First how in the world does she think a denied Petition thats in process of appeal and he will get approved and over here on a K3 which is obsolete. Does she even read up on things. I mean its like she is saying forget everyting he can just come on over and we file while he is here. WOW either she is really that clueless or well vapidly dumb.
"If your I-130 is approved before your K3". A K3 consists of a I-130 and I0-129F. WTH. WOW she scares me.

Pushbrk... this is part of the email the lawyer sent to me after reveiwing the denial letters:

-- Go through with the appeals process. While your appeal is pending, you need to come up with more evidence that your marriage is real. Do you have any wedding photos? Do you have a joint bank account in Morocco or the US? Do you own any property in common? Do you have any mail addressed to both of you, especially utilities? Any credit cards with both of your names on them? Where do you stay when you are together in Morocco? If he is leasing property, make sure to get your name on a lease contract. Basically, you need to show that you intend to create a life together. -- While your appeal is pending, I would file for a K-3 visa. This visa is meant to shorten the physical separation of spouses waiting for their I-130 to be approved. Basically, if your I-130 is approved before the K-3, the K-3 is cancelled. If the K-3 is approved, your husband can at least be here with you while you wait for the I-130 appeal process. However, in the event the I-130 denial is affirmed, if he is in the country we can refile another I-130 again and buy him some time. It is much more difficult and time-consuming for DHS to get him out of the country than in. Either way, while he is here, you must both establish evidence of your relationship: a common address, common bank accounts, utility bills. The other benefit to your husband being physically present is that, if his I-130 is denied and he is placed into removal proceedings, you can both be properly represented by an attorney and buy him some time to refile.-- If your husband remains outside the country and your appeal is denied, you will have to go through the I-130 process again and/or file for another K-3 visa.

IMO the basis for this denial spiraled from your past k1 denial. They categorically stated it. So what was the reason for k1 denial in the first place? You don't seemed to have addressed that issue giving them the impression that your marriage was done to beat them! It appeared you've done what every ordinary petitioners that got approved had done, but, it does appeared the past k1 is hurting your cr1 so sorry for you! Take heart in this! It's your life and you have to fight courageously to overcome your predicament. You don't have no much time now to waste. I recommend Marc Ellis as one of the best immigration attorney for your case. I am confident you'll be reconsidered in the appeal. Don't just get emotional now, keep the faith! God is your strength

Thanks everyone I will contact a lawyer to see what they advice is as well ... as for are K1 we were never giving a reason why it was denied never giving a chance to respond at all and the case was expired. Our age difference is 15 yrs and yes I'm with my husband now in Morocco... thanks again for the great advice :thumbs: Back... just talk with a lawyer and her advice was to start all over again reapply for the K1 and I-130 and we would need to address all the issue they found prove we have a bona fide marriage. so I asked what about the appeal process and she said I could try and see what happens just send lots of proof I explain that they gave us 30 days to respond.:blink: She did find it odd that they never gave us the reasons for our denial of K1 visa. I'm so confused :blush:

It would so help us that you fill us in on your initial packet what did you send in than the RFE. Obviously it wasn't enough. Don't want your appeal to be a waste so fill us in. Also call and do a attorney consult with an attorney that is very good at immigration and the MENA's not just anywhere.



My initial packet:I-130 app, g325 bio, marriage cert, divorce cert, photos 2009-2011, my birth cert, email,chat logs,cell phone logs 2008-2012, bank statement, flight tickets 2009- 2011,3 affidavit letters from friends certified, hand written letter from our witness of our marriage.

Thanks for all your advice what I sent for the RFE was as follow: pics 16 total from years 2009 - 2011( they said it was not enough pics & they looked like we took them only for visa reason), 401k statement showing that I added my husband as beneficiary & joint bank account statment opened in May 2012 ( they stated that these accounts were to resent opened) but I had to find a bank that would allow me to open one with my husband outside of the country & no SS# which took some time. sent divorce papers again with date highlighted because they said I married right after divorced (not true I've been divorce over 20 yrs) emails, chat logs (they said these gave no insight to our relationship because we did not send the dialogs of our emails and chats), cell phone chat logs (they siad were unable to verify because of my carrier), emails to & from work to my husband ( they said that they were to short in dialog and too resent (not true I sent emails from 2008 - 2012) letter of explaination, cover letter, they said a marriage cert. does not prove anything and it does not carry much weight to them, they also said we did not prove we have a bona fide marriage and all submitted items show no insight in the relationship and thats the reason for denial and we can appeal their decision we have 30 days. They also said they think we did all of this because we were denied K1 visa

