forms and original documents. They did keep the DS 160 form though. I was asked to sit back down. I probably waited another 20 minutes, and I was called to another window, which is where the interview took place. My finger prints were scanned again and I was asked to take an oath. The person asked me very basic questions, like what is the name of my fiancé, how we met, what he does, etc. They asked me why I wanted to move to the US, and a couple questions about living circumstances and his family. And that was it. I got handed a piece of paper with my name on it and was told I have been approved and to ?go now?.

Attached File  20140211_104228.jpg   32.01KB   0 downloads

They kept my passport in order to put the visa in it, and it is being sent back to me by courier.  I didn?t have to show them any extra stuff, and I really didn?t have to study for the questions she asked. It was over and done within 10 minutes.

If I wasn?t so excited about having my visa, I would have been disappointed. I had put so much time into organising paperwork and preparing myself and I didn?t need one bit of it. I even went out and purchased some nice slacks and a nice shirt, although I did put my hoodie on because it was bloody freezing in there. Everyone else in there when I was, however, was in jeans, and there was one lady in a cropped top and ripped jeans, and a few children á la mode de Queensland aka barefoot and topless. I really didn?t need anything besides what they had requested in the email I received when I was notified of my interview date. Although, it only occurs to me now that they didn?t ask me to sign the bottom of the DS156K and they didn?t return my sealed medical packet which I sent in for my packet 3 at their request (I didn?t know what to make of the ?medical document originals? so I email and that is what they instructed). I suppose the DS160 covers it all, or maybe they forgot, I?ve emailed them anyway.

So all in all, the process took no more than 50 minutes, and I was late. Everyone was very nice and friendly (though the interviewer was a grouch), even the desk man at the bottom of the MLC centre asked me how I went when I came back down.

I spent the rest of the day exploring Sydney and catching up with old friends, and reminding them that Queensland won the State of Origin last year and not to bother buying tickets for this year unless they enjoy watching NSW loose smile.png

I really hope this isn?t too long of a story, and that someone out there can get some information from it. Feel free to contact me about any questions that I might be able to answer.

IR-1 / CR-1 Spouse Visa Process & ProceduresNo greencard yet, I am not in system!
DARNELL/ MSHOGAN,

tnx for answering my querries. just to give u update about my case, it happened yesterday April 2, 2013

1. i called again the USCIS, i think this was the third time that i called them and they keep telling me that my data was not on the system yet, they said, it might be because of my POE which is DFW, so she gave me the number of the CBP and asked me to call them which i did.

2. CBP said, they are not the one who is responsible for my visa packet, it was the USCIS, or maybe there were some backlogged on the delivery of the files to USCIS.

3. i went to SSA to try to get SSN coz i figured it out that if my data is not on the system, SSA will not give me SSN, suprisingly, they gave me SSN and they also wondered why USCIS dont send my GC, coz the guy from SSA, found out that they issued SSN already to my name and also he found out that USCIS processed my data/file march 5 coz i came here in the US march 1.

what should i do next?

anyway, my visa was IV VISA was issued Jan. 30, 2013 in HK, so i know im not covered with the new payment rule for the visa.

i will call USCIS again, is it right to tell them what SSA told me? Am i right that SSA will not issue a SSN for me if my data was not on the USCIS system yet?

Im under the CR1 visa.

tnx

yup, is possible. You can get into a CBP Secondary inspection / deferred inspection office and talk with a human.
Don't use a telephone, simply go to the office.

If the first person you speak to seems muddled, ask for the supervisor.

Thanks Darnell! Happy Easter! I will try to keep calling them first coz my husband has work, and if this way wont really works, then i will really have to ask my hub to take off so we can go there. I hope they will give me a good answer.

Amos/Javi if you filed 1145 with your packet you should get email or text any day now thats noa1 then a letter in the mail about a week latter and will state who is processing your petition.

yes we filed for 1145.we didn't receive anything so my fiance called their hotline and they gave us until Thursday to hear from them.If not we "call them again" they said. :( I hope for some reason our petition will be sent to CSC; seems like they're processing rapidly than any other centers. ;)

Depends on where in the US the petitioner lives.

I-129F petitions currently are processed by the California Service Center (CSC) and the Texas Service Center (TSC).

California Service Center processes I-129f petitions for petitioners residing in: Alaska, Arizona, California, Colorado, Guam, Hawaii, Idaho, Nevada, Illinois, Indiana, Iowa, Kansas, Michigan, Minnesota, Missouri, Montana, Nebraska, North Dakota, Ohio, Oregon, South Dakota, Utah, Washington, Wisconsin and Wyoming.

Texas Service Center processes I-129f petitions for petitioners residing in: Alabama, Arkansas, Connecticut, Delaware, Florida, Georgia, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Mississippi, New Hampshire, New Jersey, New Mexico, New York, North Carolina, Pennsylvania, Puerto Rico, Rhode Island, South Carolina, Oklahoma, Tennessee, Texas, Vermont, Virginia, U.S. Virgin Islands, West Virginia and the District of Columbia.

CSC is very fast and TSC is slow as hell. But anyway, on the NOA1 the Service Center where your case will be processed will be clearly stated.

NOA1 includes a file number also which begins with 3 letters and has several numbers after them:

WAC = CSC

SRC = TSC

Good luck!

Unfortunately, he lives in Texas....looks like we're on a long haul of waiting. :( thanks for the info Miss Diamond.

We sent out our k1 petition May 22nd...haven't heard from USCIS yet.it's making us jiffy.

Is it true that TSC is processing k1 visa then?