We are not sure what to do next, they denied our I-130 ... I have started to write a statement to address the issues " Proof of a Bona Fide marriage" My question is how do we respond to this on the appeal form EOIR questions? #2 on appeal specify reasons for appeal then it says Warning: If the factual or legal basis for appeal is not sufficienty described, the appeal may be summarily dismissed. Would my statement be to address this part on the form? #3 Do you desire oral argument before the BIA? If I answer yes would that be at my local INS office? #4 Do you intend to file a separate brief or statement after filing this notice of appeal? Does this mean I would send my statement at that time? If any one has been through this ur input would be greatly apprecated.

Thank you. I keep this in a word Doc and use it to send to others all the time. It is created by all my at the beginning on VJ questions. And googling and stuff. So I am glad it helps.

If nothing else it get s folk a thinking. Its amazing what you can think of.

For extra evidence I created a "Missing you". I had found an album I never saw before my mom created for dad when he was in Vietnam. It was all of what my daddy had missed.
I wanted to show the CO its not just about us being together but a whole family, church co-workers are missing him and want him here (Maybe a little heart manipulation but heck this is Lagos we are dealing with :blush::innocent:

So spread it around share with others. (disclaimer: don't share with scammers though LOL :hehe:)

If the sample from the letter was yours, then I'd recommend actually providing content this time around.

My I-130 had cell phone calls, text logs from my different cell phone providers, as well, but it had about 50-60 pages of email conversations printed out from all of my different email addresses (former business and current). I included pictures from our wedding in Canada - they weren't all of just the two of us, but mixed with my family and his; my trip to Morocco, including pictures with his family, and our first trip to Niagara Falls. Every picture had a description printed on it. I had notarized affidavits from both his parents and my parents. All in all, it was over 100 pages of evidence.

I think content is the most important thing.

Do you mean notarized or certified?
Because certified means you have to go to the issuing agency of the passport or a US Consulate to get them to make copies.
Prior to this year, this wasn't even a requirement so I'm just surprised you even did that.


Yes I do mean certified ... I went to my local IRS tax office showed them what documents I had and the IRS agent told me that I will need my husband to go back to the issuing agency and get a certified copy and that all page would need to be certified... this was for my 2011 tax year. I live in florida hubby in Morocco not sure if that has anything to do with it but thats exactly what we did. I returned to my local IRS office when I rec'ved the documents a few weeks later from my husband via snail mail the IRS agent looked over everything said it was fine and mailed it for me.:yes:

What I did was have my husband sent me certified copies of his passport bio pages, national ID card & BC via snail mail. I did go to my local IRS office to have them check over documents & they offered to mail them for me which reached fast and saved me postage cost. You can get your spouse doc. and mail them your self with tax papers & W7 & certified doc. to the address on the IRS info site. We filed married joint, got the tax ID number in the mail about 4 to 6 weeks later. Bigger refund too :thumbs: Oh I also had my husband print the tax papers, W7 & sign them and send with all his documents. Hope this will help you :)

I hope this doesn't come across too bold....I'm sure it will. What do you mean by YOU ARE TIRED OF WAITING if your wife can't get a sponsor and you said you will just give up? Immigration is a VERY SLOW process. You make it sound like if she can't sponsor you for the visa, you are giving up on your marriage and moving on. Was it a marriage for love or visa and are you being fair to this wife? If my husband told me this I am sure he will not have to give up...I would give up on him,lol....anyway, ask yourself why are you with your wife and why you married her? You make this simple post sound like you can just throw her away if she can't get you what you want and you know a lot of fraud and denial comes out of Morocco. For your wife's sake, I hope I am wrong. You must have known too there is that possibility of denial and do you love your wife enough to bring her to Morocco to live with you if she is willing? I would think too after marrying someone from USA and then finding another USA wife or other would red flag you in their system and set you up for denial in the future. I personally think if you made the choice to marry your wife with these obstacles & chances in the way, you should stiill be loyal to her and keep waiting for a better outcome if you truly love her, afterall you DID MARRY!....just my opinion for what it is worth.

It took USCIS 5 days to send an answer to us. I would call to check status, also did you setup a proflie on their website so you can get updates on your case through your email address. You can check the status of your case once you setup your profile there on the website of USCIS.

Hi everybody. Even though I am a new member posting today, I have been reading here on this forum for a long period of time. I was kind of happy to share with you guys about my [b] I-129F approval just two days ago. I have never seen anybody that experienced the samething that I have encountered. I have known my fiancee for couple of years now and my first I-129F to USCIS was on Auguest 11, 2009. The USCIS approved the petition on January 6, 2010. my love had an interview @ consulate office on march 18, 2010 and got denied with the findings that we didn't provide enough proof of relationship (such as album full of pictures and phone records). Even though it was heart breaking to get denied, I convinced myself that they had a reason to deny since we only provided six pictures of us together and phone records that didn't show her number on my T-mobile call logs. Because I was using phone cards, then, that had 1800 # and a PIN #, Unfortunately,it only showed 1800# on my records. Anyways...petition was forwarded back to USCIS, who then notified me about denial and gave me an opportunity to refile. On June 11, 2010, I refiled I-129F (with fees)and received Notice of Intent to Deny (NOID) letter from USCIS on October 21,2010 to respond to a consular's findings (lack of enough pictures and no records phone interaction etc). I responded to this NOID with all supporting documents and promised USCIS i will visit my love to get more pictures of us before her next interview. On December 16, 2010, they send me a second approval letter and forwarded the case to the Embassy. It was then that I made a traveling arrangement to visit my fiancee to give her confidence and to be physically with her during her consular interview and of course take many pictures together that shows that we are in relationship. So, On March 28, 2011, I left San Diego and arrived in Addis ababa, Ethiopia on March 30, 2011. On April 5, 2011, my fiancee and I showed up (with all our supporting documents including album full of our pictures together, phone records, money transfer, and E-mail exchanges) early morning at U.S Embassy in Addis Ababa with full hopes that this journey will be finally behind us. At about 3 P.M, my fiancee was called to appear @ window #11. And at the end of her interview, which lasted about four minutes, she was told that her K-1 visa was again denied. This was just without looking at any of supporting documents that she substantiated. I asked the consular to tell me the reason for denial, all he would tell me was that he was not convinced. I requested to talk to his supervisor and she told me that she cannot reverse his decision but offered an advice to reappeal. We left the embassy's office really devastated emotionally. The same thing again....case returned back to USCIS and they (USCIS) sent me a letter of denial. On June 21, 2011, I refiled I-129F for the third time, and there you go, I got approved two days ago. So, for those ppl whose k-1 visa was denied at the consular level, you still have hope to re-apply at least for three times and still gets approved. This is as long as you have a sounding bonafide relationship with your fiance/e.

:wow: Thanks for such a great example and reasonable explanation to the situation, It really help me to understand better how the intervuew process works and how they (CO) :wow: reason on each case.

Consulates in high fraud countries do ask trick questions, but not if they are completely irrelevant. They also don't automatically presume that any incorrect answer is a lie unless they can find evidence that the incorrect answer constitutes an <i>intent to deceive</i>. For example, they aren't going to ask an interviewee what is the value of PI (unless perhaps he/she claims to be a math professor), and then accuse them of lying because they don't know the precise answer (there IS no precise answer). This isn't the kind of trick question they ask because it would be useless as a basis for refusing a visa application.

Consulates apply the "reasonable person" standard when judging whether a relationship is a sham for immigration purposes. In high fraud countries, the "reasonable person" standard is the sledgehammer in their anti-fraud toolbox. If they can show evidence that the relationship deviates from the stereotypical traditional relationship in the beneficiary's country and/or culture in even the slightest way, they can use that as an excuse to deny the visa.

In many cultures, knowledge and consent of the family is considered to be critically important. In some cultures it would be unthinkable for someone to marry without the consent and active participation of their family. When presented with a relationship where there were several possible motives for a person wanting to marry, a "reasonable person" in such a culture would have a hard time believing that someone wanted to marry for traditional reasons if the relationship itself did not conform to tradition.

Something about your case made the CO very suspicious. In order to confirm his suspicions, he pulled out his "sledgehammer" and he used it. Apparently, marrying a divorcee is a big deal in Morocco, and the father of the groom would be expected to know whether his future daughter-in-law had ever been married. He didn't, so the CO concluded that the beneficiary's family doesn't consider this relationship to be serious. If that's enough to set off the "reasonable person" alarms in Morocco, then it's enough to deny the visa.
